Minutes of a regular meeting of the Common Council of the City.of

Rochester, Minnesota, h-eld in. the Council Chambers in the City Hall, in said
City on Ma.y 1, .1944. .
President Lemmon called the meeting to order at 2:00 olclock P. m., -the
following members being present: Lemmon, Fryer,.Kennedy, Kjerner, McQuillan,
Mrachek, and Yaeger. Absent: None.
Upon motion by Fryer, second by Kennedy, the minutes of the meeting of

jj Mr. Arndt J. Duvall, representing Toltz,.King & Day, Inc., appeared

before the Council and stated -that his firm wished to be consi.dered.at the time
lengineers and architects were .em-oloyed for drawing -plar_s and specifications for

the proposed bridge connecting 2nd.Avenue and 2nd Street Southeast with 3rd Avenue
!ISoutheast. Upon motion by Pdrachek, second by Fryer, 41r. Duvall was requested to
submit a, written propLosal of the services. to be furnished in connection with plans
and specifications f-or -the. proposed bridge and fees for preparing same.

j City. Assessor, Knute Olson, appeared at the meeting and requested that
Ira committee be appointed to re -appraise -certain lot values in the City of Rochester

!'and upon motion by Kennedy, second by Yaeger, it -was recommended that a committeej'
l'be appointed, consisting of one member from each ward in the City to be appointed
'!by the Common Council and one member at large, to be appointed by the Mayor and L
!President of the Council, to wort: in eonnection with the Public Grounds Committee,,,
Ithe appointments to be announced later.
Two communications from the State of Minnesota, Department of Highways, I
,I notifying the City of Rochester that agreements covering Post War Surveys for
;item No. 563, Bridge connecting Second Street Southeast and Second Avenue South- I'
,east to Third Avenue Southeast, and item No. 565, Bridge over Cascade Creek on
Eighth.Avenue Northwest, had been approved by the Public Roads Administration in
!,Washington on April 15, lQ44, were each read and President Lemmon ordered that II
same be -olaced on file. L
The proposal of Walter H. Wheeler, Designing and Consulting Engineer,

for making surveys, plans, specifications, -etc. , for the' pooposed bridge over the
IlZumbro River connecting second Avenue Southeast and second Street Southeast and
Third Avenue Southeast, was read and President Lemmon ordered that same be

placed on file,.
j' The Ma,•or's aropointment of James M. O' ConNcr, Louis A. Brunsting,
i'Lestar N. Fawcett, Fred R. Sonnenberg, Ralph-B. Compton, Herbert Trienell and
.''George Laack as Special Policeman for the parks of the City of Rochester, to serve'!
,without pay until the second Monday of April, 1945, was read and upon motion by

An agreement received.from the State Fire Marsrall's,Office covering th
loan of fire fighting equipment from the Office of.Civilian Defense was presented
by C. E. Ginther, Chief of the Fire Department, and upon .motion by Kennedy, seconc
by Kjerner, the Mayor was authorized to execute -the agreement.
The City Engineer's trial balance for the month of April, 1944 was. read
and. the same was ordered placed on file.
The _report of expenditures from the City Engineer's payroll for the
month of' April, 1944 was read and the same was ordered placed -on file.
The report of th,e Clerk of Municipal Court for the week ending April 29,
194.4, showing; criminal fines and costs collected $642. 45 and conciliation court
fees $.50, was read and having been previously approved - by the City Attorney,
President Lemmon ordered that same be placed on- file-.
The report of_the Finance Committee approving the granting of a loan by
the Firemen's Relief Assocition to Clifford Kuphal on his residence.located at
�+18. Fifteentli Avenue Northeast in the City of. Rochester, said. loan to be in the
amount of Twenty Three Hundred. Dollars a.tFcdr. Per Cent interest, was read and
upon motion. by Fryer, second _ by ,Kjerner, _the same , was approved.
The offi.ci_al bonds cf Edward T. Connolly, _E. Harold Vrieze, and Ora .R. .
Ackerman in the amount of $1000.00 each with the Fidelity & Easualty Company of
New.York as.surety and the bonds of Manfred H. Waldron, Edria Oesterreich and.
Darrel Sanford in the amount of $500.00 each with .the Fidelity & Deposit Company
of Maryland- as surety, were each read and upon motion by IYirachek, second by Yaeger
the bonds were approved, the surety thereon- accepted and it was ordered that same
be placed on file..
The reports of the Building and Plumbing Inspector showing building
permits issued $2.8.00'and plumbing permits issued $19.75 and of the Electrical
Inspec6(tr showing electrical permits issued $5.25, were each read. and President
Lemmon referred' same to the Finance Committee.
The applications of Fredric W.. Berg, Arthur Kobi and Harold H. Coe for
Driver's license.were-each read and upon.motion by Mrache,k, second by Kjerner, the
licenses were granted.
The application of Edward T. Connolly for a A4aster Plumber',s license
was read and upon motion by Kjerner, second by .McQuillan, the license was granted.
The applications of George Baily, Donald C. Connolly, E1mer,�C. Kruesel,
Herman F. Gerth and Edward T. Connolly for JourneyMan Plumber's license were each
read and upon motion by McQuillan, second by Mrachek, the licenses were granted.
The -application of Albert. F. Spiess, Sr. for a license to sell non -
intoxicating malt -liquor "off sale° was read and upon motion by Fryer, second by
Yaeger, the license was granted.

The applications of Albert F. Spiess, Sr., Quality Food Stores (2), and!.
George Myhr for license to sell cigarettes were each read and upon motion by
Kjerner, second by Kennedy, the licenses were granted.

Alderman Fryer introduced a resolution appropriating $407.1E from the
Ij General Fund and ordering payment made to the State of Minnesota, Commissioner of
hTaxation, for state gas tax and inspection fee, which was read. i
Upon motion by Kennedy, second by Kjerner, that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the ; it

',said resolution -duly passed and adopted.
I' Alderman Kennedy introduced a resolution appropriating $243.40 from the
;Park Improvement Fund and ordering payment made to H. & H. Electric Company for
I
airing outlets at the auditorium, which was read.
Upon motion by Fryer, secondl by McQuillan, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolu.tion granting a public dance
permit to Percy Klein, which was read.

Alderman Yaeger introduced a resolution appropriating $327.24 from the
IF. E. Williams Estate Fund and ordering same credited to the Park Improvement Fund
Ifor skating admissions for children under•15 years for school holidays and
�iSaturday mornings from October 30, 1943 to April 1, 1944, which was read.
Upon motion by Pdrachek, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the I

-Alderman Mrachek introduced a resolution appropriating $557.15 from the
General Fund and ordering same credited to the Street & Alley Fund for us-e of

equipment during April, 1944, which was read.
Upon motion by Yaeger,- second by Kjerner, that the said resolution be.
(iadopted as read, and all voting in favor thereof, President Lemmon declared the

!said resolution duly passed and adopted.

Alderman Kjerner introduced a resolution granting 8 public dance permit
to the Veterans of Foreign Wars, which was read.
Upon motion by Kennedy, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution d3Zly passed and adopted.
The following claims were read, and upon motion by Yaeger, second by
Fryer,.the same were allowed and the Mayor and City.Clerk were authorized and

• Mayor Gra.ssle stated that he had received a call from. Per. Roy Kingrey
asking if the City would again be in favor of holding a fire works display on
July 4 and. would be willing to appropriate the same amount as in prior years.
Upon motion by McQuillan, second -by Kjerner, the Council went on record as being
in favor of the fire display and making appropriation to cover part of the expense
of same.
The matter of the report on the Sewage Disposal Plant submitted by Chkrles
H. Pisslbury Company was discussed and upon motion by Mrachek, second by Fryer,
the report was accepted and the City Clerk was instructed to notify them to submit
a. bill for their services.
Upon motion by Mrachek, second by Kjerner, the Purchasing Committee and
City Clerk were authorized to purchase 1,000 City Government Booklets.

Alderman Fryer stated that representatives of the American Legion

Auxiliary and the Veterans of Foreign Wars Auxiliary had made request -to sell
I
poppies on the- streets of Rochester or_ May 27, 1944, and peon motion by Fryer,
second by Kjerner, the requests.we-re granted.
Fire Chief C. E. Ginther requested permission for himself and two 11
1' officers of the Rochester Fire Department to attend the Northwest Fire School
Ito be held in St. Paul on May 15, 16, and 17. Upon motion by Kennedy, second byl
Fryer, they were authorized to attend the said. school at city expense.
President Lemmon declared a recgss from-3:30 P. M. until 5:00 P. !I -
President Lemmon called the meeting to order at 5:.00 o'clock P. M. and
up.on roll call .the following were present: Lemmon, Kennedy, Kjerner, McQuillan,
Mra.chek, Fryer and Yaeger.
An Ordinance regulating public and private ambulances, operated in the

City of Rochester; .providing for minimum equipment of such ambulances and first
I,
aid service therein;. prohibiting operation without a•permit from the City Health
Officer,. and providing penalties for violation thereof, was -given its third and
final reading and upon motion by Mrachek, second by Kennedy, and -all voting in
favor ,thereof, the ordinance was.decla.red duly adopted as read.
Upon motion by Fryer, second by Kjerner, City Attorney Hunt was
instructed to prepare a proposed agreement between the -City of Rochester and: the
Rochester Dairy -Cooperative in regard for the disposal of industrial waste from '
the ne-w dehydration plant now being constructed.
After d-iscussing. the m-atter of inspecting various sewage disposal- plants

a motion was made by -Fryer, second by Kjerner, that th-e Mayor, the Common Council
the City. Engineer and Mr. Kingston -inspect the plants located in 'the -following
I
towns in Iowa: Cedar Rapids, -Waterloo, Marshalltown and Ft. Dodge.
Upon motion by Yaeger, second by Fryer, the meeting was adjourned until
