Pdinutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall in said City .on
July 19, 1949.
Upon motion by Kennedy, second by Theel, Alderman Anderson was appointed to
act as President pro tem of the Council.
President pro tem Anderson called the meeting to order at 7:30 o'clock P.;F..,
the.following members being present: Aldermen Akenhead,.Anderson, Kennedy, Kjerner and
Theel. Absent: President Lemmon and.Alderman Yaeger, due.to illness.
Upon.motion by Akenhead, second by Theel, the minutes of the meetings of
July 5th and July 6th, 1948 were approved.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the construction of a curb and Futter on both sides of 10� Street
Southeast from 9th to llth Avenue Southeast. There was no one present wishing to be
heard.
President pro tem Anderson stated this as being the time and place set for the
first hearing on the grading of loth Avenue Northeast from the north line of Lot 3, Block
3, Stebbins Addition to SO feet North. There was no one present wishing to be.heard.
Mr. Effingham, contractor for remodeling work on the Virginia Hotel, requested
permission to move -a part of the said building over streets in the City of Rochester.
Upon motion by Kennedy, second by.Akenhead, the request was referred to the Street &
Alley Committee, the City Engineer and the Building Inspector.
A group of residents from Northwest Rochester were present at the meeting and
urged that a tract of land described as follows be purchased from ir. A. C. Gooding for
park purposes: 11 A tract of land in the NWJ of Section 35-107-14,
lying between Seventh Street N. W. and the Chicago and
North Western Railway tracks and east of the Rochester
Silo Company lands, to be known and designated as Outlot
41 Cooks Sub -Division, Rochester, Minnesota (Roughly
500 feet east and west and 550 feet north and south)."'
After hearing those present, a motion was made by Alderman A'..enhead, second by Alderman
Theel, that the Council as a committee of the whole and the Park Board meet with a
committee of five to be appointed from the group of residents interested in the purchase
of the above described lands for park purposes. All present voted in favor of the-.
motion.
Mr. Howard Smith, representing residents of Southeast Rochester interested in
the construction of a shelter house in Sla.tterly Park, was present and urged that the
building be completed. He also stated that the 3awthorne Men's Club was recommending
the completion of the said project. After hearing others present on the matter, a
motion was made by Alderman Kennedy, second by Alderman Kjerner, that the matter be
referred to the Finance Committee and the Public Grounds Committee for a report at the
next regular Council meeting.

Mr. A. J. Hall was before the Council and requested that a curb and gutter be
constructed on 1st Avenue -Southeast between Center Street and 1st Street Southeast and
also on Center Street North of his building at the corner of lst Avenue' and Center Stree',t

Southeast. He stated that the sidewalk was often blocked by cars driving across same

and that the building had been damaged by cars due to the fact that there was no curb
i
for the cars to park at. He also requested that parking meters be installed in that '
vicinity. Upon motion by Kennedy, second by Kjerner, the matter was referred to the
Street & Alley Committee and the City Engineer.
The recommendation of the, Street & Alley Committee that the bids.for the
construction of a curb and gutter on 2nd Street Northeast from llth to 13th Avenue
Northeast be rejected and the checks be returned to the bidders was read and upon motion;
by Kennedy, second by Theel, the recommendation was approved.
The recommendation of the Street & Alley Committee that the contract for the

construction of a curb and gutter on 'both sides of 5th Avenue Southeast from loth to
llth Street Southeast be awarded to Gordon Winslow Company in the amount of $3,387.59 1.
was read and upon motion by Kennedy, second by Theel, the recommendation was approved.
The recommendation of the Sewer Committee'that the petition of property owners,'
for a sanitary sewer on 7th Street Northeast from Silver Lake Park to llth Avenue
Northeast be denied was read and upon motion by Kennedy, second by Theel, the recommendation
was approved.
The recommendation of A. M. Nelson, Acting Chief of Police, that an entire j
new Gamewell System be purchased and the same be installed. before cold weather was read
and upon motion by Kjerner, second by Kennedy, the same was referred to the Purchasing
Committee.
The recommendation of the Street & Alley Committee and the Acting Chief of
Police that Parking Ordinances No. 489 and 585 be amended was read and upon motion by
Akenhead, second by Kennedy, the recommendation was approved.
Upon motion by Kennedy, second by Akenhead, the City Attorney was instructed
to draft a new ordinance on parking of cars in the City of Rochester and repealing
Ordinance No. 498.
A letter from the State of Minnesota, Department of Aeronautics, submitting
202, 202A, 218 and 220 was read and upon motion by Kennedy, second by
the City Attorney was instructed to prepare resolutions approving the above

numbered forms.
A copy of a.notice by the City Engineer to L. 14. Sather in regard to the
i
construction of a masonry retaining wall at 1184 Plummer's Circle was read and upon
motion by Kennedy, second by Theel, the same was ordered -placed on file.

In compliance with the Civil Service Law regarding positions
filled on a temporary basis in the Rochester Police Department
the Police Commission has ordered the following positions
vacated as of July 16, 1948:
Assistant to the Chief in charge of records;
Captain of Detectives;
Detective;
Desk Sargent - filled on temporary basis by rotation of
Patrolmen who volunteered for this work.
It is ordered that these men filling these positions on a
temporary basis be returned to their permanent rank and
salaries of their permanent rank, effective as of July 16,
194s.

transfer -of $3,587.00 from the General Fund was read and the same was ordEred placed on

A request by the Board of Park Commissioners for the approval of the Council
of the purchase of a tract of land in the NW4 of Section 35-107-14, lying between 7th

A notice of injury to Carole Jeanne Hoag by her mother Mrs. C. N. Hoag was
read and the same was referred to the City Attorney.
A communication from the Minnesota Department of Health stating that plans
for numerous sanitary sewer.extensions submitted on June 16 and 23, 1949 by the City
Engineer had been examined by the Division of Water Pollution Control and.found'to
conform with the standards of the Minnesota Department of health and stated further that,

to the City. of Rochester was read and upon motion by Kennedy, second by Theel, the said
petition was ref -erred to the Street & Alley Committee and the City Engineer:

Building was -read and upon motion by Kennedy, second by Akenhead, the matter was referred
to the Police Committee and the Acting Chief of Police.
The reports of the Clerk of the Municipal Court for the week ended July 10,
1949 showing total criminal fines and costs -collected $1142.00, civil fees received
$.35 and conciliation court fees $2.00 and for the week ended July.17, 1949 showing
total criminal fines and costs.collected $901.00, civil fees received $2.00 and concil-
iation court fees $1.50, were each read and having been previously approved by the City
Attorney, President pro tem•Anderson ordered that the same lie placed on file.
The City Engineer's trial balance for the month of June, 1949 was read and the •
same was ordered placed on file.
The application of Angeline Kyle for an "On Sale" non -intoxicating malt liquor
license was read and upon motion by Akenhead, second by Kjerner, the license was gr-anted.
The applications of Angeline Kyle and Francis Washburn for "Off Sale" non -
intoxicating malt liquor license were each read and upon motion by Kjerner, second by
Kennedy, t•he •licenses were granted.
The applications of Wilma Prihar, Gypsy Cafe, Roy Brown, Rochester Baseball
Association and Francis Washburn for license to sell cigarettes were each read and upon
motion by Akenhead, second by Theel, the licenses were granted.
The application of Fred Chase for license to do cement construction work was
read and upon motion by Kennedy, second by Kjerner, the license was granted.
The application of the Holland Furnace Company for a Hot Air Heating, Air
Conditioning and Ventilating Contractor's license was read and upon motion by Kjerner,
second by-Theel, the license was granted.
The applications of Lester Larson and 0. M. Webber -for Journeyman Heating
Worker's and Steam Fitters license.were each read and upon motion by Kjerner, second by
Theel, the licenses were granted.
The applications of Wilma Prihar and Francis Washburn for license to sell soft
drinks were each read -and upon motion by
Theel, second by

A request by 17 residents of Southeast Rochester for sufficient additional
funds for the construction of a -permanent shelter building in Slatterly Park was read
and the same was ordered placed on file.
A communication from Mr. A. R. Nachreiner, President of the Board of Park
Commissioners, -stating that there was some misunderstanding as to how the expense of
dredging Silver Lake -was to be financed and requesting that a joint meeting of the
Council and all departments involved be held, was read. 'A motion was made by Theel,
seconded by Akenhead, that the Council meet with the various departments as requested,
the Park Board to call the said meeting. All present voted in favor thereof.
The M ayor's reappointments to the Library Board of Mr. Frederick J. Furlow,
Dr. J. A. Bargen and Mr. William Sperling , the terms of the said appointees to expire
on the third -Saturday of July, 1951, -was read and upon motion by Kennedy, second by
Akenhead, the appointments were approved.

A communication from the Mayor stating that he had been served with a notice

of Expiration of Redemption on Lot 13, Block 1, Kummer's Addition and had turned the
Service over to the City Attorney Hunt for disposition was read and the same was ordered;
placed on file. -
A preliminary estimate for -air conditioning council and municipal court -

chambers in the amount of $2,784.15 was.read and upon motion by Kennedy, second by
Akenhead, the same was referred to the -Purchasing Committee for -recommendation.

Fund and ordering payment made to Junius Lemmon for painting curbs and'streets, which

Alderman Theel introduced a resolution appropriating $207.30 from the Street &
Alley Fund and ordering payment made to The George T. Ryan Company, which was read.
Upon motion by Kjerner, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $3, 492. 75 from the
P.I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 1 for
sanitary sewer in Fratzke's 1st Addition and Silver Lake Sub -Division, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted

Alderman Akenhead introduced a resolution appropriating $1,907.02 from the
P. I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 2 for
installation of a sanitary sewer in Miner's Heights, which was read.
.Upon motion by Theel, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $1,979.38 from the
P. I. R. Fund and ordering payment made to Gordon Winslow Company for estimate No. 1 for
construction of a curb and gutter on both sides of 9th Avenue Southeast from 12th to 13th
Street Southeast, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $5,093.39 from the P.I..
R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 2 for installation
of a watermain in Miner's Heights, which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Akenhead introduced a resolution appropriating $b67.93 from the Sewer
Fund and ordering payment made to Armco Drainage & Metal Products, Inc., which was read.
Upon motion by Kjerner, second by Theel, that the said resolution be adopted

Alderman Akenhead introduced a resolution appropriating $1,974.86 from. the
(Park Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving Fund,
which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the. said
resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $673.35 from the Park
Improvement Fund and ordering payment made to Reynolds Wholesale Company for merchandise
delivered to concession stands, which was read.
Upon motion by Theel, second by Kjerner, that the said resolution be adopted t

Alderman Kjerner introduced a resolution appropriating $429.50 from the Park
Improvement Fund and ordering payment made to Squires Electric Company for installing
(sound. system at auditorium, which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted
as read, and. all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.

Alderman Kjerner introduced a resolution appropriating $219.29 from the Park
Improvement Fund and ordering payment made to Herbert G. Knopp Insurance Agency, which

Upon motion by Kjerner, second by Theel, that the said resolution be adopted
Ias read, and all voting in favor thereof, President pro tem Anderson declared the said
(resolution duly passed and adopted.
Alderman Kjerner introduced. a resolution appropriating $635,.1'0 from the Park
(Improvement Fund and ordering payment made to Rochester Dairy Coop. for, merchandise
(delivered to concession stands, which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted

Alderman Kennedy introduced a resolution appropriating $380.20 from the Lighting

(Fund and ordering payment made to City of Rochester, Public Utilities for lighting at

airport, which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said

Alderman Kennedy introduced a resoluti.on accepting plans andspecifications
and ordering bids for construction of a curb and gutter on the south side of llth Street
Southwest.from 7th Avenue Southwest to within 256 feet of the west city.limits, which

Upon motion by Kennedy, second by Theel, that the said resolution be
adopted as read, and all voting in favor thereof, President pro tern Anderson declared
the said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution fixing the salary of the parking
meter maintenance man, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolutionbe adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution ordering plans, specifications and
estimate of cost and 2nd hearing on grading of 14th Avenue Northeast from the North line
of Lot 3, Block 3, Stebbins Addition to 80 feet North, -which was read.
Upon motion by Kennedy, second by Akenhead, that the said resolution be
adopted as read, and all voting in favor thereof, President pro tem Anderson declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution ordering plans, specifications ,
profile and estimate of cost and 2nd hearing on construction of a curb and gutter on both
sides of 102 Street Southeast from 9th to llth Avenue Southeast, which was read.
Upon motion by Akenhead, second by Theel, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution accepting.the bid of Gordon Winslow
Company for construction of a curb and gutter in 5th Avenue Southeast from loth to llth
Street Southeast, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $235.24 from the Street
Alley Fund and ordering payment made to Firestone Stores, which was read.
Upon motion by Kjerner, second by Akenhead, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $l,o47.68 from the
General Fund and ordering payment made to The Standard Oil Company for cutback asphalt,
which was read.
Upon motion by Akenhead, second by Kennedy, that the said resolution be adopted
as read, and all voting in favor thereof, President pro tem Anderson declared the said
resolution duly passed and adopted.

which was read.
Upon motion by Kennedy, second by Kjerner, that th-e said resolution 'be adopted

City Attorney
Hunt brought up the matter
of setting up a. license fee for the
new outdoor
theater and
upon motion by Kennedy, second
by Akenhead, the matter was
referred to the License Committee and the City Attorney for report at the next meeting.
Alderman Kennedy suggested that plans be prepared for a, new warehouse for the
City Engineer's Department and upon motion by Kennedy, s econd.by Kjerner, the City
Engineer was instructed to prepare plans for the proposed warehouse and bids be ordered
at the next regular Council meeting.
The matter of purchasing a coin sorting machine for use in the City Treasurer's
Department was discussed and upon motion by Akenhead, second by Theel, the Purchasing
Committee was authorized to procure a coin sorting machine.
Alderman Akenhead again brought up the matter of renaming 71 Avenue Northeast
in Carroll's Second Addition. No action was taken on the matter at this time.
The following communication was read:

Rochester, Minnesota
Dear Sir:
In reply to your inquiry of June 28, 1949, we have made no
plans to remove our facilities from the land which we have under
lease in Rochester from the Railroads.
These facilities have considerable potential value to us,
and we are disinclined to go to the expense of dismantling •
them at this time.

A motion was made by Kennedy, second by Theel, that the City Attorney notify the Shell
Oil Company and the Cities Service Oil Company to remove their bulk plants from the
present sites within the next 60 days.
Chief of the Fire Department, C. E. Ginther, stated that additional new hose
should be purchased for use in the Rochester Fire .Department and also three new beds
were now needed. Upon motion by Kjerner, second by Kennedy, the request was referred to
the Fire Committee.
Upon motion by Kennedy, second by Akenhead, the meeting was adjourned.
