Minutes of a special meeting of the Common Council of the City of
'Rochester, Minnesota held in the Council Chambers, in the City Hall in'sa.id City,
Ilon May 19, 1944.

President Lemmon called the meeting to order at 4:00 o'clock P. M., the
Iifollowing members being present: Lemmon, Kennedy, Kjerner, McQuillan, Mrachek,
and Yaeger. Absent: Alderman Fryer due to illness.
The call of the special meeting was read, and President Lemmon ordered
that same be placed on file;, said meeting having been called for the purpose of
further considering an agreement between the City of Rochester, Minnesota, and
the Rochester Dairy Co-operative regarding the disposal of industrial waste from
,their new Dehydration Plant and any other business the Common Council may deem
inecessary.

ll' Upon motion by Yaeger, second by Kjerner., the minutes of the meetings

�of May 1st and May 2nd, 1944 were approved.
A communication from the Rochester Dairy Co-operative transmitting an
,:agreement approved by their association to the City of Rochester for the considerai-

,tion of the Common Council of said City was read.and ordered placed on file.
City Attorney Hunt also submitted an agreement between the Rochester
i,Dairy Co-operative and the City of Rochester for the disposal of industrial waste II'

,from the dairy's new dehydration plant. After hearing the proposed agreement !
(read and discussed Alderman McQuillan moved that the proposed agreement be
rejected, his motion was declared out of order for lack of a second. After dis-
cussing the matter further Alderman McQuillan moved that the matter be tabled and

this motion was declared lost for lack of a second. Upon motion by Kennedy, second,
lby Mrachek, the City Clerk was instructed to prepare a resolution authorizing the
:Mayor and City Clerk to execute the agreement as presented by the City Attorney,
I'the said resolution to be presented to the Common Council at the next council
meeting.

giving names of clients as references and also a proposal for engineering services

'covering topographical survey of site, supervision of sounding and test borings,
preliminary plans and estimates, etc. for a proposed bridge connecting Second
Avenue Southeast and Second Street Southeast. with Third Avenue Southeast, was read',

Wand the same was ordered placed on file.
Upon motion by Kennedy, second by McQuillan, Mr. Walter H. Wheeler, E.M.;

jV•as employed to prepare preliminary plans and surveys for the proposed bridge
connecting Second Avenue Southeast and Second Street Southeast with Third Avenue
Southeast, in accordance with his proposal submitted on April 25, 1944.

A stipulation of settlement between Florence Hogan, Independent School
(District No. 8-and the City of Rochester, and the Travelers Insurance Company,
was read and upon motion -by Mrachek,,second by Kennedy, the City'Attorney was
authorized to sign the settlement.
A notice from the League of Minnesota Municipalities of the annual
convention to•be held in Minneapolis on June 12, 13 and 14 was read and ordered
placed on file, those wishing reservations were requested to leave their names
with the City Clerk.
A letter from the Hawthorne Lien's Club thanking the members of the
Common Council for their cooperation in assisting to' eliminate the unsightly
condition of. the banks -of the Zumbro River along the C. G. W. Ry. Company yards
south of Fourth Street, was.read and the same was ordered placed on file.
The Mayor's emergency order given to the City'Clerk for the purchase of
approximately.9000 gallons of gasoline was read and upon motion by Mrachek, second
by Kennedy, the same was approved.
The following resolution passed -and adopted by the Sinking Fund Commissi
was -rea.d and upon motion -by Kennedy,, second by Mrachek, the same was approved:
"That the sum of $12,000.06 be'and the said sum is hereby
appropriated from the Sinking Fund, and ordered paid to the
First National Bank -of Rochester, Minnesota, for the June lst,
1944, maturity of Trunk Line Surface Drainage Sewer Bonds,
Numbers 37 to 49, inclusive."
A resolution extending the discounts as established in a resolution
passed by the Public Utility Board on (March 29, 1943 and approved by the Common
Council on the same date was read and the sa�ie was ordered placed on file.
The Mayor's appointment of Elmor- E. Nelson as Special Policeman to serve
at the Waters Conley Company, was read and upon motion by Yaeger, second by Kennedy,
th-e same was approved.
The application of Kris Nielsen -for a House Mover's Permit was read and
upon motion by Kjerner, second by Mrachek, the same was granted.
The application of. Kris Nielsen to move a house, size 20 ft. by 26 ft.,
sta.rting.at 812 Ninth Avenue N.W. South to Seventh Street N.W., thence West. on.
Seventh Street N.-W. to Eleventh Avenue. N. W. , thence North on Eleventh Avenue N. W.
to Fourteenth Street N. W. or the limits of the City of Rochester, was read and
upon motion by Kennedy, second by Kjer-ner, the same was granted.

The applications of Paul O'Byrne and Arthur J. Felten were each read and
upon motion by Yaeger, second by McQuillan, th-e licenses were granted-.
The applica.ti6ns for License to sell non -intoxicating malt liquors 110ff
sale".of Henry C. Lewis and Henry G. Smith were each read and upon motion by
Kjerner, second by Mrachek, the licenses were granted.

The applications of Edward J. Hoffman and -Jefferson Transportation Col
for license to operate machine or device for Vending -soft drinks or confections
were each read and upon motion by Mrachek, second by IIcQui-llan, the licenses wer
granted.
h The applications for license to sell cigarettes of William J. Ranfranz,
Oscar Hargesheimer, Hollands Food Shop, Edward L. Hoffman, .Edwin F. Hughes,
Fred A. Root, Jefferson Transportation Co., Gus Hargesheimer, Board of Park
Commissioners (3), Henry C. Lewis, and Henry_G. Smith, were each read and upon
motion by Kjerner,_second by Kennedy, the licenses were granted.
The applications for license to sell soft drinks of Harold Blakeslee,
Henry C. Lewis,_Board of Park Commissioners (3), Samaritan Hotel, Gus Hargesheimer,
Jefferson Transportation Co., Fred A. Root, Edward L. Hoffman,.. Hollands Food
Shop, Harry T. Treatofillou, Oscar Hargesheimer, Herman Ackerman and Henry G. I'
Smith, were each read and upon motion by Mrachek', second by McQuillan, the
licenses were granted.

The offic9al bond of William C. Toomey in the_ amount of $500.00 with the
Western Surety Company as surety, the bonds of f Joseph A. Carroll and Elmor E.
Nelson each in the amount of$1000.00 with the Fidelity & Casualty Company of
New York as surety; the license boncb of Bemel Bros. in the sum of $1000.00 with ,
thb Standard Accident Insurance Company as surety, and Kris Nielsen -in the sum
of $7500.00 with the Western Surety Company as surety; and the Contractor's Bond
in the sum of $62.50 with the United States Guarantee Company as surety, were II i
each read and upon motion by Mrachek, second by Yaeger, the bonds were approved,
the surety thereon accepted, and it_was ordered that same be placed on file.

referred same to the Finance Committee.

The r.epo.rts of the Clerk of Municipal Court for the week ending May 6,

1.944 showing criminal fines and costs collected $622.80, and civil fees received
$9.25, and for the. we.ek ending May 13, 1944 showing criminal fines and costs
collected $397.4o, civil fees received, $.60,• and conciliation court fees $1.50,
were each -read and having been previously approved by the City Attorney, Presidenit

Alderman Yaeger introduced a resolution granting a public dance permit
to George C. Ramme, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the j

said resolution duly passed.and adopted.

Alderman Mrachek introduced a resolution granting two public•dance
Ipermits to. Percy Klein, which, was read.
Upon motion by Kjerner, second.by.Kennedy, that the said resolution•be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution,appropriating $269.63 from the
(General Fund and ordering payment made to Rochester Post Bulletin for publishing
minutes, dog lists, ordinances-, etc., which was read.
Upon motion by Mrachek,.second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman K.jerner introduced a resolution appropriating $270.00_ from the
Park Improvement Fund and ordering payment made to R. C. Drips Grocer Company -for
20 sic.. popcorn, which .wa.s read..
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read., and all voting in favor thereof,! President Lemmon declared ,the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $294.O9 from th
Park Improvement Fund and $63.20 from the Lighting- Fund _and ordering payment made
to the City of Rochester, Public Utility Dept. for- power, -water a.nd electricity,,
which was read.
Upon motion by Mrachek, second by Yaege•r,'that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced°a resolution appropriating- $800.00 from the
Interest Fund and ordering payment made to the First National Bank of Rochester,
Minnesota, which was read.
Upon motion by McQuillan, second by. Kjerner, that the. said resolution,bel
adopted as read, and all voting in favor thereof, President Lemmon declared the,
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution -approving -the resolution
passed by the Public Utility Board. extending date of, dis count for one year bE.n_nin�
June 1, 1944, which was read.
Upon motion by Kennedy, second by Yaeger, that the said resolution be
adopted as read, and all .voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced_a. -resolution.appropriating $296.00 from the
Park Improvement Fund and ordering payment ,made to City of 'Rochester, Public Utili
Dept. for, steam heat for Mayo Civic Auditorium, which was read.

The matter of -paying double time -for a vacation period for those
employees of the various departments of the City of Rochester, who do not take
vacations during the fiscal year, was discussed. Upon motion by Yaeger, second by
Kjerner, the payment of double time to the employees.of various departments for
their vacation period, providing they work straight through the year and do not
take a vacation, was authorized. This arrangement being effective during the
present fiscal year.
Upon motion by Mrachek, second by Yaeger, the meeting was adjourned.
