Minutes of a regular meeting of the Common Council of the City of

President Lemmon called the meeting to order at 2:OO o'clock P.M., the

President Lemmon stated this as being the time and place set for a

hearing on the construction of a curb and gutter on 92 Street Southeast from the
Chicago Great Western Railway to lst Avenue Southeast and along the west side of
I'lst Avenue Southeast from 92 Street Southeast to loth Street Southeast. There
Iwas no one present wishing to be heard.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the construction of a curb and gutter on 5th

i'of C. M. Boutelle in the amount of $2054.75 was read and the same was referred '

to the Sewer Committee, the Water Committee, and the City Engineer.

I' Mr. Francis H. Underwood presented a proposed layout of a plat South
lof llth Street Southwest and upon motion by Kjerner, second by Fryer, the same
was referred to the City Engineer for survey and recommendation.
A notice by St. Francis Rectory that in accordance with H. F. Bill 1303i'
of the 54th, Session of the Minnesota Legislature, the Men's Club of St. Francis

Church would hold a series of Bingo Parties to be held on Tuesday evenings in the!
I
dining hall of the church beginning on October 2, 1945 was read and ordered
placed on file.
The following communicatio4 from Toltz,'King and Day, Engineers and
lArchitects, was read and the same was ordered placed on file:
"At your request we have investigated the possibility
of locating the sewage disposal plant on the west side of
the river about a half mile below Site "A". This site
has been designated Site "C" on the plans the writer left
with you on Monday.
It is our judgement that the plant can be economically
constructed on this site provided the first stage units
are located on the west side of the road. Such a plant
location will give an excellent layout that can be land-
scaped to give a very pleasing appearance. This site
compares very favorably with the other sites.
While an increase in construction cost for the sewer
will -result at this location, it has advantages such as �
ready access to roads and powers lines. We can see no
objection to the use of this site for the plant, and the
small added cost for the sewer to this site would
certainly be a. good investment in the event the City
!, should grow in this direction.

. The following communication from the State Board of Health, Division of
Sanitation, was read and the same was ordered placed on file;
City Council

Rochester, Minnesota
Gentlemen;
We have received preliminary plans from Toltz, King
and Day, Inc., your consulting erdneers, showing an additional
site for the proposed sewage -treatment -plant at Rochester.
On the plans this site is referred to as site "C"
and is situated on the west side of the Zumbro River approxi-
mately one -and -three -fifths miles north of the present sewage -
treatment plant. As you will recall, site "C" as .shown on the
preliminary plans was investigated by Mr. S. P. Kingston, Public
Health Engineer with this Department, and he discussed this
investigation with your Council at a meeting held on August 27.
Site "C" has the advantage over sites "A" and "B" in that
it is farther away from the present city limits and would allow
for the future expansion of Rochester. It is our opinion that
site "C" can be developted in a satisfactory manner and we
would have no. -objection to the construction of the proposed
sewage treatment plant on this site."

A copy of a letter addressed to Mr. Lee Nelson, Superintendent of
Utilities, from the State of Minnesota, Department of Health, stating that they
did not object to a new well being located in Central Park, was read and. the same
was ordered placed on file.
A notice from the League of Minnesota, Municipalities of a three day
Institute on Environmental Sanitation. to be held.at the University Center for
Continuation Study on September 17, 18, and 19, 1945 was read and the same was
ordered placed on file.
A petition signed by Addie Van Schaick, Mrs. Lottie Moorhead and William
Moorhead to have the east half (E,-�) of the Northeast quarter (NE4) of Block No.
seventy nine (79) of the Original Plat of the town, now city, of Rochester, and
also all that part of Lot No. sixty five (65) in the State Plat of Section No.
thirty six (36) in Township No. one hundred seven (107) North of Range No.,
fourteen (14) West, which lies North of the South line (if extended) of the North
half (N2) of Block No. seventy nine (79) of the Original Plat of, the town, now
city, of Rochester, in the County of Olmsted and State of Minnesota, changed from
esidential to industrial zone was read and President Lemmon..r.eferred same to the
oard of Zoning.
The petition of Mrs. David Dee to have the property located at 512 -
12th St. S. E. changed from residential to commercial zone was read and President
,emmon referred same to the Board of Zoning.
A protest against changing the zoning of the property located at 1208-

commercial zone was read and the same was referred to the Board of Zoning.

A petition by Kris Nielson for the construction of a sanitary sewer and'k

watermain in llth Street N: W. from 4th Avenue N. W. to Cascade Creek was read
and the same was referred to the Street & Alley Committee, the Water Committee,
the Sewer Committee, and the City Engineer.

The appointment of Mrs. Ella Richter as second stenographer and clerk
of registration in the City Clerl�:'s office was read and upon motion by Fryer,
second by iJarveson, the same was approved.
Mr. H,yer, representing the LaFrance Company, appeared before the
Council and recommended that the specifications for the new aerial truck be
changed so as to permit contractors figuring either four or six wheel trucks and
either 85 or 100 foot aerials. Upon motion by 1"cQuillan, second by Kjerner, the

(specifications which were previously presented for the aerial truck were amended
i
to include the above recommended changes.
The recommendationcf the Sewer Committee that a sanitary sewer be not

constructed on loth Street Southeast from 9th Avenue to llth Avenue Southeast, was

read and the same was ordered placed on file.
The recommendations of the Sewer Committee and the Water Committee that

a sanitary sewer and waterma.in be constructed on 4th Avenue Southeast between
�13th and 14th Streets were each read and upon motion by Fryer, second by Kjerner,�

ithe reports were accepted and ordered placed on file.
II The report of the Clerk of the Municipal Court for the week ended
!September 1, 1945 showing total criminal fines and costs collected $159.00, civil,
i
fees received $3.35, and conciliation court fees $.50 was read and having- been
previously approved by the City Attorney, President Lemmon ordered that the same i!
��be placed on file.

II The report of the Building and Plumbing Inspector showing building
I'permits issued $111.00 and plumbing permits issued $55.50 and the report of the
!Electrical Inspector showing electrical permits issued $55.00, were each read and,'
President Lemmon referred same to the Finance Committee.

The application of the Minnesota. Amusement Company for a license to
operate a theatre at 222-224 South Broadway was read and upon motion by Narveson,
second by McQuillan, the license was granted. -
The application of Mrs. Raymond Giese for a license to sell cigarettes

was read and uponmotion by Kjerner, second by McQuillan, the license was granted.
The application of Mrs. Raymond Giese for license to sell soft drinks
was read and upon motion by McQuillan, second by Yaeger, the license was granted.
The application of A. L. Fritsch for transfer of 3.2 beer "On Sale'
license No. 572 and "Off Sale" license No. 951 to William J. Murphy and also his
applications for soft drink and cigarettes licenses were again considered by the,
Council and upon motion by Narveson, second by Fryer, the same were granted subjec
• to the approval of the License Committee and the Chief of Police, the said
committee having power to act.
The application of Louis Golod for transfer of "On Sale" Liquor license
�d to Ambrose Huberty and also his application for a soft drink license were each
read and upon motion by Narveson, second by Kennedy, the same were granted subject
to the approval of the License Committee and the Chief of Police, the said Committ
having power to act.
Liability and Automobile Property Damage Insurance Policy No. 3774
covering buses operated by the Rochester Bus Line, Inc. was read and unon motion
by Kjerner, second by Fryer, the same was ordered placed on file.
Alderman Fryer introduced a resolution appropriating $210.13 from the
General Fund and ordering payment made to Chicago Great Western Ry. Company for
weight on cutback asphalt, which was read.
Upon motion by Narveson, second.b,y McQuillan, that the said resolution b
.dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $105.71 from
the General Fund and $221.13 from the Street & Alley Fund and ordering payment
made to Union Asphalts & Roadoils, Inc. for cutback asphalt, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
• adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman '"cquillan introduced a. resolution appropriating
$205.25 from
the General Fund and ordering payment made to P. F. Donovan for weed inspector's
salary, which was read.

Upon motion by Kennedy, second by Narveson, that the said resolution be
dopted as read, and.all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $6,200.00 from -the
I. R.. Fund and ordering payment made to Carlisle G. Fraser for the construction
of a waterma.in on 3rd Avenue Northwest, which was read.

Alderman Ivarveson introduced a resolution accepting the bid of C. M.
Boutel.le for the construction of a curb and gutter on 5th Avenue Southeast from j
� 12th to 13th Street Southeast, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed, and adopted.
Alderman Yaeger introduced a resolution ordering a hearing on the
construction of a sanitary sewer and waterma.in on Fourth Avenue Southeast from I'

1,'13th Street to 14th Street Southeast, which was read.
Upon motion by-Warveson, second by McQuillan, that the said resolution

be adopted as read, and all voting in favor thereof, President Lemmon declared the

isaid resolution duly passed and adopted.
An Ordinance entitled, "An Ordinance Providing for the Licensing,

,Supervision, Inspection, and Enforcement of Heating, Air Conditioning, and i
�,V,ntilating, in the City of Rochester, Minnesota," was given its second reading.

An Ordinance entitled, "An Ordinance amending an Ordinance entitled,
,an Ordinance to preserve the Public Health by regulating the storing and handlings

foodstuff intended for human consumption, offered for sale within the City of
•lof
jRochester, and providing penalties for the violation thereof," was given its
second reading.

Maycr Grassle announced the appointment of Miss Muriel Hansen as his
private secretary and upon motion by Yaeger, second by Narveson, the appointment
was approved.
Mayor Gra$le stated that the shortage of housing in Rochester was
t me
becoming a serious matter and recommended that steps be taken at this to relieve
the condition if possible.: Upon motion by McQuillan, second by Fryer, the Mayor
was authorized to confer with housing authorities in regard to getting additional
permits for the construction of homes or other housing units in the City.
The matter of keeping Mr. H. M. Persons on the City payroll at this
time was brought up by Alderman McQuillan and the matter was referred to the Sewe:
Committee to make an investigation to determine the amount of sick leave or other
leave that might be due Mr. Persons at this time.
Alderman Narveson asked if any further plans had been made to station
a policeman on North Broadway where children are crossing to Northrop School.
Chief of Police, H. N. Tompkins, stated that up to the present time he had been
unable to employ a special policeman for that location. Also the matter of a
bus run around 14th Street Northeast was discussed and the matter was referred
to the Police Committee and.the Chief of Police to make a study of the proposed
run and to confer with Mr. Trenholm as to whether or not it would be feasible to
start a trial run.
Alderman Yaeger stated that the Fire Chief had recommended the
installation of a watermain.and fire hydrant in the vicinity of the new Rochester
