Minutes of an adjourned regular meeting of the Common,Council of the
City of Rochester., Minnesota, held in the Council Chambers in the City Hall, in
said City on September 19, 1944.
President Lemmon called the meeting.to.order at 7:30 o'clock P. M., the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, McQuillan, Mrachek and Yaeger. Absent:' None.
Upon motion by Fryer, second by Kjerner, the minutes of the meeting of
September 5, 1944 were approved.
President Lemmon stated this as being the time and place set for a
hearing on bituminous treatment to be applied to the North and South Alley in
Block 39, Original Plat of the City of Rochester, Minnesota. There was no one
present wishing.to be heard on the bituminous treatment of said alley.
President Lemmon stated this as being the time and place set for a
hearing on the construction.of._A curb and gutter on Sth Avenue Southeast in
front of lots 10, 7, 6, 3 and part of Lot 2, Block 37, Morse and Sargents Addition
and_in front of Lots 10, 11, 12 and part of 13, in Block 39, Morse and Sargents
Addition to the City of Rochester. There was no one present wishing to be heard
on the construction of said curb and gutter.
A request from Erwin L. Briese, President of the Rochester Armory Board,l
that $500.00 be appropriated from the General Fund for maintenance of the Rocheste
Armory was read and the same was ordered placed on file.
A request from the Board of Public Health and Welfare that the Common
Council approve increases in the salaries and transportation expense of the
Public Health nurses and also additional salaries and traveling expense for two
nurses employed by the State Board of Health beginning September 1, 1944 was read.
The matter was referred to the. Finance Committee and the City Attorney.
Aletter from the County Auditor requesting that the Common Council
approve the classification of a list of lands within the City of Rochester as
non -conservation lands was read and the same was approved by the Common Council.
The Mayor's appointment of Seth A. Thorsness as special policeman at
Waters Conley Company was read and upon motion by Mrachek, second by Yaeger, the
same was approved.
The City Attorney presented a contract covering architectural and
engineering services on the proposed Sewage Disposal Plant and the City Clerk was
instructed to notivy Toltz, King & Day, Inc. to have a representative at the
meeting of the Common Council to be held on October 2, 1944.
A Communication from Lee M. Nelson, Superintendent of the Electric Light

bridge and also repairs necessary below the dam was read. Upon motion by Yaeger,
second by Kennedy, the Mayor was authorized to issue an emergency order covering
the work as outlined by Mr. Nelson.
The petition of Mrs. 0. T. Clagett and Richard Grounds that 12th Avenue
Southwest be oiled from 7th Street Southwest to the City limits, was read and
upon motion by Kennedy, second by Fryer, the same was referred to the Street &
'Alley Committee with power to act.
A petition that bituminous treatment be -applied to Sth Avenue Southeast
from 4th Street Southeast .to Bear Creek, was read and the City Clerk was
instructed to prepare a resolution ordering a hearing on October 2, 1944.
A petition that a sanitary sewer and watermain be constructed in 3rd
Avenue Northwest from the present manhole to approximately 700 ft. North, was
!read and the same was referred to the Sewer Committee and the City Engineer.
The recommendation of the St. & Alley Committee and the City Engineer
that the East and West Alley in Block 20, Head & McMahon's Addition be vacated
'iwas read and upon motion by Mrachek, second by Kjerner, the same was approved.

The report of the Clerk of Municipal Court for the week ending
.September 9, 1944 showing total criminal fines and costs collected $206.80, civil

fees received $5.65, and conciliation court fees $1.50, was read and having
.been previously approved by the City Attorney, President Lemmon ordered that the
;same be placed on file. !

Upon motion by Yaeger, second by Kjerner the action taken at the
meeting held on September 5, 19.44 regarding the preparation of plans, specifications,

Northwest, was rescinded and the matter was referred to the .Council and the City
Engineer for further study.
The appli cation of R. A. Phipps for a Drivers License was read and upon
motion by Yaeger, second by Kennedy, the license was granted.
The application of Robert W. Donaldson for a license.to sell non -
intoxicating malt liquors "Off Sale" was read and upon motion by Kjerner, second
by Yaeger, the license was granted.
The application for the transfer of 3.2 Beer License "On Sale " No. 507
and "Off Sale" No. 897 from Katherine Kennedy to Vern Day was read and upon motion,
by Kennedy, second by McQuillan, the transfer was granted.
The application of the Rochester Bus Line for a license to operate a
new 1944 Ford Bus #26, license No. 633800, was read and upon motion by Fryer,
second by Kennedy, the license was granted.
The application of Fred W. Oesterreich to transfer "On Sale " 3.2 Beer
License No. 496 and "Off Sale" 3.2 Beer License No. 882 from 301-303 North
Broadway to 412-418 First Avenue Southwest, was read and upon motion by Mrachek,
second by.Kjerner, the transfer was granted.
The applications of Mary Dee Manning, Vern Day and Mike Caffes for
license to sell cigarettes were.each read and upon motion.by.Yaeger, second by
Fryer, the same were granted.
The applications.of Mary Dee Manning, Mike Caffes and Vern Day for
license to sell soft drinks were each read and upon motion by Kjerner, second by
McQuillan, the licenses were granted.
The applications.of H. L. Doepke for permits to move four houses were.
each read and upon motion by Mrachek, second by Kennedy, the permits were granted.
The license bond of.the Hankee Heating Company for $1,000.00 with -St..
Paul Mercury Indemnity Company as surety and the official bond of Seth Thorsness
for $1,000..00 with the Fidelity & Casulaty Company as surety, were each read and
upon .motion by Mrachek, second by Kennedy, the bonds were .approved,. the surety
thereon accepted and it: -was ordered that the same be placed on file.
The following claims were read, and upon motion by Yaeger, second -by
Fryer, the same were allowed and the Mayor and City Clerk were ,authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Alderman Fryer introduced a resolution granting 16 public dance permits
to N. C. 0. Club, Co. K, which was read.
Upon motion by Mrachek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and.adopted.
Alderman Fryer introduced a resolution granting 10 public dance permits

Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, resident Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $500.00 from the
(General Fund and ordering payment made to the Rochester Armory for expenses of
(the Armory, which was read.
Upon motion by Kennedy, second by McQuillan, that the said resolution be
ladopted as read, and all voting in favor thereof, 2resident Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $572,.51 from the
(General Fund and ordering payment made to Chicago & North Western Ry..Co.,, which
Iwas read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $1101.15 from t
Street & Alley Fund, $1321.39 from the General Fund and $21.00 from the Sewer
(Fund and ordering payment made to the St. & Alley Fund for use of equipment and
lstock used during August, 1944, which was read.
Upon motionby Fryer, second by Kennedy, that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kennedy introduced a resolution appropriating $469.00 from the

Alderman Kennedy- introduced .a resolution appropriating $1407.10 from

Alderman Kjerner introduced a resolution appropriating $396.98 from the
Sewer Fund and ordering payment made to Herbert G. Knopp for premium on insurance]
for sewage disposal plant, which was read.
Upon motion by Mrachek, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $279.70 from thel
Park Improvement Fund and ordering payment made to the Queen City Candy Co. for
candy, cigarettes, digars, etc. which was read.
Upon motion by Kennedy, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $300.72 from the
Park Improvement Fund and ordering payment made to Rochester Dairy Co. for ice
cream, sherbert, etc. which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a.resolution appropriating $909.02 from
the Park Improvement Fund and $129.4o from the Lighting Fund and ordering payment)
made to City of Rochester, Public Utilities for water and electricity, which was
read.
Upon motion by Yaeger, second by Fryer, that the said resolution be

Upon motion by Fryer, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Mrachek introduced a resolution ordering a hearing vacating
part of 5th Avenue Southwest from a point on the South line of 8th Street Southwe;
to a point where it abutts the northerly line of Soldiers Field, which was read.
Upon motion by Mrachek, second by Kennedy, that the said resolution be
I adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution ordering a hearing on the
vacation of the east and west alley in Block 20, Head & McMahon's Addition, which
was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
(adopted as read, and all voting in favor thereof, President bemmon declared the
(said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution ordering a hearing on the
(construction of a sanitary.sewer and watermain in 3rd Avenue Northwest from the
present manhole to 700 f t. North, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be
(adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Mr. A. H. Clemens, Attorney for the Rochester Bus Line, appeared at the
meeting and presented an ordinance authorizing the Rochester Bus Line to establish
conduct, maintain and operate bus lines in the City of Rochester, which was given
Zits first reading.
Upon motion by Fryer, second .by Kjerner, the City Clerk was instructed
Ito request the various departments to.prepare their tax budget and submit same
I by October 10, 1944.
Upon motion by Mrachek, second by McQuillan, an appropriation from the
(General Fund covering the unpaid balance due on the swimming pool in Soldiers
Field was authorized.
Upon motion by Yaeger, second by Kjerner, the City Attorney was
linstructed to defend the case of Rucker vs City of Rochester rather than compromis
isame.
