Minutes of an adjourned regular meeting of the Common -Council of 'the
City of Rochester, Minnesota, held in the Council Chambers in th'e City' Hall, in
said City on September 5, 1944.
President Lemmon called the meeting to order at 2:00 O'clock P. M., the
(following members being present: President Lemmon, Aldermen Fryer, Kennedy,
lKjerner, McQuillan, Mrachek, and Yaeger. Absent: None.
Upon motion by Yaeger, second,by Kjerner, the minutes of the meeting
lof August 21, 1944 were approved.
President Lemmon stated this as being the time and place -set for a
hearing on the vacation of -that part of the alley lying between Lots 1, 2, and 3,
and the West 29 ft. of Lot 4, and lots 12, 13, and 14, and the West 29 ft. of
Lot 11, all in Block 14, Head & McMahon's Addition to the City,of Rochester,
Minnesota. There was no one present wishing to be -heard on the vacation of the
said alley.
A letter from Burns & McDonnell, Engineering Company, transmitting two
copies of their proposal and contract for engineering services in connection with
lthe proposed sewage disposal plant in Rochester, was read and the same was ordered
1placed on file.
The City Engineer's 'request that $5,000.00 be appropriated from the
Street & Alley Fund for use of the Street & Alley Committee was read an'd the same
lwas ordered placed on file.
The Mayor's emergency order given to the City Clerk for the purchase of
approximately 9000 gallons of gasoline was read and upon motion by Fryer, second
by Mrachek, the same was approved.
A copy of a resolution adopted by the Sinking Fund Commission was read
and upon motion by Mrachek, second by Kennedy, the action of the Sinking Fund
Commission was approved.
A petition for a sanitary sewer in eleventh Street Northwest from
Eighth Avenue Northwest to 9th Avenue Northwest was read and President Lemmon
3rdered that same be placed on file.
A petition for -the vacation of the east and west alley in Block 20,
ead & McMahon' s Addition to , the City of Rochester, Minnesota was read and
resident Lemmon referred the same to the Street and Alley Committee for report
t the next meeting on September 19, 1944.
The recommendation of the Board of Park Commissioners that part of
if't2i Avenue Southwest, south of Eighth Street Southwest to the north line of
oldiers Field be vacated and that 25 ft. be, given to Clare Fischer and that the

The recommendation of the Public Grounds Committee accepting the

;;recommendation of the Board of Public Health & Welfare that the dog catcher, the ;I
I'dog pound, and its activities be turned over to the Public Grounds Committee was j!

;read and upon motion by Fryer, second by Kjerner, the same was approved.
The recommendation of the Street & Alley Committee that the construction

of a Guaging Station in the Zumbro River be deferred until a new Sewage Disposal
!Plant has been constructed, was read and the same was ordered placed on file.
The recommendation of the Mayor, the Police Committee, and the Chief of j
Police that the bicycle ordinance be adopted, was read and the same was ordered
(placed on file.
The statement of receipts and disbursements by the Board of Park
'Commissioners for the month of July, 1944 was read and President Lemmon ordered
(that same be placed on file.
The report of expenditures from the City Engineer's payroll for the

,month of August, 1944 was read and President Lemmon ordered that same be placed
�on file.

The City Engineer's Trial Balance for the month of August, 1944 was read
Ijand President Lemmon ordered that same be placed on file.
The reports of the Clerk of the Municipal Court for the week ending
it August 26,'1944, showing criminal fines and costs collected $321.20, civil fees
received $2.60, and conciliation court fees, $1.00; and for the week ending
September 2, 1944 showing criminal fines and costs collected $227.60, civil fees
j:received $2.00, and conciliation court fees, $1.00 were each read, and having it

Beer Licenses were each read and upon motion by Mrachek, second by Kjerner, the

Hotel for cigarette licenses, were each read and upon motion by McQuillan, •second I'

The application of Clarence W. Stewart for license to sell soft drinks
was read and upon motion by Kjerner, second by McQuillan, the license was granted.1
. The. application of ' Clarence W. Stewart for transfer of 3.2 Beer "Off
Sale" license No'. 948 from Robert.W. Donaldson was read and upon motion by Mrachek
second by McQuillan, the same was granted.
The application of H. L. Doepke for a house movers license was read and
upon motion by Mrachek, second by Kennedy, the license was granted.
Upon motion by Kennedy, second by Yaeger, Kris Nielson was granted
a permit to move a house over the following route: starting at the intersection
of llth Avenue and 7th St. Northwest, on llth Avenue Northwest down to 1st Street
Southwest, thence on 1st Street Southwest to 16th Avenue Southwest.
The license bond of H. L. Doepke in the amount `of $7500.00 with the
Seaborad Surety Company as surety, was read and upon motion by Mrachek, second by
Kjerner, the bond was approved, the surety thereon accepted and it was ordered
that the same be placed on file.
Alderman Fryer introduced a resolution.appropriating $462.00 from the
Street & Alley Fund and ordering payment made to Leon Joyce for shovel rental
for dredging Cascade Creek, which was read.
Upon motion by Kjerner, second by Kennedy, that the. said resolution be
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $1165.79 from the
St. &A.Fund and $241.80 from the General Fund and ordering payment made. to Morse
Brothers for .sand and C. P. Run, which was read.
Upon motion by Fryer, second by Kennedy,- that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $2096.10 from the
St. & Alley Fund and ordering payment made to.The Barrett Division for tar, which
was. read.
Upon motion by Yaeger, second by McQuillan, that the said resolution be
adopted as read, and all voting -in favor. thereof, President Lemmon-declared the
said resolution duly passed and, adopted.
Alderman McQuillan introduced a`=resolution appropriating $1925.90 from
the Lighting Fund, $12.90 from the Fire Protection Fund, $2.00 from the S. & A.
Fund and $196.40 from the General Fund and ordering payment made to City of,
chester, Public Utilities for power, water and electricity, which was read.
Upon motion by Mrachek, second by Yaeger. that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $5,000.00 from
the Street & Alley Fund for use of the Street & Alley Committee, -which was read.
Upon motion by Kjerner, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution vacating the alley in Block 14,
Dead & McMahont s Addition to the City of Rochester, which was read.
Upon motion by Fryer, second by Kjerner, that -the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution ordering a'hearing on the
construction of a sewer in llth Street Northwest from Sth Avenue Northwest to
9th Avenue Northwest, which was read.
Upon motion by Kennedy, second by Mcquillan ,that the said.resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared thll
said resolution duly passed and adopted.

Alderman Fryer introduced a resolution ordering a hearing on the 11
construction of a watermain in 3rd-Avenue Northwest beginning at a point 94 ft.
,North of the South line of Outlot 5 of Northern Addition to the City of Rochester 1'
and extending a distance of approximately 700 ft. north on said 3rd Avenue
Northwest, which was read. II

Upon motion by Fryer, second by Mrachek, that th-e said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The following claims were read, and upon motion by Yaeger, second by
Fryer, the same were allowed and the Mayor -and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

An Ordinance amending an ordinance entitled "An Ordinance for the
regulation and government'of Public Parks and Parkways in the City of Rochester,
Minnesota, was given its second reading.
An Ordinance entitled "An Ordinance regulating the use of bicycles and
scooters with motors for the purpose of motive power attached upon the streets of
the City of Rochester, Minnesota" was given its first reading.
Upon motion by Fryer, second by Kennedy, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given
its second reading.
Upon motion by McQuillan, second by Kennedy, that Toltz, King, & Day,
Engineers and Architects, be employed as consulting engineers and architects for
the construction of the proposed sewage disposal plant and upon roll call and all
voting in favor thereof, Toltz, King, & Day were designated as the engineers and

and architects for the construction of the new proposed sewage disposal plant
and the City Clerk was instructed to notify the various firms -who had submitted
proposals, of the action taken by the Common Council.
The matter of constructing a foot bridge across Cascade Creek in• North
�Rochester was again discussed and upon motion by Kennedy,•second by Fryer, the
, City Engineer was instructed to furnish, data, plans and specifications of the It
proposed bridge for the consideration of the Common Council at their next meetingil
Upon motion by Kennedy, second by Kjerner, Mr. Knute Olson, City
i
i'Assessor, was authorized to attend the National Assessors Convention -at Des Moines,
'Iowa at city expense.

Upon motion by Fryer, second by Yaeger, the.City-Engineer was authorized

Ito attend the Public Works Convention to be held in St. Paul, Minnesota. j
The. report of the Building and Plumbing Inspector -showing building
permits issued•$80.00 and plumbing permits issued $27.50, and the report of the
iElectrical Inspector showing electrical permits issued $21.25, were each read and'l

President Lemmon referred same to the Finance Committee.

Mayor Grassle suggested that an ordinance be drawn which would control
'the drilling of water wells within the City limits and upon motion by Kennedy,
second by Kjerner,.the City Attorney was instructed to prepare an ordinance
controlling the drilling of water wells within the City limits.
Upon motion by Fryer, second by Kjerner, the meeting was adjourned
until 7:30 P. M. September 18, 1944.
