Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, i,n the City Hall in said City,
on July 3, 1944-
President Lemmon called the meeting "to order' 'at 2:00 .o l-cl6ck P. M. , the
following members being present: Lemmon, Fryer, Kennedy, Kjerner, Mcquillan,
Mrachek, and Yaeger. Absent.: None.
Upon motion by,Kennedy,.second by Kj.erner, the minutes of the meeting of
• June 21, 1944 were approved.
A petition -protesting noise made by trucks traveling on Second Street
Southwest and •Eleventh Avenue Southwest. and Northwest and also a letter of protest
from St. Marys hospital were read. Several residents.fr.om that section of the
IYZ
City appeared- in -person and requested that the Council take some action in regard
to the matter. . Upon motion by Kennedy, second by-Mrachek, the Mayor., Chief .of
Police, Police Committee and the City Attorney were instructed to -draft an
ordinance giving the Police department power to handle the situation.
An agreement drawn by -City Attorne,y.Hunt..between the City of .Rochester
and Walter H. Wheeler, Engineer, was again discussed and upon,motion by Mrachek,
second by Kennedy, the 1.4ayor and.City Clerk -were authorized to execute same.
A request from the .Fire Department Relief Association that the Common
Council approve a loan in the amount -of $2200:00 to Mrs.. friary 0!Mera., -lli6 - -7th
F Avenue Southeast was read and the same was.referred to the Finance Committee.
A report of the .Finance Committee recommending that the loan to Mrs.
r-y O'Mera .in the amount,of $2200.00 be granted, was read and upon motion by
ryer, second by Mrachek, the same was approved.
Mr.. L. S. Anderson appeared at the Council meeting and asked to have his
on -intoxicating malt liquor licenses returned to him, which were revoked.at a
;. revious meeting of the Common Council. President Lemmon referred the matter to
• the License Committee for investigation and report -at the next meeting.
A petition by the Evangelical Trinity Lutheran Church of Rochester,
i�innesota to ,vacate the public alley lying between Lots 1, 2 and 3 and the west
29 -ft. of Lots 4 and 12, 13 and 14 and the lest 29 ft. of Lot 11, -all in Block 14,
read and McMahons Addition to the City -of Rochester and proposing to open at its
expense an 18 ft. alley across the*East 12 ft. of the West 40 ft. of Lots 8, 9, anc
0 and the West 6 ft, of the East 10, -ft: of Lots S, ..9 and 10 in Block 14, Head
rid McMahons Addition to the City of Rochester, was read and the _matter was
eferred to the Street and Alley Committee and the City Clerk was instructed to
prepare the -necessary papers covering the vacation of the said alleys and present
ame at the next meeting.

The following resolution adopted.by the Utility Board was read:

The request
of the City Engineer that $5,000.00 be anaropriated from
the General Fund for use -of the Sprinkling. Committee was read and the same was
ordered placed on file.
The communication of the Board of Park Commissioners stating that a,
stone wall between North Broadway Bridge and Silver. Lake Dam had given, way and
tipped over, was read -and upon motion by Yaeger, second by- 14rachek, the Public
Utility Board was instructed to rebuild same and present a billing to*the City

covering the work done by them.

The recommendation,of the Sewer Committee, Street and Alley -Committee

and the City Engineer 'that a manhole be constructed in 4th Avenue Southeast and

13th Street Southeast at the end of the sewer and the cost of same be pro -rated

i! to the property owners who petitioned for same: namely, James L. Stettler, Mrs.

Edwin Brown and Henry J. Butterfuss, was .read and ordered placed on file.

showing criminal fines and costs collected $273.20, civil fees received $4.25,
and conciliation court fees, $1.25,; and for -the week ending July 1, 1944 showing
total criminal fines and costs collected 49.9.70, civil fees received $1.05 and
conciliation court fees,.$3.50, were each read and having been previ.ously approve
by .the City Attorney, President Lemmon ordered that same be placed on file:
The application for a permit to place and maintain a sign of LeRoy Shane
was read and upon motion by Kjerner, second by Kennedy, the permit was granted.
The. application of Marie Merz for a license to sell. c.igare.tt.es was read
and upon motion by Yaeger, second by Fryer, the license was granted.
The applications of Red Owl Stores and Marie Ilerz for license to sell
soft drinks were each read and upon motion by Fryer, second by McQuillan' the
licenses were granted.
The application of M. J.. Donahue and Charles M. Dorniden for transfer of
On Sale. Liquor License No. 155, was read and upon motion by Kjerner, second by
Yaeger, the transfer was granted.
A Certificate of Insurance certifying that the United States Fire.Works
Company is insured under Public Liability OLT Policy No. 134697 was -read and upon
motion by l'rachek, second by Kjerner, the same was approved and ordered placed
on file.
_The official bonds of Bernice O'Shaughnesse.y, ,I.Irs. C1a.ire C. Chamberla, in
and F. Leslie Williams each in the sum of_$1000.00 with the Fidelity and Deposit
Company of Maryland as.surety, were each read, and upon motion by Mrachek, second
by McQuillan, the bonds were approved, the surety the,r-eon accepted, and it was
ordered that same be placed on file.
Alderman Fryer introduced a resolution appropriating $29.2.29 from.the
General Fundand ordering payment made to Chicago & N. W. Ry. Company for freight
on cutback asphalt, which was read.
Upon motion by Kennedy, second by Yaeger, .chart the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $246.90 from the
General Fund and $95.19 from the St. & Alley Fund and ordering payment made to
-Morse Brothers for sand and C. P. Run, which was read.
Upon motion by Kjerner, second -by Kennedy, that the sa.i& resolution be
adopted as read, and all voting in favor thereof, President Lemmon.declared the
said resolution duly passed and adopted.

Upon motion by Fryer, second by McQuillan, that the said resolution be
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $232.49 from the
GAneral Fund, $2.00 from the S & A Fund, $30.04 from the Fire Fund and $1809.05
from the Lighting Fund and ordering payment made to City of Rochester, Public
tili ti es, which was read.
Upon motion by Kjerner, second by Mra.chek, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $441.00 from
he Street and Alley Fund and ordering payment made to Leon -Joyce for dredging
Cascade Creek North of 7th St. IT. W. , which was read.
Upon motion by ttrachek, second by Kennedy, that the said resolution be
dopted as read, and all voting in favor thereof; President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Kjerner introduced a. resolution granting 9 public dance permits
o Veterans of Foreign Wars, which was read.

Alderman McQuillan introduced a resolution granting a public dance permii

to George C. Ramme, which was read.

Upon motion by idrachek, second by McQuillan, that the said resolution bell
adopted as read and all voting in favor thereof, President Lemmon declared the
;aid resolution duly --passed -and adopted.
Alderman McQuillan introduced a resolution granting 2 public dance permijts
;o Percy Klein, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read and all voting in favor thereof, President Lemmon declared the
laid resolution - duly passed and adopted.
Alderman Yaeger introduced a resolution authorizing -the Public Utility
3oard to enter into con tract- with Botsford Lumber- Company, which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
.dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $5,000.00 from the
',eneral Fund for use of the Sprinkling Committee, which was read.

Upon motion by Mrachek, second by K jerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The following claims were read, and upon motion by Yaeger, second by
jerner, the same were approved and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Alderman Kennedy stated that the Charter Commission had requested that
the Common Council approve the expense of a. speaker to talk before the Charter
o-mmmission on various forms of city government, and upon motion by Kennedy, second
y K jerner, the said request was approved.
The matter of who would handle the work of filling the fire extinguisher:
as again discussed and President .Lemmon referred the matter to the Fire Committee

Upon motion by Kennedy, second by Kjerner, the Street & Alley Committee
as instructed to request the services of Mr. W. Marion Roberts, United States
epartment of Agriculture, Soil Conservation Service, to assist them in making
lans to clean parts of the channel of the Zumbro River through the City of Rochester.
The report of the Building and Plumbing Inspector showing building permit
issued $23.00 and plumbing permits issued $27.25, and the report of the Electrical
Inspector showing electrical permits issued $11.00, were each read and President
