President Lemmon called -the meetingto order at 7: 30 O'clock P.M., the following members being present: President Lemmon, Aldermen Fryer, Kennedy, I Hjerner, McQuillan and Yaeger. Absent: Alderman Narveson. Upon motion by Kjerner, second -by Fryer, the minutes of the meetings of April Sth and April 12th, 1946 were approved. , President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a watermain from Third Avenue Southeast into the fair grounds and a sanitary sewer from Graham Addition into the fair grounds. The bids of Carlisle G. Fraser in the amount of $12, 387. 30 for the construction of a watermain from rd Avenue Southeast into the fair ' 3 grounds; Carlisle G. Fraser in the amount of $12,391.00 for the construction of a sanitary: I sewer from Graham Addition into the fair grounds and DeGroff Wolff in the amount) of $13,401.90 for the construction of a watermain from 3rd Avenue Southeast into land DeGroff Wolff in the amount of $14,392.00 for construction ofi8 w fr aiGrgrounkad. the fair grounds,/were received and read at this time. ' The recommendation of -the Sewer Committee that the contract for the I construction of a sanitary sewer from Graham Addition into the fair grounds be awarded to Carlisle G. Fraser for the sum of $12, 391.00 and the recommendation of, the Water Committee that the contract for the construction of a watermain from i !'3rd Avenue Southeast into the fair grounds be awarded to Carlisle G. Fraser for the sum of $12,397.30, were each read and upon motion by Fryer, second by Yaeger,! the same were approved and the City Clerk was instructed to return the bidders bond of De Graff Wolff. The following suggested amendments to the City Charter of the City of i Rochester were each read and upon motion by Fryer, second by Yaeger, the City jClerk was instructed to forward them to the Charter Commission for their con- siderat ion: "Amend that portion of Section 164 being the first subdivision thereof which provides for the levy for the General Fund to read as follows: 'For the General Fund, so much as it may deem necessary, not exceeding sixteen (16) mills on the dollar of the assessed valuation of the City as shown by the last assessment.' The purpose of this amendment is to increase the levy for the General Fund from a present limit of Eight (S) Mills to Sixteen (16) Mills to permit an increase in the amount which may be levied for police protection since all expenses of the police department. -are, under the Charter, paid from the General Fund." "Amend Section 176 by adding at the end thereof a new sub- division numbered (5) to read as follows: 15. Bonds issued for the acquisition, equipment, purchase construction, maintenance, extension, enlargement or improvement of water, lighting, heat and power plants, or either or any other public • 1 1 0 Record of Official `Proceedings of .. the . Rochester, Minnesota, ' -April 23 19 > 46 convenience from which a revenue is or may be derived, owned and overated by the City, or the acquisition of property needed in connection therewith, and the City shall have full power to establish rates and charges -for services furnished by any public convenience, including sewers and sewage treatment plants.' The Purpose of this amendment is to permit bonds to be issued for revenue producing utilities in addition to the bonds which may be issued for other general purposes under. the 5% limitation set by the provisions of Section 176." The request of the Christy Obrecht Shows to play in Rochester on June • 140 15, 16, 17 and 19, 1946 was read and upon motion by Fryer, second by 4ennedy, the same was approved. The.resignation of Mr. William Helmkay as City Justice was read and upon motion by Kjerner, second by Yaeger, the same was accepted. fe, The Mayor's appointment of Louis A. Bruns;ting, Philip H. Lampman, Edward H. Klopp, William C. Schacht, William M. Van Hook, Axel H. Reed, Herbert Thienell and George Laack as Special Park Policemen was read and upon potion by Yaeger, second by Kennedy, the said appointments were approved. The following communication was read and President Lemmon referred the matter to the Fire Committee, the Chief of•Police, the Chief of the Fire Department, and the City Engineer: April 20, 1946 "Honorable Mayor and Common Council of the City of Rochester .Dear Sirs: At two recent meetings of .the Fireman's Civil Service Commission there were lengthy discussions concerning the fairness and proper interpretation of Article (b) under Section (17) of the Rules and Regulations of the Rochester Fire Department. The Pireman's Union committee pointed out the undue hardship suffered by individual firemen who were unfortunate in having to undergo a major operation and of necessity be off duty more than thirty days. The Fireman's Civil Service Commission requests a change in this particular article to lessen the number of days for ordinary sick leave, but to provide for longer leave in cases of long hospitalization. Before setting a definite number of days leave for each case, the commission would like to suggest the possibility of the City Council • installing an article that would effect all city employees in the same manner. Respectfully, C. G. Vail, Secretary" A petition 'by 28 residents residing on Eleventh Avenue Southwest and Northwest requesting the Council to take some action to eliminate excessive noise from trucks traveling the said street was read and' the matter was referred to the Chief of Police, the Police Committee and the City Engineer. The following resolution adopted by the Public Utility Board on April 213, 1946 was read and the same was ordered placed on file: "WHEREAS, Bids were received and opened on March 5, 1946 for the furnishing of a Steam Generating Unit to the Public Utility Board and, WHEREAS: The bids were not in compliance with the escalator clause of the specifications'and the Public Utility Board by • 6S6 Record of Official Proceedings of the Common Council of the City of Rochester, Minnesota, April 23, 19 46 V i i resolution on April 23, 1946, has rejected all bids as received March 5, 1946, now THEREFORE: Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, that the Honorable Common Council, be and is hereby requested to authorize the said Board to proceed under section 281 of the City Charter, and secure the Steam Generating Unit by entering into contract with the Riley Stoker Corporation in the amount of $164,129.29, which price is in compliance with O.P.A. Order #589, dated March 21, 1946, and the contract subject to all provisions of the original specifications. j Bond to be set in accordance with the escalator clause in the specifications, which is to be 120% of the contract price." I �I A permit drawn by the Building Inspector covering the construction of 1100 temporary housing units in the Graham Addition to the City of Rochester was considered by the Common Council and upon motion by McQuillan, second by Fryer, ithe Building Inspector was authorized to issue permits covering the said units i not to exceed a term of 12 years or until the temporary units are replaced with a permanent building which complies with the building code. The recommendation of the Board of Zoning that Mr. Jack L. Capelle be permitted to construct a machine shop 20' x 30' of wood frame construction on the, property commencing at a point 135 ft. North of the intersection of the North (line of Eighth Street Northwest with the West line of Sixth Avenue Northwest; ('running thence East parallel with the North line of Eighth Street Northwest a ,distance of 44.46 feet, running thence North a distance of 40 feet, running thence �'East a distance of 44.46 feet, running thence South a distance of 40 feet to place I,�of beginning, was read and upon motion by McQuillan, second by Yaeger, the I' I ,recommendation was approved. h The recommendation of the Board of Zoning that Mrs. Nettie L. Henke be i permitted to operate a filling station located on Lot 6, Block 35, Northern I .'Addition but that no change be made in the zoning of the property was read and ,upon motion by McQuillan, second by Kjerner, the recommendation was approved. I The recommendation of the Board of Zoning that Lot 5 and 8, Block 6, of Morse and Sargent's Addition be changed from a residential to a commercial zone was read and upon motion by Kennedy, second by Kjerner, the recommendation L. II j The recommendation of the Board of Zoning that Lots 10 and 11, Block 15 East Rochester be changed from a residential to a multiple dwelling zone was readi, and upon motion by Fryer, second by taeger, the same was approved. The recommendation of the Board of Zoning that Mr. George E. Krudwig ,be permitted to construct and operate a garage on Lot 4, Block 29, Morse and :'Sargent's Sargent's Addition but that no change be made in the zoning of the said property iwas read and upon motion by Kennedy, second by Fryer, action on the same was postponed until the meeting of May 6, 1946. The recommendation of the Board of Zoning that the petition of Raymond I ;E. A motion was made by Yaeger, second by Kennedy, that the petition be denied. All members present voted eyes°. The petition of Mr. George A. Henke to have Lot 1, Block 28, Northern Addition changed from a residential zone to a commercial zone which was returned by the Board of Zoning without recommendation was considered. After hearing Mr. Henke, who urged that his petition be granted, and protests from a delegation f roi that locality, a motion was made by McQuillan, second by Kjerner, that no change be made in the zoning of Lot 1, Block 28, Northern Addition. All present voted in favor of the motion. The City Engineer's preliminary estimate for the construction of 61, watermains in llth Street Northwest, 12th Street Northwest, 6th Avenue Northwest, Sth Avenue Northwest and 9th Avenue Northwest in the sum of $23,316.00; the preliminary estimate for the construction of 'curb and gutter in 7th Avenue Southeast from llth Street Southeast to 12th Street Southeast, estimated assessment for a 49.4 ft. Lot wihtout a driveway $74.10 per lot and estimated assessment for a 49.4 ft. lot with a 10 ft. driveway $94.10; the preliminary estimate for the construction of sanitary sewers in llth Street Northwest, 12th Street Northwest, 6th Avenue Northwest, Sth Avenue Northwest and 9th Avenue Northwest in the sum of $16,6$6.00; the preliminary estimate for the construction of a watermain in 5th Street Northeast from llth Avenue Northeast to 14th Avenue Northeast, estimated cost per front foot $1.75 and approximate assessment for a 48 ft. lot would be $84.00; the preliminary estimate for the construction of a sanitary sewer in 5th Street Northeast from llth Avenue Northeast to 14th Avenue Northeast, estimated cost per front foot, $1.75, approximate assessment for a 49 ft. lot would be $94.00; the plans and , specifications for grading of and the installation of a sanitary sewer and watermain in 13th Avenue Northeast from loth Street Northeast to 14th Street Northeast; the plans and specifications for installation of a sanitary sewer and watermain in 9th Street Northeast from 13th Avenue Northeast to 130 feet East of 15th Avenue Northeast and in 15th Avenue Northeast from 9th Street Northeast to*10th Street Northeast and grading plans and specifications for 15th Avenue Northeast from.9th Street to loth Street Northeast; and the plans and specificationsand preliminary estimate for the construction of a curb and gutter in 9th Avenue Northwest from let Street to 2nd Street Northwest, the estimated assessment per front foot without driveway approximately $1.45 or $63.80 for a 44 ft. lot, the estimated assessment for a 44 ft. lot with driveway would be about $83.80, were each read and President Lemmon ordered that the same be placed on file.: The recommendations of the Street and Alley Committee that the request 0 of the property owners for the following improvement be granted and the City 6S8 Record of Official Proceedings .of : ; ;the Connmon Council of the City of Rochester, Minnesota, Ap•r 11 2 3 19 46 Engineer be.!directed to make field surveys prepare plans and specifications for i the grading and surfacing of, and the installation of curb and gutter in :Plummer's Lane from Plummer's Circle to 350 feet South; that the City Engineer i�be directed to make field surveys, prepare plans and specifications for the grading of 14th Avenue Southeast in Block 1 of Homestead Addition and the grading of Berkman Court, Damon Court and Durand Court, west of 15th Avenue Southeast; ! The recommendation of the Police Committee, the Mayor, and the Acting Chief of Police that a three wheeled motorcycle be purchased for use in the Polic epartment was read and upon motion by Fryer, second by Yaeger, the Police Committ! nd the Acting Chief of Police were instructed to prepare specifications to be resented at the meeting of May 6, 1946. The recommendation of the Police Committee, the Mayor and the Acting ief of Police that the parking on the West side of Second Avenue Southwest etween 1st Street and 2nd Street Southwest be changed from angle to parallel arking,and that the parking on the East Side of First Avenue Southwest between nd Street and 3rd Street Southwest be changed from angle to parallel parking and hat all fifteen minute parking spaces be at the end of each block on Broadway and first Avenue Northwest and Southwest only, was read and upon motion by McQuillan, econd by Kennedy,.the same was approved and ords"ed placed on file. The following recommendation of the Fire Committee was read and'upon otion by Kennedy, second by Fryer, the same was approved and the men who were ,eleased from service were allowed 5 days paid vacation: "Hon. Mayor and Common Council City of Rochester, Minnesota Gentlemen: We, the Members of the Fire Committee, report that while werfeel it would be desirable to amend the Ordinance to enlarge the personnel of the Rochester Fire Department, we find that there is not enough money in the fire fund to pay the salaries of four additional men. The budget, set up last November, was based on a 33 member Fire Department, and no money provided for additional salaries. Therefore, we recommend that the following temporary members be released as of this date: R. E. Ginther, W. Finch, W. Luecke, and J. B. McNeir. That H. Frutiger F. Sutton and P. Alderman Fryer introduced a resolution ordering the first hearing on the construction of a sanitary sewer and watermain on 13th Avenue Southeast from 9th Street Southeast South into Homestead" Addition, which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution ordering the first hearing on the construction of a curb and gutter on both sides of 6th Avenue Southwest betweE 7th and 9th Streets Southwest, which was read. Upon motion by McQuillan, second by Kennedy, that the said resolution b adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution ordering the first hearing on the grading of 15th and 16th Streets Northwest from 5th to 7th Avenue Northwest and 7th and 5th Avenues Northwest from 14th to 16th Street Northwest,. which was read. The matter of issuing.licenses for "On Sale" non -intoxicating malt liquors being sold in stores where groceries are also handled was discussed and President Lemmon referred the same to the License Committee and the City Attorney for investigation and report as to whether or not it is legal to issue the said "On Sale" non -intoxicating malt liquor licenses to such establishments.
