CJ • • • October 21. 1946 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers -in the City Hall, in said City, on October 21, 1946. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon, Aldermen Fryer, Kennedy, Kjerner, McQuillan, and Narveson, Absent: Alderman Yaeger. Upon motion by Kjerner, second by Fryer, the minutes of the meeting of October 7, 1946 were approved. President Lemmon stated this as being the time and place set for receiving and opening bids for the wrecking of the building known as the Riverside Lunch at No. 16, Third Street Southeast and the buildings attached thereto. No bids were received and upon motion by Narveson, second by Fryer, the City Enginee: was authorized to hire the necessary labor and equipment and proceed to wreck the said building. President Lemmon stated this as being the time and place set for receiving proposals for the purchase of the East 95 feet of Lot 28, in Block 7. Sunnyside Addition to the City of Rochester. The bid of the George Leiferman Insurance and Realty Company in the amount of $1000.00 was received and upon motion by Fryer, second by Yaeger, the Mayor and City Clerk were authorized to execute a deed transferring the prc?nerty to the George Leiferman Insurance and Realty Company. President Lemmon stated this as being the time and place set for receiv' bids for the construction of a storm sewer in llth Street Northwest from Cascade Creek to 7.th Avenue Northwest and in 7th Avenue Northwest from llth Street to 14th Street Northwest. The bid of Carlisle G. Fraser in the amount of $14,639.65 was received and opened. President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a storm sewer in Sth Street Southeast from Bear Creek to 13th Avenue Southeast. The bid of Carlisle G.Fraser in the amount of $6290.00 was received and opened. There was no one present wishing to be heard on the above projects. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer and watermain in Indian Heights in 14th, 15th and 16th Street North:,rest from 5th to 7th Avenue Northwest and in 5th and 7th Avenues Northwest from 14-th Street to 16th Street Northwest. Mr. Raymond Peterson was present and inquired as to the amount of the assessment on two lots which he ownd in Indian ?Heights. President Lemmon referred Mr. Peterson to the Cite Engineer for detailed information on the said assessment. The recommendation of the Sewer Committee that the contract for the construction of a. storm sewer in llth Street Northwest .from Cascade Creek to 7th Avenue Northwest and in 7th Avenue Northwest from llth Street to 14th Street Northwest be awarded to Carlisle G. Fraser in the amount of $14,639.65 and the recommendation of the Sewer Committee that the contract for the construction of a storm sealer in Sth Street Southeast from Bear Creek to 13th Avenue Southeast be awarded to Carlisle G. Fraser in the amount of $6290.00, were eech read and upon motion by Fryer, second by Tdarveson, the same were approved. Mr. George Leiferman appeared at the meeting and requested permission to remodel a. building into living quarters at the rear of the 'Castelmar Apartments Northwest, and upon motion by Warveson, second by Kennedy, the matter was referred to the Board of Zoning. The request of George Leiferman Insurance and Realty Company, on behalf of their client, Mr. Dale Arbuckle, to use the property located at the corner of loth Street and 2nd Avenue Northwest (Lots 21 and 22, Northern Addition) for a COOLIE BAKERY andalso a statement of acquiescence signed by a. number of property owners in that locality, were each read and upon motion by Kennedy, second by Fryer, the same was referred to the Board of Zoning. A request by the Board of Park Commissioners that the Common Conncil approve their action in awarding the contract for a tractor -loader to Wm. H. Ziegler Company was read and upon motion by fryer, second by Kennedy, the'purchase of the said tractor was approved. The recommendation of the Public Grounds Committee that the Rochester Red Cross office.be located on the 2nd floor of,the old library building at 104- 2nd Street Southwest was read and upon motion by McQuillan, second by Kjerner, thi recommendation was approved. The recommendation of the Public Grounds Committee that the City enter into a service contract with the Otis Elevator Company for servicing the elevator in the Old Mill Building and that the service be paid at the rate of $13.00 per month and upon motion by McQuillan, second by Kjerner, the recommendation, was approved. The City Engineers preliminary estimate of cost for the g•ra.ding of Sth Avenue Northwest from 14th Street Northwest to 395 feet Worth of 14th Street Northwest :wa.s read and the same was ordered placed on file. The City Engineers estimate of cost for the construction of a. sanitary sewer in llth Avenue Yorthwest from 6th Street t:o 5th Street Northwest was read and the same ;,gas ordered placed on file. A petition for the construction of a sanitary sewer in llth Avenue Northwest fron, 5th Street to 6th Street Northwest was read and the same was referred to the City Engineer and the Sewer Committee. A communication fr-om C. R. Holland urging that his application for an "Off Sale" intoxicating liquor license be granted was read and the same was ordered placed on file. The City Engineer's trail balance for the month of September, 1946 was presented and the same was ordered placed .on file. The reportsof the Clerk of the Municipal Court for the week ended October 12, 1946 showing total criminal fines and costs collected $1226.00, civil fees received $2.60, and conciliation court fees .$1.50 and for the week ended October 19, 1946 showing total criminal fines and costs collected $1009.00, civil fees received $4.00, and conciliation court fees $3.00, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The application of Lawrence Lysne for a permit to move a house 26ft by 24 ft and 12 stories high over the following route was read: starting at 516 - 1st Avenue Southwest, thence South to 6th Street Southwest, thence East on 6th Street to Broadway, thence South to 12th Street South, thence East to 3rd Avenue - Southeast, thence South to 14th Street Southeast thence Fast to 4th Avenue 92 October 21. 1g46 Southeast, thence I-Test.to 13th Street Southeast, thence East to loth Avenue Southeast thence North one-half block to No. 1229 - 10th Avenue Southeast. The bond of Carlisle G. Fraser in the amount of �1,676.60 with the • United States Guarantee Company as surety, was read, and upon motion by Fryer, second by Kennedy, the bond was approved the surety thereon accepted, and it was ordered that the same be placed on file. Alderman Fryer introduced a resolution levying special assessments for curb and gutter on 9th Avenue Northwest from 1st Street to 2nd Street Northwest, which was read. Upon motion by Kjerner, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution levying special assessments for the construction of a sanitary sewer and watermain in Sth Street Southeast from '12th Avenue to 13th Avenue Southeast, which nas read. Alderman Kjerner introduced a resolution appropriating $1,260.55 from the General Fund and ordering payment made to the Standard Oil Company for cutback asphalt, which was read. Alderman Kjerner introduced a resolution appropriating $299. 75 from the General fund and ordering payment made to the Rochester Post Bulletin, which was read. Alderman McQuillan introduced a resolution appropriating $1049.75 from the Street & Alley Fund and ordering payment made to Clements Chevrolet Company, for a 2 ton pickup truck, which was read. Alderman Warveson introduced a resolution ordering the first hearing on the • construction of a sanitary sewer in llth Avenue Northwest from 5th Street. Northwest to 5th Street Northwest, which was read. Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, president Lemmon declared the • said resolution duly passed and adopted. The matter of appointing a. committee from the Common Council to work with -representatives of other City Boards was discussed and upon motion -by Kjerrier, • second by Kennedy, the members of the Street & Alley Committee were appointed to serve on the said beard and Alderman Fryer was requested to act as temporary chairman until a permanent chairman is appointed by the members of the proposed board. • The matter of injuries to employees of the City of 'Rochester w4s again brought up by Alderman 1''cQuillan, who stated he wished to make complaints in the cases- of Mr. Putman and Mr. Fitting, 'Mr. Putman being an employee of the City Engineer's Department and Mr. Fitting an employee of the Park Department. The City Attorney advised that Mr. Fitting's case had already been referred to the State Industrial Commission and that Mr. Putman should also report his case to the State Industrial Commission. The matter of reporting accidents of City employees was discussed further and upon motion by Kennedy, second by Kjerner, the City Clerk %vas instructed to .notify the heads of all City departments to report all accidents to the State Industrial Commission and the City Engineer to ma.'_;e a complete report on the case -of Mr. Putman. Upon motion by Fryer, second by Kennedy, the City Clerk was ' . instructed further " to notify the department heads to take all injury cases to the Mayo Clinic for treatment and that compensation far injuries would be paid out of the General Fund. Alderman McQuillan stated that the question as to whether or not Mr. T.J. Costello was still on the payroll of the Public Health & Welfare Department or as to whether or not his back retirement fees should be paid by the Public Health & Welfare Department had never been settled. Upon motion by Fryer, second by McQuillan, the City Attorney was instructed to write the Attorney General asking for a complete ruling on the questions affecting the case *of Mr. T.J. Costello. It was reported to the Common Council that the spiking of 3.2 beer and ,soft drinks in certain places where ncn intoxicating- malt liquor was being sold "on sale", was being done by minors and other patrons of the establishments. A • ,mo•tion was made by Fryer,• second• by Kennedy, instructing the City Attorney to prepare an amendment to the non -intoxicating malt liquor ordinance making the proprietors and customers both responsible in case spiking of drinks is carried on. Again returning to the discussiion of the cases of T.J. Costello, Otto • Fitting and Wm. Putman, City Attorney Hunt requested that he be temporarily relieved from his duties az City Attorney, and upon motion by Fryer, second by Kennedy, the request was granted and he was given the privilege to speak from the floor as a citizen and taxpayer of Southeast Rochester. In his talk Mr. Hunt charged that Alderman Mcquillan represented individuals rather than City interests 99 October 21, 194 and suggested that if he wished to continue representing individuals he rlesign as an Alderman. • Alderman McQuillan then requested that he be temporarily relieved from his duties as an .Alderman in order that he might speak from the floor and' upon notion by' Fryer, second by McQuillan, the permission requested aa.s granted. Alderman McQuillan then again discussed the cases of T. J. Costello, Ctto. Fitting • and Wm. Putman and charged the City Attorney with "evesion of CLuty" and asked the City Attorney why he had sent the Chief of Police to an On Sale Liquor place to instruct the operator to see ;,fir. Hunt before he saw the City Council. At this point in the discussion Acting Chief of Police 1.elson demanded an explanation. Mr. Hunt then demanded that the discussion of the procedure in accident cases be adhered to. Alderman McQuillan continued to discuss the above mentioned cases of T. J. Costello, Otto Fitting and Wm. Putman further, upon which action had already been taker, instructing the City Clerk to notify the various departments as to the procedure to be followed in the case of injury and instructing the City Attorney to get detailed ruling on the case of T.
