HomeMy WebLinkAbout10-16-1944. 336 Record of Official Proceedings of the Common Council. of the City of Rochester Minnesota October 16 19 44 • Minutes of an adjourned meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City on October 16, 1944. President Lemmon called the meeting to order at 7:30 o'clock P. M., the following members being present: President Lemmon, Alderman Fryer, Kennedy, Kjerner, McQuillan, Mrachek, and Yaeger. Absent:' None. Upon motion by Fryer, second by Yaeger, the minutes of the meeting of !October 2, 1944 were approved. President Lemmon stated this as being the time and place set for a hearing on the placing of bituminous treatment on 8th Avenue Southeast from 1'4th Street Southeast to 245 feet south. There was no one present wishing to be heard on the bituminous treatment of said street. President Lemmon stated this as being the time and place set for a 'hearing on the placing of bituminous treatment on the North and South alley in Block 39, Original Plat of the City of Rochester, Minnesota. There was no one !present wishing to be heard on the bituminous treatment of said alley:_ President Lemmon stated this as being the time and place set for a 'hearing on the placing of bituminous treatment on the North and South alley in , ii`Block 35, Original Plat of the City of Rochester, Minnesota. There was no one I !,present wishing to be heard on the bituminous treatment of said alley,-.. President Lemmon stated this as being the time and place set for a !!hearing on the placing of bituminous treatment on 12th Avenue Southwest from 7th Street.Southwest to the City limits. There was no one present wishing to be ;heard on the bituminous tr-eatment of said street. President Lemmon stated this as being the time and place set for a (;hearing on the construction of a watermain'in Third Avenue Northwest from the present hydrant to 700 feet North. Several residents on 3rd Avenue Northwest, or their representatives, appeared at the -meeting, part of whom spoke in favor of i (laying the watermain and also the construction of a sanitary sewer, while others !,opposed the construction of one or both. Upon motion by Kjerner, second by �:Mrachek, the matter was left in the hands of the Water Committee to report at the ! meeting of November 6, 1944. Later Alderman Kjerner withdrew his motion -and also jlAlderman Mrachek withdrew his second. The bid of Wm. C. Fraser and Son in the ;amount of $2289.45 was received and upon motion by Fryer, second by Yaeger, the same was rejected. Upon motion by Fryer, second by Kjerner, the City Clerk was instructed to return the certified check of Wm. C. Fraser & Son. ii I! A request by the Board of Park Commissioners that the Common Council meet with them to discuss .the advisability of including certain items in their budget was read and the same was ord.ered placed on file,. The following copy of a resolution adopted by'the Public Utility Board was read and the same was ordered placed on file:. "WHEREAS, on September 29, 1924, the Public U-tility Board paid to the Rochester Milling Company, $39,683.96 for certain lands and water rights- in the City of Rochester, Minnesota, and described in a deed similar date, which deed is on file in the office of the City Clerk, and WHEREAS, under date of,September 14, 1931, the Public Utility Board did by resolution ask the Common Council for authority to deed certain portions of the said property to the Park Board of the said City, -but due to Charter limitations this was never done but a mutual understanding was reached placing said property under the jurisdiction of the said Park Board, and WHEREAS, certain improvements were made and.paid for from Park Board Funds and certain lands known as the Karau Land Purchase and described in the deed as the Adolph Doweidt property, and stipulated, as an exception to the lands purchased from the Rochester Milling Company property, were paid for from the general fund, and WHEREAS, the amount of $39,693.96 was charged to and remains as assets on the books of the Public Utility Department less, the amount of $5,000.00 charged off as fair value of the old mill when it was dismantled and torn down, and WHEREAS, it is the opinion of the Public Utility Board that a certain portion of the said property, as described in a "DESCRIPTION OF PROPOSED SILVER —LAKE POWER DAM SITE" dated October 3, 1944, hereto attached and a part of this resolution, be retained by the Public Utility Board for -the purpose indicated, and WHEREAS, it is the opinion of the said Public Utility Board that it would be for the best interest of the public if the remainder of the property as described and that part not included in the . description mentioned in the preceding paragraph, be placed under the jurisdiction of the Park Board and that'the General Fund of the City of Rochester be reimbursed for the monies spent for improvements and. additional land purchases from the Park and General Funds of the City of Rochester, THEREFORE, be it and it is hereby resolved that the amount of $9,715.88 be and is hereby appropriated to the General Fund for such improvements and additional lands as stipulated,,and Be it and it is hereby further resolved that the properties not included in " THE DESCRIPTION.OF PROPOSED SILVER LAKE POWER DAM SITE" be and are hereby placed under the jurisdiction of the Park Board with the stipulation that the Public Utility Board retain the right to construct or install such conduits, water lines, or other underground facilities as may be found necessary for the construction and maintenance of the said proposed power plant.' The request of the Rochester Bus Line for permission to install temporar gasoline pumps at the new garage which they are'planning on constructing on 1st Avenue Northwest was read and upon motion by Mrachek, second by Kennedy, permissio Iwas granted for a temporary installation of the gasoline pumps, not to -exceed one 1year. The resignation of Mr. Arleigh C. Smith as City Engineer effective on November 15, 1944 was read and upon motion by Mrachek, second by Fryer, the same Iwas accepted and the City Clerk was instructed to notify him of the action taken 1by the Common -Council. The applications of Oscar A. Maier and A. L. Benschoter for Drivers 338 Record of Official Proceedings of the Common. Council of the City of Rochester, Minnesota, October 16 _19 44 License were each read and upon motion by Fryer, second by Kjerner, the licenses were granted. The application of R. W. Donaldson for a cigarette license was read and upon motion by Yaeger-, second by Mrachek, the license was granted. The application of.John W. Mellor for Journeyman Electricians License was read and upon motion by Fryer, second by Mrachek, the license was granted. The application of Kris Nielson for license to move three buildings was read and upon motion by Mrachek, second by Kjerner, the same was granted. The applications of R. W. Donaldson, W. E. Just and Sam Francis to sell', 1soft drinks were each read and upon motion by Kjerner, second by Yaeger, the licenses were granted. The application of W. E. Just for the transfer of "Off Sale" 3.2-licens No. 965 was read and upon motion by McQuillan, second by Fryer, the transfer was granted. The surety bond of E. C. Johnson in the amount of $1000.00 with the Aetna Casualty and Surety Company as surety was read and upon motion by Mrachek, second by Kjerner, the bond was approved, the surety thereon accepted and it was ordered that the same be placed on file. The reports of the Clerk of the Municipal Court for the week ending October 7, 1944 showing total criminal fines -and costs collected $225.60, civil fees received $.25, and conciliation court fees $2.50; and for the week ended October 14, 1944 showing total criminal fines and costs collected $340.62, civil Ijfees received, $7.60, and conciliation court fees, $.50, were each read and havino been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The recommendation of the Fire Committee that the Common Council take steps to build a permanent training tower or an addition to the Fire Department (building to house same was read and upon motion by Yaeger, second by Fryer, the same was approved. Upon motion by Kennedy, second by Fryer, the Fire Committee was ilinstructed to make a study of the equipment needed for a training tower and to 'have plans and specifications prepared for same. The report of expenditures from the City Engineer's Payroll for the �,month of September, 1944 was read and the same was ordered placed on file. The City Engineer's trial balance for the month of September, 1944 was read and the same was ordered placed on file. The report of the City Weighmaster for the month of September, 1944 showing 275 private loads weighed and total receipts of $27.50 was read and President Lemmon referred same to the Finance Committee. Alderman Fryer introduced a resolution granting eight public dance permits to the Whitlock Sonnenberg Post #1215 V. F. W.., which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution ordering a second hearing on the placing of bituminous treatment on Twelfth Avenue Southwest from Seventh Street Aouthwest, south to the City limits, which was read. Upon motion by Mrachek, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution ordering a second hearing on the placing of bituminous treatment on the North and South alley in Block 35, Origina: Plat of the City of Rochester, Minnesota, which was read. Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $3375.73 from thi General Fund and ordering payment made to the Park Improvement Fund for transfer of funds to make same available for the payment of principal and interest due on Soldiers Field swimming pool, which was read. Upon motion by Yaeger, second by Mrachek, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution adopting plans,•specifications, and estimate of cost and ordering bids for bituminous -treatment of 12th Avenue Southwest from 7th Street Southwest to the City limits, which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution adopting plans, -specifications, and estimate of cost and ordering bids for bituminous treatment of Block 35, the alley running north and south, of the Original Plat, which was read. Alderman McQuillan introduced a.resolution appropriating $166.49 from ' 'the Park Improvement Fund and $57.41 from the Lighting Fund and ordering payment Ili I I Imade to City of. Alderman Mrachek introduced a resolution appropriating $1213.50 from th, General Fund, $15.75, from the Sewer. Fund and $918.13 from. the Street. & Alley Fund and ordering payment. made. to. the Street and Alley Fund for use of equipment, which was read.. Upon motion by Kennedy,, second by Yaeger, that the.said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and. adopted. Alderman Mrachek introduced a resolution approving a resolution adopted by the Public Utility Board, -which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as. read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Mayor Grassle made a brief report on the regional meeting of the League of Minnesota Municipalities which was held at Chatfield on October 10; 1944. Upon motion by Fryer, second by Kjerner,•Mr. Kenneth L. Hansen, was appointed as acting City Engineer until such time as an engineer is appointed by I the Common Council. Upon motion by Kennedy, second by Kjerner,, the Street & Alley Committee was authorized to interview applicants for the position of City Engineer for the City of Rochester.
