City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City on September 19, 1945• I. President Lemmon called the meeting toorder at 7:30 o'clock P.M., the i following members being present: Lemmon, Fryer, Kennedy, Kjerner, McQuillan, Narveson, and Yaeger. Absent: None. Upon motion by Kjerner, second by Yaeger, the minutes of the meetings of September Lth and 17th, 1945 were approved. i • President Lemmon stated this as being the time and place set for a � P hearing on the construction of sanitary sewer and watermain in 4th Avenue S. E. I between 13th and 14th Streets S. E. There was no one present wishing to be heard: i, A communication from the Chamber of Commerce suggesting that proposals i for the erection of Christmas street lighting be taken in time for the completion of the said lighting by November 23, 1945 was read. Upon motion by Fryer, second!,.' i� by McQuillan, the Lighting Committee and the.Electrical Ins-ector together with I, t the Chamber of Commerce were instructed to prepare plans and specifications for j street lighting. A recommendation by Samuel P. Allen, Attorney, representing Alfred Larson, I; owner of Lot 4, Block 5, in Ireland's First Addition that 12th Street Southeast j I be made commercial zone from Broadway east to the City limits was read and President Lemmon referred same to the Board of Zoning. A petition by Lloyd W. Hemstock that Lot 2, Block 2, of D. P. Madden' s Addition to the City of Rochester be zoned as commercial was read and President �Lemmon referred same to the Board of Zoning. A petition by LeRoy Porter, Mrs. H. E. Lipscomb, Nellie Quinlan, H. E. Lipscomb, Edd Smith, Ethel Smith and Henry J. Giese that 2nd St. N. E. which is now a dead end street be opened to either 16th or 17th Avenue Northeast, was read and upon motion by Kennedy, second by Kjerner, the same was referred to the • Street & Alley Committee and the City Engineer. A petition to have the South z of Lots 7 and 9 and the SEZ of Lot 6, and the north 75 ft. of Lots 7 and 9, all in Block 83 of I Moe and Olds Addition zoned as commercial was read and upon motion by Kennedy, second by Fryer, the same was referred to the Board of Zoning. I� A petition for the vacation of a portion of the public alley in Block 19, i in Northern Addition was read and upon motion by Fryer, second by Kennedy, the !! ii City Clerk was authorized to publish notices of the closing �i of the said alley. The following resolution adopted by the Public Utility Board was read and the same was ordered placed on file: "Be it and it is hereby resolved by th-e Public Utility Board of the City.of Rochester, Minnesota that an additional position of 'Assistant Chief Engineer' be established and that the salary for the said position be TWENTY SEVEN HUNDRED SIXTY DOLLARS ($2760.00)-per year, and Be it and it is hereby further resolved by the said Board that the Hon. Common Council be and is hereby requested to authorize this action." • Recommenda.tions by the Rochester Plumbing and Heating Co., Maass & McAndrew Company, and the United Association of Journeyman '.lumbers that an office of City Plumbing Inspector be created were each read and upon motion by McQuillan, second by Kennedy, the City Attorney was instructed to draft an ordinance creating n office to be known as Plumbing and Heating Inspector. A copy of a notice to the Police Department Personnel by 'the Rochester Police Civil Service Commission that Assistant Chief, A. 11. Nelson will act as Chief of Police with full power until a. Chief of the Department is appointed, was read and the same was ordered placed on file. The Mayor's emergency order given to the City Clerk for the purchase of pproximately 9000 gallons of gasoline was read and upon motion -by Kjerner, second 1y Narveson, the same,wa.s approved and ordered placed on file. The recommendation of the Board of Zoning that Mr. Roy Hocking be ermitted to construct an addition to his store building was read and upon motion y Fryer, second by Narveson, the recommendation was approved and the Building nspector was instructed to issue a building,permit. The report of the City Engineer that sanitary sewers on 7th Street S. E. 3etween 12th and 13th Avenue Southeast and 5th Street Northwest between 9th Avenue land llth Avenue Northwest, that watermains on 7th Street Southeast between 12th • venue and 13th Avenue Southeast, 5th Street Northwest between 9th and lltr Ave. W. and 3rd Avenue Northwest between 14th Street to 1500 feet North, have now beer. completed, also that the grading of 5th Street Northwest between 9th venue and llth Avenue Northwest had been completed by the Engineer's Department end the sewer syphon across Cascade Creek was now finished, was read. He further eported that the channel change of Cascade Creek had been completed with the �xception of trimming the slopes and banks and rip -rapping, which will be finished this fall. President Lemmon ordered that the same be placed on file. The request of the Mayo Properties Association that the following mprovements be made in Homestead Addition, street grading and gravel on Fifteenth venue Southeast from Fourth Street Southeast to DURAND COURT SOUTHEAST and in a.mon and Durand Courts east of Fifteenth Avenue Southeast and sewer and water in Durand Court Southeast and all courts and avenues north of this court, the cost of • 8 Record of Official .Troceedings of -,the Common .Council of the City of Rochester, Minnesota, ' S e-D t emb e r - 19 1949 • Y - i I 1 i of the said improvements to be paid by them with the understanding that the usual' �irebates for watermains will be made as the individual services are connected, was I II ;read and President Lemmon ordered that the same be placed on file. A notice by Irving L. Eckholdt, Judge of Municipal Court, accepting they I resignation of Miss Dorothy Henke, Clerk of Municipal Court, effective September $, 1945 and appointing Miss M. Harriet Beecher as Clerk of Municipal Court and Miss Carol Mowu as Deputy Clerk of Court, was read and upon motion by (McQuillan, second by Narveson, the same was approved and ordered placed on file. I� A notice by the League of Minnesota Municipalities of a series of Iregiona.l meetings to be held during September, 1945 was read and those wishing tojj I, attend were authorized to do so, The report of the Police Committee that they had met with George lTrenholm, A: H. Clemens, and Paul Colson in regard to making a trial run over 14th I Street Northeast was read and after discussing the same with the officials of they Bus Company, who explained that the service to those living Northwest would have I to be reduced if a run was made over 14th Street Northeast. Due to this fact the' Ili Commi ttee recommended that the trial run be not made at this time and upon motion j I, by Kennedy, second by Kjerner, the report was accepted. The request of the City Engineer that a position of Transit mar_ be established in the City Engineer's Department, that the salary be $225.00 per II,month and that Louis V. McGarry be appointed to fill the position was read and (President Lemmon ordered that the same be placed on file. I II The report of the City Weighmaster for the month of August, 1945 showin 1340 private loads weighed and receipts of $34.00 was read and President Lemmon referred same to the Finance Committee. t The report of expenditures from the City Engineer's Payroll for August, 1945 was read and President Lemmon ordered that the same be placed on file. The City Engineer's Trial Balance for the month of August, 1945 was read and President Lemmon ordered that the same be placed on file. The statement of expenditures and receipts in the Park Department for the month of August, 19L.-5 was read and President Lemmon ordered that the same be II ala.ced on file. - I i The reports of the Clerk of the Municipal Court for the week ended !September 8, 1945 showing total criminal fines and costs collected $607.00 and conciliation court fees $1.00 and for the week ended September 15, 1945 showing total criminal fines and costs collected $301.00, civil fees received $.25 and ;I conciliation court fees $1.75, were each read and having been previously approved, �I :by the City Attorney, President Lemmon ordered that the same be placed on file. �I I'. i I I 71 • 1 • 1 Fj L • Record of Official Proceedings of the Common Council of the City of Rochester, Minnesota, September, 19 .19 4 5 `- a�,2 9 1 1 • 1 • 1 The application of J. DeWitz for non -intoxicating malt liquor license "Off Sale" was read and upon motion by Yaeger, second by Narveson, the license was granted. The applications of J. DeWitz and A. M. Huberty for license to sell cigarettes were each read and upon motion by Fryer, second by Kjerner, the licensies were granted. The applications of Wm. Ewing and John D. Hanson for Drivers License were each read and upon motion by McQuillan, second by Narveson, the licenses wer granted. The application of John D. Mellor for Journeyman Electricians License was read and up.on motion by Yaeger, second by Fryer, the licenses were granted. The applications of LeRoy H. Winter and J. DeWitz for soft drink licenses were each read and upon motion by Kjerner, second by Yaeger, the license) were granted. The.license bonds of Hankee Heating Company in the sum of $1000.00 withi the St. Paul Mercury Indemnity Company as surety, Squires Electric Company in the sum of $1000.00 with the Fidelity and Casualty Company of New York as surety, and Ambrose Huberty in the sum of 83000.00 with the Western Surety Company as surety, were each read and upon motion by Fryer, second by McQuillan, the bonds were approved, the surety thereon accepted, and it was ordered that the same be placed on file. Alderman Fryer introduced a resolution granting a. public dance permit to Reynold Hanson, which was read. Upon motion by Yaeger, second by McQuillan, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $1289.30 from the General Fund, $625. 29 from the S & A Fund, $51.00 from the P.I.R. Fund and $130. 21 from the Sewer Fund and ordering payment made to the Street & Alley Fund for use of equipment and materials used out of stock during August, 1945, which was read. Upon motion by Kjerner, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, �resideit Lemmon declared the said resolution duly passed and adopted. 1 Alderman Kennedy introduced a. resolution appropriating $371.70 from the General Fund, $248. 18 from the S & A Fund and $38. 50 from the P.I.R. Fund and ordering payment made to Morse Brothers for sand and C. P. Run, which was read. Alderman Kennedy introduced a resolution appropriating $1039- 50 . from the Park Improvement Fund and $190.360 from the Lighting Fund'and ordering payment made to the Public Utility Department, which was read. Upon motion by Narveson, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a. resolution appropriating $405.10 from the Park Improvement Fund and ordering payment made to the Rochester Dairy Co. for I merchandise for Soldiers Field and Mayo Park Stand, which was read. it Upon motion by Kennedy, second by Narveson, that the said resolution be,1 I I' I; adopted as read, and all voting in favor thereof, President Lemmon declared the li i sa.id resolution duly passed and adopted. Alderman McQuillan introduced a. resolution appropriating $227.49 from �1 I I�the Park Improvement Fund and ordering payment made to Reynolds Wholesale Company ;for merchandise for concession stands, which was read. Upon motion by Yaeger, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman McQuillan introduced a resolution appropriating $595.42 from the General Fund and ordering payment made to Mayo Properties Association for unearned premium fire and extended coverage on Northern hotel and Old Mill Property, which was read. I' Upon motion by Kjerner, second by Kennedy, that the said resolution be (,adopted as read, and all voting in favor thereof, President Lemmon declared the ('said resolution duly passed and adopted. Alderman larveson introduced a resolution approving a resolution by the Public Utility Board establishing an -addition al position of "Assist2nt Chief , Engineer° in the Public Utility Department, which was read. Upon motion by Kennedy, second by Fryer, that the said resolution be j adopted as read, and all v.oting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution ordering plans and specificati for the construction -of a sanitary sewer and-watermain on 4th Avenue -Southeast between 13th and 14th Streets -S. E. , which was read. Upon motion by Kjerner; second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Narveson introduced -a resolution adopting plans and profile and specifications and ordering a second hearing on the construction of a sa.ni-tax sewer and watermain in 4th Avenue S. E. bets-.een lath and 14th Streets S. E., wh-i was .rea.d. Upon motion by Kjerner, second by Fryer, that the said resolution be a.dop.ted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a, resolution appropriating $1098.06 from the Sewage Disposal Plant Fund and ordering payment made to the General Fund to close out balance in the Sewage Disposal Plant Construction Fund, which was read. Upon motion by Yaeger, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution ordering a, hearing on the con- struction of a.•sanitary sewer and watermain on Sth Avenue Northwest -from llth Street Northwest to loth Street Northwest, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said -resolution duly passed and adopted. Alderman Tenn-edy introduced a resolution fixing the salary for a trans! man in the City Engineer's Office at $225.00 per month, which was read. Upon motion by Fryer, second by Kennedy,*that the said resolution be adopted as read, and -all voting in favor thereof-, President Lemmon declared the said resolution duly passed and adopted. Grassle, a motion,was made by Kjerner, second by Fryer, instructing the City Clerk and the_ City Attorney to draft a. resoalution in memory of the late Harry N. Tompkins and .that the resolutic be made a. part of the permanent records cf the City and a copy be delivered to Mrs. Tompkins. Mayor Gra.ssle recommended that a joint meeting of the Common Council, the Zoning Board, the Public Utility Board, and. the heads of the various departments be held for the purpose of making a study of zoning rroblems in the City.. A motion was made by Fryer, second by Kjerner, and all voting in favor thereof, that a joint meeting as recommended by the Mayor be held at 7:30 o'clock P.M. on Tuesday, September 25, 1945. Alderman Kennedy brought up the matter of extending 132 Avenue and 14th Avenue Southeast to 3rd Street Southeast and the matter was referred to the Street & Alley Committee and the City Engineer for survey and report at the next meeting. Upon motion by Fryer, second by Yaeger, the meeting was adjourned. City Clerk EJ
