Minutes of a regular meeting of the Common Council -of the City of Rochester, j.
Minnesota, held in the Council Chambers in the 'City Hall, in said City, on May 3rd, �I
1949.
President Lemmon called the meeting to order at 2:00 o' clock P.M., the
following members being present: President Lemmon, Aldermen Akenhead, Anderson,

Kennedy, Kjer ner,•Theel and Yaeger. Absent: None.
Upon motion by Kjerner, second 'by Therl, the minutes of the meeting of -
April 26, 1949 were approved. j
President Lemmon stated this as being the, time and place set for the first
hearing on the construction of a curb and gutter on both sides of 9th 'Avenue. Southeast
from 12th to 13th Street Southeast. There was no one present wishing to be heard.
President Lemmon stated this as being the time and place set for the first
hearing on the grading of the east half of 16th Avenue Northwest from -2nd Street
Northwest to 134 feet -North. There was no o.ne present wishing to be heard.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a curb and gutter on both sides of 6th Avenue Southeast
between Sth Street and loth Street Southeast. There was no one present wishing to be
heard.
President Lemmon stated this as being the time and place set for the first
hearing on the construction of a sanitary sewer and watermain and grading in 7th Avenue
Northwest from 16th Street to 100 feet North. There was. no one present wishing to be
heard.
President Lemmon stated this as being the time and -place setfor.the second
hearing on the construction of a curb and gutter and the grading in Plummer's Lane from'
Plummer's Circle to 400 feet South. There was no one present wishing to be heard. I

President Lemmon stated this as being .the time and place set for the second
hearing on the installation of a watermain and the grading in 2nd Avenue Northwest from
13th to 132 Street Northwest, Mr. Earl Pike was present and inquired if they intended

to install the sewer and watermain as proposed. He was informed that the project had
been dropped for the present.
President Lemmon stated this as being the time and place set for the second
hearing on the construction of a curb and gutter in loth Avenue Southeast .from 12th to
lath Street Southeast. There.was no one present wishing to be heard.

hearing on the construction of a curb and gutter in 2nd Street Northeast from llth to
13th Avenue Northeast. There was no. one present wishing to be heard.
President Lemmon stated thi.s as being the time and place set for the second
hearing on the construction of a curb and gutter in 9th Avenue Southeast from ,1st
Street to 3rd Street Southeast. Mr. Matt Mulvihill was*'present at the meeting and stated •
that if the said curb was installed there would be a block South of Center Street and
a block North of 4th Street Southeast which would still not be curb and the damage of
surface water would not be taken care of. He further stated that if the curb and gutter
was installed from let to 3rd Street Southeast on 9th Avenue the other two blocks
mentioned should have curb and gutter installed at the same. time. Hearing on the matter
was continued until the meeting to be held at 7:30 o'clock'P. M. on May 17, 1948.
President Lemmon stated this as being the time and place set for the second
hearing on the grading of 7th Avenue Northeast from the south line of Silver Lake
Addition to 14th Street Northeast; 8th Avenue Northeast from 92 to 14th Street Northeast;
9th Avenue Northeast from 9th to loth St.reet Northeast; loth Avenue Northeast from 9th
to 14th Street Northeast; 9th Street Northeast from 9th to llth Avenue Northeast; 919
Street Northeast from 8th to 9th Avenue Northeast and loth Street Northeast from 7th to
llth Avenue Northeast. Mr. Walter Fratzke was present and stated that they wished to
have the improvement made.
President Lemmon stated this as being the time and place set for the second
hearing on the -construction of a sanitary sewer and .wgtermain in loth Avenue Northwest
from loth to 14th Street Northwest; 102 Avenue Northwest from 12th to 14th Street

Point 585 feet east; and grading of 9th Avenue Northeast

Heights to the east City limits. Mr. John Miner was
present and stated that he wished
to have the improvement completed as soon as possible. •

President Lemmon stated this as being the time and place set for receiving an
opening bids for the construction of a watermain in llth Street Northwest between 4th
Avenue Northwest and Cascade Creek; The bids of Carlisle G. Fraser in the amount of 'I

$1,944.55 and Phelps Drake Company in the amount of $2,081.50 were each received and

President Lemmon stated this as being the. time and place set for receiving and'
opening bids for the construction of a sanitary sewer and watermain and the grading of

,The bids of Phelps Drake Company in the amount of $16,008.60, Carlisle G. Fraser in the
amount of $13,471.'05 and O'Loughlin & Hansen in the amount of $13,971.91 for sanitary
sewer; the bids of Phelps Drake Company in the amount of $34,552.00 and Carlisle G.
Fraser in the amount of $29,960.65 for watermain; and the bid of Leon Joyce in the
amount of $11,064.80 for grading, were each received and opened.
President Lemmon stated this as being the time and place set for receiving and'
opening bids for furnishing of corrugated iron culverts. The bid of Armco Drainage &
Metal Products, Inc. in the amount of $644.90 was received and opened.
President Lemmon stated. this as being the time and place set'for receiving and',,
opening bids for furnishing the season's supply of crushed rook and gravel for use in

the City Engineers Department. No bids were received.
President Lemmon stated this as being the time and place set for receiving and'I
opening bids for furnishing a coin counting machine and a coin sorting machine. Opening
of the bids was postponed.
President Lemmon brought to the attention of the Council.and others present

at the meeting, that an action had been started by merchants in the business area of the',
City, which resulted in the issuance of a temporary order restraining the City from
i
installing parking meters, the said order, in which C. E. Knowlton is the plaintiff, j
having been issued by the Olmsted County District Court. President Lemmon defended - the
i
Council in the purchase of meters, stating that there had been a number of hearings on
meters and requests from organizations for them. Among other remarks, he said the
I
statement had been made that.the Council had purchased meters befor@ bids were taken,
land that a statement to that effect was untrue.
A communication from the Mayor stating that he refused to give an emergency
order for the printing of an Ordinance book and that he would insist on the requirement
that specifications be prepared and the necessary advertising for -bids be done was read
and upon motion by Kennedy, second by Yaeger, the City Clerk and City -Attorney were
'instructed to employ some one familiar with setting up specifications for the printing

of the said Ordinance book and after specifications are prepared, present a resolution
ordering bids for the printing of the said Ordinance book.
The following resolution adopted by the Public Utility Board was read and the
same was ordered placed on file:
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota that the Common Council of the said City be
and is hereby requested to authorize the said Board to enter into a
contract with the Southern Minnesota Supply Company for the furnishing,
in accordance with specifications, of -
Item 1 - 29,000 lb. #2/0 Weatherproof Wire at a price of
$29.45 per CWT, and
Item 2 - 10,000 lb. +2 Weatherproof Wire at a price of
$29. 20 per CWT
Making a total lump sum rice of ELEVEN THOUSAND SIXTY SIX DOLLARS
( $11,066.00) discounted 2 of 1%-10 days, the 'said Southern Minnesota
Supply Company being the lowest responsible bidder."
A request from the American Legion Heart Fund to use the Mayo Civic Auditorium
on May 11, 1949 for a program scheduled by the American Legion in connection with the
Heart Fund Drive was read and upon motion by Kennedy, second by Theel; the request was
referred to the Board of Park Commissioners.
A recommendation from the Mayor recommending that the Council give immediate
consideration to the matter of housing in the City of Rochester was read and President
Lemmon referred the communication to the Public Grounds Committee.
An assignment in the amount of $3,000.00 given by Mr. Robert A. McDowell,
dba/RaTel Company, given to the First National Bank of Rochester was read and upon motion
by Yaeger, second by Kennedy, the said assignment was approved subject to final
approval by the Finance Committee.
A letter from the State of Minnesota, Department of Aeronautics, stating that
their Department had been authorized to advertise for bids for construction work at
the Rochester Airport was read and upon motion by Kennedy, second by Theel, the same
was ordered placed on file.
The following communication from"the RochesterBuilding and Construction Trades
Council was read and the same was ordered placed on file:
"To the Honorable Mayor and
the Common Council of the
City of Rochester, Minnesota
Gent 1 emen:
In view of the fact that the Common Council of the City of
Rochester has ignored our requests to respect and .live up to an
agreement between the Council and the Painter's Union #681 of
Rochester, Minn., I hereby claim damages to be paid to Painter's
Union for all painting done is violation of this agreement. This
agreement as below was passed and adopted April 3, 1944.
Quote. "The report of the Fire Committee to the Mayor -and the
Common Council, dated Jul' 20, 1942, which recommended that the
Firemen do no painting on the interior ,or exterior of the fire hall
or upon apparatus, and that the work be done by painters if the
amount of same exceeds $15.00, was read and upon motion by Fryer,
second by Kennedy, the report was approved and ordered placed on
file."
We request that the Council appoint a committee to meet with
the Painter's Union #691 to determine the amount of damages.

The following recommendation by the Public Grounds Committee which had been
previously read at the meeting of the Council on April 26, 1949 was again presented to
the Council:

"To the Honorable Mayor and

City of Rochester, Minnesota
Gentlemen:

We, the undersigned members of the Public Grounds
Committee, recommend that painting of equipment in the
Fire Department and signal, boxes on the streets be done i
by, the firemen, and that any painting on the inside

or outside of the fire station be not done by firemen.

A claim for damage to her,property by Esther A. Schwanke was. -read and President

Lemmon referred the same to the Street & Alley Committee.
The Deports for the month of April, 1949 of the Building Inspector showing j
$292,00 fees received for building permits issued, of the Electrical Inspector showing
$373.25 fees received for electrical permits issued, of the Heating Inspector showing
$94.25 fees received for heating permits issued and of the Plumbing Inspector showing
$220.75 fees received'for plumbing permits issued, were each read and President Lemmon
referred the same to the Finance Committee.
The recommendation of the Water Committee that the contract for the construction

of a watermain in filth Street Northwest between -4th Avenue Northwest and Cascade Creek be

awarded to Carlisle G. Fraser for -the price of $1944.55 was read and upon motion by i
Yeager, second by Theel, the recommendation was approved.
The recommendations of•the Sewer Committee, the Water Committee and the Street;

& Alley Committee that contracts for the construction of a sanitary sewer in the amount
I
of $13.471.05 and watermain in the amount of $29,960.65 be awarded to Carlisle G. Fraser
i
for construction of a sanitary sewer and watermain in Fratzke's First Addition and Silver
i
Lake Sub -Division and that the contract for grading be awarded to Leon Joyce in the amount
of $$ll, 064. s0, were each read. Upon motion by Kjerner, second by Anderson, action on

the letting of the above contracts was deferred.

The recommendation of the Street & Alley Committee that the contract for
(furnishing Iron Culverts for use on 14th Street Northeast at 7,8,10 and 11 Avenues
Northeast be awarded to Armco Drainage & Metal Products Inc. for the price of $644.90
was read and upon motion by Akenhead, second by Yaeger, the recommendat-ion was approved.J
The recommendation of the Street &Alley Committee that a One-half Ton Pick -UP 1
Truck be purchased faruse in the City Engineer's Department, was read and upon motion by�

Kjerner, second by Akenhead, the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb be constructed
on the South side of llth Street Southwest from 7th Avenue Southwest to within 256 feet
of the West city limits was read and upon motion by Yaeger, second by gjerner, the
recommendation was approved.
The recommendations of the Sewer Committee, the Water Committee, and the Street
& Alley Committee that a sanitary sewer and watermain be installed and .tYat grading be
done in First Avenue Southwest from 6th Street to 7th Street Southwest, were each read
and the same were ordered placed on file.
The license bond of Martin Paulson in the amount of $1,000.00 with the Fidelity
and Casualty Company of New York as surety was read and upon motion by Yaeger, second by
Akenhead, the bond was approved, the surety thereon accepted and it was ordered that the
same be placed onfile.
The contract bond of Borchert Ingersoll, Inc. in the amount of $6,040.50 with
the Anchor Casualty Company as surety was read and the same was referred to the Mayor
for his approval.
The contract bond of Carlisle G. Fraser in the amount of $8,303.60 with the
United States Guarantee Company as surety was read and the same was referred to the Mayor
for his approval.
It was brought to the attention of the Common Council that Mr. Joe Bandow and
Mr. Peter'Butlin had not been notified of the recommendation made by the Street & Alley
Committee in regard to damage to their poperty and the City Clerk was requested to
Notify them of the recommendation made by the Street & Alley Committee.
The applications for license to sell cigarettes of Edell W. Erbes, Harold
Washburn, Albert Angelici, Carroll R. Silker, Robert P. Kennedy, Co-op Oil Employees
Club, Mrs. Rose Witt, Red Owl Store and H. M. Souders were each read and upon motion by
Anderson, second by Akenhead, the licenses were granted.
The applications of Wendell Erbes and Albert Angelici for a non -intoxicating

malt liquor "off sale" license were each read and upon motion by Kjerner, second by
Anderson, the licenses were granted.
The application of Reuben Enderson for a Journeyman Heating Workers and Stean
Fitters license was read and upon motion by Akenhead, second by Theel, the license was
granted.
The application of Joseph Cozik for a Journeyman Plumber's license was read
and upon motion by Theel, second by Anderson, the license was granted.
The applications of Art Chaddock and A. Freeman for a Junk Dealers license
were each read and upon motion by gjerner, second by Theel, the licenses were granted.
The applications for a permit to place and maintain a sign of Standard Oil
Company (7) and George McGuire were each read 'and upon motion by Yaeger, second by
Akenhead, the permits were granted. •

Silker, Albert Angelici, Co-op Oil Employees Club, H. M. .Souders, Rose Witt, Red Owl
Store and Mrs. George Henek for license to sell soft drinks were each read and upon
motion by Kjerner, second by Anderson, the licenses were granted,
The application of C. C. Pagenhart for a license to construct sidewalks was
(read and upon motion by Kennedy, second by Kjerner, the license was granted.
The applications of Maass and McAndrew Company for a Master Plumber's license
land a Hot Water and Steam Heating Contrabtor's license were each read and upon motion
by Theel, second by Kennedy, the licenses were granted:

Alderman Kennedy introduced a resolution accepting the` bid of Armco Drainage

Alderman Akenhead introduced a resolution ordering a hearing on vacating a part
of 4th Street Southwest, West of 15th Avenue Soithwest, which was read.
Upon motion by Kennedy, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the -said
resolution duly passed and adopted.

Alderman Akenhead introduced a resolution ordering plans, specifications,
profile and estimate of cost and 2nd hearing on construction of a curb and gutter on both
sides of 9th Avenue Southeast from 12th to 13th Street Southeast, which was read. �
Upon motion by Yaeger, second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the said

Alderman Kjerner introduced a resolution granting five dance permits to Archie
Dieter, which was read.
Upon motion by Akenhead, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution

Alderman Theel introduced a resolution authorizing the Public Utility Board to
enter into contract with the Southern Minnesota Supply Company, w14ich was read

adopted as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $9, 397.52 from the Park
Improvement Fund and ordering payment made to the Collector of Internal Revenue, uhich
was read.
Upon motion by Yaeger, second by Akenhead, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Theel introduced a resolution appropriating $11, 506.93 from the Park
Improvement Fund and ordering payment made to the Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $206.40 from the General
Fund and ordering payment made to the Minnesota Box Manufacturing Company for stakes,
which was read.
Upon motion by Theel, second by Yaeger, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.

Upon motion by Anderson, second by Akenhead, that the said resolution be adopted

Alderman Yaeger introduced a resolution ordering bids for furnishing a one half
ton truck for use -in the City Engineer's Department, which was read.
Upon motion by Kennedy,second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Yaeger introduced a resolution accepting plans and specifications and
ordering .bids for the construction of a sanitary.sewer and watermain in 16th Avenue
Northeast from 9th to loth Street Northeast; . 17th Avenue Northeast from 9th to loth
Street Northeast; loth Street Northeast from the West line of Miner's Addition to 19th
Avenue Northeast; 9th Street Northeast -fromthe West line of Miner's Addition to a point
585 feet east and the grading of 9th Street Northeast f romthe West line of Miner's
Addition to East City limits, which was read.
Upon motion by Akenhead, second by Yaeger, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Yaeger introduced a resolution accepting plans and specifications and
ordering bids for the construction of a sanitary sewer and watermain in 10th Avenue
Northwest from 12th to 14th Street Northwest; loth Street Northwest from' 9th to loth
Avenue Northwest; 12th Street Northwest from 9th to 10-91 Avenue Northwest and grading in
Cascade Sub-Divis.ion, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
l as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Yaeger introduced a resolution ordering the first hearing on the
installation of a sanitary sewer and watermain and the grading of First Avenue Southwest
from 6th to 7th Street Southwest, which was read.
Upon motion by Kennedy, second by K jerner, that the said resolut ion be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
(duly passed and. adopted.

The following claims were read and upon motion by Yaeger, second by Theel, the
same were approved and the Mayor and City Clerk were authorized and directed to draw
warrants on the City Treasurer and make payments accordingly;

An Ordinance prohibiting the making of any noise, riot or disturbance or
improper diversion, to the annoyance of any person and to prevent the collection of
persons on the streets or sidewalks in the City of Rochester so as to obstruct travel
thereon, was given its first reading.
Upon motion by Kennedy, second by Anderson, and upon roll call and all voting
in favor thereof, the rules were suspended and the ordinance was given its second reading.
Upon motion by Yaeger, second by K jerner, and upon roll call and all voting
in favor thereof, the rules were suspended and the ordinance was given its third and
final reading.
Upon motion by Kjerner, second by Kennedy, that the said Ordinance be adopted

The matter of notifying merchants
to renew their licenses the first of the
fiscal year was discussed and upon motion
by
Theel, second by Kennedy, the City Clerk
was instructed to advertise all licenses
due
on April 1st, 30 days prior to that date.
Upon motion by Anderson, second
by
Kennedy, Elmer Lee was granted a 30 day
leave of absence from the Rochester Fire
Department,
beginning May 16, 1948.
Upon motion by Akenhead, second

Yaeger, the City Engineer was instructed to

take charge of the dredging project at Silver Lake.
Upon motion by Yaeger, second.by Anderson, a claim by the Mayor in the amount
of $42.00 for expenses was approved in the amount of $37.00.
Carnet Spring, Building Inspector, informed the Council that he had not been
able to call a meeting of the Board of Zoning due to the fact that hee could not get a
quorum of the Board to act. Upon motion by Kennedy, second by Theel, the City Clerk
was instructed to request the Mayor to submit appointments to the Council to fill the
vacancies on the Board of Zoning.
Upon motion by Kennedy, second by Akenhead, the meeting was adjourned until
7: 30 o 1 clock P. M. on May 17, 1948.
