Augus t 6 19 �5 i' �i Minutes of a regular meeting of the Common Council of the City of ��Rochester, Minnesota, held in the Council Chambers, in the City Hall in said City, Ion August 6, 1945. President Lemmon called the meeting to order at 2:00 o'clock P.M., the I�following members being present: P.res.identLemmon, Aldermen Fryer, Kennedy, Kjerner, McQuillan, Warveson, and Yaeger. Absent: None. Upon motion by Kjerner, second by Fryer, the minutes of the meeting of I 1July 24, 1945 were approved. President Lemmon stated this as being the time and place set for receiving and opening bids for the purchase of two Industrial Wheel Tractors with 1' Sidewalk Snow Plow Attachments. The bids -of Wm. H. Ziegler Co., Inc. in the- u liamount of $7,082.82, The George T. Ryan Co. in the amount of $4,316.00, and The Rosholt Equipment Co., 2 International I-9 Industrial Wheel Tractors, each $2,171:30 �a.nd 2 One -Way Side Walk Snow Plows, each $365.00, were each read and the same (were referred to the Street & Alley Committee and the City Engineer for report and, ,recommendation at the meeting to be held on August 20, 1945. I jMr. A. E. Benike appeared at the meeting and asked that permission be ,,granted to construct a temporary building to be used as a church by the Grace lLutheran Congregation on the corner of llth Avenue and 5th Street Northeast. Upon I motion by Fryer, second by McQuillan, the request was granted. President Lemmon stated this as being the time and place set for a hearing on the construction of a curb and gutter on 5th Avenue Southeast from I ' 112th Street to 13th Street Southeast. There was no one present wishing to be I I.Ilheard. 1. I; A letter from the State of Minnesota, Department of Highways, transmitting 11in triplicate six agreement forms covering Postwar Survey and Plans for the City I i of Rochester with the request that the Council authorize by resolution their i . i;execution was read and the same was ordered placed on file. j A request by Kris Nielson for permission to clean out sand bars in IlCascade Creek between loth and 14th Streets Northwest was read and upon :notion by McQuillan, second by Narveson, Mr. Nielson's request was granted, the work to be ,supervised by the City Engineer. I� 1' The recommendation of Knute Olson, City Assessor, that Bruce Gillis be ,granted a leave of absence, without pay, to assist in making a reassessment in I�Golden Hill Township, which adjoins the City limits of Minneapolis, and that Mr. i Ole Anderson be employed as Deputy Assessor until Mr. Gillis returns, was read and upon motion by Fryer, second by Yaeger, the same was approved. J 1 • 1 1 • Record of Official Proceedings of. the Common Council of the City of Rochester, Minnesota, Augu s t .6 1945 17 L 4V i 1 it • 1 1 • of Rochester for a strip of land 18 feet wide through Lots g, 9 and -10,. in Block 14, Head & McMahon's Addition for a. public alley and agreeing to pay the cost of -grading and paving the said alley was read and upon motion by Fryer, second by Kennedy, the deeds were accepted, subject to the approval of the City Attorney, and the City Engineer was instructed to prepare plans for the project. A letter .from the Board of Park Commissioners stating that they had nowl agreed to accept the compromise proposal submitted by Mr. Joseph F. Mackey for th� sale of land to the City of Rochester for park purposes and the also the sale of land by the City of Rochester to himself, was read and upon motion by Kennedy, second by Kjerner, the said sale and purchase of land by the Park Board was approved. A petition for the construction of a sidewalk on the west side of 12th Avenue Southeast from 6th Street to 7th Street Southeast was read and President Lemmon referred the same to the, Street & Alley Committee and the City Engineer for report at the meeting on August 20, 1945. A petition for the construction of a watermain and sanitary sewer in 102 Street Southeast to service Lots 2 and 3, Block 6, Sunnyside Addition, signed by Mr.. G. A. Harders and Mrs. Arthur O'Neill, owners was read. Alderman Fryer stated that he understood the petitioners were willing to pay the cost of same and that it would not be necessary to construct the project on an assessment basis. The City Engineer and the City Attorney were requested to get an -agreement d from the petitioners to that effect. The following resolutions adopted by the Public Utility Board were each read and the same were ordered placed on file: "WHEREAS, it is deemed in the best interest of the City of Rochester that the amount of $120,000.00 be made available to the General Fund from the Public Utility Fund of the. said City, and WHEREAS, the Public Utility Board is agreeable to the trans- fer of that amount from the Public Utility Fund to the General Fund with the stipulation that said transaction be termed Advanced Gross Income Tax Payment to be repaid out of future Gross Income Tax in ten (10) equal annual payments beginning on March 1st 1947 with interest on the unpaid balance at the rate of one (1) percent per annum, THEREFORE, be it and it is hereby resolved by the Public - Utility Board of the City of Rochester, Minnesota, that the Hon. Common Council of the said City be and is hereby req- uested to authorize the said transfer with the stipulation that FIFTY THOUSAND DOLLARS ($50,000.00) be paid with the adoption of this resolution and SEVENTY -THOUSAND DOLLARS ($70,000,00) to be paid on December 31st 1945, subject to the terms and conditions stipulated in this resolution." Upon motion by Fryer, second I' by Kjerner, the recommendation of the Board of Zoning covering the addition to i ,his property as submitted to them was approved and also the recent plans to make u ;(the addition to his present building larger were approved subject to the approval;; I iof the Board of Zoning and provided that Mr. Verson file an affidavit with the I I � i City that non -intoxicating malt liquor would not be served on his premises. Mr. Ruel E. Gatewood was present at the meeting and the recommendation ,of the Board of Zoning that he be permitted to construct an addition to his (!filling station was again considered, and upon motion by Kennedy, second by Yaeger, the recommendation was approved providing that Mr. Gatewood furnish the i j'�Building Inspector with plans and specifications to meet his approval. i I �I The request of the City Engineer that $5,000.00 be appropriated from the !; 1 �Peneral Fund and $5, 000.00 from the Street & Alley Fund for use of the Street & Alley Committee was read and the same was ordered placed on file. The report submitted by the Board of Education showing cash on hand lAugust 1, 1945 $169,539.42; receipts received during the year ended July 31,1945 $749,893.64; disbursements during the fiscal year ended on the same date I $693,836.74; leaving a balance on hand on July 31, 1945 in the amount of 1 I'$224,595.32+ was read and the same was ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended i iJuly 28, 1945 showing total criminal fines and costs collected $98.10 and civil j ,fees received $1.35 and for the week ended August 4, 1945 showing total criminal j fines and and costs collected $220.00, civil fees received $3.60 and conciliation i court fees, $.50, were each read and having been previously approved by the City I ;Attorney, President Lemmon ordered thatthe same be placed on file. j i The report of the Building and Plumbing Inspector for the month of I�July, 1945 showing total building permits issued $81.00 and total plumbing permits ;,issued $52.00 and the report of the Electrical Inspector for the month of July, i;1945 showing total electrical permits issued $19.25, were each read and President I I'Lemmon referred same to the Finance Committee. The request of John D. Ryan for leave of absence from his duties at the �lRochester Fire Department beginning August 7, 1,945 was read and upon motion by �Kjerner, second by McQuillan, the request was granted. The application of H & H Electric Company for Electrical Contractor's License was read and upon motion by McQuillan, second by Na.rveson, the license was granted. The applications of Jno. P. Huyber and Vincent Huyber for Master Electrician's License were each read and upon motion by Yaeger, second by Narveson, the licenses were granted. The applications of Frank Adair, Lewis C. Fordham and Ben Zimdars for Journeyman Electrician's license were each read and upon motion by McQuillan, second by. Kjerner, the licenses were granted. The applications of Leo J. Smith, All Veterans Club and Sam Ingalls for soft drink licenses were each read and upon motion by Fryer, second by Yaeger, the licenses were granted. The application of Clarence Cameron for Driver s license was read and upon motion by Fryer, second by Kennedy, the license was granted subject to the approval of the Chief of Police. The application of Frederic Berg for a Taxi. Club License was read and upon motion by Yaeger, second by McQuillan, the license was granted. The license bond of Herman Dornack in the sum of $1000.00 with the American Surety Company of New York as surety, and.the contract bonds of Carlislei G. Fraser in the amount of $2,245.00 and $7,864.60 with the United States Guaranty as surety, were each read and upon motion by Fryer, second by Kennedy, the bonds were approved, the surety thereon accepted and.it was ordered that the same be placed on file. Alderman Kennedy introduced a resolution appropriating $935.92 from the General Fund and ordering payment made to Phillips Petroleum Company for two truck transports of gasoline, which was read. Upon motion by Kennedy, second by McQuillan, that the said resolution b� adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $212.99 from the General Fund and ordering payment made to Chicago Great Western Ry. Company for freight on cutback asphalt, which was read. Upon motion by Kjerner, second by Narveson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy .introduced a resolution appropriating $370. 30 from the; General Fund and $35.75 from the Street & Alley Fund and ordering payment made to Morse Bros. for sand and C. P. Feller Company for crane rental for channel change in Cascade Creek, which was read. Upon mo.tion by Narveson, second by Kennedy, tha.t the said resolution. be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $305.46 from the Park Improvement Fund and ordering payment made to Reynolds Wholesale Company for merchandise delivered to concession stands., which was read. Upon mo.tion by Kjerner, second by McQuillan, that the said resolution be adopted as read, and all voting in favor thereof, , President Lemmon declared. the said resolution duly passed and adopted. Upon motion by Yaeger, second by McQuillan, $199.00 was appropriated from the General Fund to the. Mayor Is Contingent Fund. The following claims were read anti upon motion by Yaeger, second by McQuillan, the same were allowed and the Mayor and City Clerk were authorized.and directed to draw warrants on. the City Treasurer and make payments accordingly:. An Ordinance entitled, "An Ordinance Providing for the Licensing, Supervision, Inspection, and Enforcement of Heating, Air -Conditioning, and Ventilating, in the City of Rochester, Minnesota, was given its first reading. Mayor Grassle stated that he had reappointed to the Library Board Mr. Frederick J. Furlow, Dr. J. A. Bargen and Mr. Wm. Sperling and -upon motion by, Kjerner, second -by McQuillan, the Mayor's appointments were approved. Mayor Grassle stated that he had received letters and complaints in regard to patients from the Rochester State Hospital being allowed to leave the hospital grounds when they were not accompanied by attendants. After discussing the matter a motion was made'by Mcquillan, second by Narveson, that Dr. M. C. Peterson, Superintendent of the State Hospital, be requested to keep all patients on the grounds of the institution and, that they be not permitted to leave same unless accompanied by some one responsible for their conduct. The recommendation of the Public Grounds Committee and the City Engineer that the City purchase the property lying west of the Chicago Great Western Ry. tracks and the alley and between 2nd Street Southeast and 4th Street Southeast was read and upon motion by Yaeger, second by Kjernler, the same was approved. Upon motion by Kennedy, second by Narveson, the meeting was adjourned until 7:30 o'clock P.-M. on August 20, 1945. City Clerk 0
