Minutes of a special meeting of the Common Council of the City of I'
I'.
Rochester, Minnesota, held in the Council Chambers, in the City Hall in said
City, on June 21, 1944.
President Lemmon called the meeting to order at 7:30 o'clock P. M., the
following members being present: Lemmon, Fryer, Kennedy, Kjerner, Mcquillan., and
Yaeger. Absent: Mrachek.
it Upon motion by Fryer, second by Kennedy, the minutes of the meeting of
jl June 5, 1944 were approved. •
The call of the special meeting was read, and President Lemmon ordered 11
'that the same be placed on file; said meeting having been called for the purpose

Iof considering agreements between the State of Minnesota, Department of Highways,)

land the City of Rochester for postwar surveys and plans and any other business
�Ithe Common Council may deem necessary.
Three communications from the State of Minnesota-, Department of Highways,
iltransmitting agreements for -postwar surveys and plans for the following proposed

1-projects, were each read and President Lemmon ordered that same be placed on file:;

Construction of Curb and gutter on 6th Ave. S.E. from 6th St. to
13th St. S. E.; construction of curb and gutter on 7th Ave. S.E.
from 6th St. to 13th St. S. E. ; and cons truc tion of curb and gutter
on Sth Ave. S. E. from 6th St. to lath St. S.E.
The petition of Hayes Lucas Lumber Company and Rochester Bus Line, Inc.

Ilto include in the industrial district of the City of Rochester, Lots six, seven,
!I eight and nine in Block 65, of the Original Plat of the City of Rochester, Minnesota
;was read and upon motion by Yaeger, second by Fryer, the same was referred to the
!;Board of Zoning.
II A -oetition for the construction of a sidewalk on the South side of
I Lot 92, Auditor's Plat "A", in the City of Rochester was read. and action on same

A communication from the Department of Public Health & Welfare in regard.

Ito supervision of the buildings and equipment at the Dog Pound was read and i

�Presiclent Lemmon referred same to the Public Grounds Committee and the City
Attorney to look up the matter and determine whose duty it is to supervise the

said property and reply to the communication from the Board of Public Health and I

The request of Mr. James J. Stettler, Mrs. Edwin Brown, and Henry J.
i' Butterfuss to have a. manhole constructed at the end of the sewer on Fourth Ave.

'Sewer Committee and. the City Engineer.

"That the sum of $10;000.00 be and the said sum is hereby
appropriated from the Sinking Fund for the purchase of $15, 000
7 9% United States Treasury Certificates of Indebtedness, Series
C 1945, and $125,000.00 lg% United States Treasury Notes of
Series B-1947, and ordered paid to the Federal Pesorve Bank .of
:Minneapolis, Minnesota, the said bonds being purchased for the
following investment.a.ccounts:
$60,000.00 U.S. Treasury Notes - 11,%, Series B 1947
for the Electric Department -Extensions
$15,000.00 U.S. Treasury Notes - 11% Series B 1947
for the Water Department Extensions
$ 5,000.00 U.S. Treasury, Notes - 1 �,. Series B 1947

"That the sum of $15,000.00 be and the said sum is hereby'
appropriated from the Sinking Fund and ordered paid to the First,
National Bank of Rochester, Minhesota,;for the July 1, 1944
maturity of City of Rochester, Light Bonds."
"That the sum of $1501.30 be and the said sum is hereby
a.ppropriated'from the Sinking Fund and ordered paid to .the
Interest Fund to make same available for the payment of
July 1, 1944 maturity of interest on City of Rochester,
Minnesota 5% Light Bonds."
Upon motion by Fryer, second by Kennedy, the above resolutions as
adopted by the Commissioners of the Sinking Fund were approved.
An agreement between Walter H. Wheeler, Engineer of the City of
(Minneapolis, Minnesota. and the City of Rochester, Minnesota was read by City
Attorney hunt and action was deferred on same until the meeting of July 3, 1944.
The request of the City Engineer that $5,000.00 be appropriated from
the Street & Alley Fund and $2,000.00 from the Sewer Fund for use of the Street
& Alley Committee was read and the same was ordered placed on file.
A notice to the Mayor and Common Council by C. E. Ginther, Chief of the
Fire Department, that he had suspended Frank .Springer for ten days from June, alst
to June 30th, inclusive, without pay, for calling officers of the Fire Department
vile names, was read and the same was ordered placed on file.
The report of the City Weighma.ster for the month of May, 1944, showing
262 private loads mi.ghed and receipts of $26.20, was read and President Lemmon
referred same to the Finance Committee.
The report of the Clerk of the Municipal Court for the week ended
June 10, 1944, showing criminal fines and costs collected $417.55, civil fees
received $9.10, and conciliation court fees $1.50, wa.s read and having been
previously approved by the City Attorney, President Lem-tcn -ordered that same be
placed on file.
The application for license to sell ciggrettes of the IMyrow Hotel was
read and upon motion by Kjerner, second by Kennedy, the license was granted.

The applications for Driver's License of Albert Fellows, Leo 1-1. Diskin,

and Don Donahue, were each read and upon motion by Yaeger, second by Kennedy, the'
licenses were granted.
The applicationsoof Ben Zimdars and E. J. Butlin for Journeyman
;Electrician's License were each read and upon motion by Kennedy, second by
McQuillan, the licenses were granted.
The application for license to sell soft drinks of M. J. Myrow was
.
tread and upon motion by Kjerner, second by Fryer, the license was granted.

The contract bond of the Standard Oil Company in the amount of 36s.00
I[ with the Seaboard Surety Company as .surety and the official 'bond of Jose Bosley
I� in the amount of $500.00 vrith the Fidelity 4- Casualty Company of New York as

surety, were each read and upon moti-on by Yaeger, second, by Fryer, the ,bonds were

,approved, the surety thereon accepted and it was ordered that the same be placed

Alderman Fryer introduced a resolution authorizing the Mayor and City
Clerk to execute an agreement with ii. J. Hoffman to apply for Federal aid funds
for PWS 6-Item 1163, Sth Avenue S. E. from 6th St. to 13th St. S. E., which was

Upon motion by Kennedy, second by Kjerner, that the said resolution be

adopted as read, and all voting -in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution granting two public dance
permits to Percy Klein, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
• said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution granting a public dance permit
to F. A. McGovern, which was read.

Alderman Kennedy introduced a resolution granting five public dance
permits to the Veterans of Foreign Wars, which was read.
Upon motion by Yaeger, -second by McQuillan, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $671.99 from the
General Fund and ordering payment made to Cities 'Service'0il Co., for 2 transport
of gasoline, which was read:
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolutlan duly passed. and adopted.
1 II Alderman Kjerner introduced a resolution appropriating $320.46 from the
General Fund and ordering payment made to the Commissioner of Taxation for state
gas tax and inspection fee on 2 transports of gasoline, which was read.
• Upon motion by Yaeger, second by McQuillan, that the said resolution be
adopted as read, and all voting in favor thereof, President' Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $6551.12 from the
General Fund and ordering payment made to the Park Improvement Fund for transfer
of funds, which was read.
Upon motion' by Kjerner,' second by Kennedy, that the' said resolution be
adopted as read,. and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $232.56 from
the General Fund and ordering payment made to 'Chicago & N. W. Ry. Co. for freight

on cutback asphalt, which was read.
Upon motion by Yaeger, second by Fryer, that,the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed.and adopted.
Alderman McQuillan introduced a resolution appropriating $239.25 from
the General Fund and ordering payment made to the Standard Oil Company for cutba
asphalt, which was read.

.adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $210.54 from
the General Fund, $664.22 from the Street' & Alley Fund and $1.27 from the Sewer
Fund and ordering payment made to the General Fund for gasoline furnished each
department, which was read.
Upon motion by Yaeger, second by Kjerner, that the said -resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $201.90 from the
Street & Alley. Fund and ordering payment made to Frank Fordham for construction
of sidewalks, which was read.
Upon motion by K jerner, second by McQuillan. that the said resolutionbe
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $459.75 from the
'Sewer Fund and ordering -payment made to The. Kruse Company for coal furnished the
Sewage Disposal Plant, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $315.00 from the
Permanent Improvement Revolving Fund and ordering payment made to the First

'ational Bank for interest on P. I. R. bonds, which was read.

adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $2625.00 .from the
Interest Fund and ordering payment made to the First National Bank, which was read

Upon motion by Yaeger, second by McQuillan, that the said resolution -be
adopted as read, . and. all voting in favor thereof, 'President Lemmon• declared the
