Minutes of an adjourned regular meeting of the Oommon Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on November 17, 1947. •
President Lemmon called the meeting to order at 7:30 o'clo•ck P.M., the
following members being present: President Lemmon, Aldermen Akenhead, Fox,
Fryer, Kennedy and Kjerner. Absent: Alderman Yaeger, due to illnes.
President-Lemmon stated this as being the time 'and? place set for the •
second hearing on the construction of a sanitary sewer and watermain and the
grading of llth Avenue Southeast from 225 feet south of 7th Street Southeast to
555 feet South of 7th Street Southeast. There was no one present wishing to be
heard.
President Lemmon stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a sanitary
sewer and watermain in 13th Avenue Southeast from 4th to 6th Street Southeast.
There was no one present wishing to be heard. -
President Lemmon stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a watermain,
in loth Street Southeast from 9th to llth Street Southeast. There was no one
present wishing to be heard.
President Lemmon stated this as being the time and place set.for a -
hearing on the levying of special assessments for the construction of a curb and
gutter on the east side of 5th Avenue Northwest from West Center to 1st Street
Northwest. There was no one present wishing to be heard.
President Lemmon stated this as being the time and place set for a
hearing on the levying of special assessments for the grading of Sth Avenue
Northwest from loth Street to 395 feet North. There was no one present wishing
to be heard.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the construction of a sanitary sewer and watermain
and the grading in 12th Avenue Northeast, North of 14th Street Northeast in DuVille •
Addition.Mr. George Leiferman was present and stated that they wished to postpone
the said improvement until next spring. A motion was made by Fryer, seconded by
Kjerner, and all voting in favor thereof, that Mr. Fraser's bid be returned to
him unopened and that the City readvertise for bids on the said project in
February, 1949. •
President Lemmon stated this as being the time and place set for
receiving and opening bids for the construction of a sanitary sewer and watermain
and the grading of llth Avenue Southeast from 225 feet South of 7th Street
Southeast to 555 feet South of 7th Street Southeast. The bid of Carlisle G. Fraser
in the amount of $3,067.50 for watermain and $330.00 for sanitary sewer and the

bid of Leon Joyce for grading in the amount of $1,097.30 were each received and
opened.
President Lemmon stated this as being the time and place set for
receiving and opening -bids for furnishing a street sweeper for use in the City
Engineer's Department. The bid of The George T. Ryan Company in the amount of
$5,700.00 was received and opened.
President Lemmon stated this as being the time and place set for
receiving and opening bids for furnishing one material spreader for use -in the
City Engineer's Department. The bids of Wm. H. Ziegler Company in the amount of
$915.00 and Ruffridge Johnson Equipment Company in the amount of $735.00 were
each received and opened.
President Lemmon stated this as being the time and place set for
receiving and opening bids for furnishing t-wo dump trucks for use in the.. -City
Engineer's Department. The bids of Ellis Motor Company in the amount of $5,300.0

for two trucks and the bid of Clements Chevrolet Company in the amount of $2, g8.211 5
each, were received and opened.
President Lemmon stated this a-s being the time and place set for
receiving and opening bids for furnishing an industrial type tractor for use in
the City. engineer's Department. The bids of Universal Motors, Inc; in the amount
of $1,250.00, Rosholt Equipment Company in the amount of $3,935.00, The George T.
Ryan Company in the amount of $2,550.00, Gopher Equipment and Supply Company in
the amount of $2, 550.00, and Wm. H. Ziegler Co._, Inc., in the amount -of $2, 768.10
were each received and opened.
President Lemmon stated this as being the time and place set for
receiving and opening bids for making the proposed change in the channel in Bear
Creek. The bid of Leon Joyce in the amount of $14,615.65 was. received and opened.
The recommendation of the Sewer Committee that the contract for the
installation of a. sanitary sewer in.11th Avenue Southeast Prom 225 Feet South of
7th Street Southeast to 555 feet South of 7th Street Southeast be awarded to
Carlisle G. Fraser for the sum of $330.00 was read and upon motion by Fryer,
second by Fox, the recommendation was approved.
The recommendation of the Water Committee that the contract for the
installation of a watermain in llth Avenue Southeast from 225 feet South of 7th
Street Southeast to 555 feet South of 7th Street Southeast be awarded to Carlisle

Akenhead, the recommendation was approved.
The recommendation of the Street and Alley Committee that the contract

Upon motion by Fryer, second by Kennedy, action on the purchase -of a
street sweeper, a Material Spreader, two Dump Trucks, and one Industrial Type •
Tractor was deferred until the meeting of December 1, 1947.
The recommendation of the Street & Alley Committee that the contract
for the Bear Creek Channel Change be not awarded and that the Engineer be ,
instructed to proceed with the work was read and upon motion by Akenhead, second •
by Kennedy, the same was approved.
Upon motion by Fryer, second by .Kennedy, the, City Clerk was authorized
to return the certified checks submitted with bids for the change in the Bear
Creek Channel,
President Lemmon stated that the City Clerk had made a verbal report
on the recommendation of the Board of Zoning that real estate in Block SS, of
Original Plat be not rezoned as commercial area. Upon motion by Kjerner, second
by Akenhead, the report of the Board of Zoning was approved.
President Lemmon stated that the City Clerk had made a verbal report
that the Board of Zoning recommended that their previous report on the petition
of Marie Erickson to operate a beauty parlor at 1225 Seventh Avenue Southeast
be not changed. Upon motion by Fryer, second by Fox, the recommendation of the
Board of Zoning was approved.
A communication from Lee.M. Nelson.requesting that a lease for a
private crossing over the Chicago Northwestern ,Railway be executed by the City
was read and upon motion by Fryer, second by Kjerner,, the Mayor and City Clerk
were instructed to execute the said lease.
The request of the Woman's Relief Corps for permission to operate a
bingo game once a month for, the winter months was read and the same was, ordered
placed on file..
A notice from the State of Minnesota, Liquor Control Commissioner that
reads as follows was read and President Lemmon referred the same to the License
Committee:

Dear Mr. Finch:
Through the course of regular inspections of places
licensed to sell beer and more intoxicating liquor, we
find that the Eagles, Zumbro Aerie 2229, and the Whittlock.
Sonnenberg Post 1215, V.F.W. each hold a club license to •
sell liquor. It also appears that each place is required
to pay an annual license fee of $300.00. This sum of
money is not correct under the provisions of the Liquor
Control Act.
Either the clubs must be issued a "Club" license under
M. S. 1945, Section 340.11, Subdivision 6, for which they
can only pay a•$100.00 annual license fee, or they can be
issued a regular intoxicating liquor license for "on sale",
for which they must be charged $750.00 per year as are the
other private licensees.

Under the club license the organization can sell to
members only and under the second license they may sell
to the general public.
We shall be pleased to have you review this matter with
your license authority for clarifications of which privilege
they are considered to have and which license fee they
should pay.- May we hear from you at your early convenience?

The following resolution adopted by the Public Utility Board was read
and the same was ordered placed on file:

Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to
authorize the said Board to enter into a contract with
the WM. H. ZIE GLER COMPANY for the furnishing of:

A petition for the construction of a sanitary sewer and watermain and
grading of in Cascade Sub -Division was read and upon motion by Fryer, second by
(Kennedy, the City Clerk was instructed to prepare a resolution to be -read at the
next, meeting ordering the first hearing on the project.
A petition for the revocation of the temporary permit, granted by the
Common Council to Floyd Sibley to operate a shop in his home at 607 Eleventh
Avenue Southeast was, read and upon motion by Fryer, second by Fox, the petition
was granted and the Building Inspector was instructed to notify Mr. Sibley to
discontinue operating a barber shop in his residence at 607 Eleventh Avenue
Southeast.
The following protest signed by 26 property owners in Southeast
(Rochester was read and the same was referred to the Board of Zoning:
"We, the undersigned property owners, in a residential
section, do hereby oppose the use being made of property in
this neighborhood owned by C. C. Pagenhart located in the
800 Block on the west side of llth Avenue Southeast, as it
reduces the value of our property and is a menace to
health, we, therefore request that all the materials now
on the grounds be removed."
A communitcation to the Common Council and the Board of Education frost
Robert L. Jacobs regarding the proposed 1947-48 school budget was read and the
same was ordered placed on file.

The City Engineer's Trial Balance for the month of October, 1947 was
„read and the same was ordered placed on file.
The report of the City WPighmaster for the month of October, 1947
showing 418 loads weighed and receipts in the amount of $41.80 was read and
the same was referred to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ended November
8, 1947 showing total criminal fines and costs collected $969.00, civil fees
received $2.85 and conciliation court fees $1.50 and for the week ended November
15, 1947 showing total criminal fines and costs collected $362.00, civil fees

received $1.40 and conciliation court fees $3.75, were each read and having been
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file.
The applications of Norman Wyatt and Edward Livingston and the Arthur
Hotel for a cigarette license were each r d g c read an upon motion by Fryer, second by
Fox, the licenses were granted.
The applications for a permit to place and maintain a sign of Emerald
Thiem and M. Swearinger were each read -and upon motion by K jerner, second by Fox,
the permits were granted.
The application of the Arthur Hotel for a license to sell soft drinks
was read and upon motion by Akenhead, second by Kennedy, the license was granted.
The Indemnity Bond .for lost order or warrant of Fred Schuster, jr. in
.the amount of $69.86 with Roxie S. Schuster and G. S. Schuster as sureties was
read and upon motion by Fryer, second by Kennedy, the bond was approved, the
surety thereon was accepted and it was ordered that the same be placed on file.
Alderman Fryer introduced a resolution appropriating $1,027.40 from the
General Fund and ordering payment made to the Cooperative Oil Company for gasoline,
which was read.
Upon motion by Kjerner, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Fryer introduced a resolution appropriating $51,914.00 from the

Alderman Fryer introduced a resolution appropriating $980.65 from the
Street & Alley Fund and ordering payment made to the Dunn Sand & Gravel Company
for gravel, which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $3,699.92 from the
P.I.R. Fund and ordering payment4 made to Carlisle G. Fraser for estimate No. 2
for sanitary sewer and watermain in 13th Avenue Southeast from 4th to 6th Street
Southeast, which was read.
Upon motion by Kennedy, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $369.96 from the
P. I. R. fund and ordering payment made to Leon Joyce for estimate No. 2 for- grading
loth Avenue Northeast from 9th to loth Street Northeast, which was read.

Alderman Kennedy introduced A resolution authorizing the Public Utility
Board to enter into contract with Wm. H. Ziegler Company, which was read.

said resolution duly passed and adopted.

Fraser for furnishing of all labor, material, equipment, etc. necessary for the

Alderman Akenhead introduced a resolution appropriating $2,111.62 from
the General Fund and ordering payment made to K. M. McGhie for engineering services
on construction work at airport, which was read.

Alderman Kjerner introduced a resolution appropriating $214.45 from the
P.I.R. fund and ordering payment made to Leon Joyce for estimate No. 2 for gradin
'Ilstreets in Indian Heights, which was read.
Upon motion by Fox, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $359.94 from the
Lighting Fund and ordering payment made to City of Rochester, Public Utilities
for lighting at airport, which was read:

adopted as read, and all voting in favor thereof, President Lemmon declared -the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $202.90 from the
Park Improvement Fund.and ordering payment made -to Reynolds Wholesale Company for
merchandise for concession stands, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $2,573.53 from
the Park Improvement Fund and ordering payment made to the Mayo Civic Auditorium
Revolving Fund to reimburse revolving fund., which was read.
Upon motion by Akenhead, second by Kjerner, that the said resolution bel
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $223.75 from the
Park Improvement Fund and ordering payment made to Owatonna Nursery Company for
10 Elms, 10 Lindens, 10 Maples and 525.Buckthorn, which was read.
Upon motion by Fryer, second by Kjerner, that the said resolut16n be
adopted as read, and all toting in favor thereof, President Lemmon declared the
said resolution duly,passed and adopted.
Alderman Fog introduced a resolution appropriating $546.•54 from the Fire
Protection Fund and ordering payment made to the Rochester Ice & Fuel -Company for
104 200 lbs. Supertherm, which was read.

Alderman Fox introduced a resolution appropriating $591.90 from the
General Fund and $94- 70 from the Fire Protection Fund and ordering payment made to
the Schmidt Printing Company for office supplies, which was read.

Upon motion by Kennedy, second by Fryer, that the said resolution be

Alderman Kjerner introduced a resolution accepting the bid of Leon
,Joyce for furnishing of all labor, material, equipment, etc. necessary for the
grading of llth Avenue Southeast from 225 feet South of 7th Street Southeast to
,555 feet South of 7th Street Southeast, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

An Ordinance lice4sing,and regulating persons engaged in the business
of building or rebuilding concrete side -walks, driveways and curb and gutter in
the streets, alleys and public grounds within the City of Rochester, Minnesota,
was given its first reading.
Upon motion by Fryer,.second by Kennedy, and upon roll call and all
voting in favor thereof, the rules were suspended and the. Ord,ina.nce was given its
second reading.
Upon motion by Kennedy, second by Fryer, the City Clerk, was instructed to
return the proposed.1947-49 school budget to the Board of Education with the
request that, their levy be reduced by the amount of the deficiency items, totaling
�190,149.00 and,that a revised resolution be submitted to the Common Council for
their consideration.. All -voted in favor of the motion:
A.motioa was made by Alderman Fryer, second by -Alderman Fox, that it is
the desire of this Council that future Council's hold hearings each -year similar
to the one held on November 14th, at which time any citizen may be heard on
.
'proposed school or city budgets. All voted in favor of the -motion.
President Lemmon suggested that a Committee of citizens be organized
to make a study of School and City tax budgets and the matter of revenues other
than taxes on real estate on the operation of City departments and schools.
Upon motion by Fryer, second by Akenhead, the meeting was adjourned until
7: 30 o'clock P. M. on November 24th, 1947.
