Minutes of anadjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City on November 27, 1944.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, Mcquillan, Mrachek, and Yaeger. Absent: None.
Upon motion by Kjerner,-second by Mirachek, the minutes bf the meeting of
November 20,•19 44 were approved.
The following applications for assistant custodian of the City Hall'
building were each read, Oscar Distad, Ivan B. Boyd, Tee Gustine, Allen W. Smith,
Alfred If. Dewar, Herbert L. Liesch,and President Lemmon referred same to the Publi
Grounds Committee and the Chief of Police.
The application of Matt E. Mulvihill for 3.2 beer "Off Sale" License
was read and upon motion by Fryer, second by Mrachek, the license was granted.
The applicatiol of C. J. Bremer for a permit to place and maintain a
sign was read and upon motion by Fryer, second by Yaeger, the permit was granted.
The report of the Street and Alley Committee that the.. assessment for
street improvements made against Lot 3, Block 7, Ireland's First Addition, owned
by Mr. H. Kulsrud is just and fair was read and upon motion_ by Yaeger, second. by
Kjerner, the report of the Committee was approved.
The report of the Clerk of the Municipal Court for the week ended
November 25, 19444 showing total criminal fires and, costs collected $255.90, civil
fees received $1.35, and conciliation court fees; $3.50, was read and. having been.
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file.
A revised agreement between the City of Rochester and Walter H. ?heeler
for engineering and architectural services -on the proposed bridge connecting
second Avenue and Second Street Southeast to Third Avenue Southeast was preser_ted
to the Council and upon motion by Fryer, second by Mrachek, the Mayor and the Cit3
Clerk were authorized to execute the said agreement.
The chairman of the License Committee made a verbal recommendation that
the application of Kris Nielson for a license to connect with sewers and drains
be not granted, and upon motion by Mrachek, second by Fryer, and all voting in
favor thereof, the license was not granted.
Upon motion by Yaeger, second by Mrachek, the City Attorney was authoriz
o attend the National Institute of Municipal Law Officers to be held at Cleveland
hio, on December 6,7, and 9, 1944 at City expense.
Alderman_ Fryer introduced a resolution appropriating $315.95 from the

General Fund and ordering payment made to the State of Minnesota, Commissioner of

jTaxation_ for gas tax and inspection fee on 2 transports of gasoline, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be

,adopted as read, and all voting in favor thereof, President Lemmon declared the
lsaid resolution duly passed and adopted.

I Alderman Fryer introduced a resolution appropriating $192.56 from the
llGeneral Fund, $2.00 from the Street & Alley Fund, and $2701.50 from the Lighting
Fund and ordering payment made to City of Rochester, Public Utilities, ,•!hich was
read.
Upon motion by Kjerner, second by NcQui llan, that the said resolution bel
liadopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution ordering a hearing on levying
special assessments for bituminous treatment on 12th Avenue Southwest from 7th
St reet Southwest , south to the City -limit s ; 9th !venue Southeast f rom 4th St .
Southeast to Pear Creek; the alley in Block.39, Original Plat, and the alley in

,adoptecl as read, and all. voting in favor thereof, President Lemmon declared the

Alderman_ Kjerner introduced a resolution approving a resolution adopted

Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

General Fund, $355.40 from the Fire Protection Fund, and $5.62 from the Bridge
Fund and ordering payment made to Fullerton Lumber Company, which was read.
Upon motion by Mrachek, second by Yaeger, that -the said resolution be
adopted as read, and all voting in favor. thereof, President Lemmon declared the
said resolution duly passed and adopted.
The following claims were read, -and upon motion by Yaeger, second by
Fryer, the same were allowed and the Mayor and City Clerk were authorized and
directed to -draw warrants on the City Treasurer and make payments accordingly:
