Minutes of'a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall in said
City. on February 7, 1944.
President Lemmon called the meeting to order at 2:00 o'clock P. M., thel
following-members,being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, Mrachek, Naas$ and Yaeger. Absent: None.
Upon motion by Fryer, second by Yaeger, the minutes of the meeting of
January 3, 1944 were approved.
Upon motion by Mrachek, second by Kjerner, the City Clerk was instructe
to request the -various boards and department heads to submit inventories as of
February 29; 1944.
A notice by F. M. Feldman, M.. D. , City Health Officer that Miss Mary
Anne Harwick had been temporarily appointed as.Social Welfare Worker padding the
return of Mrs. Jean Alger who is now on indefinite leave of absence since
January 1, 1944 and that the salary for -the said position had been set at $100.00
per month for the balance of the fiscal year was read and ordered placed on file.
The following copies of resolutions passed.by the Public Utility Board
were read and ordered placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Hon.' Common Council
of the said City be and is hereby requested to authorize the
said Board to enter into a contract with the BOTSFORD LUMBER CO.
of this city for the furnishing, in accordance with specifications;
50 - Class 3 Western Red Cedar Poles-30' ®$12.80 each
70 - Class 3 ditto -35' 0$16.40 each;
the total amount of the said contract to be SEVENTEEN HUNDRED AND
EIGHTY EIGHT DOLLARS ($1799.00)."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Hon. Common Council
of this City be and is hereby requested' to authorize the said
Board to enter into a contract with SARGENT and LUNDY -Engineers
of Chicago, Illinois employing' said firm to - 'make a careful
study and prepare for the said Board an Engineering Report
outlining their conclusions and recommendations as to the best
scheme along which our City Power Plant, steam and electrical
distribution should be developed, same to cover unit size, steam
conditions, general plant arrangement, electrical connections,
heating,system connections, estimate of cost, etc., said
infromation to be so complete that as and when the said Board
would be in a position to get equipment it_ would then be only
a matter of going ahead with the equipment specifications and
construction design'; said contract of employment to be on a
per diem -basis and the approximate cost of same .not to exceed
the amount of THREE THOUSAND DOLLARS ($3,000.00)."
The request of the City Engineer that $5,000.00 be appropriated from
the Sewer Fund and $5,000.00 from the Street & Alley Fund for use of the Street
and Alley Committee was read and ordered placed on file.
A request by the Rochester Fire Department Relief Association that the
Common Council approve the action of their board in granting a loan in the amount
of $400.00 to Chas. Atkinson was,read and ordered placed on file.

The recommendation of the Finance Committee that the loan of $400.00 lI

was read and upon motion by Fryer, second by Kjerner, the same was approved.

costs $99,000.00; Bridge at 2nd St. S. E. and 2nd Ave. -S. E. thence
diagonally S. E. to 3rd Ave. S. E. and 3rd St. S. E. estimated cost. of
surveys $300.00, cost of plans $1500.00, total cost $172,700.00; Curb
and Gutter and Storm Sewer, also fine grading to conform to new Curb

A letter from Richard A. Golling, Public Examiner, transmitting copies
I' of reports on the financial affairs of the City of Rochester -and the Rochester
Fire Department Relief Association for the fiscal year ended March 31,.1943 was
� .read and the same was ordered placed on file.
A waiver by Wm. B. Shinn of any and all rights or claims to admission
to the Relief Association of the Rochester Police Department and claims against
the City of Rochester due to the aggravation of any disability that he now may
have at the time of the commencement of employment as a temporary patrolman
was read -and the same was -ordered placed on file.

A request for leave of absence by Joseph L. McDermott from his duties

on the Rochester Police Department while izi the -armed forces of the United Statel

was read and upon motion by Fryer, second by Kjerner, the same was approved.
The request of Arthur Riess for leave of absence from his duties on
the Roche ster.Fire Department was -read and upon motion by Kennedy, second by

Mrachek, the same was approved.
The following copies of resolutions passed by the Commissioners of the
Sinking Fund of the City of Rochester on January 24, 1944 were read:

Upon motion by Fryer, second by Kennedy, the action of the Sinking
Fund Commissioners was approved.
A notice from the League of Minnesota Municipalities of a meeting of
the Pension Committee to be held February 25, 1944 at the League office, and
also of the 1944 session of the "Minnesota Tax Conference" to be held February 2
and 26, 1944 was read and City officials interested in the above meetings were
authorized to attend at City expense.
The.Public Library Statistical Report for the year ended December 31,
1943 was read and the same was ordered placed on file.
A copy of the 78th Annual Report to the members of the Library Board
submitted by Miss Lucille Gottry, Librarian, was read and the -same was ordered
placed on file.
The report of the Trustees of the Walter Hurlbut Book Fund for the
calendar year of 1942, showing receipts in the amount of $4 494.60 and disbursement
amounting to $4059.24, leaving abbalance on hand of $435.36 which was remitted to
the City Treasurer on January 14, 1944, was read and upon motion by Mrachek,
second"by Kennedy, the same was approved and ordered placed on file —
The Financial Report of the Firemen's Relief Association for the
calendar year ended December 31, 1943 showing receipts of $30,572.76., disbursement
$27,010.79.and- Vhilanceon hand $6,549.96, was read and upon motion by Kennedy,
second by Kjerner, the same was approved and ordered placed on file.
The annual statistical return of the Rochester Police Department for.
.the calendar.year of 1943 was read and upon motion by Kennedy, second by Fryer,
the same was accepted and ordered placed on file.
The .reports of the City,Weighmaster for the month of December, 1943
showing 261 loads weighed and receipts of $26.10 and for the month of January,
1944 showing 292 loads weighed and receipts of $29.20, were each read and
President Lemmon referred same to the Finance Committee.

The application of Maass & McAndrew Company for a License to connect
ith Sewers and Drains was -read and upon motion by Mrachek, second by-Kjerner,
the license was granted. -
The application of Arthur Westphal for a license to sell cigarettes
as read and upon motion by Yaeger, second by -Kennedy, the license was granted.
The applications for Driver's -Licenses of Francis Sutton, Frank E.
Smalley, Louis R. Fellows and Loren.Smallbrock werg each read and upon -motion by
ryes, second by Kennedy, the licenses were granted.
The license.bonds of Arthur A. Brown for $1,000.00 with the Western
Surety Company as surety, Frederick A._Roepke for $1,000.00 and.Maass & McAndrew
Company for $1,000.-00 each with the National Surety Company as surety, and -the
official bond of Wm. B. Shinn for_$500.00 with the Fidelity and Casualty _Co. of
ew.York as surety, were each.read and upon motion by Mrachek, second by Kjerner,
the bonds were approved, the surety thereon accepted and it was ordered that same
Abe placed on file. _
Alderman Fryer introduced a resolution approving the appointment and
alary of the Social Welfare Worker., which was read.
Upon motion by Kennedy, -second by Kjerner,that-the said resolution be-
dopted-as•read, and all voting in favor -thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Public Utility
and to enter into contract with Sargent and Lundy Co. , which, was read.
Upon motion -by Kjerner, second by Kennedy, that the said resolution be
dopted .as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted._ .
Alderman Fryer introduced a resolution authorizing the Public Utility
and to enter into contract with Botsford Lumber. Company for the purchase of
estern Red Cedar Poles, which was read.

Upon motion by Kennedy, second by Yaeger,. that the said resolution: be.
adopted as read, and all voting in favo-r thereof, President Lemmon declared the
said resolution duly passed an.d adopted.
Alderman Fryer -introduced a resolution f-ixing the distribution of the
110% Gross Income payments from the Public Utility Department for the year

i;beginning February 1, 1944; which was read.
Upon..motion by Fryer, second by Kennedy, that the said resolution be

ladopted as read, and all voting in favor thereof, President Lemmon declared the
,said resolution duly passed and adopted.
Alderman Fryer introduced a resolution.requesting an examination of the
.Books and records of the City of Rochester by the State Public Examiner for the.
,period beginning April 1, 1943 and ending March 31, 1944, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
!adopted as read, and all voting in favor thereof, President Lemmon declared the

said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $5000.00 from the I'

Mayor Grassle read a copy of a letter addressed to J. M. Punderson,
II!General Manager of the Rochester Dairy Cooperative at Rochester; dated January 28,
1,1944, which he had written in regard to the Rochester Dairy Cooperative securing
a building permit from the Building Inspector before proceeding further with the
constijjaction of their new plant. In his letter he also called their attention
lino the taking of immediate steps for the handling of thewawaste disposal from this
plant when same is in operation.
The Mayor also read a letter dated January 29, 1944 written by Mr. J. M.1
'Punderson, General Manager of the Rochester Dairy Cooperative, stating that
('complete plans of the building had not been received to that date. He also stated'

,that their company had employed a Mr..George Grindrod, Consulting Milk Engineer
Hof Oconomowoc, Wisconsin, to study the problem of the disposal of waste from the
