President John Hunziker called the meeting to order at 3:45 P.M. with the
following members present: Councilmembers Mack Evans, Ed Hruska, Marcia
Marcoux, Jean McConnell, and David Senjem. Absent: Walter Stobaugh.
President Hunziker took testimony from several area waste haulers.
Councilmember Walter Stobaugh was present.
Several individuals spoke as to the proposed rate hike of sewer dumping fees at
the Water Reclamation Plant. They stated that $60-70/1000 gallons was too
much of a hike at one time. Many spoke of having contracts and customers that
would not pay the increase. One individual stated that they are trying to educate
citizens with private sewer systems to periodically have them cleaned; these
people will be discouraged in doing so because of the rate increase. Another
individual related the complicated and time consuming paper work that had to be
done at the Plant prior to dumping of any sewage; she noted that in other
municipalities it's more of an honor system. It was also asked why campers can
dump without cost and on weekends and holidays but the haulers cannot. Those
in attendance agreed that $30/1000 gallon increase would not seriously affect
their business.
The amended ordinance does raise, as of January 1, 1998, dumpage fees
$30/1000 gallons and continues to raise fees each year thereafter until the year
2002.
Councilmembers Senjem moved, Hruska seconded, to reconsider the Council's
action in adopting an amendment to Chapter 77 of the Rochester Code of
Ordinances Relating the Sewer Charges. Ayes (7), Nays (0). Motion carried.
The matter was reconsidered. Discussion.
Councilmembers Hruska moved, Stobaugh seconded, to approve amending
Chapter 77 of the Rochester Code of Ordinances, Relating to Sewer Charges
and instruct the City Attorney to prepare the required ordinance for adoption
incorporating the $30/1000 gallon sewer charge. Ayes (7), Nays (0). Motion
carried.
President Hunziker told those present that Richard Freese, Director of Public
Works, and Lyle Zimmerman, Water Reclamation Plant, would meet with the
waste haulers to consider solutions to problems of logistics, documentation, etc.,
and then the ordinance may be reconsidered by the Council
Councilmembers Hruska moved, Stobaugh seconded, to incorporate into the
ordinance dealing with off premise advertising signs (billboards) a provision
which would prohibit the installation of off premise advertising signs on the
following roadways:
CSAH 22 from Trunk Highway 52 at Apache Mall westerly and northerly
to Trunk Highway 52 at 55th Street Northwest.

CSAH 22 from Trunk Highway 14 at the University Center northerly and
westerly to Trunk Highway 63 at 37th Street Northwest.
55th Street Northwest from Trunk Highway 52 easterly to C.R. 133 (West
River Road).
Ayes (7), Nays (0). Motion carried.
E-3 Councilmembers Senjem moved, Marcoux seconded, to waive the conflict of
interest for the Messerli and Krasmer firm with regard to the personal injury case
being handled by their Minneapolis office. Discussion.
Councilmember McConnell felt that there were many law firms in the State that
could represent the City without having one with a conflict of interest. Terry
Adkins, City Attorney, explained that this has occurred numerous times before
and it should not pose a problem as the City's legal positions would not be
compromised; large law firms many times are unaware that they have a conflict.
Ayes (5), Nays (2). Motion carried. Councilmembers Evans and McConnell
voted nay.
E-4 Councilmembers Evans moved, Stobaugh seconded, to adopt Resolution No.
704-97 approving the purchase of the 143H Caterpillar motor grader from the
Cass County contract in the amount of $159,620 and to approve future
purchases at the discretion of the City Administrator. Discussion.
It was explained that a public bid must be done by a public entity but then other
public organizations can "piggyback" off the bid through a joint powers
agreement: The City Administrator would be approving only items that have
previously been approved by the Council through the budget process.
Ayes (7), Nays (0). Motion carried.
F-2a I An Ordinance Amending and Reenacting Chapter 77 of the Rochester Code of
Ordinances, Relating to Sewer Charges, was given a first reading.
Councilmembers McConnell moved, Stobaugh seconded, to suspend the rules
and give the Ordinance a second reading. Ayes (7), Nays (0). Motion carried.
The Ordinance was given a second reading. Councilmembers McConnell
moved, Evans seconded, to adopt the Ordinance as read. Ayes (7), Nays ((0).
Motion carried.
F-2b Sandy Goslee explained the Off -Premise Advertising Signs ordinance as it
pertains to the 250 foot from residential properties abutting right of ways.
An Ordinance Creating Subdivision 7 of Section 60.504, Section 60.509, and
Paragraph a of Subsection 1 of Section 63.224; and Amending and Reenacting
Sections 60.200, 63.221, Subsection 5 of Section 63.224, Sections 63.225, and

65.510 of the Rochester Code of Ordinances, Relating to the Regulation of
Advertising Signs in the City of Rochester, was given a first reading.
Ken Moen, representing DeLite Advertising, stated that they did not have a
chance to study the amended ordinance. They will be provided a copy and may
submit comments to the City Administrator's Office prior to January 21 st when
the Ordinance will receive a second reading.
Having no further business, Councilmembers Stobaugh moved, Marcoux
seconded, to adjourn the meeting.
