Minutes of an adjourned/`meeting of the Common Council -of the City of
Rochester, Miinnesota, held in the Council Chambers in the City -Hall, in said City
on August 21, 1944.
President Lemmon called the meeting to order at 7:30 o"clock P.M., the
following members being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, McQuillan, Mrachek, and Yaeger. Absent: None. Alderman McQuillan was
excused due to the illness of his sister.
Upon motion by Mrachek, second by Fryer, the minutes -of the meeting -of
August 7, 1944 were approved.
Leo Herrick appeared at the meeting for the purpose of.protesting a
proposed Motorized Bicycle Ordinance. He -was informed that the ordinance had
not been introduced as yet and there would be still further opportunity to
protest same .if it was. not satisfactory, at the time of its formal reading.
Communications from the State.of Minnesota, Department of'Highways;
submitting 19 agreements for postwar surveys were read and the same were ordered
placed. on file.
An appraisal of land known as the "old mill pond" in the amount of
$10,000.00 was read -and the same was ordered placed on file and the City Clerk
was instructed to notify the Board of Park Commissioners of the amount of the
appraisal.
The resignation of B. Seth Green as a member of the Rochester Police
.Department was read and upon motion by Mrachek, second by Fryer, the same was
accepted and ordered placed on file.
A notice by C. E. Ginther, Chief of the Fire Department, that Charles
Smart had been suspended for ten days without pay, from August 16th to August
25th, inclusive, was read and the same was ordered placed on file.
A proposal by the United States Department of the Interior, Geological
Survey, to cooperate in establishing and maintaining a stream flow measuring
station in the Zumbro River, North of the City, the estimated cost of same being
$2400.00 and the City to pay one half of the cost of construction and maintenance
was read and the same was referred to the Street & Alley Committee for report at
the next meeting.
The complaint of Bertha Rusch versus the City of Rochester, Minnesota
claiming damages in the amount of $30,000.00 to her farm was read and the same
was referred to the City Attorney.
Specifications for frequency modulation two way radio communication
equipment for the Police Department was read and the same was ordered placed on
Porposed engineering agreements covering plans, specifications,

'engineering services, etc. in connection with the design and construction of the
(proposed sewage disposal plan t.. submi tted by Buell & Winter Engineering Co. of
Sioux City, Iowa and Black and Veatch and Ellerbe and Company of St. Paul,
iMinnesota, were each read and the same were held for future consideration.
A communication from the Boa-rd of Public Health & Welfare recommending
to the Common Council that the Dog Catcher, the Dog Pound, and all —of its
activities be taken over by the Public Grounds Committee, was read and President
'Lemmon referred same to the Public Grounds Committee for report at the next
council meeting.
A letter from Toltz, King & Day, Inc. Engineers and Architects, stating
that approximately sixty days would be required to complete a preliminary survey
of the proposed sewage disposal plant and that working plans and specifications
would take from four to six months for completion, was read and ordered placed on
file.
The application of the Rochester Hotel for license to sell cigarettes
was read and upon motion by Mrachek, second by Fryer, the same was granted.
The application of Wm. A. Peterson for a Drivers License was read and
upon motion by Kjerner, second by Fryer, the license was granted.
The applications of L. C. Fordham and Earl J. Squires for Journeyman
Electricians license were each read and upon motion by Yaeger, second by Kjerner,
the licenses were granted.
The license bonds of M. J. Donahue for $3.000.00 with Western Surety Co:,
as surety, Herman Dornack for $1000_.00 with the American Surety Co. as surety,
L. F. Milostan"and J. A. Daly for $1000.00 each with the National Surety Corporation
as surety and the official bonds of Angela Mary Wagoner and Cleo Paullin for
$1000.00 each and Alberta Chance for $2000.00, each with the Fidelity and Deposit
Co. as surety, were each read and upon motion by Fryer, second by.Mrachek, the
bonds were approved, the surety thereon accepted and it was ordered that the
same .be placed on file.
The reports of the Clerk of Municipal Court for the week ending August
�12, 1944 showing total criminal fines and costs collected $508.95, civil fees
i
received, $10.45 and conciliation court fees $1.50; and for the week ending
I�August 19, 1944 showing total criminal fines and costs collected $197.80, civil
1Ifees received, $2.35, and conciliation court fees, $1.25, were each read and having

been previously approved by the City Attorney, President Lemmon ordered that
;'!,same be placed on file.

i The report of the City Weighmaster for the month of July, 1944, showing �
1,287 private loads weighed and receipts of $28.70, was read and President Lemmon

The report of cash receipts and.disbursements of.School District #$ for
the year ended July 31, 1944 was read and the-same.was ordered placed on file.
The report of the Street & Alley Committee that the matter of vacating
Fifth Avenue Southwest from a point on the South line of Eighth Street Southwest
to;a,point where it abutts on the northerly line of Soldiers Field had been
referred to the Park -Board for their consideration, was read and the same was
ordered placed on file.
The recommendation of the Mayor, Police Committee and Chief of Police
that the Council advertise for bids for a new two way Frequency Modulation Radio
Communication set,,was read and President Lemmon ordered that same be placed on
fiJe..
The recommendation of the Street & Alley Committee that the construction
of ,a foot bridge across Cascade Creek be taken care of after the near, was read
land President Lemmon ordered that same be placed on file.
The recommendation of the Street & Alley Committee.and the City
Engineer tha.t sidewalks be constructed on both sides of 92 Street Southeast from
I9th Avenue Southeast to 500 ft. East., was read and President Lemmon ordered that
(same be placed on file.
A petition for curb sidewalk on Sth Avenue Southeast between 4th Streetl
Southeast and Bear Creek was read and: the same was referred to the Street. & Alley
Committee.
A petition for bituminous paving on the North and South alley in Block
39, Original Plat, was read and the same was ordered placed on file.
Alderman Fryer introduced a resolution authorizing the Mayor. and City
Clerk to execute an agreement with M.- J. Hoffman, .Commissioner of Highways to app]
for Federal Aid Funds for PWS 7-Item 1307, 7th St. N. E. and N. W. from llth
Ave. N. W.. to 2nd Avenue N. E. , which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the.

Alderman Fryer introduced a resolution authorizing the Mayor and City

Alderman Fryer introduced a resolution authorizing the Mayor and City
Clerk to execute an agreement with M. J. Hoffman, Commissioner of Highways, to
apply for Federal Aid Funds for PWS 7-Item 1315,. 9th St. S. E. from 3rd Ave. S.E.
to 9 th Ave. S. E. , which was read.
Upon motion by Kjerner, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kennedy introduced a resolution authorizing the Mayor and City

Alderman Kennedy introduced a resolution authorizing the Mayor and City

Alderman Kennedy introduced a resolution authorizing the Mayor and City
Clerk to execute an agreement with M. J. Hoffman, Commissioner of Highways, to

(R.R. underpass-4o, wide), which was read.

Alderman Kennedy introduced -a •reso-lu-tio.n deeming it necessary that

the Police Department, adopting plans, specifications and estimate of cost and -
ordering advertisement -for bids, -which wa.s read.
Upon motion by Fryer_, second by Kennedy, that the said resolution be

Alderman Kjerner introduced a resolution appropriating $576.52 from the
General Fund'and ordering payment made to the Chicago and N. W. Ry. Co. for heatix
and: freight on cutback asphalt, which was. read.
Upon motion by Kjerner, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a.resolution appropriating $480.89 from the
General Fund and ordering payment made to Standard Oil Company for cutback asphalt
which was read.
Upon motion by Fryer, second by .Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $534:92 from
the,General Fund and ordering payment made to.Park Improvement Fund for transfer
of funds, which was. read.

Alderman Kennedy introduced a resolution ordering a hearing on paving
the alley running North and South in Block 3.9, Original Plat, which was read.'
Upon. motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon.declared the
