Minutes of an adjourned regular meeting of the.Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall in
said City on July 3, 1946.
President Lemmon called the meeting to order at 10:00 o'clock A.M., the
following members being present: President Lemmon, Aldermen Kennedy, Kjerner,
Mc'uillan, Narveson, and Yaeger. Absent: Alderman Fryer.
Alderman Kennedy introduced the following resolution which was read:

"WHEREAS, The Board -of Freeholders heretofore appointed by the Judges
of the Third Judicial District of the State of Minnesota, to frame a Charter for
the City of Rochester, in said City, and to propose amendments therefor, has
delivered to the Mayor of the City of Rochester, Minnesota, two proposed
amendments to the said Charter, which said amendments are numbered 1 and 2, the
said amendment No. 1 to amend Section 164 of said Charter, and the said amendment
No. 2 to amend Section 176 of said Charter, and the Mayor of said City has sub-
mitted to the Common Council of the said City a copy of the amendments so
proposed and has submitted the matter of the said amendments to the said Common
Council, the said amendments being as follows:
AMENDMENT NO. I
Amend that portion of Section 164 being the first sub -division thereof
which provides for the levy of the general fund to read as follows:
"For the general fund, so much as it may deem necessary, not exceeding
sixteen (16) mills on the dollar of the assessed valuation of the city as shown
by the last amendment."
AMENDMENT NO. II
Amend Section 176 by adding at the end thereof a new subdivision
numbered 5 to read as follows:
115. Bonds issued for the acquisition, equipment, purchase, construction,
maintenance, extension, enlargement or improvement of water, lighting, heat and
power plants, or either or any other public convenience from which a revenue is
or may be derived, owned and operated by the City, or the acquisition or property
needed in connection therewith, and the City shall have full power to establish
rates and charges for services furnished by any public convenience, including
servers and sewage treatment plants."
NOW THEREFORE, Be it and it is hereby resolved by the Common Council of
the City of Rochester, Minnesota:
That the City Clerk of said City be and he is hereby ordered -and directed
to file said copy of said proposed amendments in his office, and that a special
election is hereby called to be held in the several election districts in said
City on Tuesday, August 20th, 1946, between the hours of 9:00 o'clock A. M. , and
7:00 o'clock P.N,., for the purpose of submitting said proposed amendments to the
qualified electors of said City, for their ratification or rejection.
Be it further resolved: That the City Clerk be and he is hereby directed
to cause said proposed amendments to be published for at least 30 days before
said special election, in the Rochester Post Bulletin, in the City of Rochester
Minnesota.
Be it further resolved: That the City Clerk is hereby directed to give
notice of said special election and the purpose thereof, to the qualified
electors of said City as provided by law.'!
Upon motion by Yaeger, second by Kennedy, that the said. resolution be •
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Narveson,second by Kjerner, the City Clerk was instructed
to publish notice of the special election to be held on August 20th, 1946.
The matter of advertising for the proposed amendments was discussed and •
upon motion by Yaeger, second by Harveson, the publications were ordered to be
set in 8 point type.
Upon motion by Kennedy, second by Narveson, the meeting was adjourned
until 7: 30 o'clock P. M. on Monday, July 15, 1946.
