Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall in
• said City, on April 19, 1947.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Akenhead, Fox, Fryer,
Kennedy, Kjerner, and Yaeger. _Absent: None.
Upon motion by Kjerner, second by Fryer, the minutes of the meeting of
• April 14, 1947 were approved.
The Mayors appointment of the following members and employees of the
Park Board as special policeman for the fiscal year 1947-1949 was read: Arthur R.
Nachreiner, William C. Schacht, Phillip H. Lampman, Andrew L. Koehnen, William M.
Van Hook, Axel H. Reed, Grant Fellows, George White, Herbert Thienell and George
Laack. Upon motion by Yaeger, second by Akenhead, the appointments of the Mayor
were approved.
The following copy of a resolution adopted by the Commissioners'of the
Sinking Fund -was read and upon motion`, by Fryer, second by Fox, the same was
approved:
"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $220,000.00 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the
First National Bank of Rochester, Minnesota, for the purchase
of $220,000.00 United States Treasury Notes, Series G, Dated
April 1, 1947 and maturing April 1, 1950, the same being pur-
chased for the following Sinking Fund Investment accounts:
Electric Light Depreciation Reserve 100,000.00
Electric Department Extensions Reserve 100,000.00
Waterworks Depreciation Reserve 20,000..00u
A remonstrance against the annexation to the City of Rochester, of
Ilnollwood Acres, a subdivision in Rochester Township, Olmsted County, Minnesota
Signed by 37 owners of real estate in said subdivision was read and President Lemm
ordered that the same be placed on file.
A petition for the construction of a curb and gutter on the east side of
5th Avenue Northwest between West Center Street and 1st Street Northwest was read
lnd President Lemmon referred the same to the City Engineer and the Street & Alley

The recommendation of the Finance Committee that the Rochester Fire
(lDepartment Relief Association make a loan to Lyle Brown in the amount of $1, 500.00
withl,interest at the rate of 4% and a loan to Carl Lee in the amount of $1200.00
with interest at the rate of 4% was read and upon motion by Fryer, second by Fox,
the recommendation was approved,
The application of Don E. Postier for Journeyman Electricians License was
read and upon motion by Kjerner, second by Akenehead the license was granted.
The application of the Board of Park Commissioners for license to sell
cigarettes at the auditorium was read and upon motion by Yaeger, second by Fox, the

The applications of the Board of Park Commissioners (5) and Leroy R. j
Hennum for license to sell soft drinks were each read and upon motion by Kjernerl,

second by Kennedy, the licenses were granted.
The application of Margaret Lewis for a license to operate a public
automobile camp was read and upon motion by Yaeger, second by Fryer, the license;
was granted.
The application of Donald Cunningham for a license to operate a pool
hall (6 tables) was read and upon motion by Yaeger,.second by Fryer, the license;
was granted.
The surety bond of Francis J. Magnuson in the amount of $500.00 with the

Hartford Accident and Indemnity Company as surety was read .and upon motion by
Fryer, second by Kennedy, the bond was approved, the surety thereon accepted and!,
President Lemmon ordered that the same be placed on file.
A petition that Carl Persons be permitted to operate his .store known
as Carl's East End Grocery at 1021 Fourth Street Southeast and continue selling
both groceries and non intoxicating malt liquors "on sale" was read. The City
Attorney stated that he had given a written opinion to the Mayor and he had alsoi,
presented quoted opinions of the Attorney General to the effect that, it is
illegal to sell both groceries and non intoxicating malt liquor "on sale" under
the same business.
Alderman Fryer introduced a resolution fixing the salary of the City
Clerk at $4.680.00 per year; City Engineer at $7,000.00 per year; City Attorney ;I
at $3,600.00 per year; City Treasurer at $3,000.00 per year; City Weighmaster at:
$2,400..00 per year; Assistant Custodians of the City Hall, one at $2,460._00 per j!
year and two at $2,340.00 per year; Assistant City Engineer at $3,600.00 per I!
year; Foreman (Engineer Department) at $3,300.00 per year; and Mechanic at

i Warehouse at $3,120.00 per year, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution fixing the salary of the
Electrical Inspector at $3,300.00 per year, which was read. j
Upon motion by Kjerner, second by Kennedy, that the said resolution be'�
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution fixing the salary of the Building

Alderman Fryer introduced a resolution fixing the salary of the Heati
Inspector at the sum of $3,300,00 per year, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution fixing the salary of the City
Clerk.'s first stenographer 8b the sum of 2,640'000, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolutionfixing the salary of the City
Clerk's Second Stenogrpaher at the sum of $2,040,00, which was read.
Upon motion by Kennedy, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution fixing the salary of the City
Engineer's private secretary at the sum of $?,640.00 per year, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
said resolution ditly-passed and adopted.
Alderman dennedy introduced a resolution fixing the salary of the Mayo:
Secretary at the sum of $2,400.00 per year, which was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution, be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the salary of the
Stenographer for the Chief of Police, Juvenile Officer and City Attorney at the
sum of $2,100.00 per year, which was read.
Upon motion by Kjerner, second by Fox,.that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the salary of the Judge
of Municipal Court at the sum of $39900.-00 per year, which was read. -
Upon motion by Kennedy, second by Fox, that the said resolution be-
adopted as read, and all voting in favor thereof, President Lemmon declared the,
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the salary of the Clerk
of the Municipal Court at the sum of $2,220.00 per year, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Kennedy introduced a resolution fixing the salary of the

Second Assistant Superintendent of the Dumping Grounds at $2,64o.00 per year,
which was read.
Upon motion by Fox, second by Kjerner, that the said resolution be

Alderman Akenhead introduced a -resolution fixing the salary of the l'

Provided that all policemen appointed who have not had previous
expreience as policemen shall receive a salary and compensation in the amount
of $195.00 for the first six months; $2.10.00 for the next 12 months; and $225.00
maximum.
Such salaries and com-pensation shall be paid from the General Fund of
said City in equal monthly installments, one half of the monthly salary and
compensation being payable on the 16th day of each month and the balance thereof
on the last day of each calendar montbr during. the ensuing official year."
Upon motion by Fryer, second by Akenehead, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Akenhead introduced the following resolution which was read:
"Be it and it is hereby resolved by the Common Council of the
City of Rochester, Minnesota:
That pursuant to the provisions of Section 117 of the Charter
of said City, the City Engineer is hereby authorized to employ
30 men regularly on a monthly basis at a salary not to exceed
$220..00 each, per month;
Be it further resolved by the said Common Council:
That the City Engineer is hereby authorized to employ one
bub-foreman on a monthly basis at a salary of $2,700.00 per
year.
Be it further resolved by the said Common Council:
That in case of extreme emergency the City.Engineer of
said City is hereby authorized to employ such additional men
as may be held necessary during said emergency."
Upon motion by Fox, .second by- K jerner, that the said resolution be
adopted as read, and all voting.in favor thereof, President Lemmon declared the

Alderman Akenhead introduced the following resolution which was read:

in the Public Health and Welfare Department, as'llsted in the minutes of the
meeting held on April 14, 1947, which was read.

Alderman Fryer- introduced a resolution approving salaries to be paid
,,to the employees in the Public Utility Department, as listed in the minutes of
•the meeting held on Apri-1 14, 1947, which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
adopted as read, and upon roll call and all voting in fa-vor thereof, President
,Lemmon declared the said resolution duly passed and adopted.
Alderman Fryer introduced a resolution granting a dance permit to the
Rochester Junior Chamber of Commerce, which was read.

stakes, which was read.

Alderman Kennedy introduced a resolution appropriating $631.95 from the
Park.Improvement Fund and ordering payment made to Addressograph Division, which
was read.

Alderman Akenhead introduced a resolution appropriating $432.00 from thi
Park Improvement Fund and ordering payment made to Albert F. Runnel for two
spotlights, which was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $1,333.40 from
the'Park Improvement Fund and ordering payment made to The Ra-Tel Company , which
was read.
Upon motion by -Akenhead, second by Fox, that the said resolution be

Alderman Kjerner introduced a resolution appropriating $235.00 from the
Park Improvement Fund and ordering payment made to Velie Ryan'Inc. for merchandise
delivered to the the Mayo Civic Auditorium, which was read.
Upon motion by Fryer, second by Akenhead, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Yaeger introduced a resolution appropriating $442.50 from the I,

Upon motion by Kjerner, second by Fox, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the J

Alderman Yaeger introduced a resolution appropriating $411,72 from the J
Lighting Fund and ordering payment made to City of Rochester, Public Utilities,'

Upon motion by Kennedy, second by Akenhead, that the said resolution bel'I
,adopted as read, and all voting in favor thereof, President Lemmon declared the �I

Alderman Kennedy introduced the following resolution which was read:

"WHEREAS, Section 7 of Ordinance No. 415 provides that the
Common Council of the City of Rochester, Minnesota, on the first
Monday in April in each year shall establish a minimum wage
scale for all public works for the ensuing official year;
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, 05Minnesota:
That for and during the official year following the passage •
and adoption of this resolution all contracts hereinafter entered j
into for the purpose of performing any work for the City of
Ro"chester, involving either new construction work or repair on
any roads, bridges, sewers, alleys, parkways, buildings, streets,
or any other public work involving the improvement of public
property, shall be made upon the basis that the wages paid
skilled and unskilled labor shall conform to the prevailing
wages established by the unions, representing such labor and
various contractors for skilled and unskilled labor.11

Upon motion by Fryer, second by Akenhead, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Mr..Walter Heasley was present at the meeting and requested that the
employees represented by him in various departments work 40 hours per week. A
motion•was made by Fryer, second by Kjerner, that all employees in the Park
Department, City Engineer's Department, and Public Health & Welfare Department.

A motion was made by Fryer, second by Fox, that the action taken by the
Common Council on April 7, 1947 approving the recommendation of Francis J.
Magnuson-, City Engineer, that 30 men be employed in the City •Engineer's Departmen

Mr. Paul Plantz, Electrical Inspector, stated the Electricians in" the
City had requested that all emergency resolutions or ordinances effecting electrical
work within the City of Rochester which had been adopted during the war emergency
be repealed. A motion was made by Fryer, second by Fox, that any emergency
regulation which had been adopted for the duration of the war be repealed. All
noted in favor of 'the motion.
Mr. Paul Plantz, Electrical Inspector, asked to attend a meeting to be
to be held in St. Paul on May 7. Upon motion by Fox, second by Bjerner, the
request was approved. -
A petition to the Charter Commission of the City of Rochester that
Section.293 of the Charter of the City of Rochester, Minnesota, be amended to
increase the salary of the -Mayor to $1200.00 per year, the Alderman at Large to
$1200.00 per year, and the general members of the Common Council to $1000.00 per

presented by Mr. Harry Gimbert. -City Attorney Hunt ruled that the said petition
should be presented directly to the -Charter Commission df the City of Rochester,
and no action was taken on same by the Common Council.
The matter -of an Ordinance regulating transportation systems to be

operated over the streets of the City of Rochester, requiring such transportation
systems to -be licensed and providing penalty therefor, was again discussed.
President- Lemmon recommended that an amendment to the said ordinance be adopted
which would permit any person' or persons, firm, association, partnership or
corporation to operate upon or over the streets, alleys,' or public highways of the

City of Rochester operat* ae of April 1st,' to continue their operations providing
that an application for a franchise is made to the Common Council not later than
,ten days after the adoption and official publication of the said amendment.

Kennedy, to override the Mayor's veto of the said ordinance. All voted In favor

thereof. After further discussion a motion was made by Fryer, second by Kennedy,
that the motion to override the Mayor's veto.be withdrawn. All voted in favor
thereof.
City Attorney Hunt then presented an ordinance regulating tran'sportatlo

transportation systems to be licensed and providing penalty therefor, which*conta
_the prOvisions.;as-recommended by President Lemmon, was given its first reading.
Upon motion by Fryer, second by Kennedy, and upon roll call and.all
voting in favor thereof, the rules were suspended and the ordinance was given
its second reading.
Upon motion by Yaeger, second by Kjerner, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Fryer, second by Kennedy, that the said ordinance be
adopted as read, and,all voting in favor thereof, President. Lemmon declared the
said ordinance duly passed and adopted.
Upon motion by Kennedy, second by Kjerner, the meeting was adjourned
until 7:30 o'clock P. M. on Monday, April 21, 1947,
