Minutes of an adjourned regular -meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in.the City Hall,
in said City
, on December 27, 1943-
President Lemmon called the meeting to order at ;i g 7; 30 P. M. , the
ilfollowing members being present: Lemmon, Fryer, Kennedy, Kjerner,-Mrachek,
1iNass, and Yeager. Absent: None.

Upon motion by Fryer, second by Yeager, the minutes of the meeting
of December 6, 1943, were approved.
Attorney Allen, representing David Bemel, appeared before the. Council
regarding the sale of property -North of the Seventh Street bridge North West.
The matter was referred to the Street and Alley Committee, the City Engineer,
and the City Attorney.
(I The City Engineer's request that $2000.00 be appropriated from the
,,General Fund and $1000.00 from the Bridge Fund for use of the Street and Alley
Committee was read, and President Lemmon ordered that the same be placed on
file. -
A letter from the State of Minnesota, Department of Highways, trans-
mitting five copies of an agreement for maintenance of trunk highways within
Ilthe corporate limits of the City was read. Upon motion by Mrachek, second by

(Fryer, the same were approved; and the Mayor and City Clerk were authorized to
lsign the agreements.
A communication from the Rochester Civilian Defense Council express
ing their appreciation of the co-operation which has existed between the

governing body of the City and t-he Civilian Defense Council was read and ordered
(placed on file, and the receipt of an unused balance of the funds appropriated
by the Common Council for the use of said Civilian Defense Council in the amount
of $192.77 was ordered returned to the General Fund.
The Mayor's emergency order given to the City Clerk of approximately
1,8000 gallons of gasoline was read. Upon motion by Mrachek, second by Kennedy,

the same was approved.

The report of Druar and Milinowski, consulting engineers, after making
;,a study of the conditions at the sewage disposal plant at Rochester was read,

..also a copy of their letter to Mr. H. A. Whittaker, Director of Division of
Sanitation for the Minnesota State Department of Health, was read, and the
I; recommendation of A. J. Chesley, M. D. , Executive Officer of the State of
Minnesota Department of Health. Upon motion by Mrachek, second by Kennedy,
,'the report and communications were ordered placed on file, and the matter was

referred to the consulting engineer now employed -by the City of Rochester and
the Rochester Dairy Cooperative for report and-recommendatibns.
A•notice of injury to Mrs. Florence Hogen while employed on the
recreation program -at Lincoln School -in the City of Rochester by Dr. George
L. J6yce was - read, and 'the same was ordered placed on file.
Notice by the Rochester Police Civil Service Commission that Seth
Green had been certified for regular employment as of April 1, 1943, and Axel
Moberg as of -May 6, 1943, was read. Upon motion by Fryer, second by Kennedy,
the City -Clerk was instructed to adjust his records to comply.with the notice.
The following copies of resolutions passed and adopted by 'the
Commissioners of the Sinking Fund were read:
"That the sum of $15,000.00 be and the said sum is
hereby appropriated from the Sinking Fund and ordered paid to
the First National Bank of Rochester, Minnesota, for the
January is t, 1944 maturity 'of City of Rochester Light Bonds,
Nos.• 531 to -545 inclusive. ° 1 1
"That the sum of $3,000.00 be and the said sum is
hereby .appropriated from the Sinking Fund ( Code 3) and
ordered paid to the Interest -Fund ( Code 2) .for the trans=
fer of funds to make same available for the payment of
January 1,- 1944 maturity of'City of Rochester Light bond
interest."
Upon motion by Fryer, second.by Kjerner, the above resolutions as
adopted by the Commissioners of the Sinking Fund were approved.
A statement of receipts and disbursements for the month of November,
1943, by the Board of Park Commissioners was read, and President Lemmon ordered
the same _be placed on file.
The report of the Clerk of the Municipal Court for the week ending
December 11, 1943, showing criminal fines and costs collected, $169.80; and
conciliation court fees, $1.25; and civil fees, $1.60; for the week ending
December .18, 194-3, showing criminal fines and costs collected,, $129.20, civil
fees received, $.70, and conciliation court fees, $.50; for the week ending
December 25, 1943, showing criminal fines and costs collected, $100.60, civil
fees received, none, conciliation court fees, $1.50, were each read, and having
been previously approved by the City Attorney, President Lemmon ordered that the
same be placed on file.
The.following claims -were read, and upon motion by Yeager, second by
Fryer, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordingly:

Alderman Fryer introduced a resolution appropriating $2,000.00 from
the General Fund and $1.000. 00 from the Bridge Fund (a xd aadartag psc;Sma nk ma cka
for use of.the Street and Alley Committee, which was read.
Upon motion by Fryer, second by Nass, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the salary of the
Assistant.City Engineer at $200.00 per month, which was read.
Upon motion by Yeager, second by Nass, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution'grant-ing five public dance
permits to Percy Klein, which was read.
Upon motion by Kjerner, second by Mrachek, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Kjerner introduced a. resolution appropriating $249.90 from
the Sewer Fund and ordering payment made to the Minnesota Fire Equipment Co. for
300 feet of sewer hose , which was read.
Upon -motion by Mrachek, second by Kjerner, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said.resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $240.00 from
the General Fund and ordering payment made to the City of .Rochester, Public
Utilities. for Steam Heat for City Hall, which was read.
Upon motion by Fryer, second by Yeager, that.the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $52.09 from
the General Fund, $2.00 from the Street & Alley Fund, and $2945.60 from the
Lighting Fund and ordering payment made to the City of Rochester, Public
Utilities Department for street lights and the "stop and Go" signals.

Upon motion by Yeager, second by Kjerner, that the said resolution
1�be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $10,000.00 from
the P.I.R. Fund and ordering payment made to the First National Bank of
Rochester for the January 1st, 1944 maturity of P.I.R. bonds, which. was read.

Alderman Kass introduced a resolution appropriating $410.00 from the

'P.I.R. Fund and ordering payment made to the First National Bank of Rochester
Ifor the January 1st, 1944 maturity of interest on P.I.R. bonds, which was read.
Upon motion by Mrachek, second by Fryer, that the said resolution
be adopted' as read, and all voting in.favor thereof, President Lemmon d.eclared
the said resolution duly passed and adopted.
i, Alderman Nass introduced a resolution appropriating $3,000.00 from the

Interest Fund and ordering payment made to the First National Bank of Rochester
for the January 1st, 1944 maturity of Interest on Electric Light Bonds, which
jwas read.

adopted as read, and all voting in favor thereof, President Lemmon declared

Alderman Yaeger introduced a resolution appropriating $192.32 from
;the Park Improvement Fund and $63.60 from the Lighting Fund and ordering payment
made to the City of Rochester, Public Utility Department, for water, electricity,
land power, which was read.
Upon motion by Nass, second by Fryer, that the said resolution be.

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Yaeger introduced a resolution appropriating $343.69 from the
i.Sewe r Fund and ordering payment made to City of Rochester, Public Utility Depart-
riPent for power and water for sewage disposal plant, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The application of Charles E. Jerniss for a Driver's License was read,

Band upon motion by Nass, second by Kjerner, the same was granted.
The application of Wilber Fruit and Vegetable Exchange for a permit to
place and maintain a sign was read, and upon motion by Fryer, second by Nass,
