Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester,.Minnesota,- held in the Council Chambers in the City Hall, in
said City on July 21, 1947.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Alderman Fryer, Fox, Kennedy,
Kjerner, and Yaeger. Absent: None.
Upon motion by Kjerner,'second by Akenhead, the minutes of the meetings
of June 23rd and July 7th, 1947 were approved.
President Lemmon stated this as being the time and place set for a
second hearing on the construction of a sanitary sewer and watermain in 6th Street
Southeast between 12th and 13th Avenues Southeast. There was no"one present
wishing to be heard.
President Lemmon stated this as being the time and place set for a

between hth Avenue Northwest and Cascade Creek. There was no one present wishing
to be heard.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the purchase of one Fordor Sedan for use in the
Police Department.

The bid of Universal Motors, Inc. in the amount of $825.00 wail
The recommendation of the Police Committee that one 1947 Ford Sedan,
100 F. P. for use in the Police Department be purchased from Universal Motors, Inc.
for the amount of $825.00, was read and upon motion by Kennedy, second by Akenhead,
the recommendation was approved.
Mr. Leon Pike, Chairman of the Haverhill Township Board and two other
members of the Board appeared before the Council and inquired as to whether or
not the City maintained 2 of the road running North and South directly,East of th
State Hospital. Upon motion by Fryer, second by Akenhead, the matter was referre
to the Street & Alley Committee, the City Engineer and the City Attorney to
determine whose responsibility it was to maintain the said road.
Alderman Fox, Chairman of the License Committee, made a verbal recommendation
that the applications of Arthur S. Bourassa and Carl Persons for "On Sale" non -
intoxicating malt liquor licenses be granted. Upon motion by Fox, second by
Kennedy, the licenses were granted.
The recommendation of the Airport Commission that the plans and speci-
fications submitted by the consulting engineer for improvements to be made at the
Rochester Airport be approved and that bids be called for 'on August 4, 1947 was
read and upon motion by Fryer, second by Kjerner, the recommendation was approved
and the City Clerk was instructed to advertise f-or bids to be received on August
1947.

The following report and recommendation by the Firemen' Civil Service
Commission and the Fire Committee were each read and President Lemmon ordered that
the same be placed on file: •
"Honorable Mayor & Common Council
of the City of Rochester
Rochester, Minnesota
Dear Sirs:
The examinations for regular firemen are completed and
the elegibility list has been set up. All applicants •rho
took the examination have been mailed their grades and •
position on the list. One hundred two applicants completed
the examination and after adding five points for veterans,
there were ninety (90) that received a passing grade.
We, the Commission understand that we have no authority
over hours and wages of firemen but we do wish to make the
following recommendations:
1. That firemen work six days a week and eight hours
each day.
2. That beds in the department be removed.

We, the Fire Committee, in line with former discussions,
that whenever the Department goes on 8 hour day working
basis, that the beds and bedding be removed and disposed"
of at best prices available.

The abb ve recommendation of the Fire Committee was read and upon motion-,
by Ye.eger, second by Kennedy, the matter of disposing of the beds and bedding was'
referred to the Fire Committee with power to act.
The following petition signed by 101 petitioners from North Rochester
was read:
"To Honorable Mayor and Common Council,
City of Rochester.
We, the undersigned property owners in North Rochester, hereby
petition your Honorable Body to take immediate action to remove
the City Dump from its present location or provide funds and •
equipment for the removal of the smoke nuisance now existing
at the city dump.
We request immediate action as present conditions create a
hazard to the health and welfare of residents in this vicinity.
Conditions which now exist do have a damaging effect on the
value of our properties. In addition the smoke pall which
continuously lays over this section of town is irritating
and uncomfortable. Also the odor created from said smoke is
a nuisance and detriment to our health and to the standard of •
living in our community which is otherwise a representative
residential district.
Your prompt action is solicited and will be appreciated."
Mr. James A. Donovan, representing a delegation of residents from North''
Rochester was present and urged that the dump be moved from North Broadway as soon
as possible and in the meantime that provisions be made to control fires which
burn almost constantly. President Lemmon ordered that the petition be placed on

file and referred the matter to the Public Grounds Committee for report at the
meeting of August 4, 1947.
The City Engineer's estimate of cost for the construction of a curb an
gutter in 7th Avenue Southeast from 9th Street to 12th Street Southeast in the
amount of $79.04 for a 49.4 ft. lot without driveway and $97.04 for a 49.4 ft.
lot with a 9 ft. driveway, was read and President Lemmon ordered that the same be
placed on file.

A communication from the Minnesota Association of Professional Engineer!
calling attention to the provisions of Chapter 390, Laws of Minnesota of 1945,
in regard to the employment of professional engineers, was read and the same was
ordered placed on file.
A communication from Richard S. Cook, Sr. suggesting that the Common
Council adopt an ordinance licensing all parties or firms engaged in refilling,
recharging and serviceing any and all types of Fire Protection Equipment, was
read and President Lemmon referred the same to the Fire Committee, the Chief of
the Fire Department and the City Attorney.
The claim of Richard E. Hanson in the amount of $400.00 for damage whi
he claims was caused by being struck by a Vets Cab owned by Harry Prouty and drive
by Duane Berg, was read and upon motion by Yaeger, second by Fryer, the matter
was referred to the City Attorney with power to act.
The application of Bert Winslow for the position as watchman atthe newt
parking lot was read and the same was ordered placed on file.
The request of the Board of Park Commissioners for the approval by the
Common Council of the employment of a second stage electrician and general
maintenance man at the Mayo Civic Auditorium was read and upon motion by Fox, se

by Akenhead, action was deferred on the matter until the meeting of August 4, 19471•
A notice that the Railroad and Warehouse Commission will conduct a
hearing on August 15, 1947 at 1; 30 o'clock P. M. in the matter of the application
of Rua.n Transport Corporation for Petroleum Carrier Certificate, was read and the
same was ordered placed on f ile.
Seven certificates of insurance issued by the Underwriters of Lloyd's
London certifying that the Vets Cabs are insured under separate policies for each
car, effective date June 27, 1947, were each read. The matter of the said Company
furnishing endorsements for the said policies requiring 10 days notice of
cancellation was discussed and upon motion by Yaeger, second by Kennedy, the City
Attorney was instructed to amend all taxi cab ordinances requiring 10 days notice
of cancellation of policies filed with the City. All voted in favor thereof
except Alderman Fox who voted "no".
The recommendation of the Board of Zoning that the request to operate
a furniture and electrical appliance store at 1204 north Broadway be not granted

was read and upon motion by Yaeger, second by Kjerner, the said recommendation was
approved and the request was denied.
The recommendation of the Board of Zoning that the petition of Mrs. Eva •
Garbisch to have her property known as the North 1 of Lots 5 and 6, Block S3, Moe
& Olds Addition changed from a residential to a commercial zone be granted was
read and upon motion by Yaeger, second by Fox, the same was approved and the City
Attorney was instructed to draw an amendment to the Zoning Ordinance making the •
said change.
The following recommendations of the Committee appointed by the Council
'to make a study of the use and operation of the new parking lot were read and
President Lemmon ordered that the same be placed on file: (1) That parking in the
City Parking Lot be free for a period of not over one (1) hour. (2) That the
restricted hours be the same in the lot as on the streets. (3) That the lot be
lighted at night.
The Mayor's veto of a resolution accepting plans and specifications and
'ordering bids for the grading and graveling of 6th Avenue Northwest from loth to
14th Street Northwest; 7th Avenue Northwest from.10th to 14th Street Northwest;
8th Avenue Northwest from llth to 14th Street Northwest; 9th Avenue Northwest from
loth to 14th Street Northwest; llth Street Northwest from 5th to 9th Avenue
Northwest and 12th Street Northwest from 5th to 9th Avenue Northwest, adopted by
the Common Council on July 7, 1947 was read. A motion was made by Kennedy, second
by Yaeger to override the Mayor's veto, and upon roll call all voted in favor
thereof except Alerman Fox who voted 11no".
The following report from the Veterans Housing Project was read and the,
same was ordered placed on file:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
The enclosed checks for $500.00 and $1,623.81 represent
the end of the fiscal year settlement of the Rochester
Veterans Housing Project.
According to the contract executed between the Federal
Public Housing Authority and the City of Rochester, the
City is to receive $62.50 per month for the rent of the
ground. The check for $500.00 covers eight months rent
•
from November 1, 1946 to July 1, 1947.
The $1,623.81 check represents the saving between the
actual operating costs and the fixed operating costs.
According to the ammended contract between the City of
Rochester and the Federal Public Housing Authority,
Section (2), sub -section 2.04 states that any money
saved by efficient operation may be set aside as a
reserve for the payment of deficits in future operation

and Management.

The City Treasurer's report for the month of June, 1947 was read and
the same was ordered placed on file.
The Health Officer's Lockup Inspection Report dated July 19, 1947 was
read and the. same was ordered placed on file.
The reports of the Clerk of the Municipal Court for the week ended
July 12, 1947 showing total criminal fines and costs collected $874.00, civil fee:
received, $4. 30 and conciliation court fees $. 50 and for the week ended July 19,
1947 showing total criminal fines and costs collected $373.00, civil fees receive(
$4.20, and conciliation court fees $3.50,.were each read and having been previous:
(approved by the City Attorney, President Lemmon ordered that the same be placed
on .file.
The application of John R. Morrison for a Journeyman Electricians Licen;
was read and upon motion by Kjerner, second by Fox, the license was granted.
The applications for license to sell cigarettes of Arthur and Hazel
(Kruger, Orville L. Rowland and Robert C. Ramsdell were each read and upon motion
I by Fryer, second by Kennedy, the licenses \ire granted.
The application of the Lysne Construction Company for permission to move
a new house over certain streets in the City of Rochester was read and upon motio
by Kennedy, second by Fryer, th-e permit:, was granted.
The applications for licenses to sell soft drinks of Robert H. Tank,
Arthur A. Krueger, Bernard J. Semadenie and Robert Ramsdell were each read and
upon motion by Kjerner, second by Akenhead, the licenses were granted.
The license bonds of Squires Electric Company in the amount of $1,000.01
with The Mill Mutuals as surety, E. J. Armit in the amount of $1,000.00 with The
Fidelity &. Casualty Company as surety and Emil J. Nietz in the amount of $1,000.0

with the Western Surety Company as surety, were each read and upon motion by Fryer,
second by Kennedy, the bonds were approved, the surety thereon accepted and it wa,
ordered that the same be placed on file.
The surety bonch of Gordon Winslow in the amount of $6,920.95, Carlisle
(Fraser in the amount of $1,649.10-and Cleveland Wrecking Company in the amount of
l$67.70 were each read and the same were referred to the Mayor.for approval.
Alderman Fryer introduced. a resolution appropriating $296.10 from the
General Fund and ordering payment made to.Walter C. Heins Agency for premium on
insurance as.listed on general insurance form, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduceda resolution appropriating $230.13 from the
General Fund and ordering payment made to.R. W. Chadwick for premium on insurance
as listed on general insurance form, which.was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $1,119.60 from the
General Fund and ordering payment made to C. 0. Brown Agency for premium on insurance
as listed on general insurance form, which was read.
Upon motion by Kennedy, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $20,5.88 from the
General Fund and ordering payment made to Scheidel & Company for premium on insurance
as listed on general insurance form, which was read.
Upon motion by Fryer, second by Akenhead, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $396.33 from the
General Fund and ordering payment made to Herbert G. Knopp for premium on insurance
as listed on.general insurance form, which was.read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Frier introduced a resolution appropriating $200.00 from the

Alderman Fryer introduced a resolution appropriating $1,725.96 from the
(General Fund and ordering payment made to Standard Oil Company for cutback asphalt

Upon motion by Fryer, second by Fox, that the said resolution be adopted'

• Alderman Fryer introduced a resolution -appropriating $643.15 from the
(General Fund and $69.30 from the Fire Protection Fund and ordering payment made to
the Schmidt Printing Company, which was read.

dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $571.40 from the
(General Fund and ordering payment made to Chicago Great Western Ry. Company for

Street & Alley Fund and ordering payment made to California Brush Company, which

Alderman Kennedy introduced a resolution appropriating $490.00 from the
Street & Alley Fund and ordering payment made to Quarve and Anderson for crushed
rock, which was read.

Alderman Kennedy introduced a resolution appropriating $410.12 from the
Street & Alley Fund and ordering payment made to C. M. Boutelle for extra work
on curb and gutter job at Sth Avenue Southeast from 6th to 9th Street Southeast,
which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be,
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $22. 30 from the
Street & Alley . Fund and $374. 47 from the Sewer Fund and ordering payment made to
Hayes Lucas Lumber Company, which was read.
Upon motion by Kennedy, second by Fryer, that the said.resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $20,000.00 from
the Fire Protection Fund and ordering payment made to American LaFrance Foamite
Corporation, which was read.
Upon motion by Akanhead, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Park Improvement Fund and ordering payment made to Departmental Insurance Charges-
eneral Fund for insurance on Parks, which was read.

dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Fox introduced a resolution appropriating $5, 377.33 from the

Alderman Fox introduced a resolution appropriating $444.30 from the Par
Improvement Fund and ordering payment made to Perry Beach for sanding auditorium
loon, which was read.
Upon motion by Fox, second by Akenhead, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Park Improvement Fund and ordering payment made to Coca Cola Bottling Company,
which was read. •
Upon motion by Kennedy, second by Fox, that the said resolution be -

Alderman Fox introduced a resolution appropriating $390.00 from the •
Park Improvement Fund and ordering payment made to W. H. Schaper Company for two
popping machines, which was read.

adopted as read, and all voting in favor thereof, President' Lemmon declared the
said resolution duly passed and adopted.
Alderman Fox introduced a resolution appropriating $1,513.73 from the
Park improvement Fund and ordering payment made to Departmental Insurance Charges -
General Fund for insurance on auditorium, which was read.
Upon motion by Yaeger, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fox introduced a resolution appropriating $126.24 from the Park
Improvement Fund, $141.91 from the Lighting Fund and $10.44 from the F. E. Williams
,Fund and ordering payment made to City of Rochester, Public Utilities, which was
read.
Upon motion by Akenhead, second by Fox, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fox introduced a resolution appropriating $305.94 from the
Lighting Fund and ordering payment made to City of Rochester, Public Utilities for
lighting airport, which was read.
Upon motion by Fox, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Motors, Inc. for the purchase of one four door sedan for use in the Police
Department, which was read.

Alderman Kjerner introduced a resolution ordering bids for construction
of base and bituminous surface on 1943 Runway extensions at the Rochester Airport,

Alderman Kennedy stated that he had met with Mr. Duval, of the firm of
Toltz, King & Day, Inc. Architects and Engineers for the proposed Sewage Disposal,'
Plant, and he recommended that a study be made of the sewage rentals. Upon motion
tby'Fox, second by Kennedy, the City Engineer was instructed .to get in touch with
Mr. Duval and make an appointment.for him to meet with the Council and himself

to go over the matter -of sewage rentals.
Alderman Kennedy stated that he had-talked.vrith Mr. Bert Leitzen in
regard to the -purchase of land North of Silver Lake and upon motion by Kennedy,
second -by Fox, the matter -was referred to the Mayor and the two Aldermen from the
Third. Ward.' _-
Alderman Akenhead, of the Fire Committee, presented specifications of al
cable for the Fire Alarm System to replace a cable running between the Fire
Station and -the City Hall Building. Upon motion by Akenhead, second by Fox, the
bity Clerk was -instructed to advertise for bids for the said cable, the bids -to -be
received on.August-4th, 1947. -
-The matter of claims for damaged clothes of employees of the City -was
discussed and a motion was made by Kennedy,*second by Kjerner, and all voting in
favor thereof, that such claims be not allowed. 1. -
Inquiry. was made of Acting Chief of Police,. A. M.. Nelson, as to whether
or not dates had been set for -any examinations to -set up 'an eligible list, of -
employees in the Police Department. Acting Chief Nelson stated that no dates-hadl
been set to the present time and upon motion by Fryer, second by Fox, the City -
Clerk was instructed to write -the Police Civil Service .Commission making inquiry
as to when they expected to hold the said examinations.
Upon motion by Fryer, second by Kjerner, $199.00 was appropriated from
the General Fund and payment made to t-he -Mayor's Cont-ingent Fund.
The matter of a -gift of $150,000.00 from the Mayo .Association to the
City of Rochester to aid i-n construction of a publ-ic health center was again
brought up- and upon motion by Kennedy, second by Akenhead, the same was accepted
and it was directed that the same be placed in a -sinking fund and that the Sinking
Fund Commission invest it until such time as it can be used.
President-Lemmon stated that -it was -very noticeable that boxes -and
rubbish were strewn about the streets off of rubbish haulers wagons and upon motic
by Kennedy, second by Fox, the City Attorney was'instructed to amend the rubbish
hauling ordinance requiring all rubbish haulers to provide end gates to the boxes
o'n their trucks.
At a meeting of the Common Council held on July 7, 1947, the transfer
the.tetrahydron United States Civil Aeronautics to the City of Rochester, Minnesolta
for maintenance under license forms 401 and 4olA was approved by the Common Counci
However, no authorization of any city official to sign the said license form was
made. Upon motion by Fryer, second by Akenhead,' Mayor Claude v. McQuillan was
authorized to execute the said license forms.
Upon motion by Fryer, second by Kennedy, the meeting was adjourned.
