Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on January 20, 1947.
President Lemmon called the meeting to order at 7.30'o'clock P.;M., the
following members being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
Upon motion by Kjerner, second by Yaeger, the minutes of the meeting of
January 6, 1947 were approved.
The following communication from the Street & Alley Committee was read:1
"Honorable Mayor and Common Council
of the City of. Rochester, Minnesota
Gentlemen:
In accordance with the request of the Minnesota
Department of Highways, we the undersigned members of
the Street & Alley Committee, present for your
consideration plans for the improvement of that part
of 12th Street S. E. lying between 3rd Avenue S. E.
and ll th Ave. S.E.

Also a letter from the State Highway Department dated January 14,1947
addressed to Mr. Francis J. Magnuson, City Engineer,' transmitting to him a plan
of the proposed project on 12th Street Southeast between 3rd Avenue and llth
Avenue Southeast was read.
Mr. Al Hafner, Mr. Raymond Krueger, and Mr. Jack Batdorf were present
at the meeting and opposed the installation as shown on the plan prepared by the
Minnesota State Highway Department. Upon motion by Fryer, second by Kjerner,
action on the matter was deferred until the City Engineer could contact the proper
authorities of the Minnesota State Highway Department and arrange a meeting with
groups from the Southeast part of the d'ity, who are interested in the project.
Mr. Jack Batdorf also called tb the attention of the Common Council
that used cars had been sold at filling stations on 12th Street Southeast operate
by David- Dee and Ray Sonnenberg. It was also stated that a welding business was
(being conducted in the Sonnenberg station. The Building Inspector reported that
he had already notified these parties to discontinue the used car and welding
business in their stations.
A communication from the, State Department of Health, Division of
Sanitation, stating that plans had been submitted on December 30, 1946, by Toltz,
King & Day, Inc., Engineers and Architects, for sanitary interceptor and outf all
sewer to the Department of Sanitation and that this department would recommend th,
approval of these plans at the next duly called meeting of the Water Pollution
Control Commission.

A letter from John A. Marsh,,Plumbing Inspector, stating that the
'� applications of W. T. Hankee for a Master Plumbers License and for a Hot Water
and Steam Heating Contractor's License were not in accordance with the ordinance

,providing for the licensing of Master Plumbers and Hot Water and Steam Heating
Contractors due to the fact that Mr. Hankee has not had a residence in the City
of Rochester for the past six months as required by the ordinance, was read and
the same was ordered placed on file.
The applications of Mr. W. T. Hankee for a Master Plumbers License and
for a Hot Water and Steam Heating Contractor's License were each read and upon
motion by Fryer, second by Kjerner, the same were referred to the License Committee
with power to act.
I' A letter from Edward M. Petty and a petition signed by the negro

I, ci tizens, patients and visitors in Rochester requesting that a non -intoxicating
'malt liquor license be again granted to Mr. Petty at the Avalon Cafe were each

1'read. Mr. Petty was present at the meeting and spoke in his behalf regarding the,

(granting of a new license to him. The Acting Chief of Police, A. M. Nelson,
stated that there had been violations on Mr. Petty's part during the time he held

A communication from the Board of Park Commissioners inquiring as to

;whether or not there was any possibility that the flood control program for Bear
Creek would be started in time to furnish fill for the playground areas in
Slatterly Park was read: Alderman Fryer stated that the matter was being
studied by the City Coordinating Committee and'that a recommendation would be
made at their meeting to be held on January 21, 1947.
l The recommendation of the Street & Alley Committee that a curb and
,gutter be installed on 3rd Street Southeast from 6th Avenue to llth Avenue
Southeast was read andupon motion by McQuillan, second by Yaeger, the same was 1
,approved and the City Engineer was instructed to prepare plans and specifications,
(for same.
The recommendation of the Street & Alley Committee that the Building

Inspector's Department be combined with the Department of the City Engineer, the
change to be effective as of April 1, 1947, was read and upon motion by McQuillan;
second by Fryer, the same was approved and the City Clerk was instructed to notify •
all Boards that all plans of City projects be submitted to the City Engineer for
his approval.

"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $300,000.00 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the
First National Bank of Rochester, Minnesota, for the purchase
of $300,000.00 United States Treasury Notes, Series C, dated
January 1, 1947 and maturing January 1, 1950, the same being
purchased for the following Sinking Fund Investment accounts:
Electric Department Depreciation Reserve $100,000.00
Electric Department Extensions Reserve 150,000.00
Water Department Depreciation Reserve 30,000.00
Water Department Extensions Reserve 20,000.00"
The City Engineers trial balance for the month of December, 1946 was
ead and the same was ordered placed on file.
The statement of receipts and disbursements in the Park Improvement Fund
as read and the same was ordered placed on file.
The City Treasurer's report for the month of December, 1946 was read

The reports of the Clerk of Municipal Court for the week ended January
1, 1947 showing total criminal fines and costs collected $276.00, civil fees
eceived $1.60 and conciliation court fees $3.50 and for the week ended January 1
947 showing total criminal fines and costs collected $499.00, civil fees receive
.25,.and conciliation court fees $3.75, were each read, and having been previous
pproved by the City Attorney, President Lemmon ordered that the same be. placed o
ile.
The request of Donald W. McConnell for transfer of his "On Sale" licens
or sale of liquor be transferred from 11 - 3rd Street Southwest to 15- 2nd Stree
outheast was read and upon motion by Narveson, second by Kennedy, the transfer
as granted.
The applications for license to sell cigarettes of Francis C. Washburn
nd Reynolds Wholesale Company were each read and upon motion by Narveson, second
y MCQuillan, the licenses were granted.
The application of Francis C. Washburn for a "Off Sale" non -intoxicating
alt liquor license was read and upon motion by Kjerner, second by McQuillan, the
icense was granted.
The application of Edward C. Aolst for a Journeyman Electricians license)
as read and upon motion by McQuillan, second by Kennedy, the license was granted.1
The applications of Deluxe Liquor Store, Don's Liquor Store and C & R
rket for permits to place and maintain a sign were each read and upon motion,:by
jerner, second by Narveson, the permits were granted.
The applications of Donald W. McConnell, Francis C. Washburn, and Norman
yatt and Edward Livingston for license to sell soft drinks wereeach read and upo

held on January 18, 1947 had recommended to the Common Council that all that partl;
of Outlot No. 14 lying north of 14th Street Northeast and all of Outlot No. 21
all in Northern Addition to the City of Rochester be changed to a commercial zone.

Upon motion by Narveson, second by Kjerner, action on the matter was temporarily i
,deferred until further study could be made of the zoning and platting in that

locality.
Alderman Fryer introduced a resolution appropriating $217.45 from the
'General Fund and ordering payment made to Quality Print Shop for office supplies,
which was read.
Upon motion by Kjerner, second by "jcQuillan, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution duly passed and adopted.

I, Alderman Fryer introduced a resolution appropriating $340.24 from the
General Fund and ordering payment made to State of Minnesota, Department of Taxation,
for inspection fee and state gasoline tax on 8691 gallons of gasoline, which was
'read.

Street & Alley Fund and ordering payment made to Rochester State Hospital for 207
yards crushed rock, which was read.

Alderman Kennedy introduced a resolution appropriating $5,400.00 from
the Fire Protection Fund and ordering' payment made to the Public Utility Fund for
2 rental of fire hydrants, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $1,762.69 from
he Park Improvement Fund and ordering payment made to Collector of Internal
evenue for taxes collected on admissions during December, 1946, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Aldermen Kjerner introduced a resolution appropriating $.333.00 from the
(lark Improvement Fund and ordering payment made to City of Rochester, Public
Utilities, for steam heat for auditorium, which was read.

An Ordinance entitled, "An Ordinance creating the office of City
Arborist in the Department of Parks; prescribing the duties of the City Arborist;
prescribing regulations relating to the planting and care of lawn extensions and
the planting, care, and removal of trees and shrubs in public highways, parkways,
parks, and other public areas of the City of Rochester, Minnesota; providing for
the issuing of permits in connection with -the planting, care, control, protection,
and removal of trees and shrubs in the public highways, parkways, parks and other
public places in the City of Rochester; and prescribing penalties for the violatio
of said ordinance", was given its first reading.
Alderman Yaeger reported that the Fire Department found it difficult to
get ladders to the third story of the Wagoner Hotel Building during the fire, due
to the fact that wires bracing the. sign were in the way. Upon motion by taeger,
aecond by "arveson, and all voting in favor. thereof, the Building Inspector was
instructed to have the Fire Chief approve all sign permits before the same are
granted.
The matter of publishing a new ordinance book was again discussed and
upon motion by Narveson, second -by Lennedy, the.matter was left in the hands of
the Finance Committee, the City_Attorney and the City Clerk.
Upon motion by Yaeger, second by Fryer, Acting Chief of Police, Arnold r
PT-elson and Officer, Harold Fitzpatrick were authorized to go to St. Paul ta_ make
plans with the F.B.I. officers for a police school.
Upon motion by Fryer,_second by Yaeger, the meeting was adjourned.
