I. 1 • 1 F-iinutes of• a regular meeting of the Common Council of the City of" Rochester, ?Minnesota, held in the Council Chambers in _the `City Ha.1.1, in said City on August '7, 1944. President Lemmon called the meeting to order at 2:00 o.1clock'P.M., the following members -being present: President Lemmon, Aldermen Fryer,.Kennedy,` Kjerner, McQuillan, Mrachek, and Yaeger. Absent: None. Upon motion by Fryer, second -by ifirachek.,. the minutes. -of the meeting of July 17, 1944 were approved.* - -A request by the Rochester Fire Departmei-A Relief'Association that 'the Common Council approve a .loan in th-e amount. of $400.00 to "Mrs. Joe Brogan was read and. President- Lemmon. ordered that same- be placed•' or_ file. A communication from the Waters Conley Company stating that they will tear down the te.mT)orary- building, to be constructed in connecfioii with their present plant., two- years after .date .of permit for same, or six months after the end of the wars, or six months after completion of its war manufacture, whichever, is the sooner, -was read and upon motion by Mrachek, second by Fryer, the L%ildi Inspector t-ra.s instructed to issue a' -permit for the construction of a temporary building to be removed'from-the site in accordance- with the above mentioned agreement. The communication from Tolz, King and Day, .Inc. , Engineers and Archicte.cts, requesting an opportunity to discuss the matter•of being re'tained as consulting engineers in connection with the construction of a proposed sewage disposal plant in Rochester, was read aild the same was ordered placed on -file. Two petitions for -the construction of a sidewalk on the west side of Fourth Avenue Southeast bet��,een Eighth Street and Ninth Street Southeast and on the south side of -Ninth Street Southeast between Third Avenue Southeast and Fifth .Avenue Southeast were each read and the same were ordered -placed -or- file. The petition -of Clarence L. Fischer that Fifth'Avenue' Southwest be vacated from -a point on the .so-dt_1 line of Eighth Street Southwest to a, point where it abutts the northerly line of Soldiers -Field was read and upon notion by Fryer, second by Kjerner, the matter was referred to the Street and Alley Committee and the Board of -Park Commissioners for recommendation at the next meeting. - The matter of constructing a. sidewalk along' -the South side` of Lot 92; Auditors flat "A° was again discussed and the same was referred to- the Street andl Alley Co:Ami t tee. The application of Fellows Auction Company for'an Auctioneers license was. read and -upon moti.on by Kjerner, second by McQuillan, the license was granted; 298 Record' of Official Proceedings .,,of the Common . Fritsch for cigarette license, soft drink I license and transfer of 3.2 Beer "Off and On Sale" were each read and -upon motion; by Yaeger, second by Kennedy, the applications were referred to the License Commi.ttee with power -to act. j The applications of Pifrs. Alfred B. Anderson for license to sell non- . I intoxicating malt liquors- "Off and- On Sale" were .each read an-d u-pon motion by Kennedy, second by I•irachek, that the, sane be not .granted, and all voting in favor thereof except Aldermen Fryer and IJicquillan, who voted no, the licenses • were not granted. j The.applications fDr license to sell cigarettes of Elizabeth M. Jack, 1! Harold A. Koffman,- Tom Andrew, and M. J. Donahue were each read, and upon. motion by Yaeger, second by Kjerner, the same were granted. The application of Alec Konetopka for a Driver's. license was read and upon motion by Kjerner., second by Kennedy, the license was granted. � I I The application of Edwar& D. Holst for Journeyman Electricians' licer_se 1 was read and upon motion by Kennedy, second by McQuillan, the license was granted' I The applications for license to sell soft drinks of Elizabeth 11. Jack, `� Tom Andrew, Id. J. Donahue and Harold A. Hoffman,- were each read and upon motion by Mra.chek, second by Kjerner, the licenses were granted. The.application of Kris 'Nielson to move a garage starting at 15th � I, Avenue Southeast and the belt line, then West on 12th Street Southeast to 7th � I I,I Avenue Southeast and then on 7th Avenue Southeast one block, was read -and upon motion b Mc uillan second by Yaeger, the permit was y q' s granted. I The applications of Walter H. Gleason for license to sell soft drinks, I' ,cigarettes, "on and off Sale" 3.2 beer, and to operate five pool tables,- were ,each read and upon motion by Yaeger, second b-%T Kennedy, the same were granted. 6 i The license bond of Fellows Auction Company with the National Surety Company as surety fn the sum of $1000.00 ana of the Sanitary Com-oany with the v � IIAetna Casualty Company as surety in the sum of $1000.00 were each read and upon 'i I (motion by Vrachek, second by Kennedy, the bonds were. approved, the surety thereon li .accepted and it was ordered that the same be -olaced on file. I Ii The reports of the Clerk of Municipal Court for the week ending July 22,I �I i 1944 showing total criminal fines and costs collected $161. 20, civil fees- receive " I' II $�1.I+0; and for the reek ending July 29, -1944 showing total criminal fines and ccst's ��collected$315.75, civil fees received $6.35 and conciliation court fees $.50; (And for the week ending August 5, 1944 showing criminal fines and - costs collected y i $370.45; civil fees.received $2.00, and conciliation court fees $2.75 were each I ;Tread and having been previously approved by the City Attorney, President Lemmon I, !ord-ered that same be placed on file. a I �I I Record of Official Proceedings of the Common Council of the City of Rochester, Minnesota, .Angus t 7 19h 1 1 A statement of receipts and disbursements for the month of June, 1944 by the Boar-d of Park Commissioners was read and the sam6 was ordered ;laced on file. The report of expenditures from the City Engineer's Payroll for the month of July, 1944 was read and the same was ordered placed on file. The City Engineer's Trial balance for the month of July, 1944 was read and the same was ordered placed on file. The recommendation- of the Finance Committee that the Common Council approve the action of the Firemen's Relief Association in making- a loan to Mrs. Joe Brogan in the amount of $400.00 was read and upon motion b,v 'Mrachek, second by Kjerner , the action of the Firemen' s Relief Association -was- approved. Alderman Fryer introduced a resolution granting a public dance permit to Perey.Klein, which was read. Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted a.s.read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman 'Fryer introduced a resolution granting nine* public dance permit to V. F. W. -T'r'1215, which was read. Upon motion by 'Mrachek, second by Kennedy, that the said resolution be adopted -as read, and all voting in favor thereof, President Lemmon declared•the said resolution duly passed and adopted. Alderman Fryer introduced' a resolution appropriating $200.50 from the General Fund and. ordering payment made to P. F.' Donovan for'salary of -weed inspector, which was read. Upon motion by Yaeger, second by Kjerner, that the•said resolution be adopted as read; and all voting in favor thereof; President Lemmon declared the said resolution duly passed and adopted. , Alderman Fryer introduced a resolution appropriating'$•303.6s from the General Fund and ordering payment made to State of Minnesota, Commissioner of Taxation for gasoline -tax and i-nspection fee on.2 transports of gasoline, which was read. Upon motion by Fryer, second by Mrachek,-that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the saicrl resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $675.36 from the ,General Fund and- ordering payment made to The Texas Company for '2 transports of gasoline, which was read. Unon motion by i.irachek, second by Kjerner, the City Attorney was authorized to take such action as necessary to protect•Park property. Alderman McQuillan brought up the matter of constructing a foot bridge I acros-s Cascade Creek on pth. Street Northwest and- upon motion by Kennedy, second by Kjerner, the matter ryas referred to the S.treet and Alley Committee. The report of the Building and Plumbing Inspector showing building I� -oer•mits issued'$1&3.00 and plumbing permits issued ;43.50 a.110. the revert of the ; • I, Electrical Inspector shoring electrical permits -issued 473.50, were each rea-d and Pr-esident Lemmon referred same to the Finance Committee-. l i Upon motion, by -Kennedy, second by Kjerner, •the meeting was adjourned I'! until 7:30 o'-clock P.
