Minutes of an adjourned regular meeting of the Common Council of the
(City of Rochester, Minnesota., field in the Council Chambers in the City Hall, in
isaid City on March 13, 1946.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
ollowing members being present: President Lemmon, Aldermen Fryer, Kjerner,
McQuillan, Narveson, and Yaeger. Absent: Kennedy._
President Lemmon stated this as being the time and place set for the
first hearing on the construction of a. sanitary sewer and watermain in 15th Avenue
Northeast from 9th Street Northeast .to loth Street Northeast and the grading of
15th Avenue Northeast from 9th Street Northeast to loth Street Northeast. One of
the petitioners ap?neared at the meeting and urged that the improvement be made as
soon as possible.
President Lemmon stated this as beir_g the time and place set for the

President Lemmon stated this as being the time and place set for
eceiving and opening bids for the purchase of used radio equipment. -A bid in the
mount of $28.00 was received from R. K. Boland and upon motion by Fryer, second
y Kjerner, the same was referred to the Police Committee and the Acting Chief of
olive with power to act.
A form of request for an audit of the City books and records from the
State Public Examiner's office was presented to the Common Council for their
ignatures.
A notice of an instructional meeting for assessors in the County to be
e-ld at the Court House on March 15, 1946 was read and the City Clerk e,ias instruct
o notify the City Assessor of the date of said meeting.
A notice of claim in the amount of $2,500.00 for injury sustained by
rs. Elsie Dicks on February 6, 1946 was read and upon motion by Fryer, second by
arveson, the same was referred to the City Attorney.
The application of Lee E. Graham for re -instatement as a patrolman in
he Rochester Police Department as of March 8•, 1946 was read and upon motion by
ryer, second by Kjerner, the same was accepted.
The resignation of Ivan B. Boyd from his duties as patrolman on the
,ochester Police Department, effective March 16, 1946 was reed and upon motion by
arveson, second by Kjerner, the resignation was accepted. After further discussi<
n the matter a motion was made by ilarveson, seconded by Kjerner, rescinding the

A certificate of issuance of insurance to Lawrence E. Fellows covering
an automobile to be operated by him as a sight seeing car was read and the same
was ordered placed on file.
�! A notice by the Jimmy Adams Company of the cancellation of a rental

lagreement covering the location known as the Riverside Lunch was read and upon
motion by Narveson, second by Fryer, the same was approved and the rental cf the
said space to Henry Rommel on a month to month basis was also approved.
A petition for the vacation of the alley running east and west in I'
;Block 41, Northern Addition was read and President Lemmon referred the same to the

Street & Alley Committee.
The recommendation of the Police Committee and A. M. Nelson, Acting
i
Chief of Police, that two stop signs be placed at the intersection of Second
i
Street Southeast and Fifteenth Avenue Southeast was'read and upon motion by
McQuillan, second by Narveson, the same was approved.
A plat of lands in Section 36-107-14 to be known as Silver Lake Sub
Division was presented to the Council and upon motion b, McQuillan, second by I
i,Narveson, the plat was accented and the City Clerk was instructed to execute the
certificate showing the action of the Common Council and to have the same recorded
(with the Register of Deeds.
The recommendation of the Street & Alley Committee that a .!ton truck
be purchased from the Clements Chevrolet Company for use in the City Engineer's
�'department was read and upon motion by McQuillan, second by Yaeger, the same was
I approved.
The City Engineer's trial balance sheet for the month of February, 194&6
was read and the same was ordered placed on file.
A statement of receipts and disbursements in the Park Improvement Fund
Ii
for the month of January, 1946 was read and the same was ordered placed on file.

report of the Clerk of the Municipal Court for the week ended

march 9, 1946 showing total criminal fines. and costs collected $1120.00, civil fees
.received $2.00 and conciliation court fees $1.00 was read and having been

previously approved by the City Attorney, President Lemmon ordered that the same
be placed o:n file.

The surety bond of Harry S. Stai in the amount of $500.00 with the

Fidelity & Casualty Company of New York as surety was read and upon motion by
McQuillan, second by Fryer, the bond was approved, the surety thereon accepted

The applications of Robert C. Ramsdell and Mrs. Ed Overkamn for a
license to sell cigarettes were each read and upon motion by Narveson, second by
McQuillan, the licenses were granted.
The applications for Driver's Licenses of Charles Ca.thelyn, Howard
Holzer, Kenneth Jones and Louis Herrick were each read and upon motion by McQuill,
second by Kjerner, the licenses were granted.
The application of John M. Hartman for a Journeyman Heating Worker's an
• Steam Fitter's license was read and upon motion by Kjerner, second by McQuillan,
the license was granted.
The application of Kris Nielson to

SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That J. T. Lemmon is hereby declared to be elected to the office of
Alderman at Large of said City, at the Charter Election held March 12th, 1946, to
hold office for two years and until his successor is elected and qualified;
That Edmund Zuehlke is hereby declared to be elected to the office of
City Treasurer of said City, at the Charter Election held March 12th, 1946 to hold
office for one year and until his successor is elected and qualtfied;
That S. Smith Fryer is hereby declared to be elected to the -office of
Alderman of the First Ward of said City, at the Charter Election held March 12th,
1946, to hold office for two years and until his successor is elected and qualifie
That Austin A. Kennedy is hereby declared to be elected to the office of
Alderman of the Second Ward of said City, at the Charter Election held March 12th
1946, to hold office for two years and until his successor is elected and qualifie

I' "WHEREAS, The Public Utility Board of the City of Rochester
Minnesota', date of March 12th, 1946, passed the following quoted
resolution:
"WHEREAS, under date of March 29th 1943 the following
resolution was adopted by the Public Utility Board-:
'Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the existing
rates on electricity, water and steam heat be changed from
ten percent discount for payment within ten days from date
i of bill to twenty percent discount for payment within ten
days from date of bill and that said additional discount
shall apply to all billings with the exception of-
(1) The "Wholesale Rate" to the Peoples Cooperative Power
Association and the Olmsted County Power Company
(2) Minimum bills for electricity and water
•
(3) The present M per KWH rate on Street Lighting and
Public Buildings
(4) The present 11-0 per KWH rate to the City Water Works

Be it and it is hereby further resolved that the present
�I 30 per KWH rate for Street Lighting and Public Buildings and
the present 110 per KWH rate to the City Water Works be
subject to a 33 1/3 percent discount and that the present
rate for Hydrant Rental to the City be discounted ten
percent, and
Be it and it is hereby further resolved that one-half of
the twenty percent discount be forfeited on' all bills not paid
within ten days from date thereof, and,
Be it and it is hereby further resolved that additional
discounts herein stipulated be known as WARTIME DISCOUNTS to
go into effect on all billings after June 1st, 1943 and that
same be subject to cancellation or renewal by the Public
Utility Board one year from that date, and
Be it and it is hereby further resolved that the Hon.
Common Council be and is hereby requested to authorize the
change in discounts stipulated in this resolution, and '
WHEREAS, due to increased operating costs -labor, materials
and fuel- and increased prices for contemplated new plant con-
struction, it is the opinion cf the Public Utility Board that
all discounts established by the above resolution as adopted
March 29th 1943 be terminated,
THEREFORE, be it and it is hereby resolved by the Public
Utility Board that all rates and discounts be re-established
as these in effect on March 1st 1943 and the new rates and
j discounts to be in effect on all billings after April 1st
j 1946, and
Be it and it is hereby further resolved that the Hon.
Common Council be and is hereby requested to authorize said li
rate and discount change as herein stipulated."

of the City of Rochester, Minnesota:

Upon motion by Fryer,.second by Kjerner, that the said resolution bE

Alderman Yaeger introduced a. resolution appropriating $374.17 from the
Park Improvement, Fund and ordering payment made to R. C. Drips Grocer Company for
merchandise for the auditorium, which was read.
Upon, motion by Kjerner, second by "icQuillan, that th-e said resolution be
adopted as.rea.d, a.nd all voting in favor thereof, President Lemmon declared the
said resolution duly, passed and adopted.
Alderman Yaeger introduced a resolution appropriating $.37$.40 from the
Park Improvement Fund and $132.20 from the Lighting Fund and ordering payment
made to the City of Rochester, Public Utilities, which was read.
Upon motion by Yaeger, second by Narveson, .that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman.McQuillan introduced a resolution appropriating $1,357.97 from
the General Fund and. ordering payment made to State of Minnesota, Department of
Public Examiner, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read,_and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

From the Lighting Fund: City of Rochester, P.U., $29.00.
Mayor Gra.ssle stated that he had recently received notice that the City
of Rochester will receive 25 housing units to house 2 families each, the same
being shipped from Spokane, Washington. He further stated that the matter had
been taken up with the County Commissioners and, an agreement had been reached to
erect the said temporary housing units at the fair grounds and that an inspection
of the said site would made at once by the federal authorities in charge of
temporary housing units. Upon motion by Fryer, second by Narveson, the site as
selected at the fair grounds for the housing units was approved.
The matter of the poor condition that certain railroad crossings are
in was discussed and -,,,upon motion by Fryer, second by McQuillan, the City Engineer
was instructed to write to each railroad company and request them to put the -
street crossings over railroad tracks in good condition.
Upon_ motion by Fryer, second by Kjerner, the meeting was adjourned unti:
7:30 o'clock P.M. on March 18, 1946.
