President pro tem Kennedy called the meeting to order at 7:30 o'clock P. M., the following members being present: Aldermen Akenhead, Anderson, Kennedy, Kjerner and 'i �Theel. Absent- President Lemmon and Alderman Yaeger, due to illness. it Upon motion by Anderson, second by Akenhead, the minutes of the meeting of ;I �I June 21, 1948 were approved. t President pro tem Kennedy stated this as being the time and place set for a second hearing on the construction of a curb and gutter on the south side of llth Street I� (Southwest from 7th Avenue Southwest to within 256 feet of the west city limits. There was no one present wishing to be heard. President pro tem Kennedy stated this as being the time and place set for receiving and opening bids for the construction of a curb and gutter on 2nd Street Northeast from llth to 13th Avenue Northeast. No bids were received. President pro tem Kennedy stated this as being the time and place set for receiving and opening bids for the construction of a watermain in 2nd Avenue Northwest from lath to 132 Street Northwest. The bid of Carlisle G. Fraser in the amount of $2, 575. 50 was received and opened. President protem Kennedy stated this as being the time and place set for receiving a.nd opening bids for the construction` of a sanitary sewer and' watermain in Mohn & Hodge Sub -Division. The bids of Carlisle G. Fraser in the amount of $5,205.40 for sanitary sewer and $8, 500.00 for watermain were each received and opened. President pro ten Kennedy stated this as being the time and place set for receiving and opening bids for the grading of 13th Avenue Northeast from 7th to 9th Street Northeast; 12th Avenue Northeast from 7th to Sth Street Northeast and 7th Street Northeast from llth Avenue Northeast to the East line of Mohn and Hodge Addition. The bid of Leon Joyce in the amount of $4, 122. 60 was received and opened. The recommendation of the Street and Alley Committee that the bids for the construction of a curb and gutter on both sides of 2nd Street Northeast from llth to 13th &t4Za4 Northeast be rejected was read and upon motion by Anderson, second by Theel, action on same was deferred until July 19, 1948. The recommendation of the Street and Alley Committee that the bid of C. M. Boutelle in the amount of $9,785.22 for the construction of a curb and gutter on both sides of 3rd Street Southeast between 6th and 11th Avenue Southeast be accepted and checks returned to the unsuccessful bidders was read and upon motion by Anderson, second by Kjerner, the same was approved. The recommendation of the Street and Alley Committee that the bid of C. M. Boutelle in the amount of $3, 449.89 for the construction of a curb and gutter on both sidew, of 9th Avenue Southeast from 1st to 3rd Street Southeast be accepted and that certified checks be returned to the unsuccessful bidders was read and upon motion by Kjerner, second by Akenhead, the same was approved. The recommendation of the Street & Alley Committee that the bid of Gordon Winslow Company in the amount of $1,496.65 for the construction of a curb. and gutter on both sides of 7th Avenue Northwest from loth Street to.11th Street Northwest be accented and that certified checks be returned to the unsuccessful bidders was read and upon motion by Kjerner, second by Akenhead, the same was approved. Upon motion by Anderson, second by Theel, the City Engineer was authorized to complete the grading and surfacing of the East a of 16th Avenue Northwest from 2nd Street Northwest to•134 feet North. �I The recommendation of th*e Water Committee that -the bid of Carlisle G. The recommendation cf the Street & Alley Committee that 14th Avenue Northeast from the North line of Lot 3, Block 3, Stebbins Addition to 90 feet north be graded was read and upon motion by Anderson, second by Kerner, the same was approved. The recommendation of the Purchasing Committee that one Banker's Special Electric Coin Counter and Packager at the price of $550.00 for use in the office of the City Treasurer be purchased was read and upon motion by Theel, second by Akenhead, the same was approved. The recommendation of the Street & Alley Committee that the City Engineer be instructed to pruchase one one-half yard dragline bucket for use at the City Dump, same to cost not more than $500.00, was read and upon motion by Akenhead, second by Kjerner, • the same was approved. The recommendation of the Street & Alley Committee.that a Model E. Ozalid Printing Machine bo purchased from the H. A. Rogers Company for the amount of $400.00 to be used in the City Engineer's Department was read and upon motion by Anderson, second by Theel, the same was approved. The four following resolutions adopted by the Public Utility Board were each read and the same' were --ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council be and is hereby requested to authorize the Mayor and City* Clerk to execute a 'License Agreement' covering electrical interconnection which is to be installed under the tracks of the Chicago and North Western Tracks adjacent to First Avenue Northeast and to be executed according to the terms stipulated in said agreement.11 "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and. is hereby requested to authorize the said Board to enter Into a contract with Carlisle G. Fraser for the furnishing of all the necessary labor, material, equipment and service necessary for the installation of a 10" water main in Fifth Avenue Southwest from Fourth Street Southwest south to the new well site in Soldier's Field at a total contract price of TWENTY FOUR THOUSAND SEVEN HUNDRED FIFTY ONE DOLLARS AND FIFTY CENTS ($24,751.50), the said Carlisle G. Fraser being the lowest responsible bidder." "Be it and it is hereby resolved by the PUBLIC UTILITY BOARD of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with FAIRBANKS MORSE and C014PANY for the furnishing and installation of a Deep Well Turbine Pump with Motor, in accordance with • specifications on file, the amount of the said contract to be SIX THOUSAND FIFTY TWO DOLLARS ($S, 0 52. 00) . " "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with Carlisle v. Fraser for the furnishing of all labor, material, equipment and service necessary for the Installation of an 8" water main and an 8" sanitary- sewer in Fifth Street Northeast from First Avenue Northeast east to the new Silver Lake Plant at a price of $4,000.00 for the watermain and a price of $1,375.00 for the sewer, making a total lump sum price of FIVE THOUSAND THREE HUNDRED SEVEWJ?Y FIVE DOLLARS ($5, 375.00), the said Carlisle G. Fraser being the lowest responsible bidder." A report by Viktor 0. Wilson, M. A� Notice by the Police Civil Service Commission that the certification of H. M. Fitzpatrick as Chief of Police which, was to be effective, on November 4, 19'17 had been revoked was read and the.same was ordered placed on file. ;I An assignment of wages by Carl C. Hooper to the Olmsted County Bank & Trust Company was read and upon motion by Theel, second by Akenhead, the same was referred to the City Attorney. A letter from the Fire Underwriters Inspection Bureau of Minnesota, North Dakota and South Dakota pertaining to the existing fire protection situation at 'Rochester and their recommendations was read and the same was referred too the Fire Committee. An agreement between the City of Rochester and John F. Miner, owner of Miner's Heights, stipulating.that the streets in the said Miner's Heights are'to be graded and i surfaced by the owner without further advertisement for bids for the said improvement. i Upon motion by Anderson, second by T.heel, the said agreement was approved and the City i i Clerk was instructed to file the same in• the office of the Register of Deeds of Olmsted County. The petition of Laura J. Russell and Mayo Association for grading to. be done on llth Avenue Southeast and watermain be extended from the Northeast corner of Lot 37, i Auditor's Plat "A" to the distance of 220 feet South was read and the same was ordered 'j placed on file. I The request of Laura J. Russell and Mayo Association to have a,sanitary sewer installed in llth Avenue Southeast from the corner of Lot 37, Auditor's Plat "A° 200 feet South was read and upon motion by Anderson, second by. Akenhead, the owners were m&orized to have the said sewer laid und.er the supervision of the City Engineer and the cost and expense of the sewer to be paid by the owners of the abutting property. A petition for the construction of a curb and gutter on both sides of 10 i Street Southeast from 9th.to llth Avenue Southeast was read and the same was ordered I placed on file. A letter from Sister i$.. Domitilla, Superintendent of St. Mary's Hospital, i expressing their appreciation for the efficient service rendered by the Rochester Fire Department .in putting out a fire on t .e roof of the 7th floor at St. Mary's Hospital was read and the same was ordered placed on file. The City Engineer's estimate of cost for construction of a sanitary secaer in easement between Lots 11 and 12, Block 5, Mohn.and Hodge Sub -Division from llth Avenue Northeast to '12th Avenue Northeast; 7th Street Northeast from 13th to 12th Avenue • Northeast, 12th Avenue Northeast from 7th to Sth Street Northeast and lath Avenue Northeast from 7th to 9th Street Northeast in the amount of $5,091.90 was read and the same was ordered placed on file. The City Engineer's estimate of cost for construction of a curb and gutter in 7th Avenue Northwest from loth to llth Street Northwest in the amount of $2,275.00 was read and the same was ordered placed on file. The City Engineer's estimate of cost for installation of a wate•rmain in.2nd Avenue Northwest from 13th to 13P, Street Northwest in the, -amount of $2,475.60 was read and the same was ordered placed on file. The report of the City Weighmaster for the month of June, 1948 showing 473 loads weighed and receipts in the amount of $47.30 was read and the same was referred to the Finance Committee. The reports for the month of June, 1948 of the Building Inspector showing receipts in the amount of $304.00 for building permits issued; of the Electrical Inspector showing receipts in the amount of $155.75 for electrical permits issued; of the Heating Inspector showing receipts in the amount of $66.00 for heating permits issued and • of the Plumbing Inspector showing receipts in the amount of $66.00 for plumbing permits issued, were each read and the same were ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended June 26, 1948 showing total criminal fines and costs collected $443.50•, civil fees received $3.05 and conciliation court fees $1.75 and for the week ended July 3, 1948 showing total criminal fines and costs collected $1,087.95, civil fees received $2.60 and conciliation court fees $1.00, were each read and having been previously approved by the City Attorney, President pro tem Kennedy ordered that the -same be placed on file. The surety bond. of Frank Halloran in the amount of $2, 000.00 with the'Maryland Casualty Company as surety was read and upon motion by Anderson, second by Akenhead, the bond was approved, the surety thereon accepted and it. was ordered that the same be placed on file. Alderman Akenhead introduced a resolution appropriating $242.62 from the General Fund and ordering payment made to Herbert G. Knopp for insurance, which was read. Upon motion by Theel, second by Anderson, the City Attorney was instructed to prepare an"ordinance providing for the licensing of real estate agents in the City of Rochester. Acting Chief of Police Nelson stated that the City was now in need of a new police ambulance and upon motion by Akenhead, second by Theel, the matter was referred to the Police Committee and the Acting Chief of Police. i.r. Hunt, City Attorney, reported that he had conferred with 'a representative of the Mayo Clinic regarding the tise of Lots 'land 2, Block 210 Original Plat for pa.rking I purposes until such .time as the City might again .,!ish to use them as a :past of Mayo Park or in connection with the Mayo Memorial. Upon motion by Akenhead, second by Anderson, (the City Attorney was instructed toprepare a resolution covering the use of the said real estate for the parking of automobiles until such time as it might be decided otherwise.
