Minutes of an adjourned regular meeting of the Common Council of the City of
,Rochester, Minnesota, held in the Council Chambers in the City Hall in said City on
June 21, 1948.
President Lemmon called the meeting to order at 7: 30 o'clock P. M. , the
following members.being present: President Lemmon, Aldermen Akenhead, Anderson, Kennedy,
Kjerner, and Theel, Absent: Alderman Yaeger.
Upon Lotion by Theel, second by Kjerner, the minutes of the meeting of June 7,
1948 were approved wit$ the correction that August 1, 1948 be designated as the date
the budgets requested in the following quoted phase of the minutes are due, I'Upon motion •
by Akenhead, second by Kjerner, the City Clerk was instructed to request all departments
to submit a complete budget, including both operating expense and capital outlay for the
year beginning April 1, 1949 and ending March 31, 1950,.by August 1, 1948.0
President Lemmon stated this as being the time.and place set for the first
hearing on the construction of a curb and gutter on the south side of llth Street
Southwest from 7th Avenue to within 256 feet of the West City limits. There was no one
present wishing to be heard.
President Lemmon stated this as being the time and place set for receiving and -
opening bids for the construction of a curb and gutter on both sides of 9th Avenue
Southeast from 12th to 13th Street Southeast. The bid of Gordon Wihslow Company in the
amount of $2,702.96 was received and opened.
President Lemmon stated this as being the time and place set for receiving and
opening bids for the construction of a sanitary sewer and watermain and the grading of
1st Avenue Southwest from 6th to 7th Street Southwest. The bids of Carlisle G. Fraser
in the amount of $3,094.90 for sanitary sewer and $1,221.95 for watermain were received
and opened. No bids were received for grading.
President Lemmon stated this as being the time and Place set for receiving
and opening bids for additional construction at the Rochester Airport. The bid of
Fielding and Shepley Inc. in the amount of $251,651.35 was received and opened.
The recommendation of the Water Committee that a watermain be constructed in •
2nd Avenue Northwest from 13th to 132 Avenue Northwest was verbally submitted and upon
motion by Akenhead, second by Kjerner, the same was accepted.
The recommendation of the Street & Alley Committee that the contract for the
construction of a curb and gutter on both sides of 9th Avenue southeast from 12th to 13th
Street Southeast be awarded to Gordon Winslow Company in the amount of $2,702.86 was
read and the.same=was accepted and ordered placed on file.
No bids were received for the grading of 1st Avenue Southwest from 6th to 7th
Street so upon motion by Kennedy, second by Anderson, the City Engineer was authorized
to do the said grading.
The recommendations of the Sewer Committee and the Water Committee that the

contracts be awarded to Carlisle Fraser for the installation of a sanitary sewer and
watermain in let Avenue Southwest from 6�h to 7th Street Southwest in the amounts of
$3,094.90 for sanitary sewer and $1,221.95 for watermain, were each read and the same
were ordered placed on file.
The recommendation of the Street & Alley Committee that the bids on the
follbwing listed jobs for construction of- a curb and gutter be re jecte,d and checks
be returned to the bidders and.that these jobs be re -advertised with bids receivable on
July 6, 1946 was read and the same was ordered placed on file: .
2nd Street Northeast from llth Avenue to 13th Avenue Northeast;
5th Avenue Southeast from loth Street, to llth Street Southeast;
3rd Street Southeast from 6th Avenue to llth Avenue Southeast,
6th Avenue Southeast from Sth Street to loth Street Southeast;
9th. Avenue Southeast from let Street to 3rd Street Southeast..
The recommendation of the Finance Committee that a. loan in the amount of
$2,000.00 with interest at the rate of 4% be granted to Walter Unger on his property in
Byron, Minnesota from the Fire Department Relief Association and also a loan in the
amount of $750. 00 with interest at the rate of 4% be granted to W. Lyle Brown on his
property located at 1134 Fourth Avenue Southeast in the City of nochester, Minnesota,
was read and upon motion by Kennedy, second by Theel, the recommendation was approved. -

The preliminary estimate, as submitted by Desmond B. Hunt, City Attorney and

F. R. Finch, City Clerk, in the amount of $2, 700.00 for the purchase of 200 bound
ordinance books of approximately 352 pages (if the complete book exceeds the above
mentioned number- of pages there will be an additional charge for each additional page)

was read and the same was referred back to the City Attorney and City Clerk for further
considerat ion.
The resignation of Mrs. AllaDehl Deitschman as secretary for the Building,
Electrical and Plumbing and Heating Inspectors, effective July 16, 1949 was read and
upon motion by Kennedy, second by Kjerner, the same was accepted.

The appointment by Garnet Spring, Building Inspector of Miss Caralita Tingley
for the position of Secretary to the office of the Building, Plumbing and Electrical
Inspectors was read and upon motion by Akenhead, second by Kjerner, the appointment was
approved.
The City Engineer's estimates of cost for a sanitary sewer in the amount of
$541. 50, for watermain in the amount of $1, 314. S5 and grading in the amount of $669- 55,
all in 1st Avenue Southwest from 6th Street to 7th Street Southwest, were each read and
the same were ordered placed on file.
Upon motion by Kennedy, second by Anderson, the City Attorney was instructed
to draft an ordinance assessing the cost of construction of a sanitary sewer on 1st
Avenue Southwest from 6th to 7th Street Southwest to the property owners.
Mr. Wm. Riege, Dr. H. Wilmer, George Henke and others residing in North
Rochester were present and again protested the condition of the City Dumping Grounds
and requested the removal of the same from its present site. Alderman Kennedy then
stated that action had -been taken and that a new site had been purchased •for the new
Sewage Disposal Plant but that something would have to be worked out with the County
Planning Board before the said site could be used as a dump ground. City Engine@r,
R. E. Monson, then stated that two new pieces of equipment had been purchased for use
at the city dumping grounds and also explained the operation of the sanitary fill. After
hearing the discussion a committee of three was appointed from the Third ward Association
to work with the Public Grounds Committee and the City Tngineer on ,the problem.
A communication from the Rochester Bus Line, Inc. stating that they were
considering bus service on 4th Street Southeast as far as 15.th Avenue but that no
decision had been arrived at at this time was read and the same was ordered placed on
file.
A communication from the Board of Park Commissioners requesting permission to
send the Mayo Civic Auditorium Manager to the annual business meeting of Auditorium
Managers in San Jose, California the week of July 12th and the Superintendent of Parks
to the 50th Annual Business Meeting of Park Executives in Boston, October 3rd, 4th, 5th
and 6th, was read. Upon motion by Kennedy, second by Kjerner, the Mayo Civic Auditorium
Manager was authorized to attend the Annual Business Meeting of Auditorium Managers in
San Jose, California the week of July 12th. A motion was made by Theel, second by
Kennedy, that the Council sponsor just.one business manager from the Park Department
to attend a national convention this year. All voted in favor thereof.
A release signed by C. C. Pagenhart wherein for the sum of $1.00 paid to him
by the City of Rochester he released the City of Rochester, Minnesota in full from any
claim for damages to his property described below as a result of establishment of grade
lines and the grading of streets affecting Lots. 2, 3, 5 and 7, Block 29, Morse and
Sargents Addition was read and the same was ordered placed on file.

"THIS AGREEMENT made .and entered into this 9th day of June,
1948, by and between Bernard J. Leitzen, party' of the first
part, and the City of nochester, Minnesota, a Municipal
Corporation, party of the second part, witnesse.th:
WHEREAS, The said party of the first part i.s the owner in
fee of certain property lying and being within the City of
Rochester, County of Olmsted and State of Minnesota, described
as follows:
'Commencing at a point 1221 feet East of the
Northwest (NW) corner onthe North line of
Lot Thirty-six (36), Township One Hundred
Seven (107.) Range Fourteen (14) West, thence
South 390 feet, thence west 316 feet, thence
North 390 feet, thence east 316 feet to the
point of beginning, said property containing
an abandoned gravel pit.'
AND, WHEREAS, The said Party of the second part is and will be
in the process of dredging a certain area located nearby and known
as Silver Lake, and the said party of the second part desiring a
location to deposit the dredgings obtained from said operations,
-NOW THEREFORE, IT IS HEREBY AGREED, That the said party of the
first part for and in consideration of the dredgings from said
lake bed necessary to complete the fill hereinafter set forth and
the payment of the sum of $1000.00 to the party of the second part,
agrees to permit.the said party of the second part to deposit said
dreAgings of Silver Lake in a manner so as to fill the low areas
of said property to an elevation higher than .the level of the road
through Silver Lake Park immediately South of said property.;
IT IS FURTHER AGREED, by and between the parties, that the
work of filling of the property, heretofore described will be
started as soon as possible and the work completed wit.hin a
period of three (3) years from the date hereof.

amount- of $11.85 for damage done to his car was read and upon motion by Kennedy, second
by Theel, the sum of $11.85 was ordered paid to Rev. Robert G. Heyne for damage done

A petition for the construction of a sanitary sewer on 7th Street Northeast '
from Silver Lake Park to llth Avenue Northeast was read and the same was referred to the;

A petition to have a sidewalk constructed on the South side of llth Street
Northwest on the corner of 2nd Avenue and llth Street Northwest and the corner of 4th
Avenue northwest and llth Street Northwest was read and the same was referred to the
City Engine-er.
The recommendation -of the Public Grounds Committee that the request of Mr. Ray!
Sonnenberg for permission to use more of the land owned by the City for his second hand ii
parking lot be not granted was presented and upon motion by Theel, second by Akenhead, i

the recommendation was appr oved.
The report of receipts and expenditures in the Park Improvement Fund for.the
month of May, 1949 was read and the same was ordered placed on file.

The reports of the Clerk of the Municipal Court for the week ended June 12, 1948

showing total criminal fines and costs collected $622.00, civil fees received $4. 30 and
conciliation court fees $1.75 and for the week ended June 19, 1949 showing total criminal
fines and costs collected $654.00, civil fees received $.35 and conciliation court fees
$2.25, were each read and having been previously approved by the City Attorney, President
Lemmon ordered that the same be placed on file.
The applications for license to sell cigarettes of Archie Ackerman, Howard
Naves and Marvin Mielke and Edwin Kriehn were each read and upon motion by Akenhead,
second by-Kjerner, the licenses were granted.
The applications for license to sell soft drinks of Archie Ackerman, Howard
Naves, Clarence Ryan, Marvin Mielke and Edwin Kriehn and Hughes Davis were each read
and upon motion by Anderson, second by Kjerner, 'the licenses were granted.
The application of Allen Lloyd Company for a permit to place and maintain a
sign was read and upon motion by Akenhead, second by Kjerner, the permit was granted
subject to the approval of the Building Inspector.
The applications for Journeyman Electricians License of Hubert Cain, Charles
Bilderback and Walter G. Lee were each read and upon motion by Theel, second by Anderson,
the licenses were granted.
The application of Earl Holloway for a license to construct sidewalks was read
and upon motion by Kjerner, second by Akenhead, the license was granted.
The application of Clifford Aaby for a Journeyman Heating Workers and Steam
Fitters License was read and upon motion by Theel, second by Anderson, the license was
g rant ed.
The bids submitted on May 3, 1949 for the furnishing of a coin counting machine
and a motor driven sorter of mixed coins by Brandt Automatic Cashier Company in the
amount of $325.00 for a hand operated Coin Counting and Packaging Machine and $550.00
for a motor driven Coin Counting and Packaging Machine and Continental Bank Supply
Company in the amount of $271.00 for an electric sorter and $283.00 for a Model "DE°
Electric Counter were each opened and the. same were referred to the Purchasing Committee,
the City Treasurer and the Chief of Police with power to act.
Alderman Anderson introduced a resolution ordering plans, specifications,
profile and estimate of cost and 2nd hearing on construction of a curb and gutter on the
South side of llth Street Southwest from 7th Avenue Southwest to Athin 256 feet of the
West City limits, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, rresident Lemmon declared the said resolution
duly passed and adopted.
Alderman Akenhead introduced a resolution accepting plans and specifications
and ordering bids for construction of a sanitary sewer and watermain and grading of 12th

Alderman Theel introduced a resolution appropriating $9,441.35 from the P.I.R.
Fund and ordering payment made to Carlisle G. Fraser for estimate No. 1 for construction
of a sanitary sewer 'and watermain in Cascade Sub -Division, which was read.
Upon motion by Akenhead, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the,said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $266.35 from the General
Fund and ordering payment made to J. F.' Winecke, R. E. Nelson and 0. C. Breviu for
reporters fees, which was read.
Upon motion by Anderson, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $231.00 from the General
Fund. and ordering payment made to F. 0. Fitting Insurance Agency, which was read.
Upon motion by Kjerner, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, fresident Lemmon declared the said resolution
duly passed and adopted.
Alderman Theel introduced a resolution appropriating $264.40 from the General
Fund and ordering payment made to T. D. Feeney Company, which was read.
Upon motion by Theel, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $594.00 from the General
Fund and ordering payment made to Herbert G. Knopp, which was read.
Upon motion by Akenhead, second by Anderson, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $231.00 from the General
Fund and ordering payment made to 0. 1-1. Schroeder, Agent, which was read.
Upon motion by Kennedy, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said resolution
duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $561.85 from the General
Fund and ordering payment made to Arthur A. Hirman Agency, which was read.

The recommendation of the Rochester Airport Commission that the bid of Fielding

Alderman Kennedy introduced a resolution accepting the bid of Fielding & II

An Ordinance amending an Ordinance entitled, "An Ordinance establishing fire
limits, and providing for all matters, regulating the construction, maintenance, i
alteration, demolition and removal of buildings and other structures erected or to be 'I
erected within the City of Rochester, Minnesota, and providing a penalty for violation
thereofll, was given its first reading.

Upon motion by Anderson, second by Akenhead, the City Clerk was instructed to i
return the certified checks of the unsuccessful bidders where contracts were not let.

A motion was made by Kjerner, second by Kennedy, that an advertisement be i

placed in the paper designating June 24, 1948 -as the time for• the parking meters to be l�

put into operation.
Upon motion by Lennedy, second by Kjerner, the City Engineer was instructed tol

Upon motion by Kjerner, second by Akenhead, the Police Pistol team of four men
and the captain, were authorized to attend the State Pistol Shoot in St. Cloud, Minnesota
on June 28, 1948.
