Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in
I; said City, on May 21, 1945.

II President Lemmon called the meeting to order at 7:30 o'clock P. M., the,,
J�following members being present: President Lemmon, Alderman Fryer, Kennedy,
IIKerner, McQuillan, Narveson, and Yaeger. Absent: None.

Upon motion by Yaeger, second by Kjerner, the minutes of the meeting
of May 7, 1945 were approved.

President Lemmon stated this as being the time and place set for a
r
;,hearing on the construction of a sanitary sewer and watermain and the grading of
Fifth Street Northwest from Eleventh Avenue -Northwest to Ninth Avenue Northwest.
j'�Mrs. Fred Walbrush, Mrs. Otto Furmeister, Mr. & Mrs. Gus Halverson and Mr. and

'Mrs. Geo. C. Wood were present and after hearing the City Engineers preliminary
i
estimate of the total cost of the sewer, watermain and grading, stated that they
!were still in favor of having the improvements made.
President Lemmon stated this as being the time and place set for11
receiving and opening bids for the construction of a sanitary sewer and watermain

lin Fifth Street Northwest from Eleventh Avenue Northwest to Ninth Avenue Northwest.
The bid of Wm. C. Fraser & Son in the amount of $Z, 376.50 was read and upon motion
by Fryer, second by Kennedy, the same was referred to the Street & Alley and the
Sewer Committees and the City Engineer for a report and recommendation at the
'meeting to be held on June 4, 1945.
A communication from the Board of Public Health & Welfare requesting
1,the Common Council's approval of the employment of two additional employees, one
in the Public Health & Welfare Department and one at the City Farm, was read and

;the same was ordered placed on file.
A communication from the Public Health & Welfare Department regarding
Ilcomplaints received about an unsanitary condition, in the alley at the rear of the

!Coney Island Lunch Room at 325 South Broadway, and recommending that additional

,lighting be installed in that area, was read and the same --was ordered placed on"

The request of the Rochester Fire Department Relief Association that the

Common Council approve a loan in the amount of $2500.00 at 4% interest by their
•,association to H. H. Bateman on real estate located at 311 Eighth Avenue Southeast;
was read and the same was ordered placed on file.
r The recommendation of the Finance Committee that the said loan to
1H. H. Bateman in the amount of $2500.00 be made was read and upon motion by Fryer,

Squires representing the Building Trades and Labor Council protesting the
employment of members of the Fire and Police Departments on work which is in

competition with them, Upon motion by McQuillan, second by Kennedy, the Chief of
the Fire Department and the Chief of the Police Department were instructed to
notify their employees to discontinue work on any projects which are in com-petiti
or int.erfere with the members of the Building Trades and Labor Council, and the
City Clerk was instructed to notify the Police and Fireman's Civil Service
Commission to that effect.
The Mayor's emergency order covering the employment of one additional
man on the Rochester Fire Department for the month of May, in access of the
number provided by ordinance and the Mayor's emergency order given to the -City
Clerk for the purchase of approximately 8000 gallons of gasoline, were each read,
and upon motion by Fryer, second by Yaeger, the same were approved.
A request by the Hawthorne Men's Club that a special policeman be
stationed at the intersection of South Broadway and 92 Street Southeast was read
and upon motion by Fryer,.second by Kennedy, the Chief of Police was authorized
to hire a man to be stationed at the above mentioned location.
The following values as submitted by the Committee appointed to appraise
the two proposed Sewage Disposal Plant Sites was read:
Site A
The west 15 acres of the N. E.1 of the S. E.4 of Sec. 23
( Hans Larson, owner) at $65. 00' per acre.
That portion of the N.W. 1 of the S.E. � of Sec. 23 lying
East of the river (W. 0. Ga.sselle, owner) 21 acres more or
less at $40.00 per acre.
Right of way for a road along the south line of the S?
of the N.E.4 of Sec. 23 (Bert Leitzen, owner) 1 acre more
or less. at $65.00 per acre.
Right of way for a road along south line of the S.W.4
of the N.W. I of Sec. 24 (E. S. Morris, owner) 2 acres more
or less at $100.00 per acre.
Site B
The northerly 28 acres of the W2 of the N.E.1 of
Sec. 26 (Otto Halling, owner) at $110.00 per acre.
That portion of the N. E. a of the N. E.i of Sec. 26
lying west o.f the river (Harry & Vera Struble, Chas. L.
and Alice Dosdal, Frank E. and Sophia Engel and
Catherine Kane, owners) 8 acres more or less at $25.00
per acre.
A portion of the SZ of the S.E.J of Sec. 23 west of
the river (Emma Gasselle, owner) at $55.00 per acre.
Upon motion by Fryer, second by Kennedy, the above description of real
estate and prices was referred to the Committee appointed to investigate the
proposed locations for the new sewage treatment plant.
A resolution by the Board of Park Commissioners requesting the Common
Council to approve the purchase of the 318 interest of the F. E. Williams Business
Property now owned by the Simon Stensrud Estate was read and upon motion by
Kennedy, second by Fryer, the action of the Board of Park Commissioners was
approved.

A complaint that the exhaust from presumably a gas engine operated by I.

the Rochester Dairy Company, the noise of which is disturbing residents of a part'I
Hof Southeast Rochester, was read and upon motion by Kennedy, second by Narveson,

the complaint was referred to the Police Committee and the Chief of Police.
The recommendation of the Water Committee that the City Engineer be
iinstructed to make preliminary surveys, plans and estimate of cost of construction
of a water.main on 3rd Avenue Northwest was read and ordered placed on file.
The City Engineer's estimate of cost of an S inch Sanitary Sewer in
9th Street Southeast from the Center line of 4th Avenue Southeast to 125 feet east
was read and ordered placed on file and the same was left in the hands of the
Sewer Committee and the City Engineer to meet with Mr. Helm to study the matter

by Kennedy, second by Kjerner, the same was referred to the Board of Zoning.
A letter from Mr. Victor F. Ludewig protesting the construction of a.
curb and gutter on 9th Avenue Northwest from lst Street Northwest to 2nd Street J'
Northwest was read and the same was referred to the Street & Alley Committee and

The reports of the Clerk of the Municipal Court for the week ended
May 12, 1945 showing total criminal fines and costs collected $219.40, civil fees)
received $1.35 and conciliation court fees $1.00 and for the week ended May 19,1945

$.70, were each read and having been previously approved by the City Attorney, j
President Lemmon ordered that same be placed on file. ,

The report of the City Weighmaster for the month of April, 1945
,showing 203 private loads weighed and receipts of $20.30, was read and President
�Lemmon referred same to the Finance Committee.

'Fund for the month of April, 1945, was read and the same was accepted and ordered;l

The applications of Ross Phill for non -intoxicating malt liquors "On
Sale". andlOff Sale" licenses for the year ending March 31, 1945 and the
application .for non -intoxicating malt liquor license "On Sale" for the Knights of
Columbus Club for the year beginning.April 1, 1945, were each read -and upon
motion by Yaeger, second by Narveson, the same were granted, providing the Knight
of Columbus Club make application for anon -intoxicating malt liquor license "On
Sale" for the year ending March 31, 1945.
The application of Ross Phill for a cigarette license for the year
ending March 31, 1945 and the applications for cigarette licenses of the Park
Board (2), Knights of Columbus and Josephine L. Kaiserlik for the year..beginning
April 1, 1945 were each read and upon motion by Fryer, second by Narveson, the -
said licenses were granted, providing the Knights of Columbus make application
for an additional cigarette license for the year ended March 31, 1945•
The application of Earl J. Squires for a Master Electricians License
was read and upon motion by Narveson, second by Yaeger, the license was granted.
The application of Lloyd Bennett for. a Master Plumbers' License was real
and upon motion by Kjerner, second by Fryer, the license was granted.
The applications of Roy A. Lindberg and Nick Rukavina for Journeyman
Plumber's License were each read and upon motion by McQuillan, second by Yaeger,
the licenses were granted..
Theapplication of George Fordham for a Jpurneyman Electricians License
was read and upon motion by Kjerner, second by -Yaeger, the license was granted.
The application of Rochester Leather Store for a permit to place and
maintain a sign was read and upon motion by Fryer, second by Narveson, the permit
was granted.
The applications of Ross Phill for a license to sell soft drinks for thi
year ended March 31, 1945 and the applications of the Knights of Columbus, Arthur
Hotel,. Josephine L. Kaiserlik, and Rochester Hotel for soft drink licenses for the
year beginning April 1, 1945 were each read and upon.motion by Yaeger, second by
Kjerner, the same were granted with the exception of the Knights of Columbus whick
was granted on condition that they make application for a soft drink license for
the year ended March 31, 1945,
The application of the Yellow Cab Company for the transferof taxi -cab
license No. .20 on a 5 passenger Cadillac to a 7 passenger Buick, was read and upox
motion by McQuillan, second by Narveson, the transfer was granted.
The License Bonds of Vincent Huyber and-J. P. Huyber each in the sum of
$1000.00 with the Aetna Casualty & Surety Company as surety and L. A. Kepp and

Alderman Kennedy introduced a resolution appropriating $255.25 from
lithe General Fund, $349.29 from the Street & Alley Fund,.and $1.21 from the Sewer
;Fund and ordering payment made to City of Rochester, General Fund, for gasoline
furnished police, street and alley, and disposal plant, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kennedy introduced a resolution appropirating $275.00 from thel
Park Improvement Fund and ordering payment made to Hugh Vincent Feehan for

preparation of studies and sketch plans for proposed improvements for Parks, which
was read.
Upon motion by Kennedy, second by Narveson, that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $269.00 from the
Park Improvement Fund and ordering payment made to City of Rochester, Public
Utility Department for steam heat for Mayo Civic Auditoriury, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $343.40 from the
Park. Improvement Fund and $103.20 from the Lighting Fund and ordering payment
made to City of Rochester, Public Utility. Department, forwater, power• and
electricity for auditorium, which was read.
Upon motion by Yaeger, second by Kennedy, that, the said resolution be
adopted as read, and, all voting in favor thereof, Pr.eside.nt Lemmon declared the
said resolution duly. passed and adopted.
Alderman ivarveson introduced a resolution appropriating $200.00 from
the Park Improvement Fund and ordering payment.made to J. H. Neutzman for popcorn
which was read.
Upon motion by Fryer, second by Narveson, that .the said resolution be
adopted as read, and all. voting in favor thereof, President Lemmon declared the -
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution ordering plan and profile,
specifications and.estimate of cost for grading and surfacing Fifth Street N.W.
from 11th Ave. NW-. to 9th Ave. N. W., which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman. Kennedy introduced a resolution approving the salary of an
extra employee to supplement the janitor service in the Health Department clinic
rooms and an extra man as needed for the garbage collection service, which was
read.
Upon motion by Kennedy, second by Yaeger, that.the said resolution
be adopted as .read, and .all voting in favor thereof, President Lemmon declared thi
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $22,000.00 from
the F. E. Williams Estate Fund and ordering payment made to Estate of Simon
Stensrud, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read and all voting in favor thereof, President Lemmon declared the
said resolution .duly passed and adopted.
Alderman Kennedy introduced a resolution appro.ving salaries for cashiersl,

Upon motion by Fryer, second by Kennedy, the RacTies.-Auxiliaries of the
American Legion and the Veterans of Foreign Wars were authorized to sell poppies
on the streets of Rochester on May 26, 1945.
The matter of appraisal of City buildings for insurance purposes was
discussed and the same was .referred to the Insurance Committee.
The matter of a sign owned by the Standard Oil Company located near the
corner of 2nd Street and llth Avenue Southwest was brought up and upon motion by
Yaeger, second by Fryer, the City Building Inspector was instructed to notify

the Standard Oil Company to move the sign so that it would not obstruct the
lighting.at the intersection of llth Avenue and 2nd Street S. W.
Upon motion by Fryer, second by Narveson, the Building Inspector and �
the City Attorney were instructed to notify Mr. Max Shapiro and his son to dis-
continue work on the apartment building which is now under construction until he
complies with provisions of the law requiring architects, engineers, and surveyors
to be registered.

at the prices listed was read and upon motion by Kennedy, second by Fryer, the
purchase prices of the various pieces of property were approved and the Board of
Park Commissioners were authorized to complete the transactions necessary to purchase
the said real estate:

Upon -motion by Fryer, second by Kennedy, the following list of names
submitted by the Mayor, President of the Common Council, and the Alderman to act
as a Committee to investigate proposed city projects to be considered by the
Common Council in the future was approved and the City Clerk was instructed to
notify each member of a meeting to be held on May 28, 1945 in the Council
