President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner, Theel and Yaeger.-. Absent: None. Y Upon motion by Kennedy, second by Kjerner, the minutes of the meetings of March 22nd and March 30th, 1948 were approved, President-Lemmon in a brief address to the Council and others present, expressed his appreciation for the _services of the members of the City's governing body and other officials who had served during the past fiscal year and welcomed the new members of the Common Council to their offices. To the Public Utility Board - Leo C. The appointment of Mr. Carl C. Hooper" as secretary to the Mayor was read and upon motion by Kennedy, second by Theel, the h appointment was not approved. Mr. Erwin Briese, Secretary of the Chamber of Commerce, Mr. Harold Whiting,l. Chairman of the Fire Protection Committee, Mr. Harold Roth, Chairman of the Retail ' i ; Division of the Chamber of Commerce, Mr. A. G. Berens, representing the Rochester! and Olmsted County Safety Council and Mr. Tom McDonald, President of the Rochester, I, Chamber of Commerce, were present and urged that the firemen's working hours be changed from the eight hour day to a 24 hour shift on and 24 hours off. Mr. Gordon I Benson spoke for the firemen a'nd urged that the.24 hour shifts, off and on, and I II 3 kelly days be set up: Mr. Robert Petersdorf, Business Agent for the Rochester � Trades and - Labor, Mr. Fred R.' Witzke, Business Agent for the United Brotherhood ofl� Carpenters and Mr. B. L. Simmer, Business Agent for the General Drivers Union No. 874, stated that they were in -favor of the members of the Rochester Fire Department working an.eight hour day. Mr. -Wm. C. Schacht was present at the meeting and requested an increase in pay -for the Rochester Police Department. Mr. Arnold Anderson, representing the Rochester Police Department, also urged that the • I salaries be increased. Mr. .A. M. Bach, representing a committee from the Izaak Walton League, appeared before the Council and urged that the matter of dredging Silver Lake be again studied and that some action be taken. Mr. Henry J. Postier, representing the Third Ward Improvement Association, was present and also urged that the Council I make some plan to begin the dredging of Silver Lake. Mr. A. M. Bach spoke on the matter of whether or not parallel parking should be used on Broadway after the meters were installed. He suggested that a poll of h the opinion of residents in Rochester should be taken, either through the local II newspaper or otherwise, to -determine the sentiment of the people on the method of parking cars. Alderman.Anderson introduced the following resolution which was read: "WHEREAS, It is deemed expedient and necessary that the Common Council of the City of Rochester, Minnesota, adopt rules of order for the conduct of its business, and WHEREAS, A copy of Robert's Rules of Order (revised) of the 1915•Copyright, is before this Common Council; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: !I That the said Robert's Rules of,Order be adopted by this Common Council as rules of order for the conduct of its business." i' • • 1 n 0_� 1 53 • 1 April 9. 1948 Upon motion by Akenhead, second by Therl, that the said.resolution be adopted as read, and,all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced the following resolution which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said Common Council of the City of Rochester, Minnesota, do hereby adopt the following rules and regulations for the order of business of said Common Council: 1. Roll Call. The roll call of the Common Council shall be had and taken in its alphabetical order according to the names of the members, except that the name of the President of the Common Council shall be called only, --at the first roll call of each meeting and then after that, at that meeting, only in case of a tie vote when his name shall be called and vote taken after the\expression of each of the other members of the said Common Council, or when a 5/7 vote is required. 11 2. Reading and approval of the minutes of the.proceeding meeting; 3. At first meeting, the appointment of officers and committees. 4. Public Hearings. 5. Reading of petitions and communications. 6. Reports of committees. All reports of committees shall hereafter be made in writing, unless ordered otherwise by said Common Council. 7. Unfinished business. 8. Resolutions and ordinances. 9. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the first hearing on the installation of a sanitary sewer in 8th Avenue Northeast fron 92 to 14th Street; 9th Avenue Northeast from 9th to 10th Street; -loth Avenue Northeast f rom 9th to 14th Street; 9th Street Nor-theast from 9th to llth Avenue; _. and 92 Street Northeast from Sth to 9th Avenue NortheV.ast. There was no one present wishing to be heard. 538 April 5. 1949 President Lemmon stated this as being the time and place set for receiving and opening bids for furnishing'road oils for the City of Rochester for 1948. The bids for approximately 150,000 gallons of Standard Oil Company in the amount of i $17,739.00 and Western. -Oil and Fuel Company in the amount of $• 1-9,535.00 were each 'received and opened. I! The recommendation of the Street and Alley Committee that the contract ,for the furnishing of 150,000 gallons of road oil be awarded to Standard Oil j Company for the sum of $17,739.00 was read and upon motion by Akenhead, second by! 'Yaeger, the recommendation was approved and the same was ordered placed on file. �I President Lemmon stated this as being the time and place set for receiving and opening bids for furnishing 179 tons of 12 inch steel "H" piling. The recommendation of the Street and Alley Committee that the contract for the purchase of One Power Shovel be awarded to Minneapolis Equipment Company for the sum of $10,212.43 was read and upon motion by Akenhead, second by Kennedy."l the recommendation was approved and the same was ordered placed on file. President Lemmon stated this as being the time and place set for receiving and opening bids for furnishing one tractor with straight blade - Bulldozer with approximate specifications of "CAT D 4". The bids of Borchert - Ingersoll Inc. in the amount of $6,04o.50, Wm. H. Ziegler Co., Inc. in the amount of $5,431.50, The George T. Ryan Co. in the amount of $6,o66.62 and Rosholt I� Equipment Company in the amount'of $6,292.50 were each received and opened. The recommendation of the Street & Alley Committee that all bids for furnishing One Tractor and Bulldozer be rejected was read and upon motion by Kjerner, second by Theel, the recommendation was approved and the same was ordered placed ,on file. i j! Upon motion by Kennedy, second by Akenhead, the Street and Alley Committee and the City Engineer were instructed to look up the matter further of purchasing a tractor with straight blade bulldozer and report to the Common Council. President Lemmon stated this as being the time and place set for receiving and opening bids for furnishing one patrol car for use in the Police Department. President Lemmon stated this as being the time and place set for receiving and opening bids for furnishing a truck to replace the truck now in use on Flusher No. 5. The bids of Wilcox and Chesley Inc. in the amount of $4,695.OQ Universal Motors, Inc. in the amount of $3;899.40 and Allen Lloyd Company in the amount of $3, 08 5. 90 . The recommendation of the Street and Alley Committee that action on thel purchase of the said truck be postponed until the meeting of April 12, 19?8 was read and upon motion by Kennedy, second by Theel, the recommendation was approved .and the same was ordered placed on file. Upon motion by Theel, second by Akenhead, the City Clerk was instructedl to return the certified checks of the unsuccessful bidders. The application of F. R. Finch for reappointment to the office of City Clerk and Commissioner of Registration was read and upon motion by Yaeger, second by Akenhead, F. R. Finch was appointed to the office of City Clerk and Commissione of Registration for the ensuing official year. The applications of Ralph E. Monson and Gerald L. Hutchins for the offic of City Engineer were each read and upon motion by Kennedy, second by Akenhead, Ralph.E. Monson was appointed as City Engineer for the ensuing official year. The application of Desmond B. Hunt for reappointment as City Attorney was read and upon motion by Theel, second by Kjerner, Desmond B. Hunt was appointee 6ity Attorney for the ensuing official year. A letter from Richard A. Golling, Public Examiner ackhewledging receipt of request for audit of the City of, Rochester for the fiscal year ending March 31, 1949 and stating that it would not be_possible to make an audit of the books.°and accounts before six to eight months was read. Upon motion by Yaeger,.second by Kennedy, the City Clerk was instructed to notify the Public Examiner to make the audit as soon as possible. A petition by Ralph M. and Myrtle A. Graen and .ors. Nellie Fryer to- have that part of 4th Street Southwest in the City of Rochester extending west across IIIth Avenue Southwest vacated was read and President Lemmon referred the same to the Street and Alley Committee and the Public Grounds Committee. The petition of W. L. Ryan to have the East a of 16th Avenue Northwest Irom 2nd Street Northwest to 134 feet North graded was read and President Lemmon referred the same to the Street and Alley Committee. The recommendation of the Acting Chief of Police, A. M. Nelson, in regari • to salary adjustments for certain officers in the Police Department and to the Iurchase of uniforms was read and the -same s me was ordered placed on file. A request from E. A. Zuehlke, City Treasurer, for an as in his office was read and upon motion by Yaeger; second by Kennedy, the same was ordered • placed on file. A communication from the Board of Park Commissioners and the report of the committee appointed to estimate the value of certain real estate on the north,s • side of Silver Lake owned by Alice Mitchell were.each read, the real estate being' described as follows and the estimated value of same being set at $4?50.00: "Commencing 643.5 feet East of NW corner Lot 33, running thence So. 200 feet, thence E. 50 feet, thence No. 200 feet, thence W. 50 feet to place of beginning." It was noted that a part of the described lands had been sold and upon motion by Theel, second by Kjerner, the appraisal committee was instructed to submit an appraisal of the real estate still owned by Alice Mitchell. The request, of E. A. Zuehlke to attend a -regional housing conference of'�- National Association of Housing Officials to beheld in Chicago on April 19, 20, and 21, 1949 was read and upon motion by Theel, second by Kennedy, he was authorized to attend. The request of Enoch J. Dis.on for an adjustment in the amount paid for the use of his car was read and the same was ordered placed on file. The following copy of a letter addressed to the Mayor was read and the same was ordered placed on file: i "Eon. C. H. McQuillan, Mayor Rochester, Minnesota Dear Mayor McQuillan: At,the March 23rd meeting of the Legislative Advisory Committee, the Governor, with the advice and consent of the LAC, withdrew the unused balance of $31, g6s.'34 remaining in the Rochester. airport project allocation, and in its place approved the tentative allocation of state airport funds in the amount of $70,000.00 to be matched with federal funds for the purpose of improving the Rochester airport, The Governor and the Committee have reserved the right to make such upward and downward revisions in these tentative allocations as may be required after bids have been received • on each individual project contained in the federal airport program.
