President Lemmon called the meeting to order at 7:30 o'clock P. M., the following members being present: President Lemmon, Aldermen Fryer, Kennedy, Kjerner, McQuillan, Mrachek, and Yaeger. Absent: None. Upon motion by Fryer, second by McQuillan, the minutes of July' 3, 1944 were approved. Il . Archie Dieter presented a petition 'signed by 114 residents in the vicinity of the North-Western and :Great Western Railways petitioning the Council to take steps to have the railroa.d -elimina.te excessive noise in that part "of the city. President Lemmon referred the petition to the Mayor, the Chief of Police, the City" Attorney and -the Police Committee -f-or investigation. A letter from the Me-nIs- Club at the `4awthorne School expressing appreciation for t!Ye efforts of the Common Council in securing -a patr•olma-n for the intersection at'Ninth Street Southeast -and Broadway was read and the same was ordered placed on file. The request of Harry Stai that he be granted a leave -of absence by the Police Civil Service Commission from hi-s duties on the Rochester police force during the period of his service in the' United States Navy was read 'and upon motion by Kennedy, second -by Kjerner, the same was granted. The Mayor Is emergency order given to the City Clerk for the purchase of 8000 gallons of gasoline was read and upon ,motion by Mrachek, second by McQuillan, the same was approved. The following resolution adopted by the Public Utility Board wa.s read and ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minneso ta. that the Hon. Common Council of the said City be and is hereby requested to -authorize the said Board to enter into the following contracts for the furnish- ing of coal screenings in accordance with specifications and with the bids of the respective bidders-; A contract with Walter Bledsoe and Company for the furnishing of SEVEN; THOUSAND TONS (7000) of 1 " screenings at a mine -price of $2.00 per ton with a. freight rate of $3.05 per ton, A contract with the Sahara Coal Company for the furnishings of TWO THOUSAND TONS (2000) of 12 "- screenings at a mine price of $2.05 per ton with a freight rate of $3.15 per ton, and A contract with Bell and Zoller Coal Company for the furnishing of ONE THOUSAND TON (1000) of 1" screenings at a mine price of $2. 35 per ton with a freight rate of $3. 15 per ton." The report of the Police Committee and Chief of Police that certain trucks tra-veling on Second Street Southwest and Eleventh Avenue Southwest for no particular reason had been eliminated and that -the balance of heavy trucks will be eliminated as. soon as, proper streets and roads are constructed to provide passage 41 for this type of transportation, was read and Presidei'it Leir.mon ordered that same 290 Record. of Official .Proceedings=.�-,of_,,the Common Council of the City.of Rochester, Minnesota, July 17 119,44 be placed on file. I The report of the City 1,1eighmaster for the month of June, 1944 showing 296 private loads weighed and receipts of $29.60, was read and President Lemmon referred some to the Finance Committee. The report of expenditures from the City Engineers payroll for the month I of June, 1944 was read and the same was ordered placed on file. The City Engineers trial balance for the month of June, 1944 was read and the same was ordered placed on file. I ' • The reports of the Clerk of Municipal Court for the week ending July S,� 19411 showing tota.l criminal fines and costs collected Y322.40, civil fees I received $.2 and conciliation court fees 5, $2.00; and for the week ending July 1�, i showing total criminal fines and costs collected $593.30, civil fees received I j � $7, 1LO, and conciliation court fees $2.00, were each read and having been I� previously approved by the City Attorney, President Lemmon ordered that same I I be placed on file. The applications of John A. Holtorf for a license to sell cigarettes, i I �I a license to sell soft drinks, and the transfer of "On Sale" 3.2 beer license I No. 497 Land "Off Sale" 3.2 beer license No. 879 from A. L. Fritsch to John A. i Holtorf, were each read and upon motion by Fryer, second by Mrachek, the same were granted subject to the approval of the License Committee and the Chief of I Police. I I' The application of James F. Joslin for a Drivers license was read and upon notion by Yaeger, second by Kjerner, the same was granted. I The applications of L. S. Anderson for Off and On Sale Licenses to sell _ I non- intoxicating malt liquors were each read. The motion_ was made by Yaeger, i second by Kjerner, that the licenses be not granted and upon roll call Alderman Kennedy, Kjerner, Mrachek and Yaeger voted in favor of the motion and Alderman • I-Icquilla.n and Fryer voting no, the licenses were not granted. i The application of C. H. Jensen for license to sell non -intoxicating j malt liquors "Off Sale" was read and upon motion by Fryer, second by Kjerner, i the license was granted. I ' The application of Martin Paulson for a license to connect with sewers and drains was read and upon motion by Yaeger, second by Kennedy, the license was granted. I I The application of I. Coppe for a transfer of Off Sale Liquor license I now owned by Joe Wallace was read andupon motion by Mrachek, second by Kjerner, the transfer was granted. I The license bonds of Martin Paulson in the amount of $1000.00 with the I � Fidelity and Casualty Company of New York as surety, I4a.a.ss &McAndrew Co. for l I • Record of Official Proceedings of the Common Council 2911 of the City of Rochester, Minnesota, July 17 19 44. $1000.00 with the National Surety Corporation of New York as surety, I. Coppe for $1000.00 with the Western Casualty Company as surety and Nancy Helen Vine for $1000.00 with the Western Surety Company as surety, were each read and upon motio by Mrachek, second by Kennedy, the bonds were approved, the surety thereon accepted., and it was ordered that the sa_iie be placed on file. Alderman Fryer introduced a resolution appropriating $241.18 from the General Fund and ordering payment made to Standard Oil Company for ci)tback asphal • II which was read. Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted as read, and all voting in'favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a. resolution appropriating $297.60 from the General Fund and ordering payment made to. Chicago & North Western Hy. Co. for freight on cutback asphalt, which was read. Upon motion by Fryer, second by.Kennedy, that the said resolution be adopted as ,read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $11,010.77 from the General Fund and ordering payment made to the Public Health & Welfare Fund for tax settlement received on June 30, 1944 which was read. Upon motion by Mra.chek, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $1134.52 from the General Fund and ordering payment made to the Public Health Fund for garbage assessments received with June 30th, 1944 tax settlement, which was read. Upon motion by Kjernerr, second by Fryer, that the said resolution be • adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $499.0o from the General Fund and ordering payment made to United States Fireworks Co. for firework which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $1009.73 from the treet 8. Upon motion by Mrachek, second by Yaeger, that the said resolution be I - - adopted as read, and all voting in favor thereof, President Lemmon -declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating $612.32 from the � Firemen's Relief Fund and ordering payment made to Rochester Fire Dept. Relief I tax Association for settlement received June 30, 1944, which was reed. Upon motion by Yaeger, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating �'J2594.81 from the, Police -Relief Fund and ordering payment made to Theo. H. Tollefson, Treasurer of I! Police Relief Association for tax settlement received June 30, 1944, which was re Id. Alderman Mcquillan introduced a resolution granting 2 public dance })ermits to ITT. C.O. Club, Co. K, George C. Ramme, which was read. Upon motion by Mrachek, second by Fryer, that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution authorizing the Public Utility, Board to enter into contrect with Walter Bledsoe & Company, Sahara Coal Company !'and Bell and Zoller Coal Company, which was read. Upon motion by Fryer, second by Kjerner, that the said resolution be j !adopted as read, and all voting; in favor thereof, President Lemmon declared the I !said resolution duly passed and adopted. I Alderman Mrachek introduced a resolution ordering a hearing on vacating ;tree alley lying between Lots 4 and 12 and 13 and 14 and West 29 ft. of Lot 11 all in Block 14, Head and NclAahon's Addition, which was read. City Candy Company, for candy bars, peanuts, etc., which was read. Upon motion by Kjerner, second by Yaeger, that the said resolution be s adopted as- read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman McQuillan introduced e resolution appropriating $210.90 from the Park Improvement Fund, $53. 34 from the .Lighting Fund and $11. 36 from the F. E. Williams Estate Fund and ordering payment made to the City of Rochester, Public Utility Department, which was read. Upon motion by Yaeger, second by Kjerner, that the said resolution be "YD: ., adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman McQuillan introduced a resolution appropriating $132- 70 from the General Fund,. $1.00 from the S A Fund, and $78.30 from the Fire Protection Fund and ordering payment made to the Community. Oil Company for gasoline, tire repairs, tubes, etc., which was read. Upon motion by Mra.chek, second by Fryer, that the said resolution be adopted as read, and al.l voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution authorizing the Mayor and City Clerk to execute an agreement between the '_'ochester. Da..iry and the City of Rochest in regard to the disposal of waste from the new dehydration plant, which wa.s read, Upon motion by Mrachek, second by Kennedy, that `the• -said resolution be adopted as read, and all voting in favor thereof except Alderman McQuillan,who vo',i President Lemmon declared the said resolution duly passed and adopted. Braa.sch, and iMrs. Harry Gimbert, and upon motion by II Fryer, second by Kjerner, the appointments were approved. Mayor Grassle announced the appointment of Philip La.mpman to fill the unexpired term of the Pa.r1r, Commissioner of the third ward and upon motion by Kennedy., second by I•:rachek, the a.p-oointment -was ap•_oroved. Mayor Grassle stated that radio equipment as"used by the Police Dep-t. rfas now available and -recommended that- stems be taken by the Common Council to receive bids for new radio equipment in the police department and -upon motion by Kennedy, s-econd-by Mrachek, the Mayor, the Police Committee and the Chief of Police were. instructed to investigate radio equipment and prepare plans and spec.ificati.ons and present same to -the Council at a future. meeting. The ma-tte•r of 1oca.tion and whether or not the old sewage disposal plant i! would• b'e remodeled or a new -o-lant constructed -was discussed and upon ;notion by Fryer, s.econ.d by Kjerner, and all v.otin in' favor thereof, the. Council went on - reco-rd• as favoring the construction. of a new plant on another site.- . ! I' Garnet Spring,. Building Inspector, stated that the platers Conley Company; Ii had made a reques-t for a permit to construct a temporary addition to their I present nla.nt to. be used for tine duration and one year thereafter.. Upon motion ! I Fryer,. second by Yaeger, the building inspector was instructed to grant a permit for the said building, the . same to be removed from. the, property after the period covered by the permit.
