Minutes of an. adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota,.held in the Council Chambers in the City Hall in
said City on April 14, 1947.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Akenhead, Fox, Fryer
Kennedy, Kjerner, and Yaeger. Absent: None.
Upon motion by Fryer, second by Fox, the minutes of the meeting of
April 7, 1947 were approved.
Proposals for being designated as City Depositories for City funds by
the First National Bank in the amount of $400,000.00, the Olmsted County Bank &
Trust Company in the amount of $200,000.00 and the Union National Bank in the
amount of $300,000.00, were each read and ordered placed on file.
President Lemmon stated this as being the -time and -place set'f.or
receiving proposals for the doing of the official printing and advertising for
the City of Rochester. The proposal of the Rochester Post Bulletin was read and
the same was ordered placed on file.
Mr. Russell Sanders, representing the Junior Chamber -of Commerce, -
appeared before the Council and requested that an appropriation in the amount of
$199.00 be made by -the City for the purpose of.furnishing music at the Gypsy
Frolic to be held._in May, 1947. Upon motion by Fryer, second by Kennedy, the
request was granted and the Mayor and City Clerk were instructed to issue the
check • to :the Junior Chamber of Commerce, ,in the amount of $199.00.
Mayor McQuillan announced the appointment of Dr. H. M.-Odel.an'd Dr. R.
.Jackman as members of the Public Health & Welfare Board for terms of three years
each. He also announced .the appointment of Mr. Carl Hooper as secretary for the
Mayor.. Upon motion by Fryer, second by Kennedy, the Mayor's appointments were
approved.

President Lemmon asked if anyone present had anything -to bring up at
Mr. Richard Manahan, representing the Vets Cabs, was present at the
meeting and protested the passage of the ordinance covering all taxi cabs operati
in the City of Rochester. Also Mayor McQuillan protested the passage of the sai
ordinance on the 'grounds that the delay before the Vets Cab's could receive a
?'tt g 8AIR4§�erepresenting the Service Cabs, was present and spoke in favor of
ranchise wou cause a loss for them. After further disdission a motion was
made by Fryer, second by Kennedy, that an Ordinance entitled "An Ordinance
regulating transportation systems 'to be operated over the streets of the City of
Rochester, requiring such transportation systems to be licensed and providing
penalty therefor", be given its third and final reading. All voted in favor
thereof.
Upon motion by Fryer, second by Yaeger, that the rules be suspended and

Upon motion by Yaeger, second by Kennedy, that the said ordinance be
adopted as read and all voting in favor thereof, except Alderman Fox who voted
"no", President Lemmon declared the said .ordinance duly naTsed and adopted.
The matter of determining the maximum number of taxi cabs which would
be allowed to operate in the City of Rochester was disc-assed briefly and upon
motion by Yaeger, second by Kennedy, the same was.referred to the Council as a
committee of the whole to study the question and for, report.

Gentlemen:
The Board of Public Health and Welfare submits herewith
the present salary schedule for - the City Health Department
and the City Farm. It is understood that any general wage
increases awarded to other city employees will automatically
be applicable to those listed here.
As it has in previous years, the Board would like
authorization for the employment of temporary farm laborers
at prevailing wages during the summer months when the work
of garbage collection is greatly increased.
During the -last year, the work of the Health Department and
the cooperating agencies has become more stabilized, and the
services to the people of Rochester have multiplied. The
Board could not have accomplished this end without the

The request of Christy Obrecht Show to May in Rochester on June 20, 21
22, 23_ and 24; 19.47 was read and the same was referred to the Finance Committee.
A notice by the. Wm. T. McCoy Post No. 92 that they intend to operate'a
bingo game in their club rooms at the Mayo, Civic Auditorium was read and President
Lemmon ordere& that the same be placed on file.
An application by the Vets Cabs to the Common Council for a :franchise
to oterate a fleet of eight taxi cabs in the City of. Rochester, was read and the

The following resolution adopted by the Public Utility Board was read
nd upon motion by Fryer, second by Irennedy, the same was approved.

A motion was made by Yaeger, second by Fryer, that the City Clerk's
salary be changed to conform with the salary set by the Public Utility Board for
the secretary of their Board.. All voted in favor thereof.
Mr. Walter IHaesley was present and protested the fact that adjustments
had been made in key position salaries when he had understood that•a flat raise
was to be given to all City employees. H-e further stated that he had received
no notice and knew nothing about an informal meeting which was held on April 11,
197 at 7: 30 O'clock P. M. Alderman Yaeger then made a motion that no action be
taken on any city salaries at this time, Alderman Fryer., seconded the motion and
the same was carried by all voting in favor thereof.
A motion was made by Fryer, second by Kennedy, that action approving
the Public Utility appointments and salaries be rescinded, all voting in favor
thereof.
Upon motion by Fryer, second by Yaeger, the City Clerk was instructed
to send notices of, an adjourned meeting of the Common Council to be held on
April 19, 1947 at 7:30 o'clock P. M. in the Council Chambers in the City Hall at
which time the matter of setting employees salaries would again be taken up, the
said notice to be sent by registered mail.
A petition for the construction of a sidewalk on the west side of 1246;h
Avenue Southeast from 6th to Sth Streets and on the south side of .6th Street
Southeast -from loth Avenue to 12th Avenue Southeast was read and the same was
eferred to the Street & Alley Committee and the City Engineer.
A petition for the construction of a curb and gutter on 5th Avenue
outheast between loth and llth Streets Southeast was read and the same was
eferred to the Street & Alley Committee and the City Engineer.
A petition for the construction of a curb and gutter on 2nd Street
ortheast from llth Avenue -to 13th Avenue Northeast was read and the same was
eferred to the Street & Alley Committee and the City Engineer.
A petition for the construction of a sanitary sewer and watermain in
Oth Avenue Northeast from •5th Street Northeast to Silver Creek was read and the

A petition that Carl Person operating Carl's East End Grocery at 1221

in conjunction with his grocery store was read and upon motion by Fox, second by ! •

a report as to the legality of issuing an •'on sale" non -intoxicating liquor

license to a store where groceries are :sold.

The recommendation of the License Committee that no further "on sale" i •
intoxicating liquor licenses be issued at this time was read. Mr. William J.
Murphy, who had previously applied for an "on sale" intoxicating liquor license.,

was present and asked the Council's reason for not granting a license to hip.
Alderman Fox replied to his request stating that the recommendation of the Licens�'
Committee was not in favor of granting any further licenses at this time. A
motion was made by Fox, second by Kjerner, that the applications of William J. j
;Murphy, Earl F. Koelsch, and Bruno G. Lisi be not granted and that the City Clerk
return the deposits made with their applications. All voted in favor thereof �
except Alderman Fryer, who voted "no".
The recommendation of the Finance Committee that the sum of $100,000.00!
be transferred from the Bridge Fund to the Sinking Fund and that the same be

invested in short term bonds, was read and upon motion by Fryer, second by Kjerner,,
the same was approved. r
The report of the Clerk of the Municipal Court for the week ended
April 12, 1947 showing total criminal fines and costs collected $504.00, civil �
,fees received $14.00, and conciliation court fees $5.75, was read and having been �
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file. II
The annual report of the Public Utili.ty Board for the year._ended
March 31, 19147 was presented and upon motion by Yaeger, second by Kennedy, the �!

The certificate of insurance of the Cleveland Wrecking Company and Rose
Brothers Lumber & Supply Company with the limits of liability as $50,000.00 for •
.each person and $100,000.00 for each accident with Liberty Mutual Insurance Company
as surety and the certificate of insurance of Howard McGoon showing the limits of
liability as $25,000.00 for each person, $50,000.00 each accident with the United

The surety bonds of Paul Dornack, Chester A. Cottingham, Erwin Standke
and Desmond Hunt each in the sum of $500.00 with the American Surety Company as

during March, 1947, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
