Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in -said
City on November 6, 1944.
President Lemmon called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Lemmon, Aldermen -Fryer,,Kennedy,
Kjerner, McQuillan, Mrachek, and Yaeger. Absent: None.
Upon motion by Yaeger, second by Kjerner, the minutes of the meetings
of October 16, 1944 and October 20, 1944 were approved.
President Lemmon stated this as being the time and place set for a
hearing on the -placing of bituminous treatment on the North and South Alley in
Block 35, Original Plat of the City of Rochester. There was no one present
wishing to be heard on the bituminous treatment.of the said alley.
President Lemmon stated this as being.the time and place set for a
hearing on the placing of bituminous treatment on 12th Avenue Southwest from 7th
Street Southwest, south to the City .limits. There was no one present wishing to
be heard on the bituminous treatment of the said street.
President Lemmon stated this as being the time and place set for a
hearing on the petition for the vacation of 5th Avenue Southwest from a point on
the South line of Sth Street Southwest to a point where i-t abutts the northerly
line of Soldiers Field. There was no one present wishing to be heard on the
vacation of the said street.
President Lemmon stated this as being the time and place set -for a
hearing on the petition for the vacation of the East and West alley in Block 20,
Head and McMahon's Addition. There was no one present wishing to be heard on .the
vacation of the said alley.

Roy Goodenough appeared at the meeting and stated that at the time the
streets were being oiled he had driven through a pile of gravel which had damaged
his car and asked that the City reimburse him for the expense of ;the repairs.
City Attorney Hunt stated that he did not think there vras any liability on the
City's part and no action was taken.
A letter from the Public Examiner transmitting copies of reports on the
financial affairs of the City of Rochester and the Rochester Fire Department
Relief Association covering the year ended March 31, 1944, was read and the same
was ordered placed on file.
A communication from the Board of Park Commissioners in regard to sellir
a small parcel of land to the I:zaak Walton League was read and upon motion by
Fryer, second by Kjerner, the same was approved and the Mayor and the City Clerk
were instructed to execute a -deed for the land being transferred to the said
J= zaak Walton League.

A communication and revised agreement between the City of Rochester andl
Walter H. Wheeler., Designing and Consulting Engineer for his services on the
proposed bridge over the Zumbro River connecting 2nd Avenue and 2nd Street
Southeast to 3rd Avenue Southeast and also a. letter from the Minnesota State
Highway Department regarding same were each read and the matter was left in the
hands of the Street and Alley Committee to meet with Mr. Wheeler.
The Mayor's emergency order given to the City Clerk for the purchase ofl
I-9000 gallons of gasoline was read and upon motion by Mrachek, second by Kennedy,

the same was approved. and ordered placed on file.
The acting City Engineer's. estimate of cost of a proposed sanitary
I,sewer in 3rd Avenue Northwest and also a -recommendation regarding the laying of

a water line in 3rd Avenue Northwest from the Public Utility Department were ea.chl
bead and ordered placed on file.
The recommendation of the acting City Engineer'in regard to the drillinj
of test holes for the new bridge in Mayo Park was read and upon motion by Fryer,
second by Kennedy, Mr. Hansen Uras instructed to employ Mr. Nelson the local
:driller to drill the test holes for the said bridge.

The acting City Engineer's request ,that $5,000.00 be appropriated from
the Street and Alley Fund for use of the Street and Alley Committee was read and
the same was ordered placed on file.
The application of Harold Miller for the transfer of "On Sale" 3.2 beer(
license No. 481 and "Off Sale" 3.2 beer license No. 951 to Eugene G. Chapman was
read and upon motion by McQuillan, second by Kjerner, the transfer was granted.
The application for a Drivers License of Earl Stanton was read and u-oo
motion by Kjerner, second by 1-4rachek, the license was granted.
The applications of Kris Nielsen for permits to move 2 houses over the
!streets of the City of Rochester were each read and upon motion by Mrachek, seco
�by McQuillan, the permits mere granted.
The application of Spencer M. Holloway for a Journeyman Electricians
liLicense was read and upon motion by Kjerner, second by McQuillan, the license was I

(granted.

The application of Waters 'Conley Company for a Cigarette license was
dread and upon motion by Yaeger, second by Kjerner, the license sas granted.
The application of Waters Conley Company for a soft drink license was
Tread and upon motion by Mrachek, second .by Yaeger, the license was granted.
The application of L. A. Kemp Contracting Co. for Electrical Centractors,i

The application of Waters Conley Company for license to operate three
vending machines was read and upon motion by Kjerner, second by Mrachek, the
license was granted.
The report of expenditures from the Cite Engineer's payroll for the
month of October, 1944 was read and the same was ordered placed on file.
The City Engineer's trial balance sheet for the month of October,- 1944
was read and the same was ordered placed on file.
The report of the City Weighma.ster for the month of October, 1944
showing 2,5 private loads weighed and total receipts $27.50, was read and the
same was referrl-ed to the Finance Committee.
The reports of the Clerk cf the Municipal. Court for the week ended
October 21, 1944 showing total criminal fires and costs collected $308.80, civil
fees received $2.35, and conciliation court fees $1.00; for the week ended
October 28, 1944 showing total criminal fines and costs collected $398.15, civil
fees received $11.35, and conciliation court fees $1.00; and for the week ended
November 4, 1944 showing total criminal fines and costs collected $183.20, civil
fees received- $.35, and conciliation court fees $2.75, were each read and having
been previoulsy approved by the City Attorney, President Lemmon ordered that the
same be placed on file.
The surety bonds of John Leng, Carlton Griffin, Oscar Frogner, a.ndScott
Jenkins each in the amount of $1,000.00 and the bond of Roy Lovejoy in the amount)
of $500.00, all with the Fidelity & Casualty Company of New York as surety, were
each read and upon motion by 'Mrachek, second by Kjerner, the bonds were approved,
the surety thereon accepted and it was ordered that the same be placed on file.
Alderman Fryer introduced a resolution vacating a part of 5th Avenue
Southwest from a point on the south line of 8th St. Southwest to a point where
it abutts the northerly line of Soldiers Field, which was read.
Upon motion by Mrachek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution vacating the alley in Block 20I
Head & McMa.hon's Addition, which was read.
Upon motion by Kennedy, second by -McQuillan, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared th�
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $5,000.00 from the
Street and Alley Fund for use of the Street and Alley Committee, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be

Alderman Fryer introduced a resolution appropriating $202.93 from the
Genera]. Fund and ordering payment made to Rochester Post Bulletin for publishing
minutes, ordinances, dog lists, which was read. i

Alderman Kennedy introduced a resolution appropriating $2126.94 from
the General Fund and ordering payment made to State of Minnesota, Department of
(Public Examiner, which was read.

Upon motion by Kennedy, second by Yaeger, that the said resolution be
{adopted as read, and all voting in favor thereof, President Lemmon declared the
jisaid resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $228.25 from the!
Street and -Alley Fund and ordering payment made to The Barrett Division for one
tank truck of tarvia, which was read.
Upon motion by Mrachek, second by Fryer, that the said resolution be
!adopted as read, and all voting in favor thereof, President Lemmon declared the
jsaid resolution duly passed and adopted.

Alderman Kennedy introduced a resolution appropriating 1281.25 from the

furnished police, sewer, and street and alley departments, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be

Alderman McQuillan introduced a resolution.appropriating $202.50 from
the General Fund, $2.00 from the S & A Fund, $4.00 from the.Fire Protection
Fund, and $2402.20 from the Lighting Fund and ordering payment made to City of
Rochester, °Public Utilities, for water., poorer and electricity,. which was read.
Upon motion by K.jerner., second by Kennedy, that the said resolution be
adopted as read, and al.l voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a reso.luti.on appropriating $616..97 from
the Park Improvement Fund and ox.dering payment made to Walter C. •Heins Agency,
which was read.
Upon motion by Mrachek, second by Fryer, that the said resolution be
adopted as read, and all voting in. favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek, introduced a resolution appropria.ting .$8206.11 from
the Park Improvement Fund and ordering payment made .to Wm. T. McCoy Post, 492
for balance due on Soldiers Field Swimming Pool Note, which was read.
Upon motion by McQuillan,.second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced• a resolution appropriating $406. 76 from the
F. E. Williams Estate Fund and ordering payment made to S-imon Stensrud, which
was read.
Upon motion by Mrachek, second by -Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted..
.Alderman Yaeger introduced a.resolution authorizing the Mayor -and City
Clerk to execute a contract with Walter H. Wheeler -for architectural and
engineering -services on a proposed bridge, which was read.
. Upon motion by Fryer, second by McQuillan, that the -said -resolution be
adopted as read, and all voting,in favor thereof,.President Lemmon declared the -
said resolution.duly passed and adopted.
The following claims were read, and upon motion by Yaeger,.second by
Mrachek, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

An,Ordinance entitled, "An ordinance authorizing Rochester Bus Line,:
Inc., its successors and assigns, to establish, conduct, maintain and operate bus
line or bus lines, tim ugh, over, upon and along the streets and avenues in the
City of Rochester, Olmsted County, Minnesota" was given its third and final
reading and upon motion by Fryer, second by Kennedy, that the ordinance be not
adopted and all voting in favor of the said motion, President Lemmon declared the
ordinance not adopted.
A revised Ordinance entitled, "An ordinance authorizing Rochester Bus
line, Inc., its successors and assigns, to establish, conduct, maintain and
operate bus line or bus lines, through, over, upon.and along the streets and
avenues in the City of Rochester, Olmsted County, Minnesota" was given its first
i reading.
Upon motion by Mrachek, second by Fryer, and upon roll call and all
(voting in favor thereof, the rules were suspended and the ordinance was given
Its second reading.
Mayor Grassle gave a verbal report on a meeting of Mayor'.s from -the
State of, Minnesota., which was. held in the Twin Cities for the purpose of devising
plans in regard to taxation which would benefit towns and cities in the State.of
Minnesota. He stated that several bills would be drafted and the copies of same
would be available to the various governmental bodies in the near future.
The report of the Building and Plumbing Inspectr showing building
permits issued $83.00 and plumbing permits issued $73.00 and the report of the
Electrical Inspector showing electrical permits issued $126.50, were each read
and President Lemmon referred same to the Finance Committee.
Upon motion by Fryer, second by Yaeger, the meeting was adjourned until
7:30 o'clock P.M., November 20, 1944.
