Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on January 30, 1946.
President Lemmon called the meeting to orderat 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
A protest signed by all of the owners of "Off Sale" liquor stores in
the City of Rochester against the granting of any more liquor licenses at this
time was read and President Lemmon referred same to the License Committee.
A petition for the construction of a sanitary sewer and watermain in
13th Avenue Northeast from loth Street Northeast to 14th Street Northeast was
read and the same was referred to the Water Committee and the Sewer Committee.
The financial report of the Firemen's Relief Association at Rochester,
Minnesota, for the year ended December 31, 1945, was read and upon motion by
Fryer, second by Yaeger, the same was accepted and ordered placed on file.
The report of the Clerk of the Municipal Court for the week ended
January 26, 1946 showing total criminal fines and costs collected $437.00, civil

fees received, $.60, conciliation court fees, $1.25, was read and having been
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file.
The application of Axel Smith for cigarette license was read and upon
motion by Yaeger, second by Kjerner, the license was granted.
The applications for Driver's License of Henry V. Poppi, Leon M. Ratch,
Al Tilford, Harold Sparks, Howard Koelsch, Audre M. Berg, Paul Swygman, Herbert R,
Dormady and Leo F. Van Allen were each read and upon motion by Kjerner, second by
Fryer, the licenses were granted.
The application of Charles H. Dornack for a JourneyMan Plumber's Licen
was read and upon motion by Yaeger, second by Fryer, the license was granted.
The application of Maass & McAndrew Company for a license to connect
with sewers and drains was read and upon motion by Fryer, second by McQuillan,
the said license was granted.
The surety bomd:o.f Harold M. Fitzpatrick in the sum of $500.00 with the
St. Paul Mercury Indemnity Company, Carl J. Bri ese in the sum of $500. 00 with the
St. Paul Mercury Indemnity Company, Maass & McAndrew Company in the sum of
$1000.00 with the National Surety Corporation were each read, and upon motion by,
McQuillan, second by Fryer, the bonds were approved, the surety thereon accepted,l!
and it was ordered that the same be placed on file.
Insurance policies No. LAC 901305 and No. LAC 78236 covering 39 cars
operated by the Yellow Cab Company the limits of liability being as follows:
for bodily injury, each person $25,000.00, each accident.$50,000.00 and for

property damage each accident $5000.00 was read and upon motion by Fryer, second)
by Yaeger, the same was approved and ordered placed on file.
AldermAh�Fryer.•introduced the following resolution which was read:
I� "Be it resolved by the Common Council of the City of Rochester:
That the following is a tabulated statement and list of the number of
votes cast for and against the proposed new Charter at the,Special Election held
on January 29th, 1946, in the City of Rochester, Minnesota, as determined by said
II Common Council on the canvass of the returns of said special election made the
30th day of January, 1946, and said statement is hereby declared to show the
I'result of the said special election; said tabulated list and statement being as
follows:

1! Be it further resolved by the said Common Council: That the number of
�i persons present and voting at said Special Election on the proposed new Charter is
i as follows: "Yes", 1003; "No", 2990.
The number of voters voting in favor of the said proposed new Charter
and against the said proposed new Charter are as shown on the above statement and
!that the said new proposed Charter was not ratified by said voters as shown by
the returns of said election. above stated.
Be it further resolved by said Common Council: That the whole number of
persons present and voting at said election on the proposed new Charter was 3993
and that it required 2224 or 4/7 of those who voted at said election to ratify
same, and that there were less than 4/7 of said total number of votes in favor of
the adoption and ratification of said proposed new Charter, and that the said
(proposed new Charter did not receive the necessary four -sevenths of said total
votes and therefore said proposed new Charter was not ratified by the voters at
said election,"
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the '
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $27.20 from the
fteneral Fund, $2.00 from the Street & Alley Fund and $3,287.10 from the Lighting ,
Fund and ordering payment made to City of Rochester, Pub. Utilities, which was
,!read.
Upon motion by Yaeger, second by kennedy, that the said resolution be
;'adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Kjerner introduced a resolution appropriating $195.90 from
(the General Fund, $122.98 from the Street & Alley Fund and $17.83 from the Fire
!Protection 'Fund and ordering payment made to National Bushing & Parts for parts
and supplies, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mcquillan introduced a resolution appropriating $279.20 from
,:the General Fund and ordering payment made to City of Rochester, Public Utilities,

for steam heat for city hall, which was "read.
Upon motion by Yaeger, second by McQuillan, that the said resolution-bel
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Kjerner, the same -were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Mayor Grassle announced that he had just received word that the City of
Rochester would receive 26 housing units At-.A,nce and it would be necessary to

obtain a location for the same at once, also the City should plan to provide the
necessary utilities.
The matter of handling the units after the same had been received and
set up on a location was discussed and upon motion by Narveson,.second by 1`1cQuillan,
it was.recommended that the American Legion.be appointed to represent the City in
handling the housing units.

Uppn motion by Fryer, second by McQuillan, the matter of finding a site
,to set up the housing.units on was left in the.hands.of the Public Grounds.Committee
with power to act and if need be call a special meeting of the Common Council..
Upon motion by Fryer, second by Kennedy, the meeting was adjourned.
