HomeMy WebLinkAbout06-04-1945460 Record of Official Proceedings of the Common Council of the City of Rochester, Minnesota, Jun e 4 19 45 Minutes of a meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on June 4, 1945• President Lemmon called the meeting to order at 2:00 o'clock P.M., the ,'following members being present: President Lemmon, Aldermen Fryer; Kennedy, 1 jKjerner, McQuillan, Narveson, and Yaeger. Absent: None. I, Upon motion by Kjerner, second by Yaeger, the minutes of the meeting ofr 1,May 21, 1945 were approved. President Lemmon stated this as being the time and place set for the hearing on the grading of Fifth Street Northwest from Ninth Avenue Northwest to Eleventh Avenue Northwest. There was no one present, wishing to be heard. I President Lemmon stated this as being the time and place set for the hearing on the construction of a sanitary sewer in Ninth Street Southeast from the center line of Fourth Avenue Southeast to 125 feet East. There was no one f ,present wishing to be heard. Mr. Max Shapiro was present at the meeting and stated that he wished to, continuewith the construction of the apartment building and inquired as to what I ;assurance he mould have that he would not be stopped again on the construction of; Ithe said building. The City Engineer stated that he had no further objections ;since Mr. Shapiro had employed a qualified architect. The Building Inspector �'a.lso stated that Mr. Shapiro would be expected to follow the plans and specifications prepared for his apartment and the building code of the City of Rochester. President I �I 'Lemmon further informed Mr. Shapiro that the Council had no legal right to Ildesignate parking area in the boulevard for the benefit of his apartment building. it The recommendation of the Finance Committee that a loan be made to I r JlRudolph Wiese in the amount of $3,000.00 at 4% interest 11 by the Fire Department ;Relief Association was read and upon motion by Narveson, second by Fryer, the same 'I was approved. I �I The recommendation of the Water and Sprinkling Committee that the contract !for the construction of a water main on 5th St. N. W. from llth Ave. N. W. to 9th' i Ave. N. W. be awarded to Carlisle G. Fraser for the sum of $1855.00, the recommendation of the Sewer Committee that the contract for the construction of I, a sewer on 5th Street N. W. from the center line of 9th Ave. N. W. to a point 400 Ifeet west be awarded to Carlisle G. Fraser for the sum of $1084.50, and the , recommendation of the Street & Alley Committee that the proposal of Carlisle G. C Fraser in the amount of $1437.00 for the grading of 5th St. N. W. from 9th Ave. i , IN. W. to llth Ave. N. W. be rejected, and that the City Engineer be instructed to i (complete the said grading in accordance with plans and specifications were each read and upon motion by Fryer, second by Kjerner, the same were approved. The City Engineer's preliminary estimate of cost of construction of a concrete curb and gutter on 9th Avenue Northwest from 1st Street Northwest to 2nd Street Northwest in the amount of $687.50 was read and upon motion by Fryer, second by Kennedy, the same was accepted and ordered placed on file. The City Engineer's preliminary estimate of cost of construction of a 4 inch water main in 7th Street Southeast from 12th Avenue Southeast to 13th Avenue Southeast in the amount of $1323.00 was read.and upon motion by Kennedy, ,second by Kjerner, the same was accepted and ordered placed on file. The City Engineer's preliminary.estimate of cost of construction of a 6 inch water main on 3rd Avenue Northwest from 14th Street Northwest to 1500 feet North in the amount of $10,054.20 was read and President Lemmon ordered that the same be placed on file. The report of the Sewer Committee and the City Engineer that a permit to construct a private sewer connection on 9th Street Southeast from 4th Avenue Southeast to a point 125 feet East had been issued to Mr. A. H. Helm, was read and President Lemmon ordered that the same be placed on file.. The report of the Sewer Committee and the City Engineer on the repair and improvement of the damaged 18 inch sanitary sewer crossing Cascade Creek South of the Chicago Great [western Railway and the correction of the water channel of Cascade Creek from the Railroad bridges to the 8th Avenue bridge was read and President Lemmon ordered that the same be placed.on file. The recommendation of the Board of Zoning that the S2 of E,—� of Lot 106, Auditor's Plat "A" except the _highway and South 221 ft. of Lot 34, Auditor's Plat "A" immediately north of State Highway and west of Bear Creek be changed from residential to commercial zoning was read. Mr. John H. Smith and Der. Phillip Ba.rck, the petitioners, were present at the meeting and Mr. Smith urged that the change in zoning be made. After discussing the matter a motion was made by Fryer, second by Kjerner, and all voting in favor thereof, 'that action be deferred until the meeting of June 18 at 7:30 o'.clock,P.M. The following communication was read and upon motion by Yaeger, second by Fryer, the appointments were approved: "To the Honorable Mayor and Members of the Common Council Gentlemen: In accordance with the power vested in the President of the Common Council of the City of Rochester by Section 43, of Chapter 5, of the Charter of said City, I hereby appoint the following members to the Board of Equalization to serve during the present fiscal year: Austin A. Kennedy, Carl B. Kjerner, and John -A. Yaeger. Respectfully submitted, J. T. II The rating of the City of Rochester by the American Automobile ,Association in the Sixth National Pedestrian Protection Contest was read and President Lemmon ordered thatthe same be placed on file. A letter of appreciation from the Building and Construction Trades11 Council for consideration given them by the Common Council in the action taken jl I in regard to city employees doing part time work was read and the same,was ordered placed on file. The City Engineer's request that $5,000.00 be appropriated from the it JjStreet & Alley Fund for use of the Street & Alley Committee was read and the same 1jwa.s ordered placed on file. The following resolution adopted by the Public Utility Board was read sand ordered placed on file: "Be it'and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Honorable j Common Council of the said City be and is hereby requested to i authorize the said Board to enter into a contract with the COMMONWEALTH ELECTRIC COMPANY of St. Paul, Minnesota for the i furnishing of one DELAVAL BOILER FEED PUMPING UNIT according to plans and specifications on file and in accordance with their bid of May 24th, 1945, the price of said unit to be j THREE THOUSAND SIX HUNDRED AND NINETY DOLLARS ($3,690.00) and the said Commonwealth Electric Company being the lowest qualified responsible bidder." I ' The City Clerk's appointment of Mrs. Allene M. The report of the Building and Plumbing Inspector for the month of May, 1945 showing building permits issued $70.00 and plumbing permits issued $71.25 and the report of the Electrical Inspector for the month of May, 1945 showing electrical permits issued $19.25, were each read and President Lemmon referred same to the Finance Committee. The application of Clarence Sather for a transfer of 3.2.110n Sale" License No. 515 and "Off Sale" 3.2 License No. 924 from Anna Houdek was read and upon motion by Fryer, second by K jerner,, the transfer was granted. The applications of Clarence Sather and Harry TTreatfillou for license to sell cigars-ttes were each read and upon motion by Yaeger, second by Narveson, the licenses were granted. The application of Austin Bros. -Circus for license to show -in Rochester) on June 21, 1545 was read and upon motion by Narveson, second by McQuillan, the license was granted. The applications for Driver's License of Robert Brown, Robert A. Kuehn,) A. Robert Lehto and John T. Tysseling were each read and upon motion by Fryer, second by Kennedy, the licenses were granted with the exception of Robert A. Kuehn's application which was granted subject to payment of the fee. The application of the U. S. Fireworks Co. for a permit to display a fireworks show on July 4, 1945 was read and upon motion by Fryer, second by Kennedy, the permit was granted. The application of Walter Mundt for a JourneyMan Plumber's license was read and upon motion by McQuillan, second by Kennedy, the license was granted. The applications of Clarence Sather, Harry T. Treatofillou, and Tom (Andrew for license to sell soft drinks were each read and upon motion by Fryer, (second by Yaeger, the licenses were granted. Alderman Fryer introduced a resolution ordering the first hearing on the construction of a sanitary sewer and water main in 7th Street Southeast from 12th Avenue to 13th Avenue Southeast, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution ordering the list hearing on the construction of a water main on 3rd Avenue Northwest from 14th Street Northwest to 1500 feet North, which was read.. Alderman Kennedy introduc.ed a resolution accepting the bid of Carlisle G. ,Fraser in the amount of $2939.50 for the construction of a sanitary sewer and water I main in 5th Street Northwest, which was read. Upon motion by Kennedy, second by Yaeger, that the said resolution be !' ��adopted as read, and all voting in favor thereof, President Lemmon declared the i !said resolution duly passed and adopted. Alderman Kjerner introduced a resolution approving a resolution adopted by the Public Utility Board to enter into contract with the Commonwealth I Electric Company, which was read. I' Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the !said resolution duly passed and adopted. �I r Alderman Kjerner introduced a resolution appropriating $5,000.00 from I' ,the Street & Alley fund for use of the Street & Alley Committee, which was read. Upon motion by Yaeg.er, second by Fryer, that the said resolution be II ;adopted as read, and all voting in favor thereof, President Lemmon declared the 1;sald resolution duly passed and adopted. Alderman Narveson introduced a resolution appropriating $213.37 from i. I; ,the General Fund and ordering payment made to City of Rochester, General Fund form 'insurance premium as per general insurance form of May 1, 1945, which was read. Upon motion by Narveson, second by Yaeger, that the said resolution be adopted as read, and all voting in favor thereof, president Lemmon declared the ;said resolution duly passed and adopted. I; Alderman Yaeger introduced a resolution appropriating $238.15 from the i I 'iStreet & Alley Fund and ordering payment made to Morse Bros. for 433 yds. C. P. !Run, which was read. • I Upon motion by Kjerner, second by McQuillan, that the said resolution be, adopted as read, and all voting in favor thereof, President Lemmon declared the ;said resolution duly passed and adopted. Alderman McQuillan introduced a resolution appr.opr.iating $1883.70 from the Lighting Fund, $170.32 from the General Fund, $2.00 from the S & A Fund and $2.80 from the Fire Protection Fund and ordering payment made to City of Rochester Public Utilities for power, water and electricity, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. The following claims were read and upon motion by Yaeger; second by Narveson, the same were allowed and the Mayor and City Clerk were authorized and directed to draw warrants on the City Treasurer and make payments accordingly: From the General Fund: N. I' Upon motion by Fryer, second by Yaeger, the Mayor and City Clerk were I I authorized to execute -a deed transferring the property known as the Williams Estate I+Cottage and the purchaser was authorized to withhold $100:00 of the payment price] the title for the said -property had been cleared.
