Minutes of an adjourned regular meeting of the Common Council of the (City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on December 19, 1945. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being.present: President Lemmon, Aldermen Fryer, Kennedy, I, Kjerner, Mcqui llar_, Narveson, and Yaeger. Absent: None. Upon motion by Kjerner, seconded by Yaeger, the minutes of the meeting (jof December 3, 1945 were approved. h President Lemmon stated this as being the time and place set for the II � !'first hearing onthe construction of a sanitary sewer and watermain in Eighth Avenue Northwest from Eleventh Street Northwest to Fourteenth Street Northwest [and in Twelfth Street Northwest from Seventh Avenue Northwest to Eighth Avenue iiNorthwest. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the I, i, first hearing on the grading of Twelfth Street Northwest from Seventh Avenue Northwest to Eighth Avenue Northwest. as to the cost of the proposed grading. Pair. Earl Cooke was present and inquired President Lemmon stated this as being the time and place set for the second hearing on the construction of a sanitary sewer and watermain to serve Lots 2 and 3, Block 6 and Lots 10 and 11, Block 5, Sunnyside Addition on Ter_ and one-half Street Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for re- ceiving bids for the grading and construction of a sanitary sewer and watermain i in Twelfth Avenue Southeast from Eighth Street Southeast .to 246 feet South. The ,bid of Carlisle G. Fraser in the amount of $2,753.50 was received and President Lemmon referred same to the Street and Alley Committee, the Sewer Committee, Water Committee, and the City Engineer for tabulation and recommendation. II' Mr. James T. Spillane, President of the Charter Commission, stated that I a draft of the charter had been presented to Mayor Paul A. Grassle and recommended i i !that the Common Council submit the same to the voters of the City at a special r. !election as soon as possible. Mayor Grassle then read a communication from the ,;Charter Commission and presented a draft of the proposed charter to the Common Council. A motion was made by Fryer, seconded by Yaeger and all voting in favor I ,,thereof except Mc0uillan who voted "no" that the report and recommendation be II accepted. Mr. Kenneth M. McGhee presented two plats of lands in the City of Rochester to be known as Lampman's Re -Plat, Outlot 1, Manley's Subdivision and i ,,Fratzke's 1st Subdivision. President Lemmon referred same to the Public Grounds "Committee. I� Mr, George C. President Lemmon referred the matter to the License Committee. The request of Ravi C. McKenny to reopen_ a filling station operated by imself previous to entering the service in February, 1942, the said filling stati+ eing located at th-e intersection of Twelfth Street and Seventh Avenue Southeast as read. Upon_ motion by Fryer, seconded by Kennedy, the matter was referred to tl oard of Zoning. The following copy of a resolution adopted by the Public Utility Board Dn December 12, 1945 was read: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Honorable Common Council of the said City be and is hereby requested to authorize the said Board to, enter into a contract with the Burroughs Adding Machine Company for the furnishing, in accordance with specifications, of ONE BURROUGHS STYLE 30-17-00 Electrically Operated Public Utility Billing Machine, the amount of said contract to be TWO THOUSAND NINE HUNDRED SEVEN DOLLARS AND FORTY FIVE CENTS ($2, 907.45) and the said Burroughs Adding Machine Company being the lowest responsible bidder.1' Th,e appointment by Garnet Spring, Bui ldi i�.g Inspector, of Harvey Wood}.iouse .s Heating Contractor and Neil Adams as Heating Engineer to serve on the investi- sating Committee as required by Ordinance No. 629 was read. Upon motion by Kennedy econded by Kjerner, the appointments were approved. The claim of Mrs. Anna Thomas in the amount of $10,000.00 for injuries ustained was read. President Lemmon referred the same to the City Attorney. A communication from Julian E. Morton, Attorney representing Mr. A. F. Flufenthi.e offering to sell to the City _of Rochester the South 109 feet of the Soutl st quarter of Lot 13, Auditor's Plat "A" for the sum of $1,300.00, was read and rdered placed on file. The recommendation of the Public Grounds Committee that the following of - ers be made for real estate required for the opening of Fourteenth Avenue South- ast to Fourth Street Southeast and Thirteen and one-half Avenue Southeast to Thre( ncl one-half Street Southeast was read: A_. Upon motion by Kennedy, seconded by McQuillan, the reports were accepted and ordered placed on I file. The recommendation of the Street and Alley Committee that a plat to be known as °Lampman's Re -Plat of Outlot 1 and Block 14, Manley's Subdivision° lying! The -applications of Waters Conley Company Employees and H. H. Hibbing for license to sell cigarettes were each read and upon motion by Yaeger, seconded by Narveson,-the licenses were granted. The application_ of John R. Kiefer for Journeyman Electrician's License was read and upon motion by Kjerner, seconded by Narveson, the license was granted. Milostan for Hot Water and Steam Heating Con- tractor's License was read and upon motion by Yaeger, seconded by Kennedy, the license was granted. The applications of Robert W. Langton and Harold R. Rahbain for Journe man Plumbe,r's license were read and upon motion by Fryer, seconded by Narveson, the licenses were granted. The applications of Carlisle G. Fraser and Kris Nielson for license to connect with sewers and drains were read and upon motion by Narveson, seconded by Kjerner, the licenses were granted. The applications for licenses to sell soft drinks of Water Conley Comp ployees and H. H. Hibbing were each read and upon motion by Narveson, seconded Yaeger, the licenses were granted. The application of the Yellow Cab Company for transfer of License No. 17 rom a five passenger Cadillac Sedan, License 206-095 to a 1940 five passenger uick, License 19-460; License No. 25 from a 1937 five passenger LaSalle Sedan, icer_se 216-075 to a 1940 seven passenger Brick 'Sedan, License 100; and License o. 31 from a 1937 five passenger LaSalle Sedan_, License 216-061 to a 1941 five pal enger Pontiac Sedan, License 215-633 were each read and upon motion by Kjerner, econded by Mcquillan, the transfers were granted. Mayor Grassle read a letter expressing the appreciation of the army er- ice Forces, 7th Service Command, for the services of Mr. roil! J. The same was ordered placed on file. A letter from the War Department, Office of the Division Engineer, 206 South Nineteenth Street, Omaha., Nebraska transmitting a lease for space in the old library building at Rochester was read and upon motion by Kennedy, seconded iby Yaeger, the same v.as referred to the Public Grounds Committee with the power I II' to act. The report of the Police Committee, the Mayor, the City Attorney, and the acting Chief of Police that at the present time any cabs operated in the city I! shall be required to be equipped with taxi cab meters and upon motion by Kennedy,' seconded by McQuillan, the report was accepted and placed on file. Alderman Fryer introduced a resolution granting 14 public dance permits! to Sgt. George C. Ra.mme, rhich was read. Upon motion by Kennedy, seconded by Mcquillan, that the said resolution be adopted as read, all voting in favor there= of, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution authorizing the Public Utility (Board to enter into contract with the Burroughs Adding Machine Company for the I " i; ,purchase of a Burroughs Billing Machine, which was read. Upon motion by Yaeger, I (seconded by Narveson, that the said resolution be adopted as read, all voting in 'favor thereof, President Lemmon.declared the said resolution duly passed and adopted. I' Alderman Fryer introduced a resolution appropriating $10,591.06 from the ,General Fund and ordering payment made to the Public Health and Welfare Fund for the transfer of the tax settlement received in December, 1945, which was read. Alderman Fryer introduced a resolution appropriating $790.98 from the General Fund and ordering payment made to the Public Health and Welfare Fund for �tran'sfer of garbage collection assessments received from the County, which was I (read. Upon motion by Kennedy, seconded by Narveson, that the said resolution be adopted as read, all voting in favor thereof, President Lemmon declared the said (resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $332, 95 from the; General Fund, $783.72 from the Street and Alley Fund, and $229.75 from the Seaver I Fund and ordering payment made to the Street and Alley Fund for equipment rental, , which was read. Upon motion by Fryer, seconded by Kennedy, that the said r esolu tion be adopted as read, all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $20,419.04 from the Street and Alley Fund and ordering payment made to Carlisle G. Fraser for Estimate No. 2 on the construction of a sanitary sewer and watermain in Homestead Addition, which was read. Upon motion_ by Fryer, seconded by Kennedy, that the said resolution_ be adopted as read, all voting in favor thereof, President Lemmon • declared the said resolution duly passed and adopted. Alderman Kjerner.introduced a resolution_ appropriating $204.28 from the Sewer Fund and ordering payment made to the City of Rochester, P.I.R. Alderman Kjerner introduced a resolution appropriating $7,000.00 from the P.I.R. Fund and ordering payment made to the First National Bank of Rochester for January 1st, 1946 maturity of P.I.R. Upon motion by Fryer, seconded by TRcQuilian, that the said resolution be adopted as read, all voting in favor thereof, President Lemmon declared the said resolution duly passed nd adopted. Fund and ordering payment made to the First National Bank of Rochester for the .payment of January 1st, 1946 maturities of interest on P.I.R. Bonds, which was read. Alderman Yaeger introduced a resolution levying special assessments for ,the construction of a watermain on Third Avenue Northwest North of Fourteenth Street Northwest and rescinding a resoluticn adopted on December 3, 1945 levying a special !assessment for the construction of a watermain in Third Avenue Northwest, which was I; ,read. Alderman Yaeger introduced a resolution accepting the bid and pro- posal of Carlisle G. Fraser for furnishing of all labor, materials, equipment, etc., necessary for the grading and construction of a sanitary sewer and watermair, in Twelfth Avenue Southeast from Eighth Street Southeast to 246 feet South, which was read. Upon motion by Yaeger, seconded by Kennedy, -that the said resolution be adopted as read, all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution ordering the proposed amended charter filed in the.office of the City Clerk and that a special election be held in the several election districts in'the City of Rochester on Tuesday, January 29, 1946 between the hours of 9 A.M. and 7 P.M. for the purpose of sub- mitting the said proposed amended charter to the qualified electors of said city for their ratification_ or rejection, which was read. Upon motion by Kennedy, seconded by Fryer, that the said resolution be adopted as read, all voting in favor thereof except McQuillan who voted "nog', President Lemmon declared the said resolution duly passed and adopted.
