Minutes of a regular meeting of the Common Council of the City of
Rochester,.Minnesota, held in the Council Chambers, in the City Hall, in said
City on February 5, 1945.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
(following members being present: President Lemmon,.Alderman Fryer, Kennedy,
Kjerner, Mcquillan Mrachek, and Yaeger.

'I Upon motion by Fryer, second by Kennedy, the minutes of the meeting
of January 2, 1945 were approved.
The following resolution adopted by the Public Utility Board was read
and ordered placed on file:
"Be it and it is hereby resolved by the Public Utility
Board: of the City of Rochester, Minnesota, that the Hon.
Common Council of the said City be and is hereby requested
to authorize the said Board to enter into a contract with
the Botsford Lumber Company of this City for the furnishing
in accordance with specifications, of-;
20 Class 3 301 poles 20 Class 3 40, poles
40 Class 4 301 poles 20 Class 4 40, poles
60 Class 5 301 poles 20 Class 5 40' poles
75 Class 3 35' poles 10 Class 4 451 poles
75 Class 5 35' poles
at prices. of $15. 35, $13. 62, $12. 23, $19, ss, $15. 67, $24. 26,
$21.4s, $ls.63, $26.44 each respectively for the said poles,
making a total lump sum price in the amount of FIFTY EIGHT
HUNDRED THREE DOLLARS AND SIXTY FIVE CENTS ($5,903.65)F.O.B.
Rochester, Minnesota."
A petition by Carl Hutchings and Frank M. Potratz to erect a. three
stall garage to be used for the business of general repair work was read, also
a statement of acquiescence to the changing of residential property facing west 1,
on 9th Avenue S. E. from the corner of 8th Street S. E. to 9th Street S. E. signe
by the following property owners, Jos. Groszbach, Perry Beach, Vernon Cole,
,'Joseph Gruntner, Mrs. H. G. Smith and Robert S. Hunter, was read and upon motion
by Fryer, second by Mrachek, the said petition and statement was referred to the
Board of Zoning.
A communication from the Anchor Casualty Co. of St. Paul stating that
the Rochester Bus Line, Inc. had filed Automobile Transportation bond Number
17-101-44 with the Railroad and Warehouse Commission in St. Paul.wa.s read and
ordered placed on file.
A resolution adopted by the Board of Park Commissioners requesting the
Common Council to approve the purchase of bleachers from the Universal Bleacher
,Company of Champaigne, Illinois for the sum of $1886.60 was read and ordered
;placed on file.
A resolution adopted by the Board of Park Commissioners requesting the
!Common Council to purchase additional .land for Mayo Field, consisting of approx-
imately three acres and owned by Mrs. Anna Reiter, 511 East Center Street, was
(read and upon motion by Mrachek, second by Kjerner, the Park Board was authorized

back to the Common Council.
The .rep.orts of the City Weighmaster for the month of December, 1944
showing 255 private loads weighed and total receipts $25.50, and for the month
of January, 1945 showing 199 private loads weighed and total receipts $19.90,
were each read and President Lemmon referred same to the Finance Committee.
The financial report of the Firemen's Relief Associa.tion., at Rochester,
Minnesota, showing cash on hand January 1, 1944, $6,549.06, receipts during
• the calendar year $29,951.69, disbursements $29,461.09, and balance on hand
December 31, 1944, $6,939.67, was read and upon motion by Kennedy, second by
Kjerner, the same was accepted and ordered placed on file.
The financial statement of the Rochester.Civilian Defense Council
covering the period from September 14, 1 4 to December
�. 9 3 31, 1944 was read and the
same was ordered placed on file.
A statement by the Board of Park Commissioners of receipts and disburse
ments in the -Park Improvement Fund for the month of December, 1944 was read and
the same was ordered placed on file.
The City Engineers trial balance for the month of January, 1945 was rea
and the same was ordered placed on file.
The report of expenditures from the City Engineer's payroll for the
month of January, 1945 was read and the same was ordered placed on file.
The annual report of the Municipal Court of the City of Rochester, for
the calendar year of 1944 was read and upon motion by Fryer, second by Kennedy,
the same was approvedand ordered placed on file.

The application

from Clarence Stewart to Oscar Nelson was read and upon motion by Mra.chek, second
by Kjerner, the same was granted.
The applications of Oscar Nelson and Chris Stateson for license to sell
• cigarettes was read and upon motion by Kjerner, second by Kennedy, the license

was granted.
The applications of Rolf Birkelo, Edna M. Maxon -and B. H. Drummond for
Drivers License.were each read and upon:.motion by McQuillan, second by Mrachek,
the licenses were granted.
The application of the Rochester Electric Company for Electrical
Contractor's license was read and upon motion by Fryer, second by Kennedy, the
license was granted.
The application of Monte Pearson for a permit -to place and maintain'a
sign was read and upon motion by Kjerner, second by McQuillan, the permit was
granted.
The application of Maass & McAndrew Company for License to connect wit
jsewers and drains was read and upon motion by Yaeger, second by McQuillan, the
license was granted.
The applications of Oscar Nelson and Chris Stateson for license to sell
soft drinks was read and upon motion by Kennedy, second by McQuillan, the license
were granted.
The official bonds of Francis J. Magnuson in the sum of $500.00 with th
Hartford Accident and Indemnity Company as surety and of Al Dewar in the sum of
$500.00 with the Western Surety Company as surety and the license bonds of Maass

& McAndrew Co. and Frederick Roepke each in the sum of $1,000.00 with the Nationa
Surety Corporation as surety, Edwin M. Raetz in the sum of $1,000.00 with the
Great American Indemnity Company as surety, and Arthur A. Brown in the sum of
$1,000.00 with the Western Surety Company as surety, were each read and upon
motion by Mrachek, second by Kjerner, the bonds were approved, the surety thereon
accepted and it was ordered that the same be placed on file.
The following claims were read, and upon motion by Yaeger, second by
Fryer, the same were allowed and the Mayor and City Clerk were authorized and

Alderman Fryer introduced a resolution granting 16 public dance permits
to Veterans of Foreign Wars, Whitlock -Sonnenberg Post +1215, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor .thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution granting two public dance permit
to George C.>Famme, which was read.
Upon motion. by Kjerner, second by McQuillan, that the said resolution b
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution' duly passed and adopted.
Alderman Fryer introduced a resolution appointing Judges of Election
for the year 1945, which was read.
Upon motion by Mra•chek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President-Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution fixing the salary of the City
Engineer for the remainder of the City's fiscal year, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting .in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution authorizing the Public Utility
Board to enter into contract with the Botsford Lumber Company, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be

Alderman Kennedy introduced a resolution requesting examination of the
books and records of the City of Rochester by the Public Examiner for and during
the period beginning April 1, 1944 and ending March 31, 1945, which was read.
Upon motion by Kennedy, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the distribution of th11

10% gross income payments.of the Public Utility, Light and Water Departments fort,
the year 1945, which was read.
Upon motion by Mrachek, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $284.90 from th
General Fund and ordering payment made to the City of Rochester, Public Utility
Department for steam heat for the city hall, which was read.
Upon motion by Kerner, second by McQuillan, that the said resolution {
be adopted as read, and all voting in favor thereof, President Lemmon declared thle

Alderman Kennedy introduced a resolution appropriating $698.63 from theI

General Fund and ordering payment made to the Texas Company for two tank trucks

of gasoline, which was read.
Upon motion by Kennedy, second by Mrachek, that the said resolution be +
adopted as read, and all voting in favor thereof, tresident Lemmon declared the
said resolution duly passed and adopted..
Alderman Kennedy introduced a resolution appropriating $329.86 from
the General Fund and ordering payment made to State of Minnesota, Department of
Taxation, for gasoline tax and inspection fee on 2 tank trucks of gasoline, whichi
was read.
Upon motion by Kjerner, second by Yaeger, that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $259.56 from the

General Fund, $1.27 from the.Sewer Fund and $322.76 from the Street & Alley Fund
and ordering payment made to City of Rochester, General Fund for gasoline j

furnished the police, sewer and st. & alley depts. which was read, it

Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all.voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $30.52 from the
General Fund, $2.00 from the S & A Fund and $3252.90 from the Lighting Fund and
ordering payment made to City of Rochester, Public Utility Fund for light, water
and power, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor -thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $203.50 from the
S & A Fund and ordering payment made to' Bert Leitzen for cleaning waterways at
Mayo Run, which was read.
Upon motion by Kjerner, second by McQuillan, that the said resolution
be adopted as read., and all voting in favor thereof, President Lemmon declared th
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $1156.29 from
the S & A Fund and $91.00 from the Sewer Fund and ordering payment made to the
Street & Alley Fund for use of equipment and materials out of stock during
January, 1945, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $412.50 from
the Bridge Fund and ordering payment made to Joe Nelson for drilling of test
holes, which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
adopted as read, 'and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a, resolution appropriating $907.52 from
the Park Improvement Fund and $82.20 from the Lighting Fund and ordering payment
made to City of Rochester, Public Utilities, for steam heat, electricity and watei
for auditorium, which was read.
Upon motion by Mrachek, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $782.45 from
the Park Improvement Fund and ordering payment made to G. Schwartz & Company for
miscellaneous repairs to the auditorium, which was read.
Upon motion by McQuillan, second by-Kjerner, that the said resolution bE

Fire Protection Fund and ordering payment made to Northwest Safety Appliance Co.
!for fire extinguishers and spare cartridges, which was read.
Upon motion by Kennedy, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

jthe General Fund and ordering payment made to. Galvin Manufacturing Co. for police
(radio, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Yaeger introduced a resolution appropriating $3,417.34 from th
Park Improvement Fund and ordering payment made to City of Rochester, Public
;Utilities for work done on North Broadway Dam and riverbed and banks, which was

Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $3, 417. 34 from the
General Fund and ordering payment made to the Park Improvement Fund for transfer
of funds, which was read.

,adopted as read, and all voting in favor thereof, !resident Lemmon declared the
(said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution authorizing the Board of Park
Commissioners to enter into contract with Universal Bleacher Co., which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Mayor Grassle appointed Alderman Kjerner and Alderman Kennedy as a
committee to wore: with the City Attorney and the plumbers of the City of Rocheste:
in drafting a heating and plumbing ordinance and upon motion by Fryer, second by
Mrachek, the appointments were approved.
Upon motion by Kennedy, second by Kjerner, the custodian of the city
hall was instructed to discontinue the loan of equipment in the community room to
activities outside of the city hall.
Upon motion by McQuillan, second by Kennedy, the matter pertaining to

the Public Utility Board for consideration and the said Board was requested to i 0
