Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, in the Council Chambers in the City Hall, in said
City, on March 26, 1945,
President Lemmon called the meeting to order at 7: 30 o'clock P. M. , the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
K,jerne.r, McQuillan, Mrachek, and Yaeger. Absent: None.
Upon motion by Kjerner, second by Mrachek, the minutes -of the meeting
of March 14,. 1945 were approved.
President Lemmon stated this.as being the time and place set for
receiving and opening bids for the furnishing of Cutback Asphalt and Tar to -:be
used for dust prevention during the 1945 season. The following -bids were
received and read at this time:

The recommendation-, of the Street & Alley Committee and. the City
Engineer that the contract for the purchase of approximately 100,000 gallons of
cu'tbac:: asphalt be awarded the Union Asphalt & Roa.doils, Inc. , at the price of
.0567 per- gallon and. also the recommendation that the c'ontra.ct for the pur:cha.se
of approximately *35,000 gallons of tar be awarded to the Barrett Division, Allied
Chemical- & Dye Corp. at th'e price of $.0952 were each read and upon motion by -
McQuillan, second by Yaeger,' the same were approved and ordered placed on file.
A communication from Marvel A. Bush stating that he was interested in
purchasing a part of Cutlot 5, in Northern :Addition, which is now owned by the
City was read an.d President Lemmon referred the same to the Public Grounds
Committee.
The Mayor's emergency order given to the Board of Park Commissioners
for the repair of two steel foot bridges in Soldiers Field *which were damaged
by flood waters was read and upon motion by Mrachek, second by Kennedy, the same
was approved.
A resolution adopted by the Board of Park Commissioners on March 14,19L
requesting permis-sion from the Common Council to advertise for sale to the highe.
bidder the Williams Apartment; Building at 506 Fifth Street Southwest and the
Williams Cottage at 119 Fourth Street Southwest was read and upon motion, by Fryer

The applications for Driver's License of Robert C..Bolton, James E. II
(Williams,
Verne M. Gage, Robert C. Keith, and Ernest Riege were each read and

upon motion by itgcQuilla.n, second by Mrachek, the licenses were granted.
II The -reports of the Clerk of the Municipal Court for the week ended

March 17, 1945 showing total criminal fines and costs collected $390.00, civil
fees received $4. 30 and conciliation court fees $, 50 and for the week ended
I
March 24, 1945 showing total criminal fines and costs collected $409.00, civil

received, $6.70 and conciliation court fees $1.50, were each read and having

11been previously approved by the City Attorney, President Lemmon ordered that same'
be placed on file.
The Auto Transportation Company Annual Report of the Rochester Bus Line',
Inc. , for the year ended December 31, 1944 was read and upon motion by Fryer,

second by Kjerner, the same was accepted and ordered placed on file.

I The report of the Zoning Board recommending to the Common Council that
the petition of Carl Hutchings and Frank M. Potra.tz be not approved was again j

considered by the Council and upon motion by McQuillan, second by Kennedy, the
recommendation was accepted.

The following claims were read, and upon motion by Fryer, second by

Mrachek, the same were allowed and the Mayor and City Clerk were authorized and
I directed to draw warrants on the City Treasurer and make payments accordingly:

Alderman Fryer introduced a resolution appropriating $206.4o from the
General Fund and ordering payment made to City of Rochester, P. U. for steam heat
for city hall, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
.Alderman Fryer introduced a, resolution appropriating $59.44 from the
General Fund, $2.00 ff°om the Street & Alley Fund and $2239.70 from the Lighting
and ordering payment made to Public Utility Dept.
Fund/for water, power and electricity, which was read.
Upon motion by Kjerner, second by.Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, president Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a. resolution appropriating $19s6.60 from
the Park Improvement Fund and ordering payment made to Universal Bleacher Company
for two 6010" groups 15 tier bleachers, which was read.
Upon motion by Mrachek, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $1254.34 from
the Park Improvement Fund and ordering payment made to City of Rochester, Public
Utility ,Dept. for material and labor on river bank at 'North Broadway Dam, which

Upon motion by Fryer, second by Kennedy, that the said resolution be

Alderman. Kjerner introduced a resolution appropriating $941.60 from they

Park Improvement Fund and $76.80 from the Lighting Fund and ordering payment
made to Gi ty of Rochester Public Utilities•, for steam heat, water and elect•ricityl
for Mayo Civic Auditorium, which was read.

Uponmotion by Kjerner, second -by Kennedy, that the said resolution be
adopted as read, and all voting i-n favor thereof, rresident Lemmon declared the

Upon motion by McQuillan, second by Kennedy, that the said resolution

Alderman Mrachek introduced a resolution accepting the bid of Union

,Asphalt & Roadoils Inc., for furnishing cutback asphalt, which was read. II
Upon motion by Mrachek, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution accepting the bid of The
,Barrett Division, Allied Chemical & Dye Corp., which was read.
Upon motion by Kennedy, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $240.94 from
the Park Improvement Fund and ordering payment made to the Allen Lloyd Company j
for repairs on trucks, which eras read.

Upon motion by Kennedy, second by Kjerner, that -the said resolution be

'adopted as read, and all voting in favor thereof, rresident Lemmon declared the II .
said resolution duly passed and adopted.
1I Mayor Grassle
stated that a number of protests had been
received ,
regarding the parking of
Rochester Dairy trucks on 6th Street Southwest
between
2nd Avenue Southwest and
Broadway and also on lst Avenue Southwest
between 5th
,Street and 6th Street.
After discussing the matter and 'nearing a.
verbal report
by the Chief of Police,
a motion was made by McQuillan, second by
Kennedy,
instructing the City Attorney,
the Police Committee, and the Chief
of Police to
prepare an amendment to
the parking ordinance if necessary, to correct
this

Upon motion by
Fryer, second by Kennedy, the City Clerk
was instructed

to return the certified
checks tc the unsuccesfil bidders who submitted
proposals
for cutback asphalt and
tar.

Dr. H. C. Halvorson, from the State Department of Health, Division of
Sanitation; at the request' of the Common Council gave an oral report on the
location of the proposed sewage disposal plant, the various plans of treatment
proposed, the treatment of industrial waste, and the design of -the plant. At
the request of the Common Council Dr. Halvorson stated that he would submit the
complete report in writing.
Upon motion by Fryer, second by Yaeger, the meeting was adjourned.
