Minutes of an adjourned regular meeting of the Common Council of the

!City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in
lisaid City on February 27, 1946.
President Lemmon called the meeting to order at 7:30 o1clock P. M., the
''following members being present: President Lemmon, Aldermen Fryer, Kjerner,
McQuillan, Narveson and Yaeger. Absent: Alderman Kennedy.
,I Upon motion by Kjerner, second by Fryer, the -minutes of the meeting of
(,February 4, 1946 were approved.
President Lemmon stated this as being the time and place set for the
first hearing on the construction of a sanitary sewer and-watermain in 13th Avenue
Northeast from loth Street Northeast to 14th Street Northeast. There was no one
present wishing to be heard.

"To the Honorable City Counctil of the City of Rochester
1! Rochester, Minnesota
Gentlemen:
The Mayo Properties Association intends to construct
approximately one hundred houses on the following described
property:
I' The west 470 feet of the NEi of Section 11 in
I, Township 106, North, Range 14, west, Olmsted
County Minnesota, subject to highway easements
along both .the north and the south boundaries
thereof.
Also a strip of land 75 feet in width lying over
and across that part of the NEJ of said Section 11
lying west of Trunk Highway No. 59, the centerline
of said strip being described as follows:
Beginning 470 feet east of the north west corner
of the SW4 of the NEJ of said Section 11 and
it running thence east for a distance of 575 feet
more or less to the west boundary of the right

of way of Trunk Highway No. 59.
j! Comprising in all 27.0 acres more or less ex-
clusive of existing highway right of way.
The Association will pay for all the necessary water,
sanitary sewer and storm sewers in the area, electric power
and street grading for this property designated on the attached
1 blue print consisting of approximately -twenty-seven acres.
Although the houses are of what is called pre -fabricated
construction to meet the present emergency, they will be located
on permanent basements with sewer and water connections made in
accordance with city specifications and regulations.
If city funds are not available for the needed extension of
trunk line, sewer and water mains, the Mayo Properties Association
will advance the funds necessary for such needed extension of
trunk line sewers to this area, upon the understanding that the
usual refund be made when connections are made with said trunk lines. '
It is the intention of the Association that this entire area
so described shall be brought into the City of Rochester as an I'
addition to the city, and we now petition that this area be
admitted as an addition to the City of Rochester.

If additional information regarding the survey or any other
question regarding this area is desired, we shall be pleased to
furnish such information and to appear before any committee of the
council or the council regarding this project.
In view of the fact that this property is leased from Doctor
Christopher Graham for ten years with an option to purchase at the
end of the ten-year period, and the Mayo Properties Association
Intends to exercise this option, we have obtained the approval of
Doctor Christopher Graham to, this petition for the admission -of
this area as a part of the City of Rochester.

Mr. A. J. Lobb, Secretary and Treasurer of the Mayo Properties Association,
also presented a preliminary layout of Subdivision of Graham Property in NEk
Section 11, Township 106 North, Range 14 West., President Lemmon stated that an
ordinance would be required to annex the said plat of land to the City of Rochester
and.further stated that the City Attorney would be requested to prepare the said
ordinance and present same at the meeting on March 4, 1946, if possible.
Mr. John J. Kerr was present at the meeting and presented a plat of land,
in the South Quarter Corner of Section 26, Township 107 North, Range 14 West, to be
known as"Indian Heights. Upon motion by McQuillan, second by Narveson, the plat
was accepted and the City Clerk was instructed to execute the certificate on said
plat showing the action of the Common Council and to have same filed with the
Register of Deeds.
A plat of land to be known as Fratzke's 2nd Subdivision of the City of
(Rochester, Minnesota, covering a plot of land east of llth Avenue Northeast and
South of 5th Street Northeast was presented to the Common Council. Upon motion
INarveson, second by Kjerner, the plat was accepted and the City Clerk was instruc&d
Ito execute the certificate showing the action of the Common Council and to have
said plat recorded with the Register of Deeds.
Mr. Emrold Thiem and Mr. Fred Sauer appeared before the Council and
asked as to whether or not it would be possible to get sewer and water to their
property in the Southeast area of the City of Rochester. Upon motion by Narveson,
second by McQuillan, the matter was referred to the Sewer and Water Committee and
the City Engineer.
A communication from Representative Walter Burdick stating that he had
orwarded to the Governor the resolution adopted by the Common Council in regard

to calling a special session of the Legislature for 'the purpose of considering a

,housing program and also a communication from the -Governor advising that a
special session of the Legislature would not be called at this time due to the
fact that the housing situation would be handled directly by Federal Authorities
land that no state legislation will be required by Minnesota communities, were each
read and ordered placed on file.

The petition of Raymond E. Karvel to change Lot 20, Block.5, Elm Park
,Subdivision from a residential to a commercial -zone was read and upon motion•by

Fryer, second by Yaeger, the same was referred to the Board of Zoning.
The requests of James J. Macken and Harry S. Stai for re -instatement as ;

,patrolmen in the Rochester Police Department were each read and upon motion by
!,Yaeger, second by Kjerner, the same were approved.
An announcement by G. Howard Spaeth, Commissioner of Taxation, of the i

three day assessor's school to be held at the University of Minnesota on March 4.

The request of Knute Olson, City Assessor, that he and his two deputies.

A communication from the Izaak Walton League urging that Silver Lake be'
dredged was read and the same was ordered placed on file.
The following communication was read:

Gentlemen:
At the regular monthly meeting of the Rochester and Olmsted
County Public Safety Council held Wednesday, February 20, the
following recommendations of the.Parking Committee were unanimously
adopted:
"That this Safety Council send a communication to the City
Council urging that the area in' the vicinity of the city warehouse
be developed for parking purposes, and, that area occupied'by the
warehouse building be ear -marked by the city government for eventual
development for parking purposes when other warehouse facilities
have been provided."
This recommendation of the Safety Council. is hereby
respectfully submitted.

We, the members of the Fire Committee, after investigation and
consultation with Chief Ginther, find that due to a shortage of
personnel in the Rochester Fire Department, it would be impossible

to make a monthly inspection of rooming houses in this city.
However, it would be possible to make quarterly inspections
of all rooming houses, and recommend that this be done in the
future. The State Inspector makes a yearly inspection, and
therefore, these five thorough inspections should lessen the
hazards of fires more effectively than more frequent routine
visits.
We recommend further, that fines be established for failure
to comply with requests of fire inspectors.

The recommendation of the Board of Zoning that Mr. & Mrs. David E. Dee
be permitted.to construct an enclosed grease rack at the'site of their present
filling station was read and upon motion by Fryer, second by Narveson, the same
was approved.
Upon motion by Fryer, second by Yaeger, the City Clerk was instructed to
request the various boards and departments to submit inventories of their equipment
and supplies as of March 1, 1946'.
The three following resolution adopted by the Public Utility Board were
each read and the same were ordered placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Hon. Common Council
of the said City be and is hereby requested to authorize the said
Board to enter into a contract with the Ellis Motor Company of this
City for the furnishing, in accordance with specifications of -
ONE - New 1946 Dodge Half Ton Pickup Truck
to be equipped as per their ;proposal; the total amount of said
contract to be ONE THOUSAND FORTY NINE DOLLARS ($1,049.00) less
an allowance of $200.00 for 'a 1939 Chevrolet Truck now 'the
property of the City Electric Department."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Hon. Common Council
of the said City be and is hereby requested to authorize the said
Board to enter into a contract with the American Cast Iron Pipe
Company, for the furnishing, in accordance with specifications,
of Ten Thousand (10,000) feet of 611, Class 150, Cast Iron Pipe
together with approximately 6870 pounds of fittings; the Drice
of said pipe to be $0.95 per foot and the price of fittings to
• be $0.07 per pound and the total amount of the said contract to
be NINE THOUSAND NINE HUNDRED EIGHTY DOLLARS AND NINETY CENTS
($9990.90), the said American Cast Iron Pipe Company being the
lowest responsible bidder. "
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Hon. Common Council
of ,the said City be and is hereby requested to authorize the said
Board to enter into a contract with Walter Bledsoe and Company for
the .furnishing, in accordance with specifications, of EIGHTEEN
THOUSAND t18,000) Tons of 11" Coal Screenings at a price of $2.15
per ton F.O.B. Mines making a total contract price of THIRTY EIGHT
THOUSAND SEVEN HUNDRED DOLLARS ($38, 700. 00) , and

the Hon. Common Council be further requested to authorize the
said Board to enter into a contract with the'Sa.hara Coal Company
for_ the furnishing of TWO THOUSAND (2,000) tons of I1" Coal Screenings
at a price of $2.25 per ton F.O.B. Mines, making a total contract
price of FOUR THOUSAND FIVE HUNDRED DOLLARS ($4,500.00)."

February 9, 1946 showing total criminal fines and costs collected $282.00 and
conciliation court fees $.50; for the week ended February 16,, 1946 showing

were each read and having been previously approved by the City Attorney, President,
Lemmon ordered that the same be placed on file.

Alderman Fryer introduced the following resolution which was read:
"Be it resolved by the Common Council of the City of Rochester, Minneso1
That the following is a tabulated statement of the number of votes cast
for each person at the Primary Election held on the 26th day of February, A. D.
1946, in the City of Rochester, Minnesota, as determined by said Common Council
on the canvass -of the returns of the said Primary Election made this 27th day of

Be it further resolved by the said Common Council:
That G. H. McCarthy and Edmund A. Zuehlke are hereby declared to be
candidates for City Treasurer of the City of Rochester, Minnesota, at the Charter
Election to be held March 12, 1946.
That August F. Dornack and S. Smith Fryer are hereby declared to be
candidates for Alderman of the First Ward of the -City of Rochester, Minnesota, at
the Charter Election to be held on March 12, 1946.
The City Clerk of said City is hereby instructed to cause the names of
the said persons to be printed as candidates for the respective offices upon the
official ballots at the coming Charter Election to be held March 12, 1946.1'

Alderman McQuillan introduced a resolution anpropriating_$599.26 from
the P. I. R. Fund and ordering payment made to Carlisle G. Fraser for estimate
No. 2 for construction of sewer and watermain in 12th Avenue Southeast from Sth
Street Southeast to 246 feet South, which was read.

Upon motion by Narveson, second by Yaeger, that the said resolution be!'

Alderman Narveson introduced a resolution appropriating $243.00 from
the General Fund, $1264..13 from the Street & Alley Fund and $12.50 from the Sewer

Alderman Narveson introduced a resolution appropriating $909.30 from

Alderman Narveson, introduced a resolution appropriating $478.07 ffom

Division for state gas tax and inspection fee on 2 transports of gas, which was

Upon motion by McQuillan, second by Fryer, that the said resolution be
adopted as read, and.all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger.introduced a resolution appropriating $956..85 from the
General Fund and ordering payment made to the Phillips Petroleum Company for two
transports of ge.soline, .which was read.
Upon motion by Fryer,.second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $623.36 from the
Park Improvement Fund, $127.60 from the Lighting Fund and ordering payment made
to City of Rochester, Public Utilities, which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, iresident Lemmon declared the
said resolution duly passed and adopted.
The following claims were read and upon motion by Yaeger, second by
Kjerner, the same were allowed and the Mayor and City Clerk w.ere authorized and
directed to draw -warrants on the City Treasurer and make payments accordingly:

Mayor Paul A. Grassle reported on a hearing of the Federal Power
Commission held in Chicago, which would give the said Commission power to regulat(
the use of'na.tural gas. The hearing was also attended by City Attorney Hunt and
other spokesmen from the City of Rochester.
Mr. Walter Fratzke appeared at the Council meeting and -inquired as - to
whether or 'not he would have to pay the entire assessment for a trunk' line sewer
made under Ordinance No. 396. He explained further that only a part of this line
could be used to serve lots in the new Fratzke's Addition. Upon motion by Yaeger,
second by Fryer, the matter was referred to the Sevier Committee and the City
Engineer for investigation and a, report.
Upon motion by Fryer, second by Yaeger, Mr. Garnet Spring, Building
Inspector, was authorized to attend a Plumbing School to be held at the Universi
of Minnesota on March 13, 1946.
President Lemmon stated that he was a member of the Minnesota League of
Municipalities Legislative Committee and that a, -.meeting of the said committee
would be -held in Minneapolis on March 2, 1946. Upon motion by Fryer, second by

The recommendation of the Finance Committee that the Rochester Fire. r
Relief Association make a loan of $1500.00 with interest at.. the rate of 4%, to.
Gordon Benson on his property located at 942 Seventh Avenue Southeast and also.
a recommendation that the Rochester Fire Relief Association make a loan in the
amount of $350.00 with interest at the rate o.f 4% .to Joseph Brogan on his
I, property located in the- Golden Hill Addition, were each read and upon motion by
Fryer, second by Kjerner, the same were approved. •
