Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, held in the Council. Chambers, in the City Hall, in said City
on February 29, 1945.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, McQuillan, Mrachek, and Yaeger. Absent: None.
Upon motion by Fryer, second by Kjerner, the minutes of the meeting of
February 5,' 1945 were approved.
A communication from Richard A. Golling, State Public Examiner,
transmitting a form of request for examination of the financial affairs of the
City of Rochester for the year ended March 31, 1945, to be signed by the members
of the Common Council was read and the said request was signed by all members of
the Council.
A notice of claim in the amount of $2500.00 for bodily injury sustained
by George Woods was read and the same was referred to the City Attorney with
power to act.
A petition by the Board of Trustees of the United Brethern Church for
a permit to erect a new church building on the present site of their church
property, the new building to cover approximately 2272 square feet more than the
Zoning ordinance allows, was read and upon motion by Mrachek, second by Kjerner,
the same was referred to the Board of Zoning.
The City Engineer's request that $3000.00 be appropriated from the
Sewer Fund and $5000.00 from the Street & Alley Fund for use of the Street & Alle
Committee was read and the same was ordered placed on file.
The first and final certificate for analysis of sewage samples issued
by Toltz, King & Day, Inc., in favor of the Twin City Testing and Engineering
Labcratory in the amount of $272.00 was read and the same was ordered placed on
file.
A resolution adopted by the Board of Park Commissioners recommending
to the Common Council that a deed be executed conveying to the Izaa.k Walton
League fo-r the sum of $1.00 the following piece of land, beginning at the south-
east corner of Lot 32, State -Subdivision of Section 36, in Township 107, north of
Range 14 west, in Olmsted County, running west 200 feet, thence north 61 feet,
thence in a southeasterly direction-to-the.point of beginning, was read and upon
motion by McQuillan, second by Kjerner, the Mayor and City Clerk were instructed
to execute the said deed.
The following resolution adopted by the Sinking Fund Commission on
February 20th, 1945 was read and upon motion by Mrachek, second by Kennedy, t-he
action of the Sinking Fund Commission was approved and the same was ordered

placed on file:
"WHEREAS, Pursuant to the terms of Treasury Department
Circular No. 764, dated February 19, 1945, 11% Treasury Notes
of Series C-1945 may be exchanged for U. S. 7/8% Treasury
Certificates of Indebtedness of Series B-1946, dated March 1,
1945 and maturing March 1, 1946;
SO THEREFORE, Be it resolved by the Commissioners of
the Sinking Fund of the .City of Rochester, Minnesota:
That the Commissioners of the said Sinking Fund exchange
$25,000.00 - 14% Treasury Notes of Series 0-1945 for $25,000.00
United States 7/9% Treasury Certificates of Indebtedness of
Series B-1946; the said investments belonging to the Electric
Light Depreciation Reserve."
Upon motion by Fryer, second by Kennedy, the City Clerk was instructed
to request the various Boards and departments of the City to submit inventories
as of February 28, 1945•
The reports of the Clerk of the Municipal Court for the week ended
February 10, 1945 showing total criminal fines and costs collected $223.00, civil
fees received $.60, conciliation court fees, $1.25; for the week ended February lj
1945 showing total criminal fines and costs collected $194.40, civil fees received,
$1.35, conciliation court fees $1.50; and for the week ended February 24, 1945
showing total criminal fines and costs collected $199.80, civil fees received,
$2.20, conciliation court fees, $2.50, were each read and having been previously
approved by the City Attorney, President Lemmon ordered that the same be placed
on file. r
The Public Library Statistical report for the calendar year ended
December 31, 1944, and also a copy of the annual report_to the members of the
Library Board were each read and the same were ordered placed on file.
A statement of receipts and disbursements in the Park Improvement Fund
for the month of January, 1945 was read and the same was ordered placed on file.
Thg applications of V. D. Elliott and. Carroll R. Silker for license to
sell cigarettes were each read and upon motion by Kjerner,' second by Yaeger, the
licenses were granted.
The applica:tlons of Arthur A. Brown and H. ,4 H. Electric for Electrical
Contractors license were each read and upon motion by Yaeger, second by Kennedy,
the licenses were granted.
The applications of Fred A. Roepke and Arthur A. Brown for Master
Electricians license were each read and upon motion by McQuillan, second by
jerner, the licenses were granted.

The application of Donald Martig for a non -intoxicating malt liquor
"Off Sale" license was read and upon motion by McQuillan, second by Kennedy, the 11
license was granted.
The application for transfer of "Off Sale" 3.2 Beer license No. 941 frog
George B. Tauer to V. D. Elliott was read and upon motion by McQuillan, second byi
Kennedy, the transfer was granted.
The applications of Carroll R. Silker and V. D. Elliott for license
to sell soft drinks were each read and upon motion by Yaeger, second by Kennedy,
the licenses were granted.
The application of the Town Taxi Company for license to operate four
additional taxicabs was read and upon motion by Mrachek, second by Fryer, the
license was granted.

The applicatiozE for "Off Sale" Intoxicating Liquor Licenses of R. M. l
Graen, Leo A. Huey, I. Coppe, Andrew C. Chafoulias, Christ Margellos, Emanuel
Kostakes, Hazel Kitzman and Robert Kennedy were each read and also the surety 1,
bonds of R. M. Graen, Leo A. Huey, Andrew C. Chafoulias, Christ Mar.gellos, Hazel
Kitzman and Robert Kennedy each in the sum of $1000.00 with the Western Surety

Company as surety and I. Coppe and Emanuel Kostakes each in the sum of $1000.00
with.the Western Casualty and Surety Company as surety were each read and upon �I
motion by McQuillan, second by Kjerner, the said licenses were granted, the bonds!

approved, the sureties thereon accepted and it was ordered that the same be
placed on file.
The contract bonds of Allen&Lloyd Company in the sum of $1500.00 with
Ithe Western Surety Company as surety and Galvin Manufacturing Corporation in the

sum of $2685.00 with the Fidelity and Deposit Company of Maryland as surety were
each read and upon motion by Mrachek, second by Yaeger, the bonds were approved,
,the surety thereon accepted and it was ordered that the same be placed on file.
The following claims were read, and upon motion by Yaeger, second by
Mrachek, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Alderman Yaeger introduced a resolution appropriating $272.00 from they
General Fund and ordering payment made to Twin City Testing & Engineering
Laboratory for analysis of sewage samples, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be it
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $728.32 from
the Park Improvement Fund and $53.20 from the Lighting Fund and ordering payment
made to the City of Rochester, Public Utilities for steam heat, electricity,
power and water for the Mayo Civic Auditorium, which was read.
Upon motion by Kennedy, second by McQuillan, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $265.90 from
the General Fund, $2.00 from the S & A Fund and $2949.40 from the Lighting Fund
and ordering payment made to City of Rochester, Public Utilities for electricity;
power and steam heat for city hall, which was read.
Upon motion by Mrachek, second by Kennedy, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman McQuillan introduced the following resolution which was read:
1) "Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the following is a tabulated statement of the
number of votes cast for each person at the Primary Election
held on the 27th .day of February, A.D. 19�5, in the City of
Rochester, Minnesota, as determined by said Common Council
on the canvass of the returns of the said. Primary Election
Made this 28th day of February, 1945, and that the said
i,abulated statement is hereby declared to show the results.

"Be it further resolved by the said Common Council:
That B. Seth Green and Howard L. Narveson are hereby
declared to be candidates for Alderman of the Third Ward of
the City of Rochester at the Charter Election to be held
March 13th, 1945;
The City Clerk of said City is hereby instructed to
cause the names of the said persons to be printed as can-
didates for the respective office upon the official -:ballots
at the coming Charter Election to be held on March 13,1945."
Upon motion by Yaeger, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $5,000.00 frog
the Street & Alley Fund and $3000.00 from the Sewer Fund for use of the Street &
Alley Committee, which was read.
Upon motion by Kjerner, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution urging the passage of bill
S. F. No. 246, empowering the City to issue Revenue Bonds for construction of a
Sanitary Sewage Disposal System in the City of Rochester, Minnesota., which was
r ead.
Upon motion by Kennedy, second by -Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $2,036.69 from
the General Fund and ordering payment made to the Park Improvement Fund for
transfer of funds, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution urging that a bill providing
for the taxation of natural gas be defeated, which was read.
Upon motion by Mrachek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Kennedy, second by Kjerner, the City Attorney and the
City Engineer were instructed to draft an ordinance requiring the removal of
snow from sidewalks in the business district of the City.
Upon motion by. Kjerner, second by Kennedy, the meeting was adjourned.,
