President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy, Kjerner, and Theel. Absent: Alderman Yaeger, due to illness. Upon motion by Kjerner, second by Theel, the minutes of the meetings of May 3rd and May loth, 1948 were approved. President Lemmon stated this as being the time and place set for the first • hearing on the installation of a sanitary sewer and watermain and grading in First Avenue Southwest from 6t1a to 7th Street Southwest. There .was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a.sanitary sewer and watermain and grading in 7th Avenue Northwest from 16th Street to 100 feet north. There was Do one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the grading of the east one half of 16th Avenue Northwest from 2nd Street Northwest to 134 feet North. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter on both sides of 6th Avenue Southeast from Sth to loth Street Southeast. There was no one present wishing to be heard. President.Lommon stated this as being the time and place set for the second hearing on the construction of a curb and gutter on both sides of 9th Avenue Southeast from 12th to 13th Street Southeast. A_group of ten property owners interested in the project were present, six of those protested the installation of a curb and gutter and four stated that they were in favor of having the improvement made. The hearing was continued and the matter was referred to the Street & Alley Committee and the City Engineer for investigation. • President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a sanitary sewer and watermain in 16th Avenue Northeast from 9th to loth Street Northeast; 17th Avenue Northeast from 9th to loth Street Northeast; loth Street Northeast f romthe west line of Miner's Heights to 17th Avenue Northeast and 9th Street Northeast from the west line of Miner's Heights to a point 585 feet east. The bids of Carlisle G. Fraser in the amount of $9,996.50 for a sanitary sewer and $10,787.70 for watermain and H. H. Frankamp in the amount of $10,021.50 for sanitary sewer and $11,799.00 for watermain were each received and opened. President Lemmon stated this as being the time and place set for receiving and opening bids for the grading of-''9th Street Northeast from the west line of Miner's Heights to east city limits. President Lemmon stated this as being the time and place set ',for receiving and; opening bids for grading of loth Avenue Northwest from loth to 14th Street Northwest; •102 Avenue Northwest from 12th to 14th Street Northwest; loth Street Northwest from 9th to loth Avenue Northwest; llth Street Northwest from 9th to loth Avenue :Northwest; 12th Street Northwest from 9th to llth Avenue Northwest. The bid of Leon Joyce in the d amount of $5, 745, 20 was received and opened. =- — President Lemmon stated this as being the time and place set for receiving andll opening bids for furnishing the season's supply of crushed rock and gravel f.or use in the I City Engineer's Department. The bids of Patterson's Quarry in the amount of $1,260.00 for 700 cu. yds. crushed rock; Quarve & Anderson iv.the- amount of $1, 575.00 for .700 cu. 'i yds. crushed rock; Clarence Paulson in the amount of $770.00 for 700 cu. yds. crushed rock -loaded on trucks at quarry; Rochester Sand .& Gravel Company in the amount of $1,150.00 for 1000 cu. yds. gravel and 300 cu. yds. washed pea gravel in the amount of $420.00 and Rochester Quarry Company in the amount of $1,225.00 for 700 cu. yds. crushed rock, were each received and opened. President Lemmon stated this as being the time and place set for receiving ands, opening bids for furnishing a one half ton pick-up truck for use in the City Engineer!.s I Department. The bid of Universal.Motors, Inc. in the amount of $1,533.23 was received ;J i and opened. j I A communication from Mrs. Elsie Loppnow claiming damage to her property in i Manley's Addition in the amount of $500.00 was read and President Lemmon'referred same ,j p to the Street & Alley Committee. A protest against parallel parking on Broadway by Mrs. R. B. Kirklin was read i and the same was ordered placed on file. A claim in the amount of $2.97.30 for damage to his car was presented by Ray i Ferdinandt and the same was referred to the Finance Committee and the City Attorney. ,i The following communication from the Board of Park Commissioners was read and upon motion by Kennedy, second by Anderson, the same was referred to the City Attorney; "Honorable Members of the Common Council City of Rochester, Minnesota Gentlemen: Attached you will find a copy of an executive order received from Mayor Claude H. McQuillan yesterday. is .Record of Official Proceedings of_the.Common Council of the City of Rochester, Minn:-,. May 17, 1949, Your bill for return of the $10,000.00 which your previous Council transferred to us for purchase of Outlot 1 0£ Cook Sub - Division on March 11, 1949, was presented for approval at our Board meeting last evening. However, after the Mayors executive order was read; the Board voted to comply with the order. It was agreed that we should not approve this bill until such time as the Common Council and the Mayor have reached an agreement, or have established that the City can repudiate the signed contract for deed without risking involvment in a possible lawsuit. Schacht, S cretary Board of Park Commissioners • City of Rochester, Minnesota" A communication from the Board of Park Commissioners advising that within another week the fill South of the Izaak Talton League Cabin would be finished, was read. It further stated that if the lands which the City had contemplated purchasing from Alice Mitchell and Bert Leitzen were not available at that time it would be necessary to move the dredging equipment.elsewhere. Upon motion by Akenhead, second by Kjerner, the Public. Grounds Committee was authorized to confer with Alice Mitchell and Mr. Leitzen again in regard to the purchase of the said lands and the City Clerk was instructed to notify the Park Board not to move the dredging equipment until, a report was made within one week. A communication from -the Board of Park Commissioners stating that they would not consider the request of the Common Council for permission to use Lots 1, 2, 3, 4, 5, and 69 in Block 21, Original Plat of the City of. Rochester, for parking .purposes until ,signed statements are provided by the members of the Mayo families that there would be no objection to using Lots 1 and 2, in the said .Block 21, of the Original Plat of the City of Rochester for parking purposes, was read.' Upon motion by Kennedy, second by Anderson, the matter was referred to the City Attorney to make arrangements if possible for the use of the said Lots 1 and 2 for parking area purposes. A communication from Special Municipal Judge, Frank G. Newhouse, addressed to Mr. J. T. Lemmon, President of the Common Council, in.regard to increasing the salary • of the Special Municipal Judge was P P g f t the City Attorney. read and the same was referred o e y y. A petition to have bus service extended east on 4th Street Southeast from llth Avenue as far.as.15th Avenue Southeast was read and the same was referred to the Street & Alley Committee to confer with the Rochester Bus Line, Inc. A petition signed by nineteen real estate dealers asking the City to adopt an ordinance licensing real estate dealers in the City of Rochester was read and President Lemmon referred the same to the License Committee. A notice from the League of Minnesota Municipalities of the 34th annual convention to be held in Faribault, Minnesota on June 14, 15 and 16th was read and the same was ordered placed on file. A letter from the League of Women Voters submitting the names of Mrs. F. P. M0ersch and Mrs. Lincoln G. Ekman and also a communication from the Wm. T. A notice of resumption of work on State Project No. 5501-01, Contract No. 72, Rochester Airport, was read and the same was ordered placed on file. .I A certified copy of a resolution adopted by the City Council of,Duluth, Minnesota, protesting an increase in telephone rates was read and upon motion by Kennedy, second by Akenhead, the same was referred to the City Attorney to cooperate in any way,•possible with the City of Duluth in protesting the proposed increase in telephone rates. °k"communication from the Olmsted County Chapter of the American National Red Cross thanking the City for the use of ,the City Hall during the Olmsted County Chest X-Ray Survey was read and the same was ordered placed on file. A copy of a letter.from the Mayo Association to the Mayor regarding possible increase An funds now available for improvement at the Rochester Airport was read and the same was' ordered placed on file. The following copy of a communication from the Mayor to Mr: L. L. Schroeder, State Commissioner of Aeronautics, was read and the same was ordered placed on file: "Mr. L. L. Schroeder, Commissioner May 12, 194s Minnesota Department of Aeronautics Holman Field Saint Paul, Minnesota Re: Rochester Airport SP 5501-02 Dear Sir: We have recently been advised by the consulting engineers on' the Rochester Airport that additional construction on the NW -SE runway is necessary. The work involved is base reinforcemont and bituminous surfacing on the sections of this runway not included in the previously approved plans, at an estimated additional cost of $50,000.00. This is to advise you that the City of Rochester approves this addi- tional work and as its share of the cost has on hand $10,000.00 )re- ceived from the Mayo Association) for this purpose. Any additional verification orcertification of deposit, which you or the C.A.A. may require, will be gladly furnished upon request. The following communication from the Mayor was read and upon motion by Theel, second by -Kennedy, the matter was referred to the City Attorney: May 17. 19148 "Members of the Common Council City of Rochester Gentlemen: The Secretary to the Mayor, Mr. Hooper, has received for his services no compensation whatsoever from the City of Rochester since April 12, 1948. An aricle appeared in the Post Bulletin on May 11, 19148 crediting Mr. Wemmon with the statement that • Mr. Hooper's appointment had not been approved by the City Council and that he was not on the City pgroll. It would appear that the President of the Council'is in error on several counts. Mr. Hooper is still on the payroll and officially in office. I refer to Section 18, of the City Charter which definitely states -"All officers of said city, whether elected or appointed, shall hold their respective offices for the term of one year, AND UNTIL (the capitals are my own) their respective successors shall be elected or appointed and qualified, except as otherwise provided in this Charter, ("Otherwise provided" in the Charter is removal from office for cause and after a trial,). Recognizing that the Council does have authority to fix the salary of the Mayor's Secretary by resolution -as provided for in the City Charter, nevertheless I am prepared to po#nt out in court that the -resolution fixing the salary of the Mayor s Secretary is void, also that you have acted with an arbitrary, unjust exercise of authority, and against the public interest in attempting to establish my secretary's salary at $600.00 a year. The reports of the Clerk of the Municipal Court for the week ended May 1, 1949,' showing total criminal fines and costs collected $877.00, civil fees received $12.65 it and conciliation court fees $1.50 and for the week ended May 8, 1948 showing total criminal fines and costs collected $652.00, civil fees received $5.05 and conciliation i court fees $2.00, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The license bonds of J. P. Hilber and Vincent Huyber each in the sum of $1, 000.00 I with the Aetna Casualty and Surety Company as surety and Edwin M. The application of George Kettner for a Journeyman Heating Workers and Steam Fitters License was read and upon motion by Kjerner, second by Akenhead, the license was granted. The application of A. P. Brinkman for a Pool Hall License (5 tables) was read and upon motion by Theel, second by Kennedy, the license was granted. The application for transfer of popcorn license No. ,153 from Oren Sizer to Vernon B. Sizer was read and upon motion by Akenhead, second by Kennedy, the transfer was granted. The applications of Eloise & Benedict Dresback, David E. Dee and Alphonse Brinkman for soft drink license were.each read and upon motion by Kjerner, second by Theel, the licenses were granted. The application of Allen Jacobson for a Journeyman Plumber's license was read and upon motion by Akenhead, second by Anderson, the license was granted. Mr. George Henke was present at the meeting and inquired about the construction of a new bridge on Sth Avenue Northwest across Cascade Creek. He was informed that future plans had been proposed and was referred to the Street & Alley Committee and the City Engineer for further information. Upon motion by Anderson, second by Kennedy, the City Clerk was instructed to return the checks of the unsuccessful bidders for construction of a sanitary sewer and wat ermain and grading in Frat zke ' s Addition and Silver Lake Sub Division. Alderman Anderson introduced a resolution accepting the bid of Carlisle G. Alderman Akenhead introduced a resolution appropriating $10,212.43 from the General Fund and ordering payment made to Minneapolis Equipment Company for one crawler shovel, which was read. Upon motion by Kennedy, second by Anderson, that the said resolution be adopted as -read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Akenhead introduced a resolution appropriating $253•85 from the General Fund and ordering payment made to H. Dornack for installing electric H. W. Heater and miscellaneous repairs, which was read. Upon motion by Kjerner, second by Theel, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Akenhead introduced a resolution appropriating $872.70 from the General Fund and ordering payment made t.o the Rochester Post Bulletin for publishing • minutes, notices, etc., which was read. Upon motion by Kennedy, second by Anderson, that the said resolution be A. adopted .as -read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Akenhead introduced a resolution appropriating $1,000.00 from the General Fund and ordering payment made to Rochester Airport Company for two 10,000 gallon tanks, which was read.
