Ofiil Proceedingsof,the CoCouncilm • of th'e City of Rochester Minnesota March 2 Minutes of an adjourned regular meeting of the Common'Council of the City of Rochester, Minnesota held in the Council Chambers, in the City Hall, in said City, on March 27, 1944. President Lemmon called the meeting to order at 7:30 o'clock P. M., the following members being present: and Yaeger-.- Absent: None. Lemmon,, Fryer, Kennedy, Kjerner,-Mrachek, Nass, Upon motion by Fryer, second*by Yaeger, the minutes of the meeting of March 15, 1944 were approved. Four communications from the State of -Minnesota Department of Highways, t-ransmitting 'copies of a form of agreement authorizing the Commissioner of I Highways -to act as agent for the City of Rochester in' applying for and collecting,. Federal Aid Funds for Advanced Engineering on the following proposed projects �Iwhich were read and ordered placed on file: jPWS 3- - Item 563, S. P. 55-514, Street in Rochester- 2nd St. S. E. and 2nd Ave., S. E. (Bridge 5-50' II Spans- 40' Roadway). PWS 3 - Item 564, S. P. 55-515, Street in Rochester - East C-enter Street (Zumbro River - Br. 4-49' Spans., 40' Rdway). PWS 3 - Item 565, S. P. 55-516, Street in Roches ter- 8th Ave., N. W. at 4th St. N. W. ( Cascade Cr. Br. 2- 35' Spans, 36' Rdway) . PWS 3 - Item 566, S. P. 55-517, Street in Rochester- 10th St. S. E. (Bear Creek) (Br. 3-26.66' Spans, j; 36' Roadway). The resignation of Wm. C. Schacht as a member of the Firemen's Civil f (,Service Commission was read and upon motion by Kjerner, second by Kennedy, the ,same was accepted and the Mayor and •City Clerk were instructed to write a letter of appreciation of his services on the said commission. , I The Mayor's emergency order given to the City Clerk for the purchase of 'a.pproximately 9000 gallons of gasoline was read and upon motion by Mrachek, second by Fryer, the same was approved and President Lemmon ordered that same be placed on file. it Two copies of anextension of lease number 43690 between the Chicago and Northwestern Railway Company and the City of Rochester covering premises now used by the Public Utility Department was read and upon motion by Mrachek, second, by Kjerner, the Mayor and City -Clerk were instructed to execute the said lease. The following action taken by the members of the Hawthorne Men's Club :was read and President Lemmon referred same to the Street and Alley Committee and the City Engineer: "That we bring to the attention of the City Council the condition and appearance of the Zumbro River bank immediately south of the 4th St. S. E. bridge and requesting that action be taken to have the refuse removed and the area, maintained in a clean and healthful' condition." • 1 0 i Record of Official .Proceedings of the Common Council 217 of the City of .Rochester, Minnesota, March* .27 19 44 . 1 The -reply to the action taken by the Hawthorne Men"s Club that the condition .and appearance of the Zumbro River Rank south of Fourth St. S. E. .bridge has been caused by the Chicago Great Western -Railroad -Company -and that the said Railroad Company had .been notified of the said condition on February 25, -194 and again on March.27, 1944 on which date they promised to' take care of the matte was read and upon motion by Nass, second by Mrachek, the report of the Street and Alley Committee and the City Engineer was accepted and ordered placed on file and it was re'co.mmended that a copy of the said report. be sent to the Chicago Great Western Railroad Company and .to the Hawthorne' Men's Club.. Th.e reports of the Clerk of, the. Municipal Court for the week ending March 11, 1944, showing criminal -fines and costs collected .$102.2,0, civil fees received. $.50,. and* conciliation. court fees $1.25; fnr the week ending, March 18, 19.E-4 showing criminal. fines and costs collected $,225.60, civil fees received $2.70, and conciliation cour.t f.ees-, $1.00; and for the week ending March- 25, 1944 shorting criminal fines and costs collected $392.0.5, civil fees received $2.05, and conciliation court fees, $.75;, w.ere each read, and having: been previously approved by the'City, Attorney, President Lemmon ordered that same Ve placed on f ile. The application.of the Foster Electric Company for an- Electrical Contractor's License_ was. read- and upon motion by Yaeger, second by Fryer, the license was granted. The application of John.H. Engle for a Master Electrician's License Iwas-read and upon motion by Nass, second by Kjerner, the license was granted. The applications of Forest Smith and Lawrence Carey for Driver's LicensE (were each.read.and upon motion by Fryer, second by Kennedy, the licenses were granted. The license bonds of Edwin M..Raetz for $1,000.00 with the Great Emerican Indemnity Company of New York as surety and John H. Engle in the amount of $1,000.00 with the Employer's Liability Assurance Corporation as surety, were each read, and upon motion by Mrachek, second by Fryer, the bonds were approved the -surety thereon accepted and it was ordered that same be placed on file. The following claims .were each read, and upon motion by Yaeger,- second by Fryer, the same were allowed and the Mayor and City Clerk were authorized and directed to draw warrants on the City Treasurer -and make payments accordingly: From the General Fund: A. Alderman Kennedy introduced a resolution granting a public dance permit to George C. Ra.mme, which was read. Alderman Kjerner introduced a resolution appropriating $4lo4'.70 from i the Str-eet and Alley Fund and ordering payment made to the Street and Alley Fund for transfer -of funds to take up overdrafts in Codes 2, 4, and 5, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be • adopted as read, and all voting in favor -thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating $6915.03 from the Sewer Fund and ordering payment made to the General Fund for payment of fundsi' i j' due the General Fund, which was read. - Upon motion by Kjerner, second by Kennedy, -that the said resolution -be' adopted as read, and all voting in favor thereof, ?resident Lemmon declared the said resolution duly passed and adopted. !! Alderman Fryer introduced a .resolution in -appreciation of Mr. Martin W. Nass's services as a member of the Common Council of the City.of Rochester during the past two years, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declar,ed.the said resolution.duly.passed.and adopted. The following opinion by the City Attorney .was read and the same -was ordered placed -on file: "This opinion is given at the request of. the Common Council and'applies to the question of' whether or not funds may be expended for the improvements of parks and- in this particular, instance, refers to the Mayo Memorial. Section 132 provides that the City may, from time to time, acquirelands for parks and Section 134 provides that the Board of Park Commissioners shall create no obligation or spend any money upon parks other than the amount levied and appropriated therefor by the Common Council. The fund -in the hands of the Park Board authorized to be spent by them and.. under their direction is, of course, limited to the amount raised by taxation upon which there is a governing -mill rate.. Any gequisition or improvement which might exceed the mill rate would necessarily have to come from gifts or donations or special appropriations 'by'the' Common Council. Section 10 provides that "money from the General Fund may be used for.any lawful city purpose in the discretion of the Common Council and the money may be temporarily or permanently transferred.from the General 'Fund to other funds by the Common Council". Any direct donation to any committee which is independent from the City Government would not be proper and legal. ^ The request should come from the Board of .Park Commissioners and the transfers,made directly into their.fund,_ and. the amount expended should be definitely accounted for upon their records."
