Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City
on February 4, 1946.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, Mcquillan, Narveson, and Yaeger. Absent: None.
Upon motion by Kennedy, second by Kjerner, the minutes of the meetings
.of January 21, 1946 and January 30, 1946 were approved.
President Lemmon stated this as being the time and place set for a
hearing on.the vacation of the alley in Block 19, Northern Addition to the City of
Rochester, Minnesota. There was no on.e present wishing to be heard.
President Lemmon announced this as being the time and place.set for_
again receiving and opening bids. fo.r furnishing t.wo cars .for th.e Rochester Police
Department. The bid of the Universal Motors,, Inc. in the amount .of $2440.20 f.or
two 1946 Ford For.dor-Sedans less $1050..00.allowance for two used Mercury Sedans
was read and President _Lemmon referred the sam.e to the Police Committee and the
Chief of Police.
The recommendation of the Police -Committee and X= Acting Chief of Police,
A. M. Nels.on, that the _City purchase two 1946 Ford Sedans for use. in the Roc.hestex
Police Department was read and upon motion by Mcquillan, second by Kennedy, the
report was. accepted.
Mr. Ray Sellers presented a plat of _land to be known as Seller's Sub -
Division,, of part of Lot 50 of School Section 36, Rochester, Minnesota and upon
motion by Narveson, second by Mcquillan, the plat was accepted and the City C1_erk.
was authorized to execute the certificate showing the action of. the Common Counci
Mr. John J. Kerr presented a proposed plat .of a parcel of 11
land consisti.rg
of 26 lots immediately south of Fratzke's Sub -Division and upon,motion by Fryer,
second by Kjerner, the same was -referred to' the Street & Alley Committee and the
City Engineer and the Board of Park Commissioners.
The petition of David E. Dee and Mrs. David Dee to build an addition fox
a grease rack to their present building located a't 517 - 12th Street Southeast and
also a statement of acquiescence by residents in that location were each read and,
President Lemmon referred the same. to the Board of Zoning.
The petition of Nettie L. Henke to have Lot 6 in Block .35, Northern
Addition changed from residential to commercial zone and a. statement of acquiesces
were each read and President Lemmon referred the same -to the Board of Zoning.

d/b/a Peterson Bus Lire for a certificate of. convenience and necessity to be held

The resignation of Peter D. Claude as assistant superintendent of the
(Dumping Grounds was read and upon motion by Fryer, second by Kjerner, the same �.

A request by Room Registry Committee of the Y.W. C.A. that the Common

Rochester, was read and upon motion by Narveson, second by Kjerner,'the same was
preferred to the Fire Committee.

;that at ton Pickup Truck be purchased for the use of the Street & Alley Department
+was read and upon motion by Yaeger, second by Kjerner, the City Clerk was

was 7resented and upon motion by Kennedy, second by Yaeger, the same was ordered
,placed on file.
The report of the City Weighmaster for the month of January, 1946

'showing total receipts of $24.60 was read and President Lemmon referred the same

to the Finance Committee.
The report of the Clerk of the Municipal Court for the week ended

February 2, 1946 showing total criminal fines and costs collected $537.25, civil
(,fees received $2.00, and conciliation court fees $1.00, was read and having been
previously approved by the City Attorney, President Lemmon ordered that the same
,be placed on file.
The report of the Building and Plumbing Inspector for the month of

January, 1946 showing building permits issued $149.00 and plumbing permits issuedi
I1$161.00 and heating permits issued $19.00 and the report of the Electrical
Inspector showing electrical permits issued $20.00, were each read and President
Lemmon ordered that the same be placed on file.
The application of Clifford A. Aaby for a Journeyman Heating Workers and'
Steam Fitters' License was read and upon motion by Mcquillan, second by Yaeger,
,the license was granted.
The applications for Driver's License of Homer Strangeway, Julius J.
Feind, Orville Wallace, Edward P. Campion, Maurice E. Lawler, E. C. Lawler, Leo R.;
+Gifford, Glenn Bundy, Marvin M. Jenkins,, Paul C. .Smith, Wesley A. McAnally, Ralph
D. Vale, Joe Van Kirk, Jack W. Simmons, Arnold Brown, Leo J. Struif, William J.
Flynn, and Robert C. Chaffee were each read and upon motion by Kjerner, second by
Oarveson, the licenses were granted.
The following claims were read and upon motion by Yaeger, second by

'Kennedy, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Mayor Grassle stated that due to the death of Theodore H. Tollefson thel
office of City Treasurer was now vacant and recommended that the City Clerk be
appointed as acting City Treasurer for the balance of the fiscal year. Upon
motion by Fryer; second by Kennedy, F. R. .Finch, City Clerk was appointed as
Acting City Treasurer for the balance of the fiscal year.
A motion was made by Narveson, seconded by Yaeger, and all voting in
favor thereof, that the Mayor request the Public Examiner's to make an examination
of the City Treasurer's books to date of February 4, 1,946.
Alderman Fryer introduced a resolution appropriating $9,965.79 from the,
Street & Alley Fund and ordering payment made to Carlisle G. Fraser for payment
of Estimate No. 3 on Homestead Addition, which was read.
Upon motion by Yaeger, second by Narveson, that the said resolution be
adopted as read,.and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduded a resolution appropriating $739.80 from the
General Fund and ordering payment made to the Rochester Post Bulletin for

Alderman Yaeger introduced a resolution ordering the first hearing on
the construction of a sanitary sewer and watermain in Sth Street Southeast from
12th to 13th Avenue Southeast, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution ordering the first hearing of
the construction of a sanitary sewer and watermain in 13th Avenue -Northeast from
loth to 14th Street Northeast., which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Narveson introduced a resolution vacating the alley in Block 11,
Northern Addition to the City of Rochester, Minnesota, which was read.
Upon motion by Kjerner, second by 14cquillan, that the said resolution b,
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution requesting examination of the
books and records of the City of Rochester, Minnesota for and during the period
April 1, 1945 to March 318t, 1946 by the State Public Examiner, which was read.
Upon motion by Kennedy, second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution fixing the distribution of 10%
Utility Income payments, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution accepting the bid of UniversF
Motors, Inc. for two four door sedans in the amount of $1390.20, which was read.
Upon motion by Fryer, second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced the following resolution which was read;
"WHEREAS, Theodore H. Tollefson was duly elected by the
peoples of the City of Rochester as the Treasurer of said City
in the year 1935 and. was thereafter elected each year to the
office to which he gave loyal and faithful service.
WHEREAS, on Sunday, February 3, 1946 he was suddenly taken
from this life;
NOW THEREFORE BE IT RESOLVED, by the Common Council of the
City of Rochester,, Minnesota, on their own behalf and as
representatives of the citizens of the City, extend their most
sincere and heartfelt sympathy to his children; may you
understand the records of his efficiency and his understanding
it

of the public will always remain as permanent records of .

BE IT FURTHER RESOLVED, That this resolution become a
part of the permanent records of the City of Rochester,

Upon motion by Yaeger, second by Kjerner, that the said resolution be I'
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution resolution duly passed and adopted.

j Ordinances covering franchises to Harlan W. Briese and Kenneth H.
jKetchum doing business as the Service Cab Company in Rochester, Minnesota and 1,
the Yellow Cab Corporation of Rochester, Minnesota, were each given their first
(r eading.

An Ordinance entitled, "An Ordinance to regulate the transportation of
(Gasoline by trucks in the City of Rochester, Minnesota", was given its second
;reading.

Mr. Arthur Boie, of the Cooperative Oil Company, introduced Mr. Elwin E.
i
Ha.dlick, Secretary of the Northwest Petroleum Association, who protested parts of
;the ordinance as read. Mr. Boie also spoke for the petroleum dealers in the City
'of Rochester stating that the 15 dealers mentioned were opposed to the passage
of the Ordinance.
A motion was made by Kennedy, seconded by McQuillan, and all voting in
favor thereof, that the Mayor call an informal meeting of the Charter Commission
and the Common Council for Friday evening, February S, 1946.

Mayor Grassle announced that each regular holiday many requests were
received by him and at the City Clerk's office in regard to closing. President
Lemmon referred the matter to the Public Grounds Committee for investigation and

Mayor Grassle also announced the dates of the League Convention to be
held in Brainerd, Minnesota and recommended that those planning on attending make'

Jr'eserva.tions in advance.

I, The City Engineer stated that he now had the agreement forms covering a
jloan from the Federal Government for the expense of preparing plans and specifications
for the.new Sewage Disposal Plant and upon motion by Yaeger, second by Kennedy, the
Mayor, the City Clerk, and the City Engineer were authorized to execute the said
agreement.
A motion was made by Fryer, second by "cQuillan, and all voting in favor'!

thereof, that the Mayor and City Clerk draft a letter thanking the members of the

Charter Commission for their efforts in drawing the new proposed charter.
The application of Willard H. Knapp for the office of City Treasurer was!

Tucker to open a gasoline station at the corner of 12th Street Southeast and 6th
Avenue Southeast be granted but that no change be made in the zoning of the
property was read and upon motion by Fryer, second by Kjerner, the same was
approved.
A list of used radio equipment owned by the City of Rochester was sub-
mitted by the acting Chief of Police with his recommendation that the same be
sold to the highest bidder. A motion was made by Kjerner, seconded by Kennedy,
and all voting in favor thereof, instructing the City Clerk to advertise for bids
for the said radio equipment to be received on March 4, 1946 at 2:00 o'clock
P. M.
The following communication from the Minnesota State Board of Control,
Department of Public Health, was read and the same was ordered placed on file:
"Mr. J.T. Lemmon
President of City Council
Rochester, Minnesota i
Dear Sir:
We are informed that the proposal which would hermit the
financing of the proposed municipal sewage treatment plant by
revenue bonds was part of the new charter which failed to be
approved at the recent city election. The State Board of
Health has been seriously concerned for considerable time over
the inadequate sewage treatment facilities and the consequent
unsanitary condition of the Zumbro River below the City of
Rochester. This condition was called to the attention of the
city in a report of the State Board of Health entitled "REPORT
OF THE SANITARY SURVEY OF THE SOUTH BRANCH OF THE ZUMBRO RIVER
IN THE VICINITY OF ROCHESTER" in 1937.
jhis report showed that the Zumbro River entering the City of
Rochester was in a relatively clean condition as evidenced by
the chemical and bacteriological findings but from points below
the sewer outlet and into Lake Zumbro because of inadequate
sewage treatment the stream would be hazardous to the health
of those coming in contact with it.
It is appreciated that engineers have studied the situation.
However considerable time has elapsed and no construction has.
been started. We urge that your co#ncil consider other methods
of financing this work without delay so that this essential
project may be completed at the earliest possible date..
