Minutes of.an adjourned regular meeting of the Common Council of the

'City of Rochester, Minnesota, held in the Council Chambers in the City ?fall, in
'said City on August 20, 1945.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon,.Aldermen Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
li Upon motion by Fryer, , second by Yaeger, the minutes of the meeting

,held August 6, 1945 were approved.
President Lemmon stated this as being the time.and place set for a
;hearing on the construction of a curb and gutter on Fifth Avenue Southeast from I
�12th Street Southeast to 13th Street Southeast. There was no one present wishing
i

A petition signed by Emrold Thiem, Fred Sauer, Harold Dunnette, Alvira.l
'Dunnette and E. C. Green to have a part of Lot 33,.Auditor's Plat "A" changed
from residential to commercial zone was read and President Lemmon referred the
�same to the Board of Zoning.
A notice of hearing before the Railroad and Warehouse Commission in the,I
Fatter of the application of Fern R. Wilber d/b/a Wilber Transfer Company, Rochestler,

Minnesota., for a certificate of public convenience and necessity as an Auto
i!Transportation Company for the transportation of general commodities in the State 11

of Minnesota, the same to be held at the Court House, Rochester, Minnesota on
October 16, 1945 wa.s.read and President Lemmon ordered that the same be placed on
file.

An agreement between the Chicago & North Western Railway Company and
the Public Utility Department of the City of Rochester covering the construction
of a. coal hopper under the track operated by the Railroad Company was read and
President Lemmon ordered that same be placed on file.
A statement signed by 13 residents stating that they did not object
to Mr. Roy Rocking constructing an addition to his present store building loca.tedI
at 16 -loth Street Northwest was read and President Lemmon referred same to the
Board of 'Zoning.
A petition for the construction of a sanitary sewer on 4th Avenue
Southeast in front of Lots 7, 10 and 11 in Block 9, Irelands Addition was read
and President Lemmon referred same to the Sewer Committee and the City Engineer.
A proposed program for expansion of Field Training facilities for Public
Health Students in Rochester. and Olmsted County was read and ordered placed on
file.
The recommendation of the Street & Alley Committee that the contract
for the furnishing of two Industrial Wheel Tractors with snow plows be awarded to
the low bidder for the sum of $4316.00 was read and upon motion by Yaeger, second)
by Kjerner, the same was approved and ordered placed on file.
Upon motion by Fryer, second by Kennedy, the City Clerk was authorized
to return the certified checks of the unsuccessful bidders.for tractors.
The recommendation of the Street &.Alley Committee that a sidewalk
be constructed on the west side of 131 Avenue Southeast from 2nd Street South
280 feet wa.s.rea.d and upon motion by McQuillan, second by Yaeger, the recommendati
was approved and the Cfty Engineer was instructed .to prepare plans.
The recommendation of the Sewer Committee that a relief. sanitary sewer
be extended south from loth Street Southeast at about llth Avenue to provide
effective sanitary drainage for the area lying south of 10th. Street Southeast was
read and the same was ordered placed on file.
The City Engineer's estimate of cost in the amount of $1.15 per front
(foot for constructing a sidewalk on the west side of 132 Avenue Southeast from
2nd Street South 280 feet was read and the same. wa.s ordered placed on file.
The City Engineer's estimate of cost for the construction of a. combined
curb and gutter and concrete driveways on 5th Avenue Southeast from 12th to 13th
Streets Southeast was read and President Lemmon ordered that the same be placed
on file.
The recommendation of the Chief of Police that the taxicab license
issued to Howard McGoon be revoked was read and upon motion by Kennedy, second by
Fryer, the recommendation was approved and the.license was revoked.

The City Engineer's trial balance for the month of July, 1945 was read

and the same was ordered placed on file.
A statement of receipts and disbursements in the Park Improvement Fund
for the month of July, 1945 was read and the same was ordered placed on file.
�i The reports of the Clerk of the Municipal Court for the week ended
August 11, 1945 showing total criminal fines and costs collected $271.50, civil I'
fees received, $.50, and conciliation court fees $1.50; and for the week ended

August 18, 1945 showing total criminal fines and costs collected $2D9.00, civil �.

been previously approved by the City Attorney, President Lemmon ordered that the

The applications of Alton Rittenhouse and Edward Holst for Journeyman
(Electricians License were each read and upon motion by McQuillan, second by
'Narveson, the licenses were granted.
The application of E. A. Swanson for a House Movers License was read

the bond was approved, the surety thereon accepted and it was ordered that the
same be placed on file.
Alderman Fryer introduced a resolution authorizing the Mayor and City
Clerk to execute a contract between the Chicago & Northwestern Railway Company
and the Public Utility Department of the City of Rochester to construct a coal
hopper on the premises of the Railroad Company for the use of the .said Public
Utility Department, which was rea.d.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced the following resolution which was read:
"Be it and it is hereby resolved by the Common Council
of the City of Rochester that a -id be accepted from the
Kellogg Foundation of Battle Creek; Michigan, for the purpose
of extending the public health services in the City of
Rochester to that the public will be better served, and so
that better training facilities for public health students
will be available.
Be it further resolved, that for a trial period of one
year, beginning September 1, 1945, subject to the approval
of the County Board of Olmsted County, the County Public
Health Nursing Service be merged with the Rochester City
Public Health Nursing Service, so that both may work together
as one unit under a trained and experienced Director of
Public Health Nursing, and that County and City Nurses for
this purpose have their central headquarters and offices
in one place.
Be it further resolved, that nothing in the foregoing
shall affect the duties and responsibilities of Boards or
Committees as constituted at present.
Be it Further Resolved, that nothing in this resolution
shall commit the Common Council to any additional expenditure
of tax funds above that already authorized and approved."
Upon motion by Mcquillan, second by Narveson, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution accepting the bid of George T.
Ryan Company for two industrial wheel tractors with snow plow attachments, which
was read.
Upon motion by.Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution ordering bids for the
construction of a curb and gutter on 5th Avenue Southeast from 12th to 13th Street
Southeast, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $435.56 from the

Alderman Mcquillan introduced a resolution appropriating $652.46 from
the General Fund and ordering payment made to Union Asphalts & Roadoils, Inc.
for cutback asphalt, which was read.
Upon motion by Kennedy, second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $393.75 from the,
General Fund and ordering payment made to L. M. Feller Company for crane rental,
which was read.

Upon motion by Fryer, second by Yaeger, that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Fryer stated that there were a. number of places in the City of
Rochester where the view for those driving cars was obstructed by shrubbery,
hedges and trees which were not trimmed high enough a.nd upon motion by Fryer,
second by Kennedy., it was recommended that the Building Inspector make a survey
of these conditions and employ men to do the necessary trimming.
Specifications for a new aerial truck for the fire department were
presented and upon motion by McQuillan, second by Yaeger, the City Clerk was
instructed.to advertise for bids to be opened at 2:00 o'clock P.M. on October 1,
19 z5.
Upon motion by Kennedy, second by Narveson, the action of the Common
Council granting a taxi cab license to Frederic Berg was rescinded.
Upon motion by Narveson, second by Kennedy, the City Clerk was
authorized to return the fee of Fred W. Oesterreich for a "On Sale" Liquor
license and also the surety bond presented with the application.
The matter of operating gasoline filling stations, tank wagons, and
distributing gasoline within the City limits was discussed and.upon motion by
Kennedy, second by Fryer, the City Attorney was instructed to draft an ordinance
regulating the sale of gasoline within the City limits, the parking of gasoline
tank trucks and the delivery of gasoline within the City.
Upon motion by Yaeger, second by Fryer, the meeting was adjourned
until 7:30 o'clock P.M. on August 27, 1945-
