Minutes of an adjourned regular meeting -of the Common Council of the
I; City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
(said City on May 7, 1945•
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being -present: President Lemmon, Aldermen -Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
Upon motion by Kjerner, second -by Fryer, the minutes of the meeting of
April 23, 1945 were approved.
President Lemmon stated this as being the time and place set for a
hearing on the construction of a sanitary sewer in-9th Street Southeast from "the

!center line of 4th Averiue Southeast to 125 feet (more or less) east, There was
ilno one present wishing to be heard.
The City Fngineerl's preliminar$ estimates of cost for the construction j

of an-8 inch sanitary sewer on Fifth Street Northwest from the center line of 9th�

,Avenue to a point 400 feet west of the said center line of 9th Avenue Northwest
I,in the amount of $1026.00 and for a 6 inch watermain in the amount of $1665.72 and

'also a preliminary estimate for the partial,grading and surfacing of Fifth Street '
;Northwest from 9th Avenue Northwest to 11th Avenue Northwest in the sum of $1272.510
each read and the -same were ordered placed on file.

i The Mayor's emergency order for the employment of one additional fireman
lin addition to the thirty-three men employed in the Rochester Fire Department as
[provided by ordinance, was read and upon motion by Narveson, second by Kennedy, the
(same was approved and ordered placed on file.

The reports of the Clerk of the Municipal Court for the week ended
April 28, 1945 showing total criminal fines end costs collected $142.00, and
,conciliation court fees $1.00 and for the week ended May 5, 1945 showing total
,,criminal fines and costs collected $429.50,-civil fees received $2.00 and
ilconciliation court fees $1.00, were each read and having been previously approved)
by the City Attorney, President Lemmon ordered that same be placed on file.
A report by Chief of Police, N. N. Tompkins, stating that on April 24th,l

Gerald Ryan, proprietor of the Brown Derby, was arrested for selling3.2 non-
, h
�lintoxicating liquor to a minor and that he had plead guilty to the charge and was;
fined $100.00, was read and ordered placed on file.

or the same licenses to cover the fiscal year beginning April 1, 1944 and ending
Aril 1, 1945.
The applications of Henry G. Smith, Albert F. Spie-ss, Sr., Caryl C.
eller, A. (._Fritsch, Donald G. Twentyman, William V. Strouckel for license to

The applications of Oscar Maier., Carl Childs and Raymond Driscoll for
river's license were each and upon motion -by Fryer, second by Kjerner, the licens,

The application of E. M. Raetz for a Master Electrician's License was
ead and upon motion by McQuillan, second by Kjerner, the license was granted.
The applications of John R. Morrison, Thomas Hesby, Wm. Hines, Fred
etz and Harold Richards for Journeyman Electrician's License were each read and
pon motion by Fryer, second by Kennedy, the licenses were granted.
The application of Morris Friedell for license to buy junk was read
nd upon motion by McQuillan, second by Narveson,..the license was granted. -
The applications of Paul T. Aberwald, Joseph Lynaugh, Joseph F. Underleal
ames B. Moyes and Louis P. Wanner for Journeyman Plumber's License were each read
nd upon motion by Kjerner, second by Narveson, the licenses were granted.
The application of Donald F. Cunningham for a permit to place and mainta:
sign was read and upon motion by McQuillan, second by Kennedy, the permit was
ranted.
The applications for license to sell soft drinks of Soldiers Field
oncession Stand, Mayo Park Concession Stand, Mayo Civic Auditorium, Piggly Wiggly,

and Empress Theatres was read and upon motion by Fryer, second by Narveson, the

The contract bond of The Barrett Division in the sum of #333.20 with
1the United States Guarantee Company as surety; the license bond of Francis j

motion by Fryer, second by Narveson, the bonds were approved, the surety thereon

:and upon motion by Kennedy, second by Kjerner, the same was approved and ordered

Alderman Fryer introduced a resolution appropriating $5,323.56 from the
;'General Fund and ordering payment made to the Public Health & Welfare Fund for
March, 1945 tax settlement, which was read..
Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $205.85 from the
;General Fund and ordering payment made to the Public Health & Welfare Fund for
,garbage assessments received with March, 1945 tax settlement, which was read.

Alderman Kennedy introduced a resolution appropriating $803.90 from the'I
it General Fund, $970.63 from the Street & Alley Fund and $66.25 from the Sewer Fund,
,and ordering payment made to the Street & Alley Fund for use of equipment during
;April, 1945, which was read.

for publishing hearings, minutes, dog lists, etc., which was read.
Upon motion by Kennedy, second by McQuillan, that the said resolution bi
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $1171.94 from th
Fire Protection Fund and ordering payment made to the Gamewell Company for
battery and single fold F.A. boxes, which.was read.
Upon motion by Kennedy, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Narveson introduced a resolution appropriating $229.89 from th
Firemen's Relief Fund and ordering payment made to Rochester Fire Department
Relief Association, which was read..
Upon motion by Narveson, second by -Fryer, that the said resolution be
adopted -as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $939•42 from
the Police Relief Fund and ordering payment made to the Police Relief Association,
which was read.
Upon motion by McQuillan, second by Kjerner, that the said resolution b,
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution.duly.passed and adopted.
Alderman McQuillan introduced a resolution o�fder.:Ln.g; plan and profile
and specification and estimate .of cost for construction of a sanitary sewer in
9th St. S. E., 125 feet east of center line of. 4th Avenue S. E.. which was read.
Upon motion by Fryer, second by Narveson, that the said resolution be
adopted as read, and all.voting in favor thereof, President Lemmon declared the
saidresolution duly.passed and adopted.
Alderman Fryer introduced a resolution adopting plan and profile,
specifications and estimate of cost and ordering bids for a sanitary sewer and
watermain in 5th St. N. W., which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution ordering a hearing on grading
and surfacing of 5th Street Northwest, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be

ladopted as read, and all voting in favor thereof, President Lemmon declared the
,said resolution.duly passed and adopted.
!' Alderman Kjerner introduced a. resolution appropriating $5000.00 from the
;Park Improvement Fund and ordering payment made to Mrs. Anna Reiter for part of
:Lot 18, Sec. 36-107-14, which was read.
Upon motion by McQuillan, second by Kennedy, that the said resolution be
;adopted as read, and all voting in favor thereof, President Lemmon declared the
,said resolution duly passed and adopted.

Fryer, the same were allowed and the Mayor and City Clerk were authorized and

�. Mayor Paul A. Grassle announced the appointment of Dr. Walter C. Popp
and the reappointment of Mr. E: B. Ballou as members of the Band Committee and

;upon motion by Fryer, second by Narveson, the said appointments were approved.

The matter of appointing a committee consisting of 24 Freeholders in
.the City of Rochester, to assist the Common Council with various problems in the
future, was considered and upon motion by Fryer, second by Narveson, and all voting
in favor thereof, each Alderman was authorized to appoint 4 members from his ward,
,and the Mayor and Alderman at L'arge.to appoint one member,:to act as chairman of
the committee.

Upon motion by Kennedy, second by Fryer, and all voting in favor therec
.the Street & Alley Committee and the City Engineer were instructed to confer witl
the Board of Education and other interested parties, to study platting of an are2
scheduled for development in N^rtheast Rochester.
Upon motion by Narveson, second by Yaeger, the Common Council instructe
the City Attorney to draft an ordinance repealing anordinance-licensing vending
Machines.
The report of the Building and Plumbing Inspector for the month of
April, 1945 showing building permits issued $16.00-and plumbing,permits issued
$2.75. and the report of the Electrical Inspector for the month of April, 1945
showing electrical permits issued $17.00, were each read and President Lemmon
referred same to the Finance Committee.
Upon motion by Fryer, second by Yaeger, the meeting was adjourned until
7:30 o'clock P.M. on May 21, 1945-
