Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on April 26, 194s.
President Lemmon called the meeting to order. at 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Akenhead, Anderson,
Kennedy, KIerner, Theel and Yaeger. Absent: None.
Upon motion by Akenhead, second by K jerner, the minutes of the meeting
of April 19, 1949 were approved.
President Lemmon stated this as being the time and place set for the
first hearing on the installation of a watermain in llth Street Northwest from
4th Avenue Northwest to Cascade Creek. There was no one present wishing to be
heard.
President Lemmon stated this as being the time and place set for
receiving and opening bids for furnishing 65 street name signs and 50 posts for
street name signs. The bids of Lyle -Signs, Inc. in the amount of -$6.55 each for
street name signs and $5.11'each for posts for street name signs and Rosenwald
Cooper., Inc. in the amount of $9.67 each for street name signs and $S.35 each for
posts for street name signs were each received and opened.
President Lemmon stated this as bd ng the time and place set for
receiving and opening bids for the construction of a sanitary sewer and watermain

The bids of Carlisle G. Fraser in the amount of $3, 722.90 for sanitary sewer and
$4, 590.90 for watermain, De Groff. Wolff in the amount of $4, 23s. 30 for sanitary
sewer and $5,174.15 for-watermain and O'Loughlin and Hansen in the amount of
$4,113.90 for sanitary sewer only, were each received and opened.
President Lemmon stated this as being the time and place set for
receiving and opening bids for- the grading in 12th Avenue Northeast, North of 14t)
(Street Northeast, in DuVille Addition. The bid of Leon Joyce in the amount of
$1, 460:g0 was received and opened.
Upon motion by Yaeger, second by Anderson, the City Clerk was
lauthorized to return the certified checks of the unsuccessful bidders.
Representatives from the Ladies Auxiliary of the American Legion and
the -Veterans of Foreign -Ware were before the Council and requested permission to
sell poppies on the streets of Rochester on May 29, 1949. Upon motion by Akenheai
second by Theel, the requests were granted.
A group of business men were again present.at the meeting for the purpo,
(of protesting parallel parking on Broadway when parking meters -are installed.
� Also a communication from Mr. George M. Murray, Manager of the Rochester Hotel,
1protesting parallel parking on Broadway was read. Alderman Kennedy discussed

(future possibilities for parking areas and the construction of a ramp on the

property now used for the parking of cars and also stated reasons why the Council
considered parallel parking. Alderman Kennedy then made a motion that parallel
,parking be installed on Broadway on a trial basis for three months beginning on

June let. After again hearing protests from those present, Alderman Yaeger
,seconded the motion and upon roll call all voted in favor thereof, except Alderman
Anderson and Theel who voted "no".
During the discussion on parking of cars on Broadway Mr. A. M. Bach •
presented a petition for angle parking on Broadway, he later requested that the
petition be returned to him and upon motion by Theel, second by Kennedy, the
request was granted.
The assignment of securities of. the First National Bank in consideration
of its designation as a depository of public funds of the City of Rochester.
Minnesota, in the amount of $420,000.00, the Union National Bank in the amount of
$300,000.00 and the Olmsted County Bank and Trust Company in the amount of
$197,000.00 were each read and the same were ordered placed on file.
The request of George P. Leiferman for a refund from the City in the sum
of $644.46 covering a culvert purchased ft use in the development of DuVille
Addition was read and President Lemmon referred the same to the Street & Alley'
Committee and the City Engineer for report at the next meeting.
A petition for the construction of a curb and gutter on the South -side
of llth Street Southwest from 7th Avenue Southwest to within 256 feet of the west,
line of the city limits was read and President Lemmon referred .the same to the
Street and Alley Committee and the City Engineer.
A petition for the construction of a sanitary sewer ansl watermain and
the grading in 1st Avenue Southwest from 6th to 7th Street Southwest was read and
President Lemmon referred the same to the Sewer Committee, the Water Committee,
the Street & Alley Committee and the City Engineer.
The recommendation of the Street & Alley Committee that 65 street name
signs and 50 posts for street name signs be purchased from Lyle Signs, Inc, for
the price of $691.25 was read and upon motion by Kjerner, second by Kennedy, the
same was approved and ordered placed on file.
The recommendation of the Sewer Committee that the contract for the
construction of a sanitary sewer in 12th Avenue Northeast, North of 14th Street
Northeast in DuVille Addition be awarded to Carlisle G. Fraser for the sum of
$3,722.90 was read and upon motion by Akenhead, second by Theel, the recommendation
was approved.
The recommendation of the Water Committee that the contract for the
construction of a watermain inl2th. Avenue Northeast,, North of 14th Street
Northeast in DuVille Addition be.awarded to Carlisle G. Fraser for the sum of

the grading of 12th Avenue Northeast, North of 14th Street Northeast in DuVille
Addition be awarded to Leon Joyce for the sum of $1,460.80 was read and upon
motion by Kjerner., second by'Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and gutte,

taken on the complaints of Mr. Joe Bandow and Mr. Peter Butlin in reference to

Ifeels that these pr&perties have not been damaged by the work, was read and upon
motion by Yaeger, second by Kjerner, the recommendation was approved.
The following recommendation presented by the Public Grounds Committee
was read:

We, the undersigned members of the Public Grounds
Committee, recommend that painting of equipment in the
Fire Department and signal boxes on the streets be done
by the firemen, and that any painting on the inside or
outside of the fire station be not done by firemen.

Mr. Robert Petersdorf, Business Agent for the American Federation of Labor in the
City of Rochester and Mr. J. F. Shepard were p resent.and protested the recommendation
made by the Public Grounds Committee. A motion was made by Alderman Kennedy
recommending that the report of the Public Grounds Committee be accepted.
President Lemmon declared the motion out of order for want of a second.
The recommendation of the Finance Committee that a loan from the
Rochester Fire Department Relief Association in the amount of $2500.00 with
interest at the rate of 4% be granted to Howard Wright on his dwelling in Byron,
Minnesota, was read and upon motion by Theel, second by Kjerner, the recommendation
was approved and ordered placed on file.
The City Engineer's estimate of cost for the construction of a curb and
gutter in 9th Avenue Southeast from 1st to 3rd Street Southeast was read and the �
same was ordered placed on file.
Mr. A. H. Clemens, representing the Rochester Bus Line, Inc., was
present and stated that they had now reestablished bus service on 2nd Street
Northwest between 7th and llth Avenue Northwest and that they were also operating
bus service in the Manley's Addition. He also suggested changes in the run on
Highway 63 to 16th Street Southwest and through Graham Addition, which arrangement
would allow the buses to load and unload patrons from the quonset huts at the
fair grounds on the East side of Highway 63. He further suggested that the
Council appoint a'.Committee to work with the officials of the Bus Company when •
trial runs are established or when changes in routes are made.
The report of the Clerk of the Municipal Court for the week ended
Apr 1 24, 1948 showing total criminal fines and costs collected $998.00, civil
fees received $none, and conciliation court fees $3.00 was read and having been
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on f ile.
The surety bonds of Paul Sandberg and Ivan Boyd each in the amount of
$500.00 with the Fidelity & Casualty Company as surety, Darrell Sanford in the
amount of $500,00 with the Fidelity and Deposit Company as surety, Walter E.
Zierath in the amount of $500.00 with the Hartford Accident and Indemnity Company

as surety, and A. J. Lentfer in the amount of $10,000.00, Lee M. Nelson, Glen E.

After hearing a complaint from Walter N.• Wyant, who resides at 161 - 3r
treet Southwest over'the Koffee Kup Cafe, that he and his wife were disturbed
antil late at night and early in the monring by the playing of a juke box, a motio
#as made by Kennedy, second by Anderson, that the City Attorny prepare an amendmen
o the Nuisance Ordinance which would regulate the hours during which jukeboxes
y be played.
Theapplication for transfer of Popcorn License No. 153 from Oreii- Sizer
o Vernon Sizer was read and as the ordinance covering the licensing of popcorn

Upon motion by Kenmdy, second by Yaeger, the City Attorney was instructed
to prepare amendments to license ordinances providing penalties for licenses which
are not renewed —on or before the date of the annual meeting.

to amend the soft drink ordinance so as to provide a simplified form of
application*
Alderman Anderson introduced a resolution ordering the first hearing on
construction of a curb and gutter on both sides of 9th Avenue Southeast from 12th
to 13th Street Southeast, which was read,

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Kjerner introduced a resolution accepting the collateral,.
ssignment, etc. of the Union National Bank in lieu of a depository bond, which

A motion was made by Kennedy, second by Yaeger, that an ordinance entitled,

An Ordinance entitled, R.An Ordinance to authorize the installation,
regulation, control, and use of parking meters in the City of Rochester, Minnesota"
was given its second reading.
Upon motion by Kennedy, second by Kjerner, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Kennedy, second by Yaeger, that the said Ordinance be
adopted as read, and upon roll call and all voting in favor thereof, President
Lemmon declared the said Ordinance duly passed and adopted.
The request of Mr. Hammond that the Building Code be amended so as to
permit the sale and installation of steel chimneys was again brought. to the
attention of the Common Council and upon motion by Anderson, second.by Theel, the
City Attorney was instructed to prepare an amendment to the Building'Code which
would permit the use and installation of steel chimney construction.
Upon request of .C. E. Ginthei, the Fire Chiek and two firemen were
authorized to attend the Annual State Fire School to be held in St. Paul on
May 3rd to 5th, 1948.
The matter of having a new ordinance book printed�Lwas again discussed
and upon motion by Kennedy, second by Akenhead, the City Clerk was instructed to
ask the Mayor for an emergency order to cover the printing of the Ordinance Book.
Upon motion by Akenhead, second by Kjerner, the meeting was adjourned.
