City, on July 16, 1945- l II President Lemmon called the meeting to order at 7:30 o'clock_P.M., them following members being present: Lemmon, u Kennedy, Kjerner, McQuillan, Narveson,i and Yaeger. Absent: Fryer. Upon motion by Kjerner, second by Yaeger, the minutes of the meeting of July 2, 1945 were approved. President Lemmon stated this as being the time and place set for a hearing on the construction of a watermain in Third Avenue Northwest from 14th b I' Street Northwest to 1500 feet North, James T. Spillane, representing L. A. Keppli I. Electric Company, and Mr. Louis Kepp appeared at the meeting and inquired as to I. II � how the assessments would be made if the proposed watermain in Third Avenue Northwest was constructed.President Lemmon explained that bids would be opened I, I at this meeting and referred to the Water Committee, who would later confer with the Public Utility Department to determine what amount of the expense of con- I' structing the watermain would be assessed to the property owners. j President Lemmon stated this as being the time and place set for a ii hearing on the construction of a sanitary sewer and watermain.in 7th Street Southeast from 12th Avenue Southeast to 13th Avenue Southeast. There was no onel present wishing to be heard. President Lemmon stated this as being the time and place set for a i hearing on the construction of a curb and gutter on 9th Avenue Northwest from lst, Street Northwest to 2nd Street Northwest. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a watermain in Third Avenue Northwest from 14th Street to 1500 feet North. The proposal of Carlisle G. j i Fraser in the amount of $7964.60 for the construction of the said watermain was I opened and upon motion by Kennedy, second by McQuillan, the same was referred I to the Water Committee and the Public Utility Board to determine the amount to j be assessed against the abutting property owners and the amount to be paid by p the Public Utility Department, a report on same was requested for Thursday, July 1Q, 1945. President Lemmon stated this as being the time and place set for l I receiving and opening bids for the construction of a sanitary sewer and watermain' in 7th Street Southeast from 12th Avenue Southeast to 13th Avenue Southeast. Fraser in the sum of $1476.00 for the construction of a watermain on 7th Street Southeast. The recommendation of the Water Committee that the bid of Carlisle G. Fraser in the amount of $1476.00 for the laying of a watermain on 7th Street Southeast from 12th to 13th Avenue Southeast be accepted, was read and upon motion by Kennedy, second by Kjerner, the same was approved. The recommendation of the Sewer Committee that the bid of Carlisle G. Fraser in the amount of.$769.00 for the construction of a sanitary sewer on 7th Street Southeast from.12th to 13th Avenue Southeast be accepted, was read and upo motion by Narveson, second by Kennedy, the same was approved. President Lemmon announced that no bids had been received for the construction of a curb and gutter on 9th Avenue Northwest from lst Street Northwe to 2nd Street Northwest and upon motion by McQuillan, second by Kjerner, the City Engineer was instructed to have the said curb and gutter constructed. Mr. H. J. Kruse stated to the Council that definite lot lines had never' been established at the east ends of Outlots 12 and 13 in Northern Addition and Broadway Street and requested that the City now have surveys made which would establish definite lines. President Lemmon referred the matter to the Street & Alley Committee, the City Engineer and the City Attorney. A complaint by Ida M. Herrick, William Buss and Florence Mae Buss, plaintiffs versus James S. Gray, Margaret A. Gray, City of Rochester and Garnet Spring, Building Inspector of the City of Rochester, as defendants, was read and President Lemmon referred the same to the City Attorney. The request of Erwin L. Briese, President of the Rochester Armory Board. for an appropriation of $250.00 for maintenance of the Rochester Armory was read and the same was ordered placed on file. The following resolution adopted by the Public Utility Board was read and ordered .placed on file; "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Hon. Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the JOHY A. CLARK ELECTRIC COMPANY for the furnishing, in accordance with specifications, of 5-100 KVA Subway Type Transformers as described in epecifications for a total lump sum bid of- THREE THOUSAND EIGHT DOLLARS and NINETY CENTS ($3,OO8.90)F. 0. B. Rochester, Minnesota, the said John A. Clark Electric Company being the lowest responsible bidder." - A communication from the Public Utility Board regarding the cop_structiot of a well in Central Park was read and upon motion by Yaeger, second by Narveson, the request was approved. A request by Roy Kingrey, Chairman of the anti -noise Committee,Division of the Chamber of Commerce, that $499.00 be appropriated by the Common Council to ;t 4S . Record. of. The request of the 3oard of Park Commissioners for authorization by the! IiCommon Council to purchase a lot from Edwin J. Kelly for $400.00 to be used for Park purposes was read and the same was ordered placed on file. A copy of a letter from the Board of Park Commissioners to Joseph F. Mackey wherein they again offered hi.m $2,550.00 for land to be used for Park purposes was read and the same was ordered placed on file. An appeal from the decision of the Building Inspector in refusing to issue a permit to Ruel E. Gatewood for the construction of a lubricating and wash room on the ground floor with living quarters on the second floor at the licorner of 4th Street and llth Avenue Southeast, together with a statement of acquiescence signed by 20 residents in that locality were each read and President ILemmon referred same to the Board of Zoning. A petition for the construction of a. watermain and sanitary sewer in loth Avenue. Southeast and llth Avenue Southeast from 12th Street Southeast to 113th Street Southeast was read and President Lemmon referred the same to the Sewer Committee and the City Engineer for report on August 6, 1945. �I The report and recommendation of the Street & Alley Committee, the City', I !Engineer and the Chief of Police that the speed limit on 2nd Street Northwest be i� jI ichanged from 30 to.25 miles per hour, and also on other streets and avenues where I necessary, was read and upon motion by McQuillan, second by Kennedy, the recommen �dation was approved. The recommendation of the Finance Committee that a loan in the amount of $200.00 with interest at 6% be made by the Rochester Fire Department Relief Assn. !,to Orin Solomon on his property descr•ibed,as Lot 7, Block 11, Golden Hill Addition I,in the Southeast Quarter of Section 11, Township 106, North Range 14 West, was read and upon motion by Narveson, second by Kjerner, the loan was approved. I The recommendation by the Street & Alley Committee that 2 Industrial r Wheel Tractors with snow plow attachments be purchased for use of the Street & (Alley Department was read and upon motion by McQuillan, second by Yaeger, the (recommendation was approved and the City Clerk was instructed to advertise for bids for said tractors on August 6, 1945. A petition that a sidewalk be constructed on the west side of 131 Avenues Southeast from 2nd Street Southeast to a point 390 feet South was read and the same was referred to the Street & Alley Committee. I The Mayor's appointment of William A. Sessing as special policeman for duty at the Rochester Dairy Cooperative was read and upon motion by McQuillan, 1I I second by Narveson, the same was approved. The report of Expenditures from the City Engineers payroll for the month of June, 1945 was read and the same was ordered placed on file, The City Engineer's Trial balance for the month of June, 1945 was read and the same was ordered placed on file. The reports of the Clerk of the. Municipal Court for the week ended July 7, 1945 showing total criminal fines and costs collected $82.00 and conciliation court.fees $4.00 and for the week ended July 14, 1945 showing total criminal fines and costs collected $159.00 and conciliation court fees $1.00, were each read and having been previously approved by the City Attorney, Presiden Lemmon ordered that the same be placed on file. The application of C. E. Anderson for a license. to hold an auction sale was read and upon motion by Narveson, second by McQuillan, the same was granted subject to the approval of the License Committee. The applications of L. W. McN_ee, Jack Simmons, Adabelle Davis and Elmer W. Judd for Driver's License were each read and upon motion by Kjerner, second by Kennedy, the same were granted. The application of Martin Paulson for a, license to connect with sewers and drains was read and upon motion by McQuillan, second by Kennedy, the license was granted. The license bond of Chas. E. Anderson in the amount of $1000. 00 with th Continental Casualty Company as surety and the license bond of Martin Paulson in the amount of $1000.00 with the Fidelity &' Casualty Company of New York as surety, were each read, and upon motion by McQuillan, second by Yaeger, the bonds were approved, the surety thereon accepted and.it was ordered that the same be placed on file. The application of Fred W. Oesterreich for a license to sell intoxicatii liquor "on,sale" was read and the same was referred to the License Committee for their recommendation as to whether or not the present Ordinance should be amended so as to increase the maximum number of."on sale" intoxicating liquor licenses to more than 15. The applica.tionlof Leo Aennum for a license to sell soft drinks was read and upon motion by Yaeger, second by Kennedy, the license was granted. Alderman Kennedy.introduced a resolution appropriating $211.70.from the General Fund and ordering payment made to _Chicago Great Western,.Ry. Co. for frei on asphalt, which was read. Alderman Kennedy introduced a resolution appropriating $660.60 from thel (,General Fund and ordering payment made to Union Asphalts & Roadoils Inc. for two li cars of asphalt, which was read. Upon motion by Kjerner, second.by Yaeger, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a.resolution appropriating $250.00 from the'' General Fund and ordering payment made to the Rochester Armory, for maintenance of the Armory, which was read. Upon motion -by Kennedy, second by Narveson, I that the said resolution be', liadopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating $499.00 from they,' it (General Fund and ordering payment made to the U. S. Fireworks Co. for partial payment of fireworks for July 4th, 1945, which was read. Upon motion by Narveson, second by Kennedy, that the said resolution bell (,adopted as read, and all voting in favor thereof, President Lemmon declared the ,said resolution duly passed and adopted. II Alderman Kjerner introduced a resolution appropriating $1216.40 from the 'General Fund, $152.25 from the Sewer Fund and $911.66 from the Street & Alley Fund ,and ordering payment made to the Street & Alley Fund for use of equipment, which !I 'was read. Alderman McQuillan intoruduced a resolution appropriating $400.00 from the Park Improvement Fund and ordering payment made to Ivan B. Boyd for deed to i E2 of S' of Lot 14, Shervem's Replat of L-ot 93, Auditor's Plat "A", which was reed. Upon motion by Kennedy, second by Narveson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating $269.90 from the Park Improvement Fund and ordering payment made to E. A. Danewick for work done at the swimming pool, which was read. Upon motion by Narveson, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared th said resolution duly passed and adopted. Alderman Narveson introduced a resolution appropriating $310.00 from the Park Improvement Fund and ordering payment made to Reynolds Wholesale Company) for merchandise -delivered to auditorium -and soldiers field, which was read. Upon motion by Yaeger, second by Kennedy, that the said resolution be adopted as -read; and all voting -in favor thereof, President Lemmon declared the 'said resolution duly passed and adopted. Alderman Narveson introduced a resolution appropriating $209.49 from - the Park Improvement Fund and ordering payment made to the Rochester Dairy Coop. for supplies for soldiers field. -which -was read. Upon motion by Kennedy, second by McQuillan, that the said resolution bi adopted as read, and all voting in favor thereof,.President Lemmon declared the said resolution duly passed and adopted.. . Alderman Narveson introduced a resolution appropriating $1000.00 from the F. E. Williams Estate Fund and -ordering payment made to the Recreation Commit,, .pro-rata portion of cost of summer playground supervision -for children under 15 years of age, which was read. Upon motion by McQuillan, -second by Kjerner, that the said resolution b� adopted. as r-ead, and all voting in -favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Narveson introduced a resolution appropriating $2204.62 from the P. I. R. Fund and ordering payment made to Carlisle G.'
