Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on July 15, 1946.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
Upon motion by Kjerner, second by Fryer, the minutes of the meetings of
July 1 and 3, 1946 were approved.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the construction of a sanitary sewer and watermain
in 13th Avenue Southeast from Sth to _82 Street Southeast. The bid of Carlisle G.
Fraser in the amount of $2,099.00 for sewer and $3,409.00 for watermain was
received and opened. The recommendation of the Sewer Committee that the contract
for the installation of a sanitary sewer in 13th Avenue Southeast from Sth Street
to 8 Street Southeast and into Block 11 of Homestead Addition be awarded to
Carlisle G. Fraser for the sum of $2,089.00 and the recommendation of the' Water
Committee that the contract for the installation of a watermair. in 13th Avenue
Southeast from Sth Street Southeast to 82 Street Southeast and in 81 Street
Southeast from 13th Avenue Southeast to Highway r#20 be awarded to Carlisle G.
Fraser in the sum of $3,1109.00, were each read and upon motion by Fryer, second
by McQuillan, the same were approved.
President Lemmon stated this as being the time and place set for
receiving and opening oids for the construction of a watermain in 14th Avenue
Southeast in Block 1, Homestead Addition. The bid of Carlisle G. Fraser in the
amount of $1,749.70 was received and opened. The recommendation of the Water
Committee that the contract for the installation of a watermain in 14th Avenue
Southeast in Homestead Addition be awarded to Carlisle G. Fraser for the sum of
$1,749.70 was read and upon motion by Fryer, second by Kennedy, the same was
approved.
Four residents from Seller's Sub -Division stated that a aerty was living
in a garage located next to Seller's Sub -Division in Crown's Sub -Division and that
-the garage had no sewer or water connections. Upon motion by Harveson, second by
McQuillan, the Building inspector was instructed to grant a temporary permit for
• the garage to be used as a dwelling for a period of five years and that the said
Iga.rage building be moved to a location or. the lot which would confrom with the
provisions of the Zoning Ordinance, the said garage to be connected with sewer
and water service.
Mr. E. A. Zuehlke, City Treasurer; appeared before the Council and
sked for one weeks vacation beginning on July 22, 1c46. Upon Notion by bicQuillar,
(second by Kjerner, the same was granted.

A notice of claim for personal injury to James Loeding, son of Fred
Loedin g, wascread and upon motion by Kjerner, second by Fryer, the same was
referred to the City Attorney.
The two following resolutions adopted by the Public Utility Board were
e;a,ch-read and the same were ordered placed on file:
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the
Honorable Common Council of the said City be and is hereby
requested to authorize the said Board to enter into a
contract with the Wallace and Tiernan Company for the
furnishing of one type SASV Semi -Automatic Solution Feed
Visible Vacuum Type Chlorinator, in accordance with
specifications on file, the amount of said contract to
be $1,675.50 (One Thousand Six Hundred Seventy Five
dollars and Fifty cents), and the said Wallace and
Tiernan Compa ny'being the lowest responsible bidder."
"Be .it and it 'is hereby resolved by the Public Utility
Board of the City of Rochester, '.Minnesota, that the
Honorable Common Council of the said City be and is
hereby requested to authorize the said Board to enter
into a contract with the Elk River Concrete Products
Company for the -furnishing, in accordance with specifications
of 970 lineal feet of 49" reinforced concrete pipe at a
price of $7.03 per lineal foot, the lump sum of same to
be Six Thousand One hundred Sixteen dollars and Ten
cents ( $6, 116.10). p
A petition for the vacation of Tenth Aven'ule Northwest from the north
line of 7th Street Northwest to the north line of Lot 2 in Block 7, if said north
line of Lot 2 were extended west 60 feet, and also, 9th Street Northwest from the
test line of 9th Avenue Northwest to the East line of loth Avenue Northwest all
of said streets being in Cascade Sub -Division, was read and President Lemmon
referred the same.to the Street & Alley Committee and the City Engineer.
A petition for the construction of a curb and gutter on 9th Avenue
Northeast from East Center Street to 3rd Street Northeast was read and President
Lemmon referred same to the Street & Alley Committee and the City Engineer.
A petition for the construction of an intersection "island" at Ninth
Avenue and Tenth Street Southwest was read and President Lemmon referred the same
to the Street & Alley Committee and the City Engineer.
A petition signed by all the judges and clerks employed on the election
board July 9, 194asking that their pay be increased to 600 per hour w4s read
and upon motion by Mcquillan, second by Kjerner, the 600 rate was approved.
A petition to have a street light vlaced on llth Street Northeast
between Broadway and First Avenue Northeast was read and upon motion by Kennedy,
second by Fryer, the same was referred to the Lighting Committee with power to act:
Specifications for furnishinn tires and tubes for use on Fire Department
equipment was read and upon motion by Narveson, second by Fryer, the City Clerk
was instructed to advertise for bids to be received on August 5, 1946.
The City Engineers preliminary estimate in the amount of $3644.00 for
the grading of the streets in Indian Heights Addition was read and the same was

ordered placed on file.
The City Engineer's estimates of cost of construction of a.sanitary
sewer in the amount of $8,082.70 and a watermain in the amount of $8,946.40 in
the street and avenues in Indian Heights Addition were each read and the same wer,
ordered placed on file.
The recommendation of the Finance Committee that a loan in the amount
of $2500.00 bearing interest at 4% be granted to Charles Smart at 703-55th Avenue
Southeast was read and upon motion by Fryer, second by Kjerner, the same was
approved and ordered placed on file.
The recommendation of the Police Committee, the Acting Chief of Police,
and the City Engineer that the request to,have the parking changed to one hour
on East Center Street from Broadway to 2nd Avenue Southeast and on let Avenue
Southeast between East Center and let Street Southeast be delayed until such time
as the City Engineer can construct curbs and widen the streets, in order that
parking may be more uniform in that section, was read and upon motion by Kennedy,
second by Narveson, the recommendation was approved.
The recommendation of the Police Committee, the. Acting Chief of Police,
and the City Engineer that the request of the Service Cab Company for a stAnd on
lst Street and 2nd Avenue,Southwest be postponed until further study and survey
can be pade by the Chief of -Police and the City Engineer was read and upon motion
by Narveson, second by Kennedy, the same was approved.
The recommendation of the Street & Alley Committee and the City Engineez
that the contract for the purchase of 1-?Cubic Yard. Lorain TL-20, 6 X 4 Rubber
Mounted Power Shovel and Dragline be awarded to the :Minneapolis Equipment'Company
for the sum of $14,465.00 was read and upon -motion by Yaeger, second by Kjerner,
the same was approved.
The recommendation of the Street & Alley Committee that the alleys in
Block 3, of Conley's Addition be not vacated.was read and upon motion by Yaeger,
second by Kjerner, the same was approved.
The recommendations of the Sewer Committee and the Water Committee that
anitary.sewer and watermain be constructed in 13th Avenue Southeast from 7th to
th Street Southeast were each read and upon -motion by Fryer, second by Yaeger,
the same were approved.
The recommendations of the Sewer Committee and the Water Committee that
sanitary sewer and watermain be constructed in 4th Avenue Southeast between
3th and 14th Streets Southeast were each reed and upon motion by Fryer, second by
ennedy, the same-vere approved.
The recommendations of the Street & Alley Committee -that a curb and
gutter be installed on both sides of loth Street Northwest from Broadway to 2nd

Avenue Northwest was read and upon -motion by Yaeger, second by Kjerner, the same
was approved.
The recommendation of the Finance Committee that a loan in the amount •
of $600.00 with interest at the rate of-4% be granted to Edgar and Adelia Van de
Walker on their property located in Golden Hill Addition was read and upon motion
by Narveson, second by Kjerner, the same was approved.
The report of the City Weighmaster for the month of June, 1946-showing •
284 loads weighed and receipts of $28.40 was read and President Lemmon referred
the same to the Finance Committee.
The City Engineer's trial balance for the month of June, 1946 was read
and the same was ordered placed on file.
The City Treasurer's report for the month of June, 1946 was read and the
same was ordered placed on file.
The reports of the Clerk of Municipal Court for the week ended July 6,
1946 showing total criminal fines and costs collected $666.00 and conciliation
court fees $4.00 and for the week ended July 13, 1946 showing total criminal fines
and costs collected $919.00, civil fees received $4.35, and conciliation court
fees $4.75, were each read, and having previously approved by the City Attorney,
President Lemmon ordered that the same be placed on file.
The surety bonds of Carlisle G. Fraser in the amounts of $15,713.30 and
as
$22, 487.00 with the United States Guarantee Company/surety; Guy E- Inx.ne-s in the
amount of $500.00 with the National Surety Company as surety; Squires Electric
Company in the amount of $1000.00 with the Fidelity and Casualty Company as surety;
a.nd the bond of Hanson Hardware Company in the amount of-$30.03 to cover a
duplicate warrant, were each read, and upon motion by Kennedy, second by Yaeger,
the bonds were approved, the surety thereon accented and it was ordered that the
same be placed on file.
The application of Edward M. Petty for license to sell non -intoxicating
malt liquors "on sale" was read and upon motion by Narveson, second by Yaeger, the,
same was referred to the License Committee with power to act. •
The applications of M. R. Anderson, Paul M. White, and Edward M. Petty
for license to sell cigarettes were each read and upon motion by Kjerner, second
by McQuillan, the licenses were granted:
The application of the Nelson Tire Service for a permit to place and •
maintain a sign was read and upon motion by Narveson, second by Yaeger, the permit'
was granted. -
The applications of Donald L. Close, Orville L. Rowland, Bernard Semadine,
Paul N. White and Edward M. Petty for license to sell soft drinks were each read
and upon motion by Narveson, second by Fryer, the licenses were granted.

The applications for "Off Sale" intoxicating Liquor licenses of Elden Li
Holtorf, Jr. , Donald W. McConnell, John P. Goggins, and Leo J. Smith and the
applications for "On Sale" intoxicating Liquor licenses of William J. Moriarty,.,
Harold Macken, and John,Margellos were each read and upon motion by McQuillan,

second by Narveson, the same were ordered Placed on file.
The application of Joseph B. McGovern_ for a Journeyman Plumber's �licenst
was read -and upon motion by Fryer, second by Kjerner, the license was granted.
The application of Earl J. Squires for Electrical Contractor's License
was read and upon motion by Yaeger, -second by McQuillan, the license was granted.
The application of A. C. Evans for a license to conduct an auction sale
was read and upon motion by Fryer, second by Kjerner, the license was granted.
Upon. motion by Fryer, second by Kennedy, the City Clerk was instructed
to return the certified checks to the unscuccessful bidders on the power shovel
purchased for the City Engineers Department.
Alderman Fryer introduced a resolution authorizing the Public Utility
Board to enter into contract with the Wallace and Tiernan Company, which 'was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting In favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Public Utility
Board to enter into contract with Elk River Concrete Products Co., which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution accepting plans and specification
and ordering bids for -the grading of 15th and 16th Streets Northwest from 5th to
7th Avenues Northwest and 7th to 5th Avenues Northwest from 14th to 16th Streets
Northwest, which was read.
Upon motion by Kjerner, second -by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Fryer introduced a resolution accepting plans and specification
nd ordering bids for the construction_ of a sanitary sewer and waterma.in and the
rading in Blocks 1 and 2, Indian Heights, which was read.
Upon motion by Na.rveson, second by Kjerner, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon_ declared the
aid resolution duly passed and adopted.

Alderman Kennedy introduced a resolution granting a public dance permit
to Mike Sternberg, which was read.
Upon motion. by McQuillan, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution ordering the first hea.ring.on

Alderman Kjerner introduced a resolution accepting the bid of Minnea.poli,s
Equipment Company for furnishing one Power Shovel for use in the Street & Alley
Department, which was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $1891.91' from
the irenerel Fund and ordering payment made to The Standard Oil Company for cutbacl
asphalt, which was read.
Upon motion by Yaeger, second by INcQuillan, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $1475.18 from thi

General Fund and ordering payment made to Universal Motors, Inc. for pur,ehase of
2 cars.for police department, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lerlmon declared the

Alderman Kjerner introduced a resolution appropriating $2.10 from the
General Fund and $429.43 from the Street & Alley Fund and ordering payment made
to Dunn Sand and Gravel Company, which was read.
Upon motion by Kennedy, second by iiarveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $5.79 from the
General Fund, $8.46 from the Set -ter Fund and $3369.74 from the Bridge Fund and
ordering payment made to Dodge Lumber & Fuel Company, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be.
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman AcQuillan introduced a resolution appropriating $624.40 from
the Street & Alley Fund and ordering payment made to C. M. Bou.telle for repairs to,
sidewalks and curb and gutter, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $297.41 from
(the Park Improvement Fund and ordering payment made to The Kruse Company, which
was read.

Alderman -McQuillan introduced a resolution appropriating $1,422.35 from;
the Park Improvement Fund and ordering payment made to Clements Chevrolet Company,
which was read.

Alderman larveson introduced a resolution appropriating $1,792.22 from
the Parr Improvement fund and ordering payment made to the Collector of Internal
Revenue, which was read.
Upon -motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting -in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Narveson introduced a resolution appropriating $494.18 from
th.e Park Improvement Fund -and ordering payment made to -Reynolds Wholesale Company,
which was read.
Upon motion by McQuillan, second -by Kennedy, that the said resclution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly -passed and adopted.
Alderman Narveson introduced a resolution_ appropriating $300.00 from the
Park.Improvement Fund and ordering payment made to Anderson Refrigeration Co.,
which was read.
Upon motion by Kennedy, second by Fryer; that the said resolution be •
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. - -
Alderman Yaeger introduced -a resolution appropriating $6527.46-from
the Park Improvement Fund and ordering payment made -to 'Mayo Civic Auditorium for •
reimbursing the revolving fund, which was read.
Upon motion by Yaeger; second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman_ Yeeger introduced a resolution appropriating $296.42 from the
Park Improvement Fund and $419.84 from the Lighting Fund and ordering payment

made, to City of Rochester, Public Utiliti,es,. which was read. -
Upon motion by Kennedy, second. by Narveso.n, that the sp.i.d resolution. be

Alderman Yaeger introduced .a. resolution appropriating $4245.64 from the
P.I.R. Fund and ordering payment made to Carlisle G. Fraser for installation of
• a xratermain• in 5th Street- Northeast from 11th. Ave. 2?ortheast to. 127 feet. East of
14th Avenue Northeast, yhicl-, was read..
Upon motion by Kennedy,, second by Kjerner, that the said resolution be
adopted as read, and e.11 voting in favor thereof, President. Lemmon declared the
said resolution duly passed and adopted. ,
Alderman Kennedy introduced a. -resolution appropriating $250.00 from the
General Fund and ordering payment made to the Rochester Armory for maintenance,
which was, read.
Upon motion by Kennedy; second by Frye-r, that the. said. resolution be
adopted as dead, and all voting in, favor thereof, President Lemmon declared the
said,resolution duly passed and adopted..
The following claims were read- and.upon motion by Yaeger, second by
Kennedy, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw -warrants upon the City Treasurer -and make payments accordingly:.

A lease between the City of Rochester and A. VJ. Wilken was presented and
upon motion by- Yaeger, second by Ma.rveson, the Mayor and City Clerk were
authorized to execute- the said lease between the City of Rochester, and A.V.T.
Wilken, leasing the northern Hotel for a period of 19 months beginning in
October, 1946, and upon roll call Alderman Fryer and Kennedy voted "no°•and
Alderman Kjerner, Mc(,uillan, Narveson and Yaeger voted "yes". After discussing
the matter further a motion was made by Yaeger, second by Narveson, and all
voting in favor -thereof, that the signing of the Hotel Northern .lease be Tcstponed
until the City Attorney had an opportunity to study the matter further.
It was brought to the attention of the Council that there were a:eeds'
growing on the right of -ways of the railroad tracks in the City limits and upon
motion by Fryer, second by Yaeger, the City Clerk was instructed to notify the'
Chicago Great Western Railway Co. and the Chicago-Worthwestern Railway Co. to cut
the i.reeds on the right of ways within the City limits and to prepare crossings
which are not in good condition.
Alderman Mcquillan presented advertising which he had drafted for the
proposed amendments to the .City Charter. Upon motion by Fryer, second by Narveson, •
the Mayor, President Lemmon and the City Attorney -were -designated as a committee
to work with Alderman'McQuillan in preparing advertising for the said proposed
charter amendments.
Upon motion by Fryer, second by Kennedy, the meeting •was -adjourned. •
