Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in

President Lemmon called'the meeting to order at 7:30 o'cloek P. M., the!.
,following members being present; President Lemmon, Aldermen Akenhead, Fox, Fryer;

Upon motion by Fryer, second by Kjerner, the minutes of the meeting of

President Lemmon stated this as being the time and place set for the
,first hearing on the installation of a sanitary sewer'in 9th Street N. E. from
12th to 13th Ave. N.E. ; 12th Avenue N. E. from 7th to 8th Street N. E.; and 13th
.Avenue N. E. from 7th to 9th Street N. E. There was no one present wishing to be
heard.
President Lemmon stated this as being the time and place set for the
first hearing on the installation of a watermain in 12th Avenue N. E. from 7th toil;
9th Street N. E.; Sth Street N. E. from 12th to 13th Avenue N. E.; 13th Avenue

N. E. Mr. Earl Meredith was present and stated that he would like to have the

in 9th Street Northeast. President Lemmon referred the matter to the Street&
Alley Committee and the City Engineer to confer with Mr. Meredith.
President Lemmon stated this as -being the time and place set for the
first hearing on the grading of 9th and loth Streets Northeast from the East line
of Seller's Sub -Division to the East line of 17th Avenue Northeast and 16th and 17;th

,Avenues Northeast from 9th to loth Street Northeast. Mr. John Kerr asked that
,permission be granted to Mr. John Miner to do the grading of the streets in
'Miner's Heights. Upon motion by Fryer, second by Kennedy, Mr. John Miner was
authorized to grade the streets in the said Miner's Heights under the super vision)

,of the City Engineer and to grades established by the City Engineer. All voted in

President Lemmon stated this as being the.time and place set for
receiving and opening bids for the furnishing.of two.new or used 10,000 gallon
oil storage tanks. The bid of the Rochester Airport in the amount of $500.00 each
•
for a total of, $1,000.00 was received and opened and President Lemmon referred
the same to the Street & Alley Committee and the City Engineer for tabulation and
recommendation.
The recommendation of the Street and Alley Committee that two used
• 10,000 , gallon oil tanks be purchased from the Rochester Airport, subject to lease
:i
of the Great Western Railroad, for the sum of $1,000.00 was read and the same
was ordered placed on file.
A,:group of residents from loth Street Southeast again attended the
meeting. Mr. Arnold Luehmann stated that the parking conditions on loth Street
Southeast had been relieved for a while but was again giving trouble due to the
number of cars parked in front of Dr. Loechler's office and houses at 205 and 209
loth Street Southeast. City Attorney Hunt read an opinion which h-Is' had received
from the Attorney General's office wherein it was stated, "It will be the duty of
the council to apply the vital provisions of the zoning ordinance to facts as theZ
may determine them to bell. After hearing further protests from .those present
President Lemmon asked that the City Attorney prepare any papers necessary if
Dr. Loechler is violating provisions of the Zoning Ordinance and that Garnet
Spring, Building Inspector sign same in order that the matter may be straightened!
out through a court action.
Mr. A. H.'Clemens, Attorney for the Rochester Bus Line, Inc., was presen
at the meeting and. stated that the trial run beginning on 3rd Street Northwest ove
6th Street Northwest and on llth Avenue to and Street Northwest was being,started
but that it was impossible to run the heavy bus equipment over the newly graded
t streets in Manleyls Addition and asked that the trial run be
postponed until the
streets were in better condition. Upon motion by Akenhead, second by Kennedy, thel
;previous action of the Common Council ordering the trial run through Manley's
Ldition was rescinded and was left to the City Engineer to determine when the
• streets are in condition to start the trial bus service through Manley's Addition.
The recommendation of the Sewer Committee that the installation of a
anitary sewer in 2nd Avenue Northwest from 13th Street to 132 Street Northwest
be delayed until the new trunk line sewer for the new Sewage Disposal Plant is

A notice by the State Department of Taxation of the annual instruction

and President Lemmon ordered that the same be placed on file and that the City

The following petition signed by 35 residents of the Veterans Housing
Project was read:
"To th9 Honorable Mayor and
Members of the Common Council
We the undersigned residents of the Veterans Housing Project
respectfully petition the Common Council for the following:
1. Adequate water drainage (street and gutter)
2. Painting and decorating (inside and out)
3. Review of the project contract (mechanical refrigeration,ete.)
4. Bus Line change
5. Street light at entrance
6.- Proper- maintenance
a. plumbing, lawns and landscaping, roads.
b. Salary of maintenance man
7. Reduction of rent for ice purchased
S. Reduction of rent as an alternative to proper maintenance,"
A number of restderLts.at the Veterans Housing Project were present -'at the meeting
and stated that they understood that funds were available to make improvements on
the quonset huts and grounds. After hearing the complaints of those present, a
motion was made by Yaeger, second by Kennedy, that the matter berreferred to Mr.
E. A. Zuehlke and the Federal Government. All voted in favor of the motion.
A letter from the State of Minnesota, Department of Highways, transmitting
an Agency Agreement covering PWS Item 1310 was read and the same was ordered
placed on file, a resolution having been prepared authorizing the Mayor and City
Clerk to sign the said agreement.
The appointment of Harold Akenhead, Austin A. Kennedy and Leo C. Anders
by President Lemmon to serve as a special dump grounds committee was read and the
ame was ordered placed on file.
A petition to have a curb and gutter constructed on loth Avenue Southea
rom 12th to 13th Street Southeast was read and President Lemmon referred the same

sand assessment of a sanitary sewer constructed through Soldiers Field Golf Courses
was read and President Lemmon referred the same to the Sewer Committee and the
'City Engineer.
The application of Sidney Balman that the license for an open air
;theatre be transferred from himself to the North States Enterprises,.Incorporatedl
was read and upon motion by Fryer, second by Akenhead, the transfer was approved
and the license fee for the balance of the present fiscal year was set at $10.00.1,
A request from the Board of Park Commissioners that the ' Common Council
,,approve an arrangement between the City of Rochester and Mr. A. C. flooding to
purchase the following described tract of land for use of park purposes was read:
"A tract of land in the N.W.J of Section 35-107-14, lying
between Seventh Street N.W. and the Chicago and Northwestern
Railway tracks and east of the Rochester Silo Company lands, �
to be known and designated as Outlot #1, Cooks Subdivision,
Rochester, Minnesota. (Roughly .500 feet east and west and
550 feet north and south). It

March 13, 1949 showing total criminal fines and costs collected $219.00, civil feels
received $9.60 and conciliation court fees $.50 and for the week ended March 20,
1948 showing total criminal fines and costs collected $625.00, civil fees received
$4.70 and conciliation court fees $5.00, were each read and having been previously)
approved by the City Attorney, President Lemmon ordered that the same be placed onll
file.

read and the same was ordered placed on file.
Alderman Yaeger introduced a resolution appropriating $300.60 from the
Park Improvement Fund and ordering payment made to Old Dutch Foods for merchandise
for auditorium, which was read. �l
Upon motion by Kennedy, second by Fryer, that the said resolution be

Alderman Yaeger introduced a resolution appropriating $784.12 from the
Park Improvement Fund and ordering payment made to the Mayo Civic Auditorium
Revolving Fund, which was read.
Upon motion by Yaeger, second by Akenhead, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $319.69 from the
Park Improvement Fund and ordering payment made to the,C. F. Massey Company for
25 5/6 Doz. Blue Stripe towels, which was -read.
Upon motion by Kjerner, second by Fox, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly. passed and adopted.
Alderman Yaeger introduced a resolution appropriating $902.99 from the
Park Improvement Fund and ordering payment made to Toro Manufacturing Company for
Mower and Mower parts, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $311.24 from the

Utilities for lighting at the airport, which was read.

Alderman Fryer.introduced a resolution authorizing the Mayor and City
Clerk to enter into agreement with M. J. Hoffman., Commissioner. of Highways, agree:
that he represents the City.as their agent to apply for Federal Ai.d'for Project
