Minutes of an -adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on April 10, 1944.
President Lemmon called the meeting to order at 7:30 o'clock P. M. the
following members -being present: Lemmon, Fryer, Kennedy, Kjerner, McQuillan,
Mrachek, and Yaeger. Absent: -none.
Upon motion by Yaeger, second by Fryer, the minutes of the '.meeting of
April 3, 1944 were approved.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the furnishing of Cutback Asphalt and Tar for
oiling streets during 1944. The following bids were received and read at this
time: Socony Vacuum Oil Company - MC 2 and MC 3 Cutback Asphalt at $.0635 per
gal. and RC 2 and RC 3 Cutback Asphalt at $.0660 per gal.; Standard Oil Company -
MC 2 and 3-at $.0538 per gal.a.nd RC 2 and 3 at $.0563 per gal. ; ,The Barr.ett
Division - TO 3 and TO 5 Tar at $.0955 per gal.; Skelly -Oil Company - MC 2 and MC
3 Cutback Asphalt.at $.0595 per gal and RC 2 and RC 3 Cutback Asphalt at $.0610
per gal. ; "Northwestern •Refir_ing Company -'MC 2, MC 3 andMC 4 Cutback Asphalt
at $.0775-per gal. and RC 2, RC 3 and RC 4 Cutback Asphalt at $.08 per gal.;
L. N. Sickels & Company MC 2, MC 3 and MC 4 Cutback Asphalt at $.0596 per gal.

Fuel Company - MC 2, MC 3 and MC 5 Cutback Asphalt at $.0624 per gal. and RC 2,

Mr. Clayton D. Lyke, proprietor of the. East Side Grocery Store and Mr.
A. E. Bestler, proprietor of Al's Bar & Cafe at 115? North Broadway, requested
that the Council- again consider their applications for'Off and On Sale non -
intoxicating malt liquors. After questioning the owners of the above mentioned
places regarding complaints as to violation of the liquor laws and gambling laws
and convictions now on record, Alderman McQuillan* moved that the licenses be
granted, the second was made by Alderman Fryer -and upon roll call Alderman Fryer,
Kjerner, McQuillan and Yaeger voting in favor thereof and Alderman Kennedy and
Mrachek voting no, the licenses were -granted.
President Lemmon stated this as being the time and place for receiving
proposals- for being desi'gna.ted as City Depositories. The applications of the
following named banks of -Rochester, Minnesota to be designated as a depository for
the funds of the City of Rochester, Minnesota were each read: Union National Ban
$200,000.00; First -National Bank, $300,000.00; and Olmsted County Bank and Trust
Company, $50,000.00

official year commencing A-pril 3, 19�4, in the Rochester Post Bulletin, a legal

newspaper at the rate established by statutes. of the State of Minnesota, for legal

;publications, was read and upon motion by Fryer,second by Kennedy, the Rochester
Post Bulletin was designated as the official newspaper for the year ending March 31,
1945- r,
Upon motion by Mrachek, second by Yaeger, the sum of $1.00 was appropriated
;from the General Fund in payment of the fee to the State of Minnesota, Department i;

l,of Taxation for license for the City of Rochester to distribute gasoline. I

A communication from the State Department of Health, Division of
'Sanitation and a report covering the plans and specifications for sewage and
'industrial waste disposal from the new dehydration plant of the Rochester Dairy
to -op. was read, also a supplement to report dated February 18, 1944 by the
Fuel Economy Engineering Company covering disposition of sewage, rain water and
jcirculating water was read and upon motion by Mrachek, second by Kjerner, the same'
,was accepted and ordered placed on file.

The City Engineer's appointment of Kenneth L. Hansen, as Assistant
Engineer, Soren Olsen as Foreman, George Eayres as Sub-Foreman,.'Anaa M. Drews as
Bookkeeper, and R. N. Wentworth as Mechanic;' also John. J. Cook as Chief Operator
at the Sewage Ditposal Plant and Edward Ranfranz and`H. M. Persons as Assistant
Operators at the'Sewage Disposal Plant, was read and upon motion_by Mcquillan,
second by.Kjerner, the appointments were approved.
The appointment by the City Clerk of Miss Elfreda Reiter as first
stenographer and Miss Harriet Beecher as second stenographer in the City Clerk's
office was read &nd upon motion 'by Mrachek, second by Yaege'r,' the appointments
we're `approved.
Mayor Paul A. Grassle announced the appoiA.tment of Mrs. Evelyn Renspe
as secretary in his office and upon motion by Yaeger, second by Fryer, the
appointment was approved.
Mayor Paul A. Gra.ssle announced the appointment of -Fred R. Sonnenberg
as Commissioner. cif the Board of Park Commissioners from the 3rd Ward and upon
motion by Fryer., second by ' Kennedy,- the appointment was approved.
The a.ssignment of collateral covering the deposit of City funds in the
Olmsted County Bark and Trust.. Company was read and the' same was ordered -ola.ced on
file.

1236 private loads weighed and receipts of $23.60, was read and President Lemmon
referred same to the Finance Committee.
�I The report of the Clerk of the Municipal Ccurt for the week ending
(April. g, 1944, showing criminal fines and costs_ collected $487.'90, civil fees
Ireceiwed $.60 and -conciliation court fees $.50, was read and having been
jprevi•ously approved by the City Attorney, President Lemmon ordered that same be
::placed on file.
• The recommendation of the Finance Committee that a loan by the Firemen's

!Relief Aesociation-in the amount of $2600.00 be granted to Richard McDermott was
dread and upon motion by Fryer, second .by Kennedy, the loan was approved..
The recommendation of the Public Grounds Committee that the working-

hours at the Dumping Grounds remain the same as they are now set up and that the
employees be giver_ ten days vacation each year, also the six legal holidays, and
ten days sick leave which will -be -accumulative, and that for the duration of the
war the City Dumping Grounds be closed on the six legal holidays, was read and
upon motion by Fryer, second -by McQuillan, the same was approved.
Upon :notion by McQuillan, second by Kennedy, and all voting in favor
thereof, the above recommendation of ,the Public Grounds Committee was reconsiderei
and the following provision was included "That for the duration of the war extra
help be employed to keep the dumping grounds open on such holidays as the
Committee may deem necessary".
Upon motion by Fryer, second by Kennedy, the recommendation of'the
Public Grounds Committee as amended was approved and ordered placed on file.

Alderman Fryer introduced a resolution approving the.appointments and.
fixing the salaries in the Public Utility, Department, which was read.
Upon motion by Mrachek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Public Utility
board to enter into contract with the General Electric Supply Company, which
was read.

Upon motion by Fryer, second by Mrachek, that the said resolution be
adopted as read, and.all voting in favor thereof, President Lemmon declared the
said resolution. duly passed and adopted.
Alderman Kennedy introduced -a resolution designating City Depositories
for the year 1944, which was read.
Upon motion by Fryer, second by McQuillan, that the said resolution be
adopted as read, and' all voting in favor thereof, President Lemmon declared the
said.resolution duly passed and adopted.
Alderman Kennedy introduced a resolution accepting the collateral

II assignment of the Olmsted County Bank & Trust Company and authorizing the City
I
Treasurer to execute the proper papers accepting the said collateral, which was
read.
Upon mo.tion by Kjerner, second by McQuillan,.,that the said. resolution
be adopted as read, and all voting in -favor thereof, President Lemmon declared
the said resolution duly passed and adopted.

Alderman Fryer introduced a -resolution accepting the bid -of theStan dardl�
Oil Company for furnishing Cutback Asphalt for the year 1944, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President-Lemmon declared the
said resolution duly gassed and: adopted.
Alderman Kjerner introduced a resolution appropriating $292.90 from the!'
General Fund and ordering" payment ,made to the Rochester Post Bulletin for -pub-
lishing dog lists, proceedings, etc., which was read.
Upon motion by 14rachek, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said re.sol.ution duly passed and adopted.

Alderman Kjerner introduced a resolution appropriating $736.39 from thel
�I Street & Alley Fund.and ordering payment made to the Street & Alley Fund for use
of equipment during March, 1944, which was read.
Upon motion by Fryer, second by Kjerner, that the -said resolution be
adopted as read, and all voting in favor thereof,, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $6073.39 from thll
License & Permits Fund and ordering payment made to the General Fund for transfer
of funds, which was read.
Upon motion by Yaeger, second by Mrachek; that the said resolution be
adopted as read, and. all voting in favor thereof., President Lemmon declared the
said resolution duly passed and adopted. �

Alderman McQuillan introduced a resolution appropriating,$871.72 from
the General Fund and ordering payment made to the Texas Company for. two transport
of gasoline, which was read.
Upon motion by Mrachek, second by_Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer.introduced a resolution accepting the bid of the Barrett
• Division, Allied Chemical & Dye Corporation for furnishing tar, which eras read.
Upon 'motion: by Fryer,. second by Kennedy, that the said -resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
.� Alderman Kennedy introduced a resolution approving the salaries of the
Park Department employees for 1944, which was read.
Upon motion by Yaeger, second by Kennedy, thattIthe said resolution be
adopted as read, and all voting�in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The following claims were read, and upon motion by Yaeger, second by
Mrachek, the same were allowed and the Mayo and City.Clerk were authorized and.,
directed to draw warrants on the City Treasurer and make payments accordingly:

I' Alderman Mrachek, Chairman of the Insurance Committee, stated that the

!'Committee recommended an increase of 10%,-for insurance purposes, in the valuation

J'of the buildings under jurisdiction of the•Common .Council and upon motion by
I,Mrachek, second by Kennedy, the re.commendation was. approved. ,
